4、.Inrecentyears,allregionsanddepartmentshaveconscientiouslyimplementedthedecisionsandarrangementsoftheCPCCentralCommitteeandtheStateCouncilandconcentratedtheireffortsonenhancingandinnovatingtheregulation,whichhasbroughtaboutpositiveresults.However,therearestillproblemssuchasunclarified国务院办公厅关于深入推进跨部门
5、综合监管的指导意见(国办发(2023)1号)各省、自治区、直辖市人民政府,国务院各部委、各直属机构:深入推进跨部门综合监管,是加快转变政府职能、提高政府监管效能的重要举措。近年来,各地区各部门认真贯彻落实党中央、国务院决策部署,着力加强和创新监管,取得积极成效,但一些地区一些领域仍然存在监管责任不明确、协同机制不完善、风险防范能力不强以及重复检查、多头执法等问题。为进一步加强跨部门综合监管,维护公平有序的市场环境,切实降低市场主体制度性交易成本,推动高质量发展,经国务院同意,现提出如下意见。一、总体要求(一)指导思想。以习近平新时代中国特色社会主 义思想为指导,深入贯彻落实党的二十大精神,完整
6、、准 确、全面贯彻新发展理念,加快构建新发展格局,坚持统 筹发展和安全,健全监管体制机制,完善监管制度框架, 创新监管方式方法,对涉及多个部门、管理难度大、风险 隐患突出的监管事项,建立健全跨部门综合监管制度,强 化条块结合、区域联动,完善协同监管机制,提升监管的 精准性和有效性,维护公平竞争的市场秩序,为加快建设 全国统一大市场、推动高质量发展提供有力支撑。regulatoryresponsibilities,imperfectcoordinationmechanisms,weakriskpreventioncapabilities,andrepeatedinspectionsanddupl
7、icatelawenforcementinsomeregionsandfields.Forthepurposesoffurtherstrengtheninginterdepartmentalcomprehensiveregulation,maintainingafairandorderlymarketenvironment,effectivelyreducinggovemment-imposedtransactioncostsofmarketparticipants,andpromotinghigh-qualitydevelopment,withtheapprovaloftheStateCou
8、ncil,thefollowingopinionsareherebyoffered.I. Overallrequirements(1) Guidingideology.GuidedbytheXiJinpingThoughtonSocialismwithChineseCharacteristicsinaNewEra,thespiritofthe20thCPCNationalCongressshallbefurtherimplemented;thenewdevelopmentphilosophyshallbeimplementedinafull,accurateandcomprehensivema
9、nner;effortsshallbeacceleratedtofosteranewdevelopmentpattern;coordinationbetweendevelopmentandsecurityshallbeadheredto;regulatorysystemsandmechanismsshallbeimproved;theframeworkofregulatorj,rulesshallbeimproved;innovationsshallmadeonregulatorywaysandmethods;andwithrespecttoregulatoryitemswhichinvolv
10、emultipledepartments,whicharedifficulttomanageandhaveprominentpotentialrisks,interdepartmentalcomprehensiveregulationrulesshallbeestablishedandimproved,tieredarrangementsandinterconnecteddevelopmentacrossdifferentregionsshallbeenhanced,andcoordinatedregulationmechanismsshallbeimprovedsoastomakeregul

15、管制 度,补齐监管短板、堵塞监管漏洞,切实把该管的管好、 管到位。Adheringtoaproblem-orientedapproachandfocusingonthekeypoints.Focusshallbeputonthevulnerabilitiesinregulation,paceshallbepickedupinimprovingtheinterdepartmentalcomprehensiveregulationrulesinthekeyfieldsandemergingfieldswithprominenthiddenrisks,weaknessesinregulationsh

17、ogiesshallbestrengthenedinconsiderationoftheattributesofrisksininterdepartmentalcomprehensiveregulationitemstoadvanceinanoverallmannerbusinessintegration,dataintegrationandtechnologyintegrationandconductpreciseandeffectiveregulation.(三)主要目标。2023年底前,建立跨部门综合监 管重点事项清单管理和动态更新机制,在部分领域开展跨 部门综合监管试点,按事项建立健全
18、跨部门综合监管制 度,完善各司其职、各负其责、相互配合、齐抓共管的协 同监管机制。到2025年,在更多领域、更大范围建立健全 跨部门综合监管制度,进一步优化协同监管机制和方式, 大幅提升发现问题和处置风险能力,推动市场竞争更加公 平有序、市场活力充分释放。(3) Mainobjectives.Beforetheendof2023,thelist-basedmanagementanddynamicupdatingmechanismsforkeyinterdepartmentalcomprehensiveregulationitemsshallbeestablished,thepilotprogr
