5、ectoroftheNationalHealthCommission:MaXiaowei卫生健康委主任马晓伟DirectoroftheNationalHealthcareSecurityAdministration:HuJinglin医保局局长胡静林June28,20222022年6月28日优抚医院管理办法（2011年6月9日民政部令第 41号公布，2022年6月28日退 役军人事务部、国家卫生健康委 员会、国家医疗保障局令第7号 修订）第一条为了加强优抚医院 管理，服务国防和军队建设，推 动让退役军人成为全社会尊重的 人，让军人成为全社会尊崇的职 业，根据中华人民共和国退役 军人保障法、中华
6、人民共和 国基本医疗卫生与健康促进 法、军人抚恤优待条例、 医疗机构管理条例和国家有 关规定，制定本办法。第二条 优抚医院是国家为 残疾退役军人和在服役期间患严 重慢性病、精神疾病的退役军人MeasuresfortheAdministrationofSpecialCareHospitals(IssuedbyOrderNo.41oftheMinistryofCivilAffairsonJune9,2011andrevisedbyOrderNo.7oftheMinistryofVeteransAffairs,theNationalHealthCommission,andtheNationalHea
7、lthcareSecurityAdministrationonJune28,2022)Article1TheseMeasuresaredevelopedinaccordancewiththeVeteransSupportLawofthePeoplesRepublicofChina,theLawofthePeoplesRepublicofChinaonthePromotionofBasicMedicalandHealthCare,theRegulationonPensionsandPreferentialTreatmentsforServicemen,theRegulationontheAdmi
8、nistrationofMedicalInstitutions,andtheapplicableprovisionsissuedbythestate,forthepurposesofstrengtheningtheadministrationofspecialcarehospitals,servingtheconstructionofnationaldefenseandarmedforces,andmakingeffortstomakeveteransrespectedbytheentiresocietyandmakeservicemenaprofessionrespectedbytheent
9、iresociety.Article2Specialcarehospitalsarespecialcarepublicinstitutionsofthestatethatprovidemedicaltreatmentandsupportservicestodisabledveterans,veteranswhosufferfromserious等优抚对象提供医疗和供养服务 的优抚事业单位，是担负特殊任 务的医疗机构，主要包括综合医 院、康复医院、精神病医院等， 名称统一为“荣军优抚医院”。chronicdiseasesormentalillnessduringtheirserviceandot
10、herspecialcarerecipientsandaremedicalinstitutionsthatundertakespecialtasks,mainlyincludinggeneralhospitals,rehabilitationhospitals,andmentalhospitals,amongothers,withaunifiednameofuspecialcarehospitalsforveterans51.优抚医院坚持全心全意为优抚对 象服务的办院宗旨，坚持优抚属 性，遵循医疗机构建设和管理规 律。Specialcarehospitalsshalladheretothepu
11、rposeofservingspecialcarerecipientswholeheartedly,adheretospecialcareattributes,andfollowtherulesfortheconstructionandadministrationofmedicalinstitutions.第三条国务院退役军人工 作主管部门负责全国优抚医院工 作。县级以上地方人民政府退役 军人工作主管部门负责本行政区 域内优抚医院工作。Article3TheveteransaffairsdepartmentoftheStateCouncilshalltakechargeoftheworkofs
12、pecialcarehospitalsnationwide.Theveteransaffairsdepartmentofthelocalpeoplesgovernmentatorabovethecountylevelshalltakechargeoftheworkofspecialcarehospitalswithinitsadministrativeregion.退役军人工作主管部门应当会同 卫生健康主管部门加强对优抚医 院的指导，为优抚医院医务人员 的培训进修等创造条件，支持有 条件的优抚医院在医疗、科研、 教学等方面全面发展。Theveteransaffairsdepartmentsha
13、ll,inconjunctionwiththehealthdepartment,strengthentheguidanceofspecialcarehospitals,createconditionsforthetrainingandfurtherstudy,amongothers,ofmedicalpersonnelofspecialcarehospitals,andsupportthecomprehensivedevelopmentofqualifiedspecialcarehospitalsinsuchaspectsasmedicaltreatment,scientificresearc
