8、ustrialTransfersChapter I GeneralProvisions维吾尔自治区发展改革委:根据中共中央办公厅、国务 院办公厅印发的创建示范 活动管理办法(试行)和 国务院关于中西部地区承 接产业转移的指导意见国务院关于近期支持东北 振兴若干重大政策举措的意 见有关要求,我委制定了承接产业转移示范区管理 办法,现印发给你们,请 结合实际认真贯彻执行。国家发展改革委2023年6月8日承接产业转移示范区管理办 法第一章总则第一条为进一步规范 承接产业转移示范区设立、 建设、考核,加强全周期管 理,更好发挥示范带动作 用,推动中西部和东北地区 有力有序有效承接国内外产 业转移,根据
9、中共中央办公 厅、国务院办公厅印发的Article1Forthepurposesofregulatingtheestablishment,construction,andassessmentofthedemonstrationzonesforundertakingindustrialtransfers,strengtheningfull-cyclemanagement,maximizingtheexemplaryanddrivingroles,andboostingCentralandWesternChinaandNortheasternChinatoundertakeindustrialtr
10、ansfersfromhomeandabroadinapowerful,orderlyandeffectivemanner,theseMeasuresaredevelopedinaccordancewiththeMeasuresfortheAdministrationofCreationofDemonstrationActivities(forTrialImplementation)issuedbytheGeneralOfficeoftheCPCCentralCommitteeandtheGeneralOfficeoftheStateCouncilandtheGuidingOpinionsof
11、theStateCouncilonCentralandWesternChina,sUndertakingofIndustrialTransfersandtheOpinionsoftheStateCouncilonSeveralRecentMajorPoliciesandMovesforSupportingtheRevitalizationofNortheasternChina.Article2ForthepurposeoftheseMeasures,demonstrationzonesforundertakingindustrialtransfers(hereinafterreferredto
12、asdemonstrationzones,)nmeansthezoneswhichareformedwiththeofficialreplyoftheStateCouncilortheNDRCandhavegoodfoundationandexemplaryeffectsinundertakingindustrialtransfers.Article3DemonstrationzonesshallbeestablishedinthecentralandwesternChinaornortheastChina,andmaybeoneormoreadjacentcities(includingpr
13、efecture-levelcities,regions,autonomousprefectures,leagues,anddistrictsandcountiesofmunicipalitiesdirectlyundertheCentralGovernment,hereinafterreferredtoas*tprefecture-IeveIcitiesn).Thetotalnumberofdemonstrationzonesshallbelimitedtoabout20,andthereshallbenotmorethanoneineachprovince(autonomousregion
14、,ormunicipalitydirectlyundertheCentralGovernment)inprinciple.创建示范活动管理办法 (试行)和国务院关于 中西部地区承接产业转移的 指导意见国务院关于近 期支持东北振兴若干重大政 策举措的意见有关要求, 制定本办法。第二条本办法所指承 接产业转移示范区(以下简 称示范区),是指经国务院 或国家发展改革委批复设 立,在承接产业转移方面具 有良好基础和示范效应的区 域。第三条示范区在中西 部或东北地区设立,可以是 一个或多个相邻地市(含地 级市、地区、自治州、盟、 直辖市所辖区县,以下简称 地市)。示范区总数控制在 20个左右,原则上每个
15、省 (区、市)不超过1个。第四条示范区实行有 进有出的动态管理机制,以 5年为一个示范周期,到期 后根据考核评估结果确定是 否延长示范期限。Article4Demonstrationzonesshallbesubjecttothedynamicmanagementmechanismthatsupportsentryandexit,withfiveyearsasademonstrationperiod,andwhethertoextendademonstrationperiodaftertheexpirationthereofshallbedeterminedaccordingtotheexam
16、inationandassessmentresult.Article5TheNDRCshallberesponsiblefortheofficialreplyonestablishment,guidanceontheconstruction,andexaminationandassessment,amongothers,ofthedemonstrationzones,andmajormattersshallbereportedtotheStateCouncilforinstructions;provincialdevelopmentandreformcommissionsshallberesp
17、onsiblefortheapplicationforthebuildingandroutineadministrationofthedemonstrationzonesoftheirrespectiveprovinces(autonomousregionsormunicipalitiesdirectlyundertheCentralGovernment);andthepeople,sgovernmentsoftheprefecture-levelcitieswheredemonstrationzonesarelocatedshallberesponsiblefortheconstructio