19、amofinterdepartmentalcomprehensiveregulationshallbeconductedincertainfields,theinterdepartmentalcomprehensiveregulationrulesshallbeestablishedandimprovedbasedonspecificitems,andthecoordinatedregulationmechanismshallbeimprovedsothatrelevantdepartmentsareabletoperformtheirrespectivefunctionsandrespons
20、ibilities,cooperatewithoneanotherandmakeconcertedeffortsinadministration.By2025,interdepartmentalcomprehensiveregulationrulesshallbeestablishedandimprovedinmorefieldsandinawiderrange,coordinatedregulationmechanismsandmethodsshallbefurtheroptimized,andthecapabilitiesofidentifyingproblemsandmanagingri
21、sksshallbesignificantlyenhancedsoastopropelfairerandmoreorderlymarketcompetitionandthefullyunleashedmarketvitality.二、健全跨部门综合监管体制机制II. Improvinginterdepartmentalcomprehensiveregulationsystemsandmechanisms(4) Determiningthelistsofinterdepartmentalcomprehensiveregulationitems.Competentindustrydepartmen
22、tsorthecompetentdepartmentsasprescribedbylawsandregulations(hereinafterreferredtoascompetentindustrydepartments)shallreviewthekeyitemsthatshallbesubjecttointerdepartmentalcomprehensiveregulationinconjunctionwithrelevantregulatorydepartments,andproactivelyconductinterdepartmentalcomprehensiveregulati
23、onoftheitemsinvolvingregulationbymultipledepartmentsinfood,medicinalproducts,medicaldevices,hazardouschemicals,fuelgas,specialequipment,qualityofconstructionprojects,illegalfinancialactivities,andotherkeyfieldsandemergingfieldswhicharedirectlyrelatedtothesafetyofpeopleslivesandpropertyaswellaspublic
24、safetyandhavegreatpotentialrisksandhighsocialrisks.Allprovinces(autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment)shallclarifytheinterdepartmentalcomprehensiveregulationitemsinlocalregions.Beforetheendof2023,allregionsanddepartmentsshallconductlist-basedmanagementanddynamicupdating
25、ofkeyinterdepartmentalcomprehensiveregulationitemsthroughthe44Intemet+regulationsystem.(5) Clarifyingthedivisionofinterdepartmentalcomprehensiveregulationresponsibilities.Competentindustrydepartmentsshall,inconjunctionwithotherrelevantregulatorydepartmentsandbasedonlawsandregulations,the“Three-Deter
26、minationprovisions,andlistsofpowersandresponsibilities,clarifythedivisionofresponsibilitiesconcerninginterdepartmentalcomprehensiveregulationitemsonanitem-by-itembasis.Alldepartmentsrelatedtothenew(四)确定跨部门综合监管事项清单。行业主管部门或法律法规规定的主管部门(以下统称行业主管部门)要会同相关监管部门梳理需实施跨部门综合监管的重点事项,对食品、药品、医疗器械、危险化学品、燃气、特种设备、建筑工
27、程质量、非法金融活动等直接关系人民群众生命财产安全、公共安全和潜在风险大、社会风险高的重点领域及新兴领域中涉及多部门监管的事项,要积极开展跨部门综合监管。各省(自治区、直辖市)要明确本地区跨部门综合监管重点事项。2023年底前,各地区各部门通过“互联网+监管”系统对跨部门综合监管重点事项实施清单管理和动态更新。(五)明确跨部门综合监管责任分工。行业主管部门要会同相关监管部门依照法律法规、“三定”规定和权责清单,逐项明确跨部门综合监管事项责任分工。对行业主管部门不明确、监管边界模糊、监管责任存在争议的新产业新业态新模式,与之相关的各部门都要主动履职、密切配合,防止出现监管空白;同时,要按照领域归
28、口、业务相近原则和新产业新业态新模式的主要行为特征,会同有关方面及时对其研判定性、明确监管职责。县级以上地 方人民政府要全面落实属地监管责任,对本地区涉及多部 门监管的事项,要结合地方机构设置和监管力量配置等情 况确定监管部门和职责划分,确保事有人管、责有人负。 对存在部门管辖争议的行政执法事项,各级司法行政部门 要加强协调。(六)完善跨部门综合监管制度规则。各地区各部门要强化监管政策的协同性、有效性和可操作性,既要防 止出现监管漏洞,又要避免政策叠加造成不利影响。行业 主管部门要会同相关监管部门加快推进跨部门综合监管制 度建设,明确牵头单位、配合单位、监管规则和标准等, 完善配套监管措施;对
29、现行监管标准不一致、相互不衔接 的制度规则,要抓紧修订完善.支持各地区实施综合监管industries,newbusinessformsandnewmodelswithunclearcompetentindustrydepartments,obscureregulatoryboundariesandcontroversialregulatoryresponsibilitiesshalltaketheinitiativetoperformtheirdutiesandcooperatecloselywitheachothertopreventregulatorygaps;and,atthesame
