2、ndsoverthePremisestoPartyBandwhenPartyBreturnsthePremisestoPartyAuponcompletionofthisleasingterminaccordancewiththisContract.二、租赁用途Two、Usageof,ThePremises2-1乙方向甲方承诺,租赁该房屋作为空色使用,并遵守国家与本市有关房屋使用与物业管理的规定。2-1PartyBpromisestoPartyAthatthePremisesisonlyforresidentialPUrPoSeS.andshallobeytherelevantstateand

3、localregulationsaboutuseandthemanagementofthehousing.2-2乙方保证,在租赁期内未征得甲方书面同意与按规定须经有关部门审批而未核准前,不擅自改变上述约定的使用用途.2-2PartyBpromisesthatitshallnotchangetheusageofthePremiseswithoutgettingthewrittenconsentofPartyAandtheapprovaloftherelateddepartmentaccordingtothetermshereinduringtheLeasingterm.三、交付日期与租赁期限Th

4、reeDeliverydateandleasingterm3-1甲乙双方约定,甲方于一年一月日前且合同补充条款第一条规定的首月租金与保证金到达甲方指定账户后向乙方交付该房屋。【出租】房屋租赁期自年月起至一年月一日止。甲方需在房屋交付日前做好各项整修及清洁工作。3-1BothPartiesagreethatPartyAshallhandoverthePremisestoPartyBbeforeafterPartyAreceivedthefirstmonthlyrentalanddeposit.LeasingtheleasingTermiscommencedfromto.Allmaintenanc

5、esandcleaningworkshavetobefinishedbeforetheCheck-inDay.32租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租该房屋的,则应于租赁期满前两个月,向甲方提出续租书面要求,经甲方同意后签订租赁合同。3-2PartyAshallhavetherighttotakebackthePremisesfromPartyBandPartyBshallreturnthePremisestoPartyAontimeupontheexpirationofleasingterm.PartyBshallapplyforextensioninwritingt

6、oPartyAtwomonthsbeforetheexpirationifPartyBintendstocontinuethelease,thenewleasecontractshallbesignedaftergettingPartyA,sapproval.四、租金、支付方式与期限FourRent,PaymentMethodandterm4-1甲、乙双方约定,该房屋每日每平方米建筑面积租金为(币)/Q【出租】月租金总计为(人民币)元(大写:L万上仟十佰上拾元角整)。4-1ThetwoPartiesagreethattherentofonesquaremeterforonedayis(/)/_

7、.Leasingthemonthlyrentis(RMB).该房屋租金年内不变。自第2_年起,双方可协商对租金进行调整。有关调整事宜由甲、乙双方在补充条款中约定.TherentshallnotbechangedwithinOneyears.Therentshouldbeincreasedordecreasedfromthesecondyear.Therelevantmattersonadjustingshallbespecifiedinthesupplementaryclausebybothparties.4-2乙方应于每月日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按月租金的Q%支付

8、违约金。4-2PartyBshallpaytherentbeforethe15thdayofeachmonthtoPartyA.PartyBshallpaytheoverduepaymentfineequivalentto0.5%ofthemonthlyrent,payableforeachdayfromthedateonwhichtheamountwasdueuntilthefulfillmentofthepayment.4-3乙方支付租金的方式如下:详见补充条款。4-3Thepaymentmethodoftherentisasfollows:ReferK)ADDendix.五、保证金与其他

9、费用Five、SecurityDepositandotherFees5-1甲乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为工个月的租金,即(人民币)元5-1BothPartiesagreethatPartyBshallpayPartyAsecuritydepositwhenPartyAhandingoverPremises.Thesecuritydepositistwo(2)monthsrent(RMB).52租赁期间,使用该房屋所发生的水、电、天然气、通讯、/等费用由乙无承担。5-2Duringtheleasingterm,PartyBshallberesponsib

10、leforthefullpaymentofthePremisesofthecostswater,electricity,naturalgasandcommunication.5-3Ni方负责支付的上述费用,计算或者分摊办法,支付方式与时间:详见补充条款。5-3Thecount,wayoftheshare,paymentmethodanddateofthepaidfeeare:RefertoAppendix.六、房屋使用要求的维修责任Six、TheresponsibilitiesonRepairofthePremises6-1租赁期间,乙方发现该房屋及其附属设施有损坏时,应及时通知甲方修复;甲方

