3、ftheStateCouncilofthePeoplesRepublicofChinaonSeptember23,1995;andrevisedinaccordancewiththeDecisionoftheStateCounciltoAmendSomeAdministrativeRegulationsonApril23,2019)第一章总则ChapterI:GeneralProvisions第一条为了加强对注册建 筑师的管理，提高建筑设计质量 与水平，保障公民生命和财产安 全，维护社会公共利益，制定本Article1TheseRegulationsareformulatedforthepur
4、poseofstrengtheningtheadministrationofregisteredarchitects,improvingthequalityandlevelofarchitecturaldesign,ensuringthesafetyofthelivesandpropertyofcitizensandprotectingthepublicinterestsofsociety.Article2RegisteredarchitectsmentionedintheseRegulationsrefertothosewhohavelawfullyacquiredacertificateo
5、faregisteredarchitectandareengagedinthearchitecturaldesignofbuildingsorarelatedprofession.RegisteredarchitectsarecomposedofGrade-1andGrade-2registeredarchitects.条例。第二条本条例所称注册建筑师，是指依法取得注册建筑师证书并从事房屋建筑设计及相关业务的人员。注册建筑师分为一级注册建筑师和二级注册建筑师。第三条注册建筑师的考 试、注册和执业，适用本条例。Article3TheseRegulationsshallapplytotheexam
6、ination,registrationandpracticeofregisteredarchitects.第四条 国务院建设行政主 管部门、人事行政主管部门和 省、自治区、直辖市人民政府建 设行政主管部门、人事行政主管 部门依照本条例的规定对注册建 筑师的考试、注册和执业实施指 导和监督。Article4ThecompetentdepartmentsofconstructionadministrationandpersonneladministrationoftheStateCouncilandthecompetentdepartmentsofconstructionadministrati
7、onandpersonneladministrationofthelocalpeoplesgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshalldirectandsupervisetheexamination,registrationandpracticeofregisteredarchitectsinaccordancewiththeprovisionsprescribedintheseRegulations.Article 5 TheNationalAdm
8、inistrationBoardof第五条全国注册建筑师管 理委员会和省、自治区、直辖市 注册建筑师管理委员会，依照本 条例的规定负责注册建筑师的考 试和注册的具体工作。ArchitecturalRegistrationandtheadministrationboardsofarchitecturalregistrationinprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshall,inaccordancewiththeprovisionsprescribedintheseRegula
9、tions,beresponsibleforthespecificworkoftheexaminationandregistrationofregisteredarchitects.全国注册建筑师管理委员会由国 务院建设行政主管部门、人事行 政主管部门、其他有关行政主管 部门的代表和建筑设计专家组 成OTheNationalAdministrationBoardofArchitecturalRegistrationshallconsistoftherepresentativesofthecompetentdepartmentsofconstructionadministration,perso
10、nneladministrationandotherrelevantadministrativedepartmentsoftheStateCouncil,andarchitecturaldesignexperts.省、自治区、直辖市注册建筑师 管理委员会由省、自治区、直辖 市建设行政主管部门、人事行政 主管部门、其他有关行政主管部 门的代表和建筑设计专家组成。Theadministrationboardsofarchitecturalregistrationinprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentral
11、Governmentshallconsistoftherepresentativesofthecompetentdepartmentsofconstructionadministration,personneladministrationandotherrelevantadministrativedepartmentsoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment,andarchitecturaldesignexperts.第六条注册建筑师可以组 建注册建筑师协会，维护会员的
12、合法权益。第二章考试和注册Article 6 Registeredarchitectsmayestablishprofessionalassociationsofregisteredarchitectstoprotecttheirlawfulrightsandinterests.ChapterII:ExaminationandRegistration第七条国家实行注册建筑 师全国统一考试制度。注册建筑 师全国统一考试办法，由国务院 建设行政主管部门会同国务院人 事行政主管部门商国务院其他有 关行政主管部门共同制定，由全 国注册建筑师管理委员会组织实 施。Article7TheStateshal