30、time,makeresearchandjudgmenttodeterminethenatureandclarifyregulatorydutiesinatimelymannerinconjunctionwithrelevantpartiesundertheprinciplesOfjurisdictionoverrelevantfieldsandbusinesssimilaritiesandaccordingtothemaincharacteristicsofconductofthenewindustries,newbusinessformsandnewmodels.Thelocalpeopl
31、e,sgovernmentsatorabovethecountylevelshallfullyimplementtheirterritorialregulationresponsibilities,andasforitemsthatinvolvetheregulationbymultipledepartmentsintheirrespectiveregions,determinetheregulatorydepartmentsanddivisionoffunctionsinconsiderationofthesetupoflocalinstitutions,allocationofregula
32、toryforces,andothercircumstancestoensurethatallmatteraretakencareofandallresponsibilitiesarefulfilled.Thejudicialadministrativedepartmentsatalllevelsshallstrengthencoordinationoftheadministrativelawenforcementmattersthedepartmentaljurisdictionoverwhichisindispute.(6) Improvingtheinterdepartmentalcom
33、prehensiveregulationsystemsandrules.Allregionsanddepartmentsshallintensifythecoordination,effectivenessandoperabilityofregulatorypolicies,andnotonlypreventregulatoryloopholesbutavoidtheadverseeffectscausedbyinterwovenandoverlappedpolicies.Competentindustrj,departmentsshall,inconjunctionwithrelevantr
34、egulatorydepartments,acceleratetheadvancementoftheestablishmentofinterdepartmentalcomprehensiveregulationsystems,clarifytheleadingentities,supportingentities,andregulatoryrulesandstandards,amongothers,andimprovesupportingregulatorymeasures;andsparenotimeinrevisingandimprovingthesystemsandruleswhicha
35、reinconsistentwithordonotconnectwithcurrentregulatorystandards.Allregionsshallbesupportedinimplementingthenotificationsystemfeaturingonehandbookforonebusinessscenarioforcomprehensiveregulation,underwhichasetofguidelinesforcomplianceoperationsaredevelopedforeachcategoryofmattersandmarketparticipantsa
36、reinformedoftherequirementsforcomplianceoperationsonaone-offbasistostabilizetheregulatoryexpectationsofmarketparticipants.(7) Improvingtheworkingmechanismsforinlerdeparimentalcomprehensiveregulation.Competentindustrydepartmentsshall,inconjunctionwithrelevantregulatorj,departmentsandaccordingtothereg
37、ulatoryneeds,establishandimprovecoordinatedandefficientworkingmechanismsforinterdepartmentalcomprehensiveregulation,clarifytheworkingrequirementsfordiscussions,consultationsandinformationnotification,amongothers,effectivelyintegrateregulatoryresources,makeoverallplanningonthedevelopmentofregulatoryp
38、olicies,supervisethefulfillmentofregulatoryresponsibilities,promotethesharingofregulatoryinformation,andorganizejointlawenforcementinspections.Whererelevantworkingmechanismshavebeenestablished,operationalrulesshallbefurtherimproved,businesscoordinationshallbestrengthened,andthefunctionalrolesofinter
39、departmentalcomprehensiveregulationshallbestrengthened.Thelocalpeoplesgovernmentsatorabovethecountylevelshall,inlightoflocalactualities,establishand“一业一册”告知制度,一类事项制定一册合规经营指南,一次性告知市场主体合规经营要求,稳定市场主体监管预期。(七)健全跨部门综合监管工作机制。行业主管部门要会同相关监管部门根据监管需要,建立健全协同高效的跨部门综合监管工作机制,明确议事会商、情况通报等工作要求,有效整合监管资源,统筹监管政策制定,督促监管
