15、按本合同第四条规定交付设计文件时间顺延；超过规定期限15天以上时，乙方有权重新确定提交设计文件的时间。6.1.2 AccordingtothecontentsstatedinArticle3ofthisContract,PartyAshallsubmitmaterialsanddocumentstoPartyBwithinthestipulatedtimeasdescribedandshallberesponsibleforthecompleteness,correctnessandvalidityofsuchmaterialsanddocuments.IntheeventthatPartyA
16、hasdelayedtheissuanceofsuchmaterialsanddocuments,butnotexceeding15daysfromthestipulatedtime,PartyBcouldconsequentlypostponethesubmittalofthedesigndocumentsasstipulatedinArticle4ofthisContract.IncasethatParlyAhasdelayedtheissuanceofmaterialsanddocumentsformorethan15daysexceedingthestipulatedtimelimit
17、,PartyBshallhavetherighttodeterminethenewdateforsubmittingthedesigndocuments.6.1.3 甲方变更委托设计项目、规模、条件，或者对提交资料作重大修改，以致造成乙方设计需返工时，双方除需另行协商签订补充合同、重新明确有关条款外,甲方应按乙方所耗工作量向乙方支付返工费。筑姿料下我就在筑龙网6.1.4 IfPartyAaltersgreatlythedesignproject,scale,conditionswhichtheyhavealreadyentrustedtoPartyB,orthematerialsprovide
18、dbyPartyAiswrong/incompleteorPartyAmakesmoralterationstotheapproveddesignandtheinformationgiven,asaresultofwhich,hascausedPartyBtoredothedesignwork,orhasgeneratedun-necessaryabortiveworks,bothpartiesshallenterintonegotiationandtodrawupasupplementarycontract.PartyAshallcompensatePartyBfortheadditiona
19、lworkloadinaccordancetothenewagreement.6.1.5 在合同履行期间，甲方单方提出解除合同的，乙方已开始设计工作的，甲方应根据乙方已进行的实际工作量支付设计费。6.1.6 ShouldPartyAterminatetheContractduringthecontractualperiod,PartyAshallpayPartyBaccordingtotheactualworkdone.6.1.7 甲方在收到乙方付款通知书后30天内，按本合同第五条规定的金额与时间向乙方支付设计费用；在收到付款通知书的60天仍未支付，每逾期支付一天，应承担应支付金额千分之一的逾
20、期违约金。逾期超过30天以上时，乙方有权暂停履行下阶段工作，并书面通知甲方。甲方上级对设计文件部审批或者本合同项目停缓建，甲方均应支付应付的设计费。6.1.8 PartyAshallpaythedesignfeetoPartyBwithinThirty(30)daysuponreceivingtheNoticeofPaymentfromPartyAaccordingtotheamountandthetimestipulatedinArticle5.IncasethatsuchpaymentisdelayedforSixty(60)daysuponreceivingtheNoticeofPaym
21、ent,thenapenaltyof0.1%ofthedueamountofpaymentonadailybasisshallbepaidbyPartyA.Incasethatsuchpaymentisdelayedforaperiodover30days,PartyBshallhavetherighttosuspendtheirdesignworkforthenextphaseandshallinformPartyAinwriting.IncasethatthemanagementofPartyAdoesnotapprovethedesigndocumentsortheconstructio
22、noftheprojectofthisContractisstoppedor.,postponed,PartyAshallneverthelesspaytheduedesignfee.6.1.9 甲方要求乙方比合同规定时间提早提交设计文件时，甲方应支付赶工费。6.1.10 IfPartyArequestsPartyBtosubmitthedesigndocumentsaheadofthestipulatedtimeasmentionedintheContract,PartyAshallmakeadditionalpayment筑姿料下我就在筑龙网forfastandimmediateservi
23、ce.6.1.11 一方派往现场的工作人员提供工作方便条件。6.1.12 PartyAshallprovidesiteofficeandallrelevantofficestationaryforPartyB,spersonnelwhoarebeingsenttoworksiteduringtheconstructionstage.6.1.13 方应保护乙方的设计版权，未经乙方同意，甲方对乙方交付的设计文件不得复制或者向第三方转让或者用于本合同外的项目，如发生以上情况，乙方有权索赔。6.1.14 PartyAshallprotectthedesigncopyrightofPartyB.With