11、应在接到乙方通知后2日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。6-1Duringtheleasingterm,PartyBshallinformPartyAtorepairintheeventthatthedamagetothePremisesorfacilitiesisoccurred.PartyAshallrepairitwithinthree(3)dayafterreceivingthenotice.InCasePartyAfailstorepairthedamageontime,PartyBcanrepairitinsteadofPartyAandthePartyAs

12、hallberesponsibleforthefees.6-2租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或者不合理使用,致使该房屋及其附属设施损坏或者发生故障的,乙方应负责维修。乙方拒不维修,费用由乙方承担。6-2PartyBshalltakegoodcareofandreasonablyusethePremisesandattachedfacilitiesduringtheleasingteam.PartyBshallberesponsiblefortheimmediaterepairorcompensationforthedamagetothePremisesorfa

13、cilitiesduetoPartyBsimproperuse.6-3租赁期间,甲方督促物业管理公司保证该房屋及附属设施处于正常的使用与安全的状态。甲方对该房屋进行检查、养护,应提早壹日通知乙方。检查养护时,乙方应予以配合。甲方应减少对乙方使用该房屋的影响。6-3PartyAshallguaranteethatthePremisesshallbeundertheconditionofusableandsafetyduringtheleasingterm.PartyAshallnoticePartyBone(1)dayinadvancewhilerepairingmaintenancePremi

14、ses.PartyBshallassistorcooperatewithPartyA.PartyAshallreducetheinfluenceofPartyB,susingofthePremises.6-4除本合同附件(三)外,乙方另需装修或者者增设附属设施与设备的,应事先征得甲方的书面同意,按规定须向有关部门审批的,则还应由甲方委托乙方报请有关部门批准后,方可进行。乙方增设的附属设施与设备归属及其维修责任由甲、乙双方另行书面约定.6-4IfPartyBintendstomakerenovationsorchangestotheoriginalfacilitiesapartfromtheap

15、pendix(3)ofthiscontract,PartyBshalldosoonlyafterobtainingthewrittenconsentofPartyA.PartyBshallbeabletocarryoutthesaidprojectonlyaftergoingthroughtheapplicationformalitiestotherelateddepartmentinaccordancewiththerelevantregulations.Theownershipandresponsibilitiesofrepairingtheaccessoryequipmentshallb

16、estipulatedatsomeothertimebyPartyAandPartyB.七、房屋返还时的状态Seven、ThestateofthereturnedPremises7-1除甲方同意乙方续租外,乙方应在本合同的租期满后的旦日内返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应按/元/平方米(/币)向甲方支付该房屋占用费。(详见补充条款)7-1ExceptthatPartyAagreesPartyBextendsthiscontract,PartyBshallreturnthePremisesattheexpirationoftheleasingterm.IncasePart

17、yBfailstodo,soPartyBshallpay/perdaypermetersquaremeterfortheoccupationfeeofthePremises.(RefertoAppendix.)7-2乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收认可,并相互结清各自应当承担的费用。7-2ThePremisesshallbeinthenormalstatement.Whilereturning,thePremisesshallbecheckedforacceptanceandthetwopartiesshallpayupthechargesoughttobeborn

18、ebyeachother.八、转租、转让与交换Eight、Subletting,transferandexchange8-1除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,需事先征得甲方的书面同意,方可将该房屋部分或者全部转让给他人。但同一间居住房屋,乙方不得部分或者同时转租给二个或者二个以上的承租人。8-1PartyBshallbeallowedtosubletthepremisesinpartorinwholetothirdPartyonlyaftergettingPartyAswrittenconsentduringtheleasingtermunlessPartyAautho