40、责任落实,推动监管信息共享,组织联合执法检查。已建立相关工作机制的,要进一步完善运行规则,加强业务统筹,强化跨部门综合监管职能作用。县级以上地方人民政府要结合区域实际,分事项建立健全相关跨部门综合监管工作机制,加强统筹协调,推动解决突出问题,防范化解重大风险。三、完善跨部门综合监管协同方式(八)加强风险隐患跨部门联合监测。聚焦问题多 发和高风险领域,构建科学高效、多部门联动响应的风险 隐患监测预警机制,实现风险隐患动态监测、科学评估、 精准预警和及时处置。要依托“互联网+监管”等现有信 息系统,针对具体监管事项的风险特点,构建跨部门联合 监测预警模型,建立健全预警指标体系和预警标准,明确 预警
41、信息推送规则,制定预警响应和处置预案。要利用信 息技术手段全面提升监测感知能力,有效归集分析相关部 门监管信息,及早发现和处置各类风险隐患。对重大预警 信息要开展跨部门综合研判、协同处置。improverelevantworkingmechanismsforinterdepartmentalcomprehensiveregulationwithrespecttospecificmatters,strengthenoverallplanningandcoordination,boosttheresolutionofprominentproblems,andguardagainstanddefus
42、emajorrisks.IILImprovinginterdepartmentalcomprehensiveregulationcoordinationmethods(8) Strengtheningtheinterdepartmentaljointmonitoringofhiddenrisks.Focusshallbeputonthefieldswhereproblemoccurfrequentlyandthehigh-riskfields,andscientificandefficienthiddenriskmonitoringandearlywarningmechanismsfeatur
43、ingjointresponsebymultipledepartmentsshallbebuilttorealizethedynamicmonitoring,scientificassessment,preciseearlywarningandtimelyhandlingofrisks.Itisnecessaryto,basedonexistinginformationsystemssuchasinternet+regulation,andaccordingtotheriskattributesofthespecificregulatoryitems,buildaninterdepartmen
44、taljointmonitoringandearlywarningmodel,establishandimprovetheearlywarningindicatorsystemandearlywarningstandards,clarifytherulesforpushingearlywarninginformation,anddevelopearlywarningresponseanddisposalplans.Informationtechnologymeansshallbeutilizedtocomprehensivelyimprovethemonitoringandperception
45、capabilities,effectivelycollectandanalyzetheregulationinformationofrelevantdepartments,anddiscoverandaddressthevarioushiddenrisksasearlyaspossible.Majorearlywarninginformationshallbesubjecttointerdepartmentalcomprehensiveresearchandjudgmentandbemanagedinacoordinatedmanner.(9) Conductinginterdepartme
46、ntaljointrandominspectionsofmarketparticipants.Regulationandlawenforcementresourcesshallbeeffectivelycoordinated,greateffortsshallbemadetostreamlineandintegrateinspectionitems,andjointrandominspectionsshallbeactivelypromotedtocontinuouslyenhancecoordinatedregulationcapabilities.Wheretwoormoredepartm
47、entsconductdifferentadministrativeinspectionsofasamesubjectofregulation,andsuchinspectionscanbeconductedatthesametime,aninierdepartmenlaljointinspectionshallbeconductedinprinciple.Interdepartmentaljointrandominspectionsshallbegenerallyconductedthroughtheregulatorymodeofu4randomselectionofsubjectsand
48、inspectorsandpublicdisclosure/Organizationmethodsshallbecontinuouslyoptimizedandtheproportion,frequencyandparticipatingdepartments,amongothers,ofrandominspectionsshallbereasonablydeterminedinconsiderationofthecreditratingandriskclassificationofthesubjectsofregulation.Ifindustrialorregionalviolations
49、oflawsorregulationsoruniversalproblemsorrepeatedproblemsarefound,interdepartmentaljointinspectionsorspecialrectificationshallbeorganizedinatimelymanner.(10) Promotinginterdepartmentaljointhandlingofcluestoproblems.Thechannelsforcollectingcluestoproblemsshallbecontinuouslyexpanded.Cluestoproblemsshallbeextensivelycollectedthroughvariouschannels,suchasthe“12345governmentservicehotline,thenationalintegratedonlineregulatoryplatform,industryassociations,andne