13、limplementasystemofunifiednationwidequalificationexaminationsforregisteredarchitects.ThemeasuresoftheunifiednationwidequalificationexaminationsforregisteredarchitectsshallbeformulatedbythecompetentdepartmentofconstructionadministrationoftheStateCounciljointlywiththecompetentdepartmentofpersonneladmi
14、nistrationoftheStateCouncilafterconsultationwithotherrelevantadministrativedepartmentsoftheStateCouncil,andshallbeorganizedandimplementedbytheNationalAdministrationBoardofArchitecturalRegistration.第八条符合下列条件之一 的，可以申请参加一级注册建筑 师考试：Article8Whoevermeetsoneofthefollowingconditionsmayapplyforparticipatingi
15、nthequalificationexaminationforGrade-Iregisteredarchitects:（一）取得建筑学硕士以上学位 或者相近专业工学博士学位，并 从事建筑设计或者相关业务2年 以上的；（二）取得建筑学学士学位或者 相近专业工学硕士学位，并从事 建筑设计或者相关业务3年以上 的；(1) Heorshehasamastersdegreeoraboveinarchitecture,oradoctorsdegreeofengineeringinacloselyrelatedspecialty,andhasengagedinarchitecturaldesignorthe
16、relevantbusinessfortwoyearsormore;(2) Heorshehasabachelorsdegreeinarchitectureoramastersdegreeofengineeringinacloselyrelatedspecialtyandhasengagedinarchitecturaldesignortherelevantbusinessforthreeyearsormore;（三）具有建筑学专业大学本科 毕业学历并从事建筑设计或者相 关业务5年以上的，或者具有建 筑学相近专业大学本科毕业学历 并从事建筑设计或者相关业务7 年以上的；(3) Heorsheh
17、ascompletedundergraduateprogramsinarchitectureandhasengagedinarchitecturaldesignortherelevantbusinessforfiveyearsormore,orhascompletedundergraduateprogramsinaspecialtycloselyrelatedtoarchitectureandhasengagedinarchitecturaldesignortherelevantbusinessforsevenyearsormore;（四）取得高级工程师技术职称 并从事建筑设计或者相关业务3
18、年以上的，或者取得工程师技术 职称并从事建筑设计或者相关业 务5年以上的；(4) Heorshehasthetechnicaltitleofseniorengineerandhasengagedinarchitecturaldesignortherelevantbusinessforthreeyearsormore,orhasthetechnicaltitleofengineerandhasengagedinarchitecturaldesignortherelevantbusinessforfiveyearsormore;（五）不具有前四项规定的条 件，但设计成绩突出，经全国注 册建筑师管理
19、委员会认定达到前 四项规定的专业水平的。(5) Heorshehasoutstandingachievementsindesign,whichreachestheprofessionallevelprescribedintheprecedingfoursubparagraphsasrecognizedbytheNationalAdministrationBoardofArchitecturalRegistration,althoughheorshedoesnotmeettheconditionsprescribedintheprecedingfoursubparagraphs.前款第三项至第五
20、项规定的人员 应当取得学士学位。Thepersonnelprescribedinsubparagraphs(3)through(5)oftheprecedingparagraphshallobtainabachelorsdegree.第九条符合下列条件之一 的，可以申请参加二级注册建筑 师考试：（一）具有建筑学或者相近专业 大学本科毕业以上学历，从事建 筑设计或者相关业务2年以上 的；Article9ThosewhomeetoneofthefollowingrequirementsmayapplytotakepartinthequalificationexaminationforGrade-2
21、registeredarchitects:(1) inpossessionofanundergraduateeducationoraboveinarchitectureorinacloselyrelatedspecialtyandatleasttwoyearsworkexperienceinarchitecturaldesignorarelatedprofession;（二）具有建筑设计技术专业或 者相近专业大专毕业以上学历， 并从事建筑设计或者相关业务3 年以上的；(2) inpossessionofaneducationalqualificationatorabovethelevelofh