19、rizesPartyBtosubletthePremisesintheSupplementaryAgreementmadebyPartyAandPartyB.PartyBshallnotsubletthesamePremisesinpartorsubletthePremisestomorethantwootherPersons.8-2乙方转租该房屋,应按规定与受租方订立书面合同的转租合同并按规定向该房屋所在区、县房地产交易中心或者农场系统受理处办理,登记备案。8-2WhenPartyBsubletsthePremises,PartyBshallconcludewrittensubleasing

20、Contractwiththesublesseeandregisterinthepremisestransactioncenterofdistrict/countryoracceptancebureauoffarmsystemwherethepremiseslocateinaccordancewithregulations.8-3在租赁期内,乙方将该房屋转让给他人承租或者与他人承担的房屋进行交换,务必事先征得甲方书面同意。转让或者交换后,该房屋承租权的受让人或者交换人应与甲方签定租赁主体变更合同并继续履行本合同。8-3Duringleasingterm,PartyBshallnotsublea

21、sethepremisestothirdPartyorexchangeitwiththirdPartyunlessawrittenconsentfromPartyAhasbegranted.Aftersubletting,thesuccessoroftheleaserightofthePremisesshallexecuteaprincipalpartalterationcontractwithPartyAandcontinuetofulfillthiscontract.8-4在租赁期内,甲方如需出售该房屋,应提早三个月通知乙方。乙方放弃优先购买权。转让后,甲方应保证受让人与乙方签定租赁主体变

22、更合同并继续履行本合同。8-4Duringleasingterm,PartyAshallinformPartyBthree(3)monthsinadvance,PartyBgivesuptherightofPreemDtion.AfterPlODertytransaction,PaiIyAShaIlguaanteetheSUCCeSSorOftheDrODCrtyShaIlexecuteaDrinCiDaIDaHahemationCOntnICtWithPartyBandCOntinUetofulfillthisContraCl九、解除本合同的条件Nine、conditionstotermin

23、atetheContract9-1甲、乙双方同意在租赁期内,有下列之一的,本合同终止,双方互不承担责任。9-1Duringtheleasingterm,thecontractshallbeterminatedwhenanyofthefollowingconditionoccursandtwopartiesshallnotberesponsibleforeachother.(一)该房屋占用范围内的土地使用权依法提早收回的;(a) TherighttotheuseoflandonwhichthePremiseslocatebelegallytakenbackinadvance;(二)该房屋因社会公

24、共利益或者城市建设需要被依法征用的;(b) ThePremisesbetakenbackfortheneedofpublicinterestorthecitysconstruction;()该房屋毁损、灭失或者者被鉴定为危险房屋的;(c) ThePremisesbedamaged,missingorbeauthenticatedasdangerousPremises;9-2甲、乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反本合同的一方,应向另一方按月租金的两倍支付违约金;给对方造成缺失的,支付的违约金不足抵付一方缺失的,还应赔偿造成的缺失与违约金的差额部分:9-2Thebo

26、ngPartyshallcompensatethedeficiency.(一)甲方未按时交付该房屋,经乙方催告后拾伍日内仍未交付的;(a) PartyAfailstodeliverthePremisesonscheduleandfailstodosowithinfifteen。5)daysafterreceptionofPartyB,ssummonexhortation.(二)甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或者甲方交付的房屋存在缺陷,危及乙方安全的。(b) ThePremisesPartyAdeliveredbenotinaccordancewiththeagre

27、ementofContractwhichleadstofailtofulfilltheaimoftherent.OrthePremisesbedefectivetoendangerthesafetyofPartyB.(三)乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的;(c) PartyBtransformstheusageofthePremiseswithoutthewrittenagreementofPartyAwhichdamagedthePremises;(四)因乙方原因造成房屋主体结构损坏的;(d) ThedamageofmainstructureofthePropertycau

28、sedbyPartyB;(五)乙方擅自转租该房屋、转让该房屋承租权或者与他人交换各自承租的房屋的;(e) PartyBsubletsthePremisesortherightofthetenancyorexchangethePremiseswithotherswithoutPartyA,sconsent;(六)乙方逾期不支付租金累计超过壹个月的:(f) PartyBfailstopaytherentonscheduleforlongerthanone(1)month;十、违约责任Ten、LiabilitiesforBreachofcontract10-1该房屋交付时存在缺陷的,甲方应自交付之日