18、nanddevelopmentofthedemonstrationzones.Chapter II BuildingApplicationArticle6Toapplyforthebuildingofademonstrationzone,thefollowingconditionsshallbesatisfied:1. Itshallmeettherelevantrequirementsofthenationaldevelopmentplanning,majorregionalstrategies,coordinatedregionaldevelopmentstrategies,mainfun
19、ctionzonestrategies,andnationallandandspaceplanning.2. Itslocationandtransportationconditionsarefavorable.Itislocatedinthemaineconomicdevelopmentaxis,andhasrelativelystrongeconomicandpopulationcarryingcapacity,relativelycompletetransportation,energyandotherinfrastructure,andrelativelystrongradiating
20、anddrivingcapacity.第五条国家发展改革 委负责示范区批复设立、建 设指导和考核评估等,重大 事项向国务院请示报告;省 级发展改革委负责本省 (区、市)示范区创建申报 和日常管理;示范区所在地 市人民政府负责示范区建设 发展。第二章创建申报第六条示范区创建申 报应具备以下条件:(一)符合国家发展规划、 区域重大战略、区域协调发 展战略、主体功能区战略和 国土空间规划有关要求。(二)区位交通条件良好。 位于主要经济发展轴带,经 济和人口承载能力较强,交 通、能源等基础设施比较完 善,具有较强的辐射带动能 力。(三)产业发展基础扎实。有1个及以上国家级经济技3. 21、tionofindustrialdevelopmentissolid.Ithasoneormorenationaleconomicandtechnologicaldevelopmentzones,high-techindustrialdevelopmentzonesorareasunderspecialcustomssupervision,amongothers,andmanyplatformsundertakingindustrialtransferssuchasprovincialdevelopmentzone,withreasonableindustriallayout,obviousa
22、dvantagesincharacteristicindustries,andstrongsupportingcapabilities.术开发区、高新技术产业开发区或海关特殊监管区域等,省级开发区等承接产业转移平台较多,产业布局合理,特色产业优势明显,配套能力较强。4. Thepotentialforindustrialundertakingisgreat.Minerals,energy,land,humanresourcesandotherresourcesareabundant,factorcostshavecomparativeadvantages,andtheresourceanden
23、vironmentalcarryingcapacityisstrong.5. Thefoundationforopeningupandcooperationisfavorable.Theeconomyishighlydependentonforeigntradeandkeepsclosetieswiththeeconomyofsurroundingareas,thereisagoodfoundationforcross-regionalindustrialconnectionandcooperation,andtheadvancementofthecoordinateddevelopmentw
24、ithintheregionhasbeenaccelerated.6. Thedevelopmentenvironmentisfavorable.Thebusinessenvironmenthasbeencontinuouslyoptimized,andthepolicyenvironmentisfavorable,andthegovernmentsofprovincesandcitieshaveintroducedpoliciesandmeasuressupportingtheundertakingofindustrialtransfers.Article7Applicationproced
25、uresforthebuildingofdemonstrationzones:1.Provincialdevelopmentandreformcommissionsshallmobilize,direct,andorganizerelevantprefecture-levelcitiestovoluntarilyapplyforthebuildingofdemonstrationzonesaccordingtotheapplicationconditionsandrequirements.(四)产业承接潜力较大。矿产、能源、土地、人力等资源丰富,要素成本具有比较优势,资源环境承载能力较强。(五
26、)开放合作基础较好。经济外向度较高,与周边地区经济联系紧密,跨区域产业对接合作具备良好基础,区域内部协同发展加快推进。(六)发展环境良好。营商环境不断优化,政策环境优良,省市政府出台有关支持承接产业转移的政策举措。第七条示范区创建申报程序:(一)省级发展改革委对照申报条件要求,动员、指导、组织有关地市自愿开展示范区创建申报。(二)省级发展改革委根据 本省(区、市)承接产业转 移总体安排和创建申报城市 的基础条件等,科学确定示 范区申报范围,根据承接 产业转移示范区总体方案编 写指南,组织编制示范区 总体方案。2. Provincialdevelopmentandreformcommission
27、sshall,accordingtotheoverallarrangementsoftheirrespectiveprovinces(autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment)forundertakingindustrialtransfersandthebasicconditionsforthebuildingofapplicationcities,amongothers,determineinascientificmannertheapplicationscopeofdemonstrationzon