14、h,andteaching.第四条国家兴办优抚医 院，所需经费按照事权划分列入 各级预算。Article 4 Thefundsrequiredfortheestablishmentofspecialcarehospitalsbythestateshallbeincludedinthebudgetsatalllevelsaccordingtothedivisionofpowers.第五条设置优抚医院，应 当符合国家有关规定和优抚医院Article 5 Theestablishmentofaspecialcarehospitalshallcomplywiththeapplicable布局规划。pr
15、ovisionsissuedbythestateandtheplanforthelayoutofspecialcarehospitals.卫生健康主管部门应当会同退役 军人工作主管部门，将优抚医院 设置纳入当地医疗机构设置规划 统筹考虑。Thehealthdepartmentshall,inconjunctionwiththeveteransaffairsdepartment,includetheestablishmentofspecialcarehospitalsinthelocalplansfortheestablishmentofmedicalinstitutionsforoverall
16、consideration.省级人民政府退役军人工作主管 部门应当会同省级人民政府卫生 健康主管部门根据优抚对象数量 和医疗供养需求情况，适应伤病 残退役军人移交安置工作和服务 备战打仗需要，制定本行政区域 内优抚医院布局和发展规划，并 报国务院退役军人工作主管部门 和国务院卫生健康主管部门备 案。Theveteransaffairsdepartmentoftheprovincialpeoplesgovernmentshall,inconjunctionwiththehealthdepartmentoftheprovincialpeoplesgovernment,determinethelay
17、outofandmakeplansforthedevelopmentofspecialcarehospitalswithinitsadministrativeregionaccordingtothenumberofspecialcarerecipientsandmedicalsupportneedsaswellastheneedsforthehandoverofinjured,sick,anddisabledveteransforresettlementandpreparednessforwars,andsubmitthesametotheveteransaffairsdepartmentof
18、theStateCouncilandthehealthdepartmentoftheStateCouncilforrecordation.优抚医院布局和发展规划应当纳 入当地经济和社会发展总体规划 和卫生健康、医疗保障事业发展 规划，建设水平应当与当地经济 和社会发展、卫生健康事业发展 相适应。Thelayoutofandplanforthedevelopmentofspecialcarehospitalsshallbeincludedintheoverallplanforlocaleconomicandsocialdevelopmentandtheplanforthedevelopmento
19、fhealthandhealthcaresecurityundertakings,andtheconstructionlevelshallbeinlinewithlocaleconomicandsocialdevelopmentandthedevelopmentofhealthcareundertakings.第六条因符合条件优抚对 象数量较少等情形未建设优抚医 院的地方，可以采取购买服务等 方式，协调当地其他医疗机构为 优抚对象提供医疗服务。Article 6 Whereaspecialcarehospitalhasnotbeenestablishedduetoasmallnumberofe
20、ligiblespecialcarerecipientsoranyothercircumstance,otherlocalmedicalinstitutionsmaybecoordinatedtoprovidemedicalservicestospecialcarerecipientsbypurchasingtheirservicesorothermethods.Specialcarehospitalsshallperformtherelevantdutiesinaccordancewiththelawandqualifiedspecialcarehospitalsshallbeinclude
21、dinthemanagementscopeofdesignatedmedicalinstitutionsforbasicmedicalinsurance,medicalinstitutionsunderwork-relatedinjuryinsuranceagreements,andinstitutionsunderwork-relatedinjuryrehabilitationagreementsaccordingtotherelevantprocedures.Article7Specialcarehospitalsshallenjoyrelevantpreferentialpolicies
22、ofthestateinaccordancewiththelawinsuchaspectsasconstruction,landuse,waterandelectricity,gas,heating,andtelecommunications.优抚医院应当依法履行相关职责，符合条件的按程序纳入基本医疗保险定点医疗机构、工伤保险协议医疗机构、工伤康复协议机构管理范围。第七条优抚医院在建设、用地、水电、燃气、供暖、电信等方面依法享受国家有关优惠政策。Citizens5legalpersons,andotherorganizationsareencouragedtoprovidedonationsa