22、igherlearninginarchitecturaldesigntechnologyorinacloselyrelatedspecialtyandatleastthreeyears*workexperienceinarchitecturaldesignorarelatedprofession;（三）具有建筑设计技术专业4 年制中专毕业学历，并从事建筑 设计或者相关业务5年以上的；(3) inpossessionofaneducationalbackgroundfroma4-yearsecondaryspecializedschooloraboveinarchitecturaldesignt
23、echnologyandatleastfiveyearsworkexperienceinarchitecturaldesignorarelatedprofession;（四）具有建筑设计技术相近专 业中专毕业学历，并从事建筑设 计或者相关业务7年以上的；(4) inpossessionofaneducationalbackgroundfromasecondaryspecializedschooloraboveinamajorcloselyrelatedtoarchitecturaldesigntechnologyandatleastsevenyears*workexperienceinarch
24、itecturaldesignorarelatedprofession;or（五）取得助理工程师以上技术 职称，并从事建筑设计或者相关 业务3年以上的。(5) inpossessionofatechnicaltitleoforhigherthananassistantengineerandatleastthreeyears*workexperienceinarchitecturaldesignorarelatedprofession.第十条本条例施行前已取 得高级、中级技术职称的建筑设 计人员，经所在单位推荐，可以 按照注册建筑师全国统一考试办 法的规定，免予部分科目的考 试。Article1
25、0Afterbeingrecommendedbytheunitinwhichheisworking,thearchitecturaldesignerwhohasachievedaseniortechnicalprofessionaltitleoramiddle-ranktechnicalprofessionaltitlebeforetheimplementationoftheseRegulationsmay,inaccordancewiththeprovisionsstipulatedinthemeasuresgoverningtheunifiednationwidequalification
26、examinationforregisteredarchitects,beexcusedfromexaminationincertaincourses.第十一条 注册建筑师考试 合格，取得相应的注册建筑师资 格的，可以申请注册。Article 11 Thosewhohavepassedthequalificationexaminationandattainedthecorrespondingprofessionalstatusofaregisteredarchitectmayapplyforregistration.第十二条一级注册建筑师 的注册，由全国注册建筑师管理 委员会负责；二级注册建筑
27、师的 注册，由省、自治区、直辖市注 册建筑师管理委员会负责。Article 12 TheNationalAdministrationBoardofArchitecturalRegistrationshallberesponsiblefortheregistrationofGrade-1registeredarchitects;theadministrationboardsofarchitecturalregistrationofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallbe
28、responsiblefortheregistrationofGrade-2registeredarchitects.第十三条有下列情形之一 的，不予注册：Article 13 Noregistrationshallbegrantedunderoneofthefollowingcircumstances:（一）不具有完全民事行为能力 的；(1) thosewhodonotpossessfullcapacityforcivilconduct;（二）因受刑事处罚，自刑罚执(2) thosewhoreceivedcriminalpunishment,行完毕之日起至申请注册之日止 不满5年的；andi
29、tislessthanfiveyearsfromthedateofthecompletionofthecarryingoutofthecriminalpunishmenttothedateonwhichtheapplicationforregistrationismade;（三）因在建筑设计或者相关业 务中犯有错误受行政处罚或者撤 职以上行政处分，自处罚、处分 决定之日起至申请注册之日止不 满2年的；(3) thosewhoreceivedadministrativepenaltyordisciplinarysanctionssuchasdismissalfromofficeorgreater
30、formistakesmadeinarchitecturaldesignorarelatedprofession,anditislessthantwoyearsfromthedateonwhichtheadministrativepenaltyorthedisciplinarysanctionwasimposedtothedateonwhichtheapplicationforregistrationismade;（四）受吊销注册建筑师证书的 行政处罚，自处罚决定之日起至 申请注册之日止不满5年的；(4) thosewhoreceivedanadministrativepenaltyofrev