24、outPartyB,sconsent,PartyAshallnotduplicateoftransfertoathirdpartyorusethedesigndocumentsforotherprojects.Iftheabove-mentionedishappened,PartyBshallhavetherighttoclaim.6.2 乙方责任：6.2ResponsibilitiesofPartyB:6.2.1 乙方按本合同第四条规定的内容、时间及份数向甲方交付设计文件。6.2.2 PartyBshallsubmittoPartyAtherequireddesigndocumentsinr
25、ightcontent,timeandcopiesaccordingtotheclauseofArticle4.6.2.3 乙方对设计文件出现的遗漏或者错误应在施工前负责修改或者补充。由于乙方设计错误造成工程质量事故缺失，乙方除负责采取补救措施外，应免收缺失部分的设计费，并根据缺失程度向甲方偿付赔偿金，赔偿金额根据乙方与保险公司签订的设计责任保险合同计算。6.2.4 PartyBshallberesponsibleforcorrectinganyomissionormistakeintheirdesigndocumentsbeforetheconstruction.Ifthedesignmis
26、takemadebyPartyBhascausedlossestoPartyA,PartyBshallnotonlyberesponsiblefortakingtheremedialmeasures,butalsoshallremitthedesignfeeforthepartofsuchlossesandshallpaycompensationtoPartyAaccordingtothedegreeofsuchloss.TheamountofthecompensationshallbedeterminedbypartyBandhisinsurancecompanyandtobeinaccor
27、dancetotheprofessionalindemnityinsurancecoverage.6.2.5 由于乙方自身原因，延误了按本合同第四条规定的设计文件交付时间，每筑姿料下我就在筑龙网延误一天，应减收该项目应收设计费的千分之一。6.2.6 IfitisPartyB,sownfaulttohavedelayedthesubmissionofthedesigndocumentsaccordingtothestipulatedtimeasdescribedinArticle4,PartyBshalldeduct0.1%ofthedueamountofthedesignfeeonadaily
28、basisforthedelayperiod.6.2.7 合同生效后，乙方单方提出解除合同的，乙方应当按照有关规定赔偿甲方缺失。6.2.8 AftertheContractcomesintoforces,ifPartyBproposestoterminatetheContract,PartyBshallcompensatePartyA,slossesaccordingtotherelevantregulations.6.2.9 乙方交付设计文件后，应参加甲方及有关职能部门的设计审查会议及根据审查结论负责不超出原定计划任务书范围内的必要调整补充；负责向甲方及施工各单位进行设计交底，处理有关的设计
29、问题与参加竣工验收。乙方应派有关人员参加施工期间的例会。乙方应优化设计以帮助业主将造价操纵在预算内。6.2.10 Afterthedesigndocumentshasbeensubmitted,PartyBshallalsoattendtheapprovalmeetingsheldbyPartyAandtherelevantcompetentauthoritiesandshallberesponsibleformakingthenecessaryadjustments,revisionsandsupplementswhichdoesnotexceedthescopeofthedocuments
30、ofdesignrequirementsasoriginallydefinedbasedonthecommentsofsuchmeetings.PartyBshallberesponsibleforexplainingdesigndetailstoPartyAandthemaincontractor;andshallberesponsibleforsolvingalltherelevantdesignproblemsandtoattendthehandingovermeeting.PartyBshallsendtherelevantpersonneltoparticipateintheregu
31、larsitemeetingssuringtheconstruction.PartyBshouldoptimizethedesigntoassistPartyAinmeetingtheprojectbudget.6.2.11 方不得向第三方扩散、泄露、转让甲方提交的产品图纸、技术经济资料。如发生以上情况，甲方有权向乙方索赔。6.2.12 PartyBisnotallowedtodiscloseandtransfertoathirdpartyanyproductdrawing,technicalandeconomicdataetc.whichareprovidedbyPartyA.Incaset
32、hattheabove-mentionedishappened,PartyAshallhavetherighttoclaim.6.2.13 经甲方同意乙方不得将本项目的设计工作全部或者部分转包给第三者。6.2.14 PartyBisnotallowedtosubcontractthedesignworkcompletelyorpartiallyto筑姿料下我就在筑龙网anythirdpartywithoutthepermissionofPartyA.第七条其他约定Article?.Otherprovisions7.1 甲方要求乙方派专人长期驻施工现场进行配合与解决有关问题时，双方应另行签订技术