23、ndservicestospecialcarehospitals.Allexpendituresforspecialcarehospitalsshallbegovernedbytheapprovedbudgetandbesubjecttothesupervisionoffinanceandauditdepartmentsaswellasthepublic.Article8Entitiesandindividualsthathavemaderemarkableachievementsintheworkofspecialcarehospitalsshallbecommendedandrewarde
24、daccordingtotherelevantprovisionsissuedbythestate.Article9Aspecialcarehospitalshalladmitandtreatthefollowingspecialcarerecipientsaccordingtothetasksassignedbythecompetentdepartment:(1)DisabledveteransofGradesItoIVwhoneedyear-roundmedicaltreatmentorwhoareinconvenienttobesupportedbyoneperson.鼓励公民、法人和其
25、他组织对优抚医院提供捐助和服务。优抚医院各项经费应当按照批复的预算执行，接受财政、审计部门和社会的监督。第八条对在优抚医院工作中成绩显著的单位和个人，按照国家有关规定给予表彰和奖励。第九条优抚医院根据主管部门下达的任务，收治下列优抚对象：（一）需要常年医疗或者独身一人不便分散供养的一级至四级残疾退役军人;(2)Disabledveteranswhosufferedfromseriouschronicdiseasesduringtheirserviceandveteranswhoreturnedhomewithillness.（二）在服役期间患严重慢性病的残疾退役军人和带病回乡退役军人；(3)V
26、eteranswhosufferedfrommentalillnessduringtheirserviceandrequiredhospitalization.（三）在服役期间患精神疾病,需要住院治疗的退役军人；(4)Short-termrecuperationrecipients.（四）短期疗养的优抚对象;(5)Otherrecipientsadmittedfortreatmentasarrangedforbythecompetentdepartment.（五）主管部门安排收治的其他人员。Thespecialcarehospitalshallprovidepriorityorpreferen
27、tialservicestootherspecialcarerecipientsaftercompletingtheadmissionandtreatmenttaskassignedbythecompetentdepartment.优抚医院应当在完成主管部门下达的收治任务的基础上，为其他优抚对象提供优先或者优惠服务。Article10Aspecialcarehospitalshallprovidegoodmedicalservicesandlivingguaranteesforspecialcarerecipientsinthehospital,mainlyincluding:第十条优抚医院应
28、当为在院优抚对象提供良好的医疗服务和生活保障，主要包括：(1)physicalexamination;（一）健康检查;(2)diseasediagnosis,treatment,andnursing;（二）疾病诊断、治疗和护理;(3)rehabilitationtraining;（三）康复训练;(4)healthguidance;（四）健康指导;(5) installationofaids;（五）辅助器具安装;（六）精神慰藉；（七）生活必需品供给;（A）生活照料；（九）文体活动。(6) spiritualcomfort;(7) supplyoflifenecessities;(8) lifec
29、are;and(9) culturalandsportsactivities.第十一条优抚医院应当加 强对在院优抚对象的思想政治工 作，发挥优抚对象在光荣传统教 育中的重要作用。Article 11 Aspecialcarehospitalshallstrengthentheideologicalandpoliticalworkforspecialcarerecipientsinthehospitalandmaximizetheimportantroleofspecialcarerecipientsinglorioustraditionaleducation.第十二条 优抚医院针对在 院残疾退
30、役军人的残情特点，实 施科学有效的医学治疗，探索常 见后遗症、并发症的防治方法， 促进生理机能恢复，提高残疾退 役军人生活质量。Article 12 Aspecialcarehospitalshall,accordingtothecharacteristicsofdisabledveteransinthehospital,providescientificandeffectivemedicaltreatmenttodisabledveterans,explorethemethodsforthepreventionandtreatmentofcommonsequelaeandcomplicati
31、ons,promotetherecoveryofphysiologicalfunctions,andimprovethequalityoflifeofdisabledveterans.第十三条优抚医院应当采 取积极措施，控制在院慢性病患 者病情，减轻其痛苦，降低慢性 疾病对患者造成的生理和心理影 响。Article 13 Aspecialcarehospitalshalltakeactivemeasurestocontroltheconditionsofitspatientswithchronicdiseases,alleviatetheirpain,andreducethephysicala