31、ocationoftheregisteredarchitectcertificate,anditislessthanfiveyearsfromthedateonwhichthepenaltywasimposedtothedateonwhichtheapplicationforregistrationismade;or（五）有国务院规定不予注册的 其他情形的。(5) wherethereareothercircumstancesasprescribedbytheStateCouncilfortheregistrationtoberejected.第十四条全国注册建筑师 管理委员会和省、自治区、直
32、辖 市注册建筑师管理委员会依照本 条例第十三条的规定，决定不予 注册的，应当自决定之日起15日 内书面通知申请人；申请人有异 议的，可以自收到通知之日起15 日内向国务院建设行政主管部门 或者省、自治区、直辖市人民政 府建设行政主管部门申请复议。Article 14 IftheNationalAdministrationBoardofArchitecturalRegistration,ortheadministrationboardofarchitecturalregistrationinaprovince,autonomousregionormunicipalitydirectlyunder
33、theCentralGovernmentmakesadecisionofnonregistrationinaccordancewiththeprovisionsofArticle13oftheseRegulations,itshallnotifytheapplicantinwritingofitsdecisionwithin15daysfromthedateofmakingsuchdecision.Iftheapplicantobjectstothedecision,hemay,within15daysfromthedateafterreceivingthenotification,filea
34、napplicationforreconsiderationtothecompetentdepartmentofconstructionadministrationoftheStateCouncilorthecompetentdepartmentofconstructionadministrationofthelocalpeople,sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.第十五条全国注册建筑师 管理委员会应当将准予注册的一 级注册建筑师名单报国务院建设 行
35、政主管部门备案；省、自治 区、直辖市注册建筑师管理委员 会应当将准予注册的二级注册建 筑师名单报省、自治区、直辖市 人民政府建设行政主管部门备 案。Article 15 TheNationalAdministrationBoardofArchitecturalRegistrationshallreportthelistofGrade-1registeredarchitectswhoseregistrationhavebeenapprovedtothecompetentdepartmentofconstructionadministrationoftheStateCouncilfortherec
36、ord;theadministrationboardsofarchitecturalregistrationofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallreportthelistofGrade-2registeredarchitectswhoseregistrationhavebeenapprovedtothecompetentdepartmentsofconstructionadministrationofthelocalpeoplesgovernmentsofthep
37、rovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentfortherecord.国务院建设行政主管部门或者 省、自治区、直辖市人民政府建 设行政主管部门发现有关注册建 筑师管理委员会的注册不符合本 条例规定的，应当通知有关注册 建筑师管理委员会撤销注册，收 回注册建筑师证书。IfthecompetentdepartmentofconstructionadministrationoftheStateCouncilorthecompetentdepartmentofconstructionadmini
38、strationofthelocalpeoplesgovernmentinaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentdiscoversthataregistrationapprovedbyanadministrationboardofarchitecturalregistrationdoesnotmeettherequirementsstipulatedintheseRegulations,itshallinformthatadministrationboardofarchitectural
39、registrationtocanceltheregistrationandrecalltheregisteredarchitectcertificate.第十六条准予注册的申请 人，分别由全国注册建筑师管理Article 16 TheGrade-1orGrade-2registeredarchitectcertificatesuniformlypreparedbythecompetentdepartmentofconstructionadministrationoftheStateCouncilshallberespectivelyexaminedandissuedtotheapproved
40、applicantsbytheNationalAdministrationBoardofArchitecturalRegistrationandtheadministrationboardsofarchitecturalregistrationofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment.Article 17 Theperiodofvalidityofregistrationofaregisteredarchitectshallbetwoyears.Wherethereisthen