29、起的上日内进行修复,逾期不修复的,甲方同意减少租金并变更有关租金条款。10-1ifthePremiseshasdefectwhendelivering,PartyAshallrepairthePremiseswithinten(10)days.IfPartyAfailstorepairit,PartyAagreetoreducetherentandchangetherelateditemsoftherentclause.10-2因甲方未在本合同中告知乙方,该房屋出租前己抵押或者产权转移已受到限制,造成乙方缺失的,甲方应负责赔偿。10-2PartyAshallbefullyresponsible

30、foranydamagesorlossestoPartyBifPartyAhasnotinformedPartyBthePremiseshadbeenpledgedorthetransferofthepropertyrighthadbeenlimitedinthecontract.10-3租赁期间,甲方不及时履行本合同约定的维修、养护责任,致使房屋损坏,造成乙方财产缺失或者人身伤害的,甲方应承担赔偿责任。10-3duringleasingterm,PartAshallpayforthelossoranybodilyharmtopartyBcausedbythedamageofthePremis

31、esresultingfromPartyAfailingtoperformtheresponsibilitiesforrepairandmaintenancestipulatedinthecontract.10-4租赁期间,非合同的情况甲方擅自解除本合同,提早收回该房屋的,甲方应按提早收回天数租金的皿倍向乙方支付违约金。若支付的违约金不足抵付乙方缺失的,甲方还应负责赔偿。10-4IfPartyAterminatesthecontractandtakesbackthePremisesinadvanceforcausesotherthancontractduringleasingterm,part

32、yAshallpaytheliquidateddamagesequivalenttotwotimesofthedailyrentalleftofthePremisestoPartyB.shouldtheliquidateddamagesnottobeenoughtopayforPartyBsloss,PartyAshallberesponsibleforthedeficiency.10-5乙方未征得甲方书面同意或者者超出甲方书面同意的范围与要求装修房屋增设附属设施的,甲方能够要求乙方恢复房屋原状。10-5IfPartyBrenovatesandinstallsadditionalfacilit

33、iesintheleasedPremiseswithouttheapprovalofPartyA,PartyAhastherighttorequestPartyBtorestorethePremiSeStoitsOriginaIstate.10-6租赁期间,非本合同规定的情况,乙方中途擅自退租的,甲方可没收乙方的保证金,不足抵付甲方缺失的,乙方还负责赔偿。10-6IfPartyBterminatesthecontractandgivesbackthePremisesinadvanceforcausesotherthanContractduringleasingterm,PartyAshalls

34、eizurethesecuritydepositandifthesecuritydepositnottobeenoughtopayforPartyAsloss,PartyBshallberesponsibleforthedeficiency.十一、其他条款ElevenOthersterms11-1租赁期间,甲方需抵押该房屋,应当书面告知乙方。11-1Duringleasingterm,ifPartyAneedstomortgagethePremises,PartAshallinformPartyBwithwrittennotice.11-2本合同未尽事宜,经甲、乙双方协商一致,可订立补充条款。

35、本合同补充条款及附件均为本合同不可分割的一部分,本合同及其补充条款与附件内空格部分填写的文字与铅印文字具有同等效力。11-2PartyAandBshallmakethesupplementaryagreementsfortheunaccountedtermofthisagreementthroughnegotiationbetweenPartyAandB.allsupplementarytermsintheagreementandattachmentshallbeintegralpartsofthecontractthewrittenwordsfilledintheblankofsupplem

36、entarytermsandattachmentsinthecontractshallbeofequallyauthenticwiththeprintedwordsoftheoriginalleasecontract.11-3甲、乙双方在签署本合同时,对各自的权利、义务、责任清晰明白,并愿按本合同规定索赔。如一方违反本合同,另一方有权按本合同规定索赔。11-3PartyAandBshallbetotallyawareofhisrights,duties,andresponsibilitieswhensigningthecontract.Ifanypartybreachesthecontract