32、ndpsychologicaleffectsofchronicdiseasesonthepatients.第十四条优抚医院对在院 精神疾病患者进行综合治疗，促 进患者精神康复。Article 14 Aspecialcarehospitalshallprovidecomprehensivetreatmenttoitspatientswithmentalillnesstopromotetheirmentalrecovery.对精神病患者实行分级管理，预Thepatientswithmentalillnessshallbemanagedbasedondifferentlevelstoprevents
33、uchactsas防发生自杀、自伤、伤人、出走 等行为。committingsuicideorself-injury,hurtingpeople,andrunningaway.第十五条优抚医院应当规 范入院、出院程序。Article 15 Aspecialcarehospitalshallregulateadmissionanddischargeprocedures.属于第九条规定收治范围的优抚 对象，可以由本人（精神病患者 由其利害关系人）提出申请，或 者由村（社区）退役军人服务站 代为提出申请，经县级人民政府 退役军人工作主管部门审核，由 优抚医院根据主管部门下达的任 务和计划安排入院。省
34、级人民政 府退役军人工作主管部门可以指 定优抚医院收治符合条件的优抚 对象。AspecialcarerecipientwhofallswithinthescopeofadmissionfortreatmentasprescribedinArticle9(forapersonwithmentalillness,apartyofinterestthereof)mayfileanapplication,oraveteransaffairsservicestationofavillage(orcommunity)mayfileanapplicationonbehalfthereof,andaftert
35、heapplicationisexaminedbytheveteransaffairsdepartmentofthepeoplesgovernmentatthecountylevel,thespecialcarehospitalshallarrangeforadmissionaccordingtothetasksandplansissuedbythecompetentdepartment.Theveteransaffairsdepartmentoftheprovincialpeoplesgovernmentmaydesignatespecialcarehospitalstoadmitandtr
36、eateligiblespecialcarerecipients.在院优抚对象基本治愈或者病情 稳定，符合出院条件的，由优抚 医院办理出院手续。Ifaspecialcarerecipientisbasicallycuredorisinstableconditionandmeetstheconditionsfordischarge,thespecialcarehospitalshallundergodischargeformalities.在院优抚对象病故的，优抚医院 应当及时报告主管部门，并协助 优抚对象常住户口所在地退役军 人工作主管部门妥善办理丧葬事 宜。Ifaspecialcarerec
37、ipientdiesofillness,thespecialcarehospitalshallreporttothecompetentdepartmentinatimelymanner,andassisttheveteransaffairsdepartmentattheplacewheretheregisteredpermanentresidenceofthespecialcarerecipientislocatedtohandlefuneralmattersproperly.第十六条优抚医院应当按 照国家有关规定建立健全病历管 理制度，设置病案管理部门或者Article 16 Aspecia
38、lcarehospitalshallestablishandimprovemedicalrecordmanagementrulesinaccordancewiththeapplicableprovisionsissuedbythestate,andsetupamedicalrecord配备专兼职人员，负责病历和病 案管理工作。managementdepartmentorassignfull-timeorpart-timestafftoberesponsibleforthemanagementofmedicalrecords.第十七条退役军人工作主 管部门应当定期组织优抚医院开 展巡回医疗活动，
39、积极为院外优 抚对象提供医疗服务。Article17Theveteransaffairsdepartmentshall,onaperiodicalbasis,organizespecialcarehospitalstoconductmedicaltoursandactivelyprovidemedicalservicestospecialcarerecipientsoutsidehospitals.第十八条优抚医院应当在 做好优抚对象服务工作的基础 上，积极履行医疗机构职责，发 挥自身医疗专业特长，为社会提 供优质医疗服务。Article18Aspecialcarehospitalshall,
