1、XX大学讲座教授聘任合同Emp1.oymentContractforChairProfessorOfXXUniversity聘任方：XX大学（简称甲方）受聘方：（简称乙方）PartyA:XXUniversityPartyB:为进一步实施人才强校战略，保证我校讲座教授工作的顺利实施，保障甲乙双方的合法权益，根据中华人民共和国教师法、XX工程大学讲座教授聘任办法的相关规定，经甲乙双方协商订立本合同。Inordertofurtherimp1.ementthepo1.icyofStrengtheningtheUniversitybyRecruitingTa1.entedPeop1.e,9toensur
2、ethatthechairprofessorundertakehis/herdutiessuccessfu1.1.y,andtoguaranteethe1.egitimaterightsandinterestsofbothparties,thetwopartieshavereachedthefo1.1.owingagreementsinaccordancewithTheTeachers1.awofthePeop1.efsRepub1.icofChinaandRu1.esandRegu1.ationsforEmp1.oyingChairProfessorsatX.第一条聘期I .Emp1.oym
3、entTerm甲方聘任乙方为我校讲座教授，岗位聘期为三年。聘期自20年月日至20年月日。聘任期满，聘任合同自动解除。PartyAemp1.oysPartyBaschairprofessoratSCUTforthreeyearsstartingfrom(date)of(month),(year)to(date)of(month),(year).Upontheagreementexpiration,thecontractisautomatica1.1.yterminated.第二条乙方在聘期内的工作任务II DutiesandTasksofPartyB一、教学任务(包括承担核心课程的讲授任务，开设
4、本学科前沿领域课程或讲座等)：2.1 Teaching(whichinc1.udesteachingcoreandfrontiercoursesinthere1.atedfie1.ds,and1.ecturesandpresentations.)二、科研任务(包括以甲方为第一作者单位发表SCI收录论文或出版论著，以甲方为依托单位主持或参与科研项目等)：2.2 Scientificresearch(whichinc1.udesSCIjourna1.papersormonographswithPartyAasthefirstauthor,saffi1.iation,orresearchprojec
5、tsheadedbyPartyBorPartyB,sparticipationwithPartyAashis/heraffi1.iation.)三、学科建设任务(包括协助甲方相关学科建设，对学科发展方向和研究重点提供重要建议，扩大甲方相关学科的国际影响力)：2.3 Discip1.ineConstruction(whichinc1.udesassistingPartyAinre1.ateddiscip1.ineconstruction,puttingforwardsuggestionsondiscip1.inedeve1.opmentandonresearchpriorities,andhe1
6、.pingPartyAtoenhanceitsinternationa1.inf1.uenceandstatusinthere1.ateddiscip1.ines.)四、人才培养任务(组建或参与组建科研团队，联合培养博士、硕士研究生，指导博士后研究人员、青年教师，互派高级访问学者等)：2.4 Personne1.cu1.tivation(whichinc1.udessettinguporhe1.pingsettingupscientificresearchteams,joint-supervisingPhDcandidatesandMA/MSCcandidates,supervisingpos
7、tdoctora1.researchersandyoungteachers,andhe1.pingwithorganizingexchangingvisitingscho1.ars.)五、国际交流合作(包括促进甲方与国外科研机构或企业在科研项目合作、学术互访、学生联合培养等方面的合作，邀请知名外国专家来校访问等)：2.5 Imunicationsandcooperation(whichinc1.udespromotingcooperationbetweenPartyAandinternationa1.researchinstitutesandenterprisesonscientificand
8、researchprojects,academicvisitsandjoint-cu1.tivationofstudents,andinvitingrenownedforeignexpertstoSCUT).六、其他任务：2.6 Othertasks第三条权利和义务II1.RightsandOb1.igations一、甲方权利3.1 RightsofPartyA甲方根据学校的有关规定，对乙方进行管理；甲方依照合同约定的工作目标及任务，对乙方进行考核。PartyAisentit1.edtosupervisePartyBinaccordancewithre1.evantUniversityru1.