37、,theotherpartyshallhavetherighttoclaimfordamagesinaccordancewiththetermsofthiscontract.U4甲、乙双方就履行本合同发生纠纷,应通过协商解决;协商解决不成的,双方同意选择下列第(二)种方式解决:11-4Anydisputearisingoutduringtheperformanceofthecontractshallberesolvedbyfriendlyconsultations,ifanamicableagreementcannotbereached,PartyAandPartyBagreetosolvet

38、hedisputebytheway(b).(一)、提交y仲裁委员会仲裁;(a) .Submitthedisputeto/ArbitrationCommission(二)、依法向人民法院起诉。(b) SubmitthedisputetoPeople,sCourt.11-6本合同连同附件一式三份。其中:甲方执一份、乙方执一份,一份,均具有同等效力。11-6thisContracttogetherwiththeattachmenthasthree(3)originalsamongwhicheachpartykeepsoneortwo,shallkeepone.AHtheoriginalshaveth

39、esameeffect.本合同自签字生效。Thecontractshallcomeintoeffectsubjecttosigning补充条款Appendix1.在本合同签订后的拾天内,乙方应向甲方支付首月租金及相当于工个月租金的保证金,合计为RMB(大写:人民币)o其中保证金为邈(大写:人民币元整);首月房屋租金睡(大写:人民币一元整),包含双人俱乐部卡,物业管理费,宽带安装费。在乙方支付上述首月租金及保证金后,甲方向乙方交付该房屋。若上述首月租金及保证金到达甲方指定账户时间迟于合同第3T条规定的房屋交付时间的,甲方实际交付房屋时间为上述首月租金及保证金到达甲方指定账户后第二日。1 .Wit

40、hinIen(10)daysofthesigningofthisFormalTenancyAgreement,PartyBshallpaytoPartyAasecuritydepositequivalenttoanamountoftwomonthsrentalandthefirstRental,thetotalisRMB.TheSecurityD叩OSitiSRMBOnIyandthefirstMonthlyRentalisRMB;includingMgt.Fee,ADSLinstallationfee,coupleclubmembershipcard.AndPartyAshallhandov

41、erthePremisestoPartyBafterPartyAreceivedthefirstmonthlyrentalanddeposit.IncaseofdelayingofabovepaymentslaterthanthedatestatedinClause3-1,theactualdatewhenthepremisesbeinghandedoverfromPartyAtoPartyBshouldbetheseconddayafterthepaymentsbeingtransferredtoPartyA,sdesignedbankaccount.上述款项中保证金、首期租金,合计为睡(大

42、写:人民币圆整)支付到甲方指定的空房租金帐号。租金包含会所使用费,垃圾清运费,虫害管理及其他有关管理费用。PartyBshallpaythesecuritydeposit,thefirstMonthlyRentalintotalofRMBI20000toHouseRentalAccount.Therentalshouldincludeclubfacility,trashmanagement,pestcontrol,andothermanagementfees.2 .乙方以人民币方式支付该房屋租金。人民币租金帐号收款人:人民币帐号:开户银行:2 .PartyBshallpaytheRentalt

43、oPartyAinRenMinBi:InFavorof:RMBAccountNumber:BankName:乙方应支付给甲方的上述保证金及租金,系为实际到达甲方帐户的金额。甲方在收到乙方支付的上述保证金及房屋租金后应于10日内向乙方开具房屋保证金收据、空房租金、家具租赁费正式发票及甲方指定的物业管理公司开具的物业管理费正式发票。TherealsumpaidbyPartyBsaccountshouldbesamewiththerentalregulatedincontract.AfterPartyAreceivedthesecuritydepositandtheRentalfromPartyB,

44、within10daysPartyAshallissuethesecuritydepositreceipt,HouseRentalinvoice,theFurnitureRentalinvoiceandthepropertymanagementcompanydesignatedbyPartyAshallissuetheofficialManagementFeeinvoiceandtoPartyB.3 .乙方在租赁期限内,房屋内使用的水、电、天然气及通讯等费用每月按实际使用帐单支付,按帐单规定的时间与地点支付给相对应的部门或者公司,或者委托物业管理公司代办。PartyBshallpaytheWater,Electricity,GasandCommu