40、onthebasisofprovidinggoodservicesforspecialcarerecipients,activelyperformitsdutiesofmedicalinstitutions,andmaximizeitsmedicalexpertise,soastoprovidethesocietywithqualitymedicalservices.优抚医院应当通过社会服务提升 业务能力，改善医疗条件，不断 提高医疗和供养水平。Aspecialcarehospitalshallenhanceitsprofessionalcapabilitiesthroughsocialser
41、vices,improveitsmedicalconditions,andcontinuouslyimprovethelevelofmedicaltreatmentandsupport.第十九条优抚医院在设置 审批、登记管理、命名、执业和 监督等方面应当符合国家有关医 疗机构管理的法律法规和相关规 定，执行卫生健康主管部门有关 医疗机构的相关标准。Article19Aspecialcarehospitalshallcomplywiththelaws,regulationsandrelevantprovisionsofthestateontheadministrationofmedicalins
42、titutionsinsuchaspectsastheapprovalofestablishment,registrationmanagement,naming,practice,andsupervision,andimplementtherelevantstandardsformedicalinstitutionsofhealthdepartments.第二十条优抚医院实行党 委领导下的院长负责制，科室实 行主任（科长）负责制。Article20Aspecialcarehospitalshallimplementthesystemunderwhichthepresidentassumesov
43、erallresponsibilityundertheleadershipofthePartycommittee,andthechief(sectionchief)assumesoverallresponsibilityinitsdepartmentsandsections.第二十一条优抚医院应当 加强党的建设，充分发挥基层党 组织战斗堡垒作用和党员先锋模 范作用，促进思想政治和医德医 风建设。第二十二条优抚医院实行 国家规定的工资制度，合理确定 医务人员薪酬水平，完善内部分 配和激励机制，促进医务人员队 伍建设。Article21Aspecialcarehospitalshallstreng
44、thenPartybuilding,maximizethefightingfortressroleofbasicPartyorganizationsandthespearheadandexemplaryroleoftheirPartymembers,andpromoteideological,political,andmedicalethicsconstruction.Article22Aspecialcarehospitalshallimplementthewagesystemprescribedbythestate,reasonablydeterminetheremunerationlev
45、elofmedicalstaff,improveitsinternaldistributionandincentivemechanisms,andpromotethebuildingofacontingentofmedicalstaff.第二十三条 优抚医院建立 职工代表大会制度，保障职工参 与医院的民主决策、民主管理和 民主监督。Article23Aspecialcarehospitalshallestablishasystemofanassemblyofemployeerepresentativestoensurethatemployeesparticipateinthehospitals
46、democraticdecisionmaking,democraticmanagement,anddemocraticsupervision.第二十四条优抚医院应当 树立现代管理理念，推进现代 化、标准化、信息化建设；强化 重点专科建设，发挥专业技术优 势；建立完整的医护管理、感染 控制、药品使用、医疗事故预防 和安全、消防等规章制度，提高 医院管理水平。Article24Aspecialcarehospitalshallestablishmodernmanagementconcepts,promotetheconstructionofmodernization,standardization
47、,andinformationtechnology;strengthentheconstructionofkeyspecialtiesandmaximizeitsprofessionaltechnicaladvantages;andestablishcompleterulesandregulationsonmedicalcaremanagement,infectioncontrol,druguse,preventionofmedicalmalpractice,safety,andfirecontrol,soastoimproveitsmanagement.第二十五条优抚医院实行 岗位责任制，设
48、立专业技术类、 管理类、工勤技能类等岗位并明 确相关职责；实行24小时值班 制度，按照医院分级护理等有关 要求为收治对象提供护理服务。Article25Aspecialcarehospitalshallcarryoutthepostresponsibilitysystem,setuppostsofprofessionalskills,management,andlogisticsskillsandspecifytherelevantduties;carryouttheround-the-clockdutysystem,andprovidenursingservicestotherecipientsadmittedfortreatmentinaccordancewiththerequirementsforthegradednursingofhospitals,amongothe