9、esandregu1.ations,toassessPartyB,sperformanceonthebasisofthecontract.二、甲方义务3.2 Ob1.igationsofPartyA1 .依法维护乙方应享有的各项权利。1.1.1 Toguaranteethere1.evantrightsofPartyBin1.inewiththecontract.2 .为乙方提供的工作和生活条件：3 .2.2ToprovidePartyBwiththefo1.1.owingworkingand1.ivingconditions:(1)乙方来校工作期间，甲方为乙方提供讲座教授周转公寓，入住期间发
10、生的水电煤气费等由乙方自行缴纳，学校按专家公寓房租标准收取租金；3.2.2.1 ToprovidePartyBwithappropriateapartmentwithstandardschoo1.rent.PartyBneedstopayfortherentaccordingtothestandardofSCUT,aswe1.1.astheuti1.ityfees(inc1.udingwater,e1.ectricity,andgas,etc.).(2)甲方为乙方在聘期内购买一份保额拾万左右的国内意外伤害商业保险；3.2.2.2 Topurchaseaccidentinsuranceof100
11、,000RMBforPartyB.(3)在聘期内，甲方根据讲座教授工作需要提供科研活动经费贰拾万元(主要用于国际差旅费)。3.2.2.3 ToprovidePartyBwithscientificresearchfundof200,000RMB(whichinc1.udestrave1.expenses)duringtheemp1.oyment.三、乙方权利3.3RightsofPartyB1 .甲方根据乙方实际来校工作时间(附护照出入境记录及来校机票复印件),按人民币肆万元/月(税前)的标准计算薪酬。2 .3.1PartyAsha1.1.payPartyBpre-taxsa1.aryof40
12、,000RMBpermonthinaccordancewithhis/heractua1.stayatSCUT.2.享受甲方为其提供的工作和生活条件。3.3.2PartyBhastherighttoenjoyworkand1.ivingfaci1.itiesprovidedbyPartyA.四、乙方义务3.4Ob1.igationsofPartyB1.认真遵守国家法律、法规和甲方的各项规章制度。3.4.1PartyBsha1.1.observe1.awsanddecreesenactedbyPeop1.esRepub1.icofChinaaswe1.1.asPartyA,sre1.evantr
13、egu1.ations.2.聘期内保证每年来校工作2个月(含)以上。3.4.2Duringtheemp1.oymentterm,theactua1.in-servicetimeofPartyBsha1.1.bemorethan2months(inc1.ude2months).3.全面履行岗位职责，完成岗位的工作目标及任务；聘期结束时乙方须按要求向甲方提交聘期考核表；接受甲方的管理、监督及考核。3.4.3PartyBsha1.1.fu1.fi1.1.thecorrespondingpostresponsibi1.itiesassignedtohim/herwithhighstandards.At
14、theendoftheemp1.oymentterm,PartyBsha1.1.submittheemp1.oymentperiodassessmentformtoPartyAasrequired.PartyBsha1.1.acceptPartyA,smanagement,supervision,inspectionandreviewofhis/herworkingperformance.4.乙方在校期间，应遵守我国有关宗教法律法规，不得在校内传教，不得在校外组织或参加非法宗教活动，不得组织学生在校外参加任何宗教活动。3.4.4PartyBsha1.1.abidebythe1.awsandre
15、gu1.ationsconcerningre1.igionsofChina,andsha1.1.notpreachanyre1.igionoranyinappropriatebe1.iefinSCUT.PartyBsha1.1.notorganizeorparticipateinanyi1.1.ega1.re1.igiousactivitiesororganizestudentstoparticipateinanyre1.igiousactivitiesoutsideSCUT.5.乙方应根据中华人民共和国法律法规的规定缴纳个人所得税，并由甲方代扣代缴；如根据乙方国籍所在地法律法规的规定，乙方需
16、就上述劳务费在该地缴纳税费的，乙方应依法缴纳并承担因未缴纳而产生的全部法律责任。3.4.5PartyBsha1.1.paypersona1.incometaxinaccordancewiththe1.awsandregu1.ationsofthePeop1.e,sRepub1.icofChina,andPartyAsha1.1.withho1.dandremittax.IfPartyBisrequiredtopaytaxesorfeesontheabovesa1.aryinaccordancewiththe1.awsandregu1.ationsofthep1.aceofbirthofPart
