4、cidedtoamendtheProvisionsonthe国务院决定对行政执法机关移送涉嫌犯罪案件的规定TransferofSuspectedCriminalCasesbyAdministrativeLaw作如下修改:EnforcementOrgansasfollows:I. OneparagraphisaddedinArticle3asparagraph2:Where,asforacaseinthefieldofintellectualpropertyrights,anadministrativelawenforcementorgandeemsbasedontheevidencecolle
5、cteduponinvestigationandthecasefactsascertainedthatthereisareasonablesuspicionofacrimeanditisnecessaryforapublicsecurityorgantotakemeasurestoobtainfurtherevidencesoastodeterminewhetherthecircumstancemeetsthestandardsforfilingacriminalcaseforinvestigationandprosecution,thecaseshallbetransferredtothep
6、ublicsecurityorgan.,II. InArticles15,16and17,administrativedisciplinaryactionisreplacedwith“disciplinaryaction.III. OnearticleisaddedasArticle18:IfarelevantorgancommitsanyviolationoflawaslistedinArticle15,16or17oftheseProvisions,andthesupervisoryorganshallimposegovernmentsanctionsagainstpublicoffici
7、alswhoviolatethelaw,accordingtoIhelaw,Lheorgananditssuperiorcompetentauthorityortherelevantpeoplesgovernmentshalltransfertherelevantcluestothecasetothesupervisoryorgantorhandlinginaccordancewithrelevantprovisions?,IV. Article18isrenumberedasArticle19andamendedtoread:Where,intheprocessofinvestigating
8、andpunishingaviolationoflawaccordingtothelaw,anadministrativelawenforcementorganfindsanypublicofficialsviolationoflawsuchascorruption,bribery,neglectofduty,malfeasancein一、第三条增加一款，作为第二款：“知识产权领域的违法案件，行政执法机关根据调查收集的证据和查明的案件事实，认为存在犯罪的合理嫌疑，需要公安机关采取措施进一步获取证据以判断是否达到刑事案件立案追诉标准的，应当向公安机关移送。”二、将第十五条、第十六条、第十七条中的
9、“行政处分”修改为“处分”。三、增加一条，作为第十八条：”有关机关存在本规定第十五条、第十六条、第十七条所列违法行为，需要由监察机关依法给予违法的公职人员政务处分的，该机关及其上级主管机关或者有关人民政府应当依照有关规定将相关案件线索移送监察机关处理。”四、将第十八条改为第十九条，修改为：“行政执法机关在依法查处违法行为过程中，发现公职人员有贪污贿赂、失职渎职或者利用职权侵犯公民人身权利和民主权利等违法行为，涉嫌构成职务犯罪的，应当依照刑法、刑事office,orinfringementuponcitizenspersonalanddemocraticrightsbyexploitinghis
10、orherfunctions,whichissuspectedofconstitutingaduty-relatedviolationorcrime,itshall,inaccordancewiththeCriminalLaw,theCriminalProcedureLaw,theSupervisionLawandotherlaws,transferthecluestothecasetothesupervisoryorganorthepeoplesprocuratorateforhandlinginatimelymanner.”ThisDecisionshallcomeintoforceonthedateofissuance.TheProvisionsontheTransferofSuspectedCriminalCasesbyAdministrativeLawEnforcementOrgans,asamendedandadjustedinthenumberingofarticlesinaccordancewiththisDecision,shallbereissued.诉讼法、监察法等法律规定及时将案件线索移送监察机关或者人民检察院处理。”本决定自公布之日起施行。行政执法机关移送涉嫌犯罪案件的规定根据本决定作相应修改并对条文序号作相应调整，重新公布。