33、咨询服务合同。7.2 WhenPartyArequiresPartyBtosendsitepersonneltotheconstructionsiteforalongperiod,thetwopartiesshallnegotiatefortheseadditionalworkandsignasupplementaryserviceContract.7.3 乙方为本合同项目所使用的国家或者地方标准图，由甲方自费向有关出版部门购买。7.4 PartyAshallpayforalltherelevantpublicationsandstandardcollectionsofdrawingsissu
34、edbythestateandlocalgovernmentwhichareneededbyPartyBforthepurposeofdesigningtheproject.7.5 本合同第四条规定乙方交付的设计文件份数超过本合同第四条规定的份数，乙方另收工本费。7.6 IfPartyBisrequestedtosubmitdesigndocuments,ofwhich,thenumberofcopiesaremorethanthosestipulatedinArticle4ofthisContract,PartyAshallpayforthoseadditionalcopies.7.7 本工
35、程项目中，建筑材料、设备的加工订货，甲方需要乙方设计人员配合时，所需费用由甲方承担。7.8 IfPartyArequiresPartyBtoprovidepersonneltoassistthemforprocurementpurposes,suchastheprocurementOfbuildingmaterial,equipments,etc.;theexpensesneededshallbebornebyPartyA.7.9 甲方委托乙方承担本合同内容之外的工作服务，另行支付费用。7.10 IfPartyAentrustsPartyBtoundertakethoseworkandserv
36、iceswhicharebeyondthisContract,PartyAshallpayadditionalfee.7.11 于不可抗拒因素致使合同无法履行时，双方应及时协商解决。7.12 WhenthisContractcannotbeexecutedbecauseoftheunforeseeablenaturalforces,thetwoparitiesshalltimelynegotiatetosolvetheproblem.筑姿料下我就在筑龙网7.13 建设工程设计合同在履行过程中发生纠纷，双方应及时协商解决。协商不成时，双方同意由上海市仲裁委员会仲裁。7.14 Bothpartie
37、sshalltimelydiscusseachotherforthesettlementofanydisputearisingduringtheexecutionofthisContract.Incasethatsuchdiscussionfails,bothpartieshaveagreedappealingtoShanghaiMunicipalArbitrationCommissioncanbeaccepted.7.15 方聘请为甲方的顾问，协助甲方进行设计管理与建筑设计咨询。费用由甲方另行支付。7.16 PartyAhasengagedtoactasPartyA,sconsultants
38、toassistPartyAtoprovidethemanagementanddesignconsultationservices.ThefeewillbepaidbyPartyAdirectlyandseparately.7.17 合同未尽事宜，双方可签订补充协议，补充协议与本合同具有同等效力。7.18 Supplementaryagreementcouldbemadebetweenthetwopartiesincasethatanyadditionalclauseshallbeadded.Thesupplementaryagreementshallhavethesameeffectandp
39、owerasthisContract.7.19 本合同一式八份，甲执四份，乙执三份，政府部门一份。7.20 ThisContractshallbemadein8copies.PartyAshallhold4copies.PartyBshallhold3copies.Thegovernmentauthoritydepartmentshallholdonecopy.7.21 本合同以中英参照书写，如有矛盾，应以中文文本为准。7.22 ThisContractispreparedinbothChineseandEnglishlanguages,intheeventofconflictsinanyof
40、theprovisionsbetweenthetwoversions;provisionsspecifiedintheChineselanguageversionshalltakeprecedence.7.23 本合同双方签章后，在30日内报项目所在地建设行政主管部门备案。双方认为必要时，到项目所在地工商行政管理部门签证。上方履行完合同规定的义务后，本合同即行终止。7.24 ThisContract,within30daysafterithasbeensignedandstampedbybothparties,shallbesubmittedtothelocalgovernmentauthor
41、ityforendorsement.Whenitisconsiderednecessary,bothpartiescouldsendthisContracttothelocalindustrialandcommercialadministrationdepartmentsforregistration.ThisContractistobeterminatedandexpireditselfafterbothpartieshaveperformedtheirdutiesasI筑姿料下载就在筑龙网stipulatedinthisContract.7.25 本合同经甲、乙双方盖章签字后自年月日生效。