17、yB,PartyBsha1.1.paycorrespondingtaxesorfeesaccordingto1.awandbeara1.1.1.ega1.1.iabi1.itiesarisingfromthenon-payment.第四条考核IV .Assessment一、甲方根据聘任合同岗位目标和工作任务对乙方进行聘期考核，乙方须按要求向甲方提交考核材料，考核结果作为其绩效评估的主要依据。4.1 PartyAisentit1.edtoorganizeafina1.assessmentonPartyBinaccordancewiththedutiesandtasksstipu1.atedint
18、hecontract.ItisPartyB,sob1.igationtosubmitassessmentmateria1.sanddocumentstoPartyA.Theresu1.tsoftheassessmentsha1.1.beregardedasthemainbasisofPartyB,sperformance.二、聘期考核合格，经个人申请，学校同意，可续聘讲座教授;考核不合格者，不予续聘。4.2 ThecontractmaybereneweduponPartyB,srequest,approva1.ofthere1.evantschoo1.andatPartyA,sconsenti
19、fPartyBsucceedsinthefina1.assessmentattheendofhis/heremp1.oyment.Thosewhohavefai1.edinthefina1.assessmentarenote1.igib1.etorenewtheircontracts.第五条合同的变更与解除V .A1.ternationandTerminationoftheContract一、乙方在聘期内如不能履行本合同所规定的职责，考核不合格或有违法违纪违反师德行为，甲方有权予以解聘，终止本合同。5.1 PartyAisentit1.edtodismissPartyBandterminate
20、thecontract,ifPartyBfai1.stoperformhis/herresponsibi1.itiesunderthiscontractorfai1.stopasstheperformanceassessment,orisinvo1.vedinanycrimina1.activities,orvio1.atesteachers9mora1.ityandob1.igations.二、乙方在聘期内因特殊原因提出辞聘的，需提前三个月向甲方提出申请，经甲方同意后方可辞聘，并视具体情况承担相应的违约责任。5.2 PartyBmustsubmitwrittennoticetoPartyAt
21、hreemonthsinadvanceifhe/shewishestoterminatethecontractduetoeventsbeyondhis/hercontro1.PartyBcannotterminatethecontractwithoutPartyA,sconsent.PartyBis1.iab1.etobreachpena1.ties.三、乙方在聘期内因考核不合格或因特殊原因提出辞聘的，甲方视具体情况要求乙方将拨发的科研活动经费退还甲方。5.3 PartyAisentit1.edtodemandthatPartyBreturnthescientificresearchfunds
22、hou1.dPartyBsubmitarequesttoresignduetohis/herfai1.ureintheassessmentoreventsbeyondhis/hercontro1.四、聘任期间如发生双方无法预见、无法防范而致使合同无法正常履行的事由，需要变更或解除合同的，聘任双方应按照国家的有关法律妥善处理。5.4 Shou1.dtherebeanyunpredictab1.eorunavoidab1.eeventsthatpreventthecontractfromfu1.1.imp1.ementation,theconcernedpartiesshou1.dhand1.et
23、heprob1.eminaccordancewithre1.evantstate1.awsandregu1.ations.第六条双方约定的其他事项VI Othermattersagreeduponbybothparties一、聘期内，乙方在讲座教授岗位上所取得的教学、科研等成果均属职务成果，须归属甲方。其发表有关论文、著作等须属甲方为第一作者单位；申报有关奖励、专利和科研项目及经费等，均须署甲方为乙方第一工作单位。6.1 A1.1.teachingandresearchachievementsofPartyBinthepositionappointedbyPartyAwithintheterm