28、es,andorganizethepreparationoftheoverallplansfordemonstrationzonesinaccordancewiththeGuidelinesonthePreparationoftheOverallPlansforDemonstrationZonesforUndertakingIndustrialTransfers.(三)省级发展改革委向国 家发展改革委报送申请设立 示范区的请示以及总体方 案。3. ProvincialdevelopmentandreformcommissionsshallsubmittotheNDRCtherequestsfo
29、rinstructionsonandtheoverallplansforthebuildingofdemonstrationzones.第三章批复设立ChapterIIIOfficialReplyonEstablishment第八条国家发展改革 委负责示范区批复设立,按 照成熟一个、批复一个的原 则开展工作。党中央、国务 院有明确部署安排的,报请 国务院批复设立。第九条国家发展改革 委对申报的总体方案进行研 究,并征求有关部门意见, 组织召开专家评估论证会, 综合考虑设立条件和总体方 案成熟程度,统筹研究确定 是否设立示范区。Article8TheNDRCshallberesponsiblef
30、orgivingofficialrepliesontheestablishmentofdemonstrationzones,andconductworkundertheprinciplethat“anofficialreplyshallbegivenwhenevertheconditionsfortheestablishmentofademonstrationzonearemature.,WhereanycleararrangementshavebeenmadebytheCPCCentralCommitteeandtheStateCouncil,areportshallbefiledwitht
31、heStateCouncilfortheofficialreplyonestablishment.Article9TheNDRCshallconductresearchontheoverallplansforapplication,andrequestcommentsfromtherelevantdepartments,organizetheholdingofexpertassessmentdemonstrationmeetings,comprehensivelyconsidertheestablishmentconditionsandthedegreeofmaturityoftheovera
32、llplans,andconductoverallresearchtodeterminewhethertoestablishdemonstrationzones.Article 10 TheNDRCshallpublicizethedemonstrationzonestobeestablishedthroughitsportalwebsiteforfiveworkingdays.第十条国家发展改革 委通过门户网站对拟设立示 范区向社会公示,公示期为 5个工作日。Article 11 Ifnoobjectionisraisedaftertheexpirationofthepublicationp
33、eriod,theNDRCshallissueareplyonconsenttotheestablishmentofademonstrationzone,andclarifythescopeofandtheoverallrequirementsanddivisionofresponsibilitiesfortheconstructionofthedemonstrationzone,amongothers.第十一条公示期满无 异议后,国家发展改革委印 发同意设立示范区的复函, 明确示范区建设范围、总体 要求、职责分工等内容。Article 12 Aprovincialdevelopmentand
34、reformcommissionshall,accordingtothereplyfromtheNDRC,issuetheoverallplanforthedemonstrationzone,andorganizetheeffectiveimplementationthereof.第十二条省级发展改 革委根据国家发展改革委复 函,印发示范区总体方案, 并抓好组织实施。ChapterIVConstructionManagement第四章建设管理Article13TheNDRCshallberesponsibleforprovidingworkguidanceontheconstructionof
35、demonstrationzones,providesupportinthetermsofsystemandmechanisminnovation,policyimplementation,projectconstruction,andfundingarrangements,amongothers,organizetheholdingofon-siteworkmeetingsfortheconstructionofdemonstrationzones,andsummarizeandpromotegoodexperienceandgoodpracticesformedduringtheconst
36、ructionofdemonstrationzones.第十三条国家发展改 革委负责示范区建设的工作 指导,在体制机制创新、政 策实施、项目建设、资金安 排等方面给予支持,组织召 开示范区建设工作现场会, 总结推广示范区建设形成的 好经验好做法。第十四条省级发展改 革委是示范区管理的责任主 体,要建立健全省负总责、 市县抓落实的工作机制,统 筹推进示范区建设;落实国Article 14 Asthepartiesresponsiblefortheadministrationofdemonstrationzones,provincialdevelopmentandreformcommitteess

38、dertakingindustrialtransfersanddevelopspecialpoliciesandmeasuresfortheprovinces(autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment);andtrackonaregularbasistheconstructionanddevelopmentofdemonstrationzones,summarizeexperienceandpractices,andreporttherelevantinformationtotheNDRCinatim
39、elymanner.第十五条示范区所在 地市人民政府是示范区建设 的责任主体,要做好以下工 作:Article 15 Thepeoplesgovernmentoftheprefecture-levelcitieswheredemonstrationzonesarelocatedarethepartiesresponsiblefortheconstructionofdemonstrationzones,andshalleffectivelyconductthefollowingwork:(一)建立健全示范区建设 工作推进机制,明确责任主 体和工作要求,细化示范区 总体方案提出的发展目标和 重点任