41、eedtomaintainregistrationaftertheexpirationoftheperiodofvalidity,theapplicantshallgothroughregistrationprocedureswithin30daysbeforetheperiodofvalidityexpires.Article 18 Underoneofthefollowingcircumstances,exceptingthosestipulatedinParagraph2,Article15oftheseRegulations,apersonwhohasalreadyobtainedar
42、egisteredarchitectcertificateshallbesubjecttocancellationoftheregistrationandshallhavetheregisteredarchitectcertificaterecalledbytheNationalAdministrationBoardofArchitecturalRegistrationoranadministrationboardofarchitecturalregistrationinaprovince,autonomousregionormunicipalitydirectlyundertheCentra
43、lGovernmentwhichgavetheoriginalapproval:(1) thosewhohavecompletelylostthecapacityforcivilconduct;(2) thosewhohavereceivedcriminalpunishment;委员会和省、自治区、直辖市注 册建筑师管理委员会核发由国务 院建设行政主管部门统一制作的 一级注册建筑师证书或者二级注 册建筑师证书。第十七条注册建筑师注册 的有效期为2年。有效期届满需 要继续注册的，应当在期满前30 日内办理注册手续。第十八条已取得注册建筑 师证书的人员，除本条例第十五 条第二款规定的情形外，注册后
44、 有下列情形之一的，由准予注册 的全国注册建筑师管理委员会或 者省、自治区、直辖市注册建筑 师管理委员会撤销注册，收回注 册建筑师证书：（一）完全丧失民事行为能力 的；（二）受刑事处罚的;（三）因在建筑设计或者相关业(3) thosewhohavereceivedadministrativepenaltyordisciplinarysanctionssuchas务中犯有错误，受到行政处罚或dismissalfromofficeorgreaterformistakes者撤职以上行政处分的；madeintheworkofarchitecturaldesignorarelatedprofession
45、;or（四）自行停止注册建筑师业务 满2年的。(4) thosewhoceaseprofessionalworkasregisteredarchitectsforaperiodoftwoyears.被撤销注册的当事人对撤销注 册、收回注册建筑师证书有异议 的，可以自接到撤销注册、收回 注册建筑师证书的通知之日起15 日内向国务院建设行政主管部门 或者省、自治区、直辖市人民政 府建设行政主管部门申请复议。Ifanyonewhoseregistrationhasbeencanceledobjectstothecancellationofhisregistrationandtherecallofhi
46、sregisteredarchitectcertificate,hemay,within15daysafterreceivingthenoticeofthecancellationofregistrationandoftherecalloftheregisteredarchitectcertificate,applytothecompetentdepartmentofconstructionadministrationoftheStateCouncilorthecompetentdepartmentofconstructionadministrationofthelocalpeoplesgov
47、ernmentinaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentforreconsideration.第十九条被撤销注册的人 员可以依照本条例的规定重新注 册。Article19Anyonewhohadhisregistrationcanceledmayre-registerasprovidedforintheseRegulations.第三章执业ChapterIII:Practice第二十条注册建筑师的执 业范围：Article20Theprofessionalservicesofregist
48、eredarchitectsareasfollows:（一）建筑设计;(1) architecturaldesign;（二）建筑设计技术咨询;(2) consultationonarchitecturaldesigntechnology;（三）建筑物调查与鉴定;(3) investigationandappraisalofbuildings;（四）对本人主持设计的项目进 行施工指导和监督；(4) directionandsupervisionoftheconstructionprojectsthathewasinchargeofdesigning;and（五）国务院建设行政主管部门 规定的其他业务。(5) otherprofessionalservicesprescribedbythecompetentdepartmentofconstructionadministrationoftheStateCouncil.第二十一条注册建筑师执 行业务，应当加入建筑设计单 位。建筑设计单位的资质等级及其业 务范围，由国务院建设行政主管 部门规定。Article 21 Aregisteredarchitectpracticingtheprofessionshallenteranarchitecturaldesignunit.Theendo