24、sha1.1.beserviceachievementsandbe1.ongtoPartyA.Anypub1.ishedpapersormonographsmustbepub1.ishedwithPartyAasthefirstauthor,saffi1.iation;awards,patents,projects,andfundssha1.1.bemarkedwithPartyAastheauthor,saffi1.iation.二、聘期内，乙方保证对其科研成果拥有全部知识产权，不会对任何第三方构成侵权，不违反其与其他高校或机构的任何协议。如第三方就乙方的科研成果提出异议或者乙方所取得的科研
25、成果造成对任何第三方的权利侵犯的，则由乙方负责处理并承担相应后果，如给甲方造成损失的，乙方应当予以赔偿。6.2 DuringPartyB,semp1.oymentterm,PartyBsha1.1.guaranteetheownershipofa1.1.inte1.1.ectua1.propertyrightsofPartyB,sscientificresearchresu1.tsobtained,andwithoutinfringementonanythirdpartyandvio1.ationofanyagreementwithotheruniversitiesorinstitutions
26、.Ifanythirdparty1.odgesanobjectiontoPartyB,sscientificresearchresu1.tsorPartyB,sscientificresearchresu1.tsinfringetherightsofanythirdparty,PartyBsha1.1.beresponsib1.eforhand1.ingandbearingcorrespondingconsequences.Insuchacase,shou1.dany1.ossbecausedtoPartyA,PartyBsha1.1.makecorrespondingcompensation
27、.三、聘期内，乙方保证其未与其他高校或机构签订竞业禁止协议，乙方签订本合同不违反其与其他高校或机构签订的任何协议；如因乙方与甲方签订本合同而导致乙方对第三方违约的，应由乙方负责处理并承担相应后果，如给甲方造成损失的，乙方应当予以赔偿。6.3 DuringPartyB,semp1.oymentterm,PartyBsha1.1.guaranteethatthereisnoprohibitionofbusinessstrifeagreementornon-disc1.osureagreementsignedwithanyotheremp1.oyer,norsha1.1.thiscontractvi
28、o1.ateanyagreementsignedwithotheruniversitiesorinstitutions;Shou1.dPartyBbreachthecontractsignedwithathirdpartyduetothiscontractsignedbetweenPartyBandPartyA,PartyBsha1.1.be1.iab1.eforhand1.ingandbearingthecorrespondingconsequences.Insuchacase,shou1.dany1.ossbecausedtoPartyA,PartyBsha1.1.makecorrespo
29、ndingcompensation.第七条附则VII Appendix一、本合同一式三份，甲方、乙方以及乙方所聘学院各持一份。本合同于签字盖章之日起生效。每份合同均用中文和英文写成，两种文字版本的合同于双方当事人签字后生效，具有同等效力。如中英文版本之间有任何冲突，以中文版本为准。7.1 Thecontractismadeintrip1.icate.Eachpartyandthere1.evantschoo1.ho1.donesetrespective1.y.Thecontractwi1.1.becomeva1.idsincethedayofsigning.Thiscontractismade
30、inbothChineseandEng1.ish,andthecontractinboth1.anguagessha1.1.havethesame1.ega1.effectuponsigningoftheparties.Anyconf1.ictbetweenthetwo1.anguageversionssha1.1.begovernedbytheChineseversion.二、除发生不可抗力因素致使合同无法履行外，双方应严格履行合同中的各项条款，如发生争议，双方应协商处理，对合同有关条款的变更，应征得对方同意。7.2 Exceptforforcemajeure,bothpartiesares
31、trict1.yboundbya1.1.thetermsspecu1.atedinthecontract.Friend1.ydiscussionisencouragedtosett1.edisagreementsordisputesshou1.dtherebeany.Anya1.terationtothetermsofthecontractmustbeagreeduponbybothparties.三、本合同如有未尽事项，应由双方协商，做出补充规定。补充规定与本合同具有同等效力。7.3 Otheraffairsnotinc1.udedhereofsha1.1.bemadeintoadditio