40、务,抓好工作落实;1. Establishingandimprovingthepromotionmechanismfortheconstructionofdemonstrationzones,clarifyingtheresponsiblepartiesandworkrequirements,specifyingthedevelopmentobjectivesandkeytasksproposedintheoverallplansfordemonstrationzones,andensuringtheeffectiveimplementationoftherelevantwork.(二)依托省
41、级以上开发 区,聚焦产业承接重点,深 化开放合作,开展精准招 商,积极承接产业转移;2. Deepeningopeningupandcooperation,conductingpreciseinvestmentpromotion,andproactivelyundertakingindustrialtransfersbyrelyingondevelopmentzonesatorabovetheprovinciallevelandfocusingonprioritiesofindustrialundertaking.(三)完善基础设施建设, 提升公共服务水平,提高承 接产业转移能力;3. Imp
42、rovingtheconstructionofinfrastructure,improvingthelevelofpublicservices,andenhancingthecapabilitiesofundertakingindustrialtransfers.(四)优化营商环境,强化 要素保障,落实国家和省级4. Optimizingthebusinessenvironment,strengtheningfactorguarantees,implementing有关承接产业转移的政策文 件,出台支持示范区建设发 展的政策举措;nationalandprovincialpolicydocum
43、entsonundertakingindustrialtransfers,andissuingpoliciesandmeasuressupportingtheconstructionanddevelopmentofdemonstrationzones.(五)开展统计监测和分析 研究,及时发现示范区建设 发展存在问题并改进工作, 总结报送工作进展和典型经 验做法。5. Conductingstatisticalmonitoringandanalysisandresearch,discoveringproblemsexistingintheconstructionanddevelopmentofd
44、emonstrationzonesinatimelymannerandmakingimprovements,andsummarizingandsubmittingtheinformationontheprogressoftheworkandtypicalexperienceandpractices.第五章考核评估ChapterVExaminationandAssessment第十六条国家发展改 革委组织开展示范区年度总 结评价和5年综合考核评 估,加强示范区监督管理, 指导示范区发展建设。Article16TheNDRCshallorganizetheannualsummaryandevalu
45、ationandfive-yearcomprehensiveexaminationandassessmentofdemonstrationzones,strengthenthesupervisionandadministrationofdemonstrationzones,andguidethedevelopmentandconstructionofdemonstrationzones.第十七条省级发展改 革委负责对示范区开展年度 总结自评价,总结示范区总 体方案各项任务推进落实情 况和工作成效,分析存在问 题,提出整改措施和下年度 工作考虑,于每年1月底前 将上年度总结报告报送国家 发展改革
46、委。Article17Provincialdevelopmentandreformcommissionsshallberesponsibleforconductingannualsummaryandself-evaluationofdemonstrationzones,summarizingtheadvancementandimplementationofvarioustasksspecifiedintheoverallplansfordemonstrationzonesandworkresults,analyzingexistingproblems,puttingforwardrectifi
47、cationmeasuresandworkconsiderationsforthenextyear,andsubmittingthesummaryreportsoftheprioryeartotheNDRCbeforetheendofJanuaryeachyear.第十八条国家发展改 革委在地方总结自评价基础 上,采取定量和定性相结合 方式,综合经济发展、承接Article18TheNDRCshall,onthebasisoflocalsummaryandself-assessment,conductannualsummaryandevaluationofdemonstrationzonesb
48、yadoptingbothquantitativeandqualitativemethods产业、园区建设、发展环 境、组织落实等方面指标, 对示范区开展年度总结评 价,评价结果按优秀、良 好、合格、较差进行分级。 以年度总结评价结果为基 础,建立有奖有罚的激励约 束机制。andincomprehensiveconsiderationofindicatorsineconomicdevelopment,undertakingofindustries,parkconstruction,developmentenvironment,organizationofimplementation,andotheraspects,withtheevaluationresultsclassifiedintoexcellent,good,qualified,andpoor.Basedontheannualsummaryandevaluationresults,incentiveandrestraintmechanismswithrewardsandpunishmentsshallbeestablished.(一)对年度总结评价结果 为优秀的示范区,宣传推广 其典型经验和创新做法,安 排下年度相关中央预算内投 资时予以倾斜支持。
