4、inConfinedSpacesofIndustryandTrade工贸企业有限空间作业安全规定EnterprisesArticle1TheseProvisionsaredevelopedinaccordancewiththeWorkSafetyLawofthePeoplesRepublicofChinaandotherapplicablelawsandregulationsforthepurposesofensuringthesafetyofoperationsinconfinedspacesandpreventingandreducingworksafetyincidents.Articl
5、e2TheseProvisionsshallapplytothesafetymanagementandsupervisionofoperationsinconfinedspacesofproductionandtradingentitiesinmetallurgy,nonferrousmetal,buildingmaterials,machinery,lightindustry,textiles,tobacco,commerceandtrade,andotherindustries(hereinaftercollectivelyreferredtoas“industryandtradeente
6、rprises).Article3ForthepurposesoftheseProvisions,uconfinedspacenmeansaclosedorpartiallyclosedspacethatisnotdesignedasafixedworkplacewhereworkersmayentertoconductoperationsandwhichislikelytocausetheaccumulationoftoxic,hazardous,flammable,andexplosivesubstanceorinsufficientoxygencontent.Forthepurposes
7、oftheseProvisions,“operationsinconfinedspacesmeansoperationsconductedbypersonnelinconfinedspaces.第一条为了保障有限空间作 业安全，预防和减少生产安全事 故，根据中华人民共和国安全生 产法等法律法规，制定本规定。第二条冶金、有色、建材、 机械、轻工、纺织、烟草、商贸等 行业的生产经营单位（以下统称工 贸企业）有限空间作业的安全管理 与监督，适用本规定。第三条本规定所称有限空 间，是指封闭或者部分封闭，未被 设计为固定工作场所，人员可以进 入作业，易造成有毒有害、易燃易 爆物质积聚或者氧含量不足的空
8、间。本规定所称有限空间作业，是指人 员进入有限空间实施的作业。第四条工贸企业主要负责人 是有限空间作业安全第一责任人， 应当组织制定有限空间作业安全管Article4Theprincipalpersoninchargeofanindustryandtradeenterpriseshallbetheprincipalpersoninchargeofworksafetyinconfinedspaces,organizeanddevelopmanagementrulesforworksafetyinconfinedspaces,specifythedutiesofthepersoninchargeo
9、ftheapprovalofoperationsinconfinedspaces,supervisors,andworkers,aswellastherequirementsforsafetytraining,operationapproval,protectivesupplies,emergencyrescueequipment,operatingprocedures,andemergencydisposal.Article5Anindustryandtradeenterpriseshallimplementrulesforthesupervisionofoperationsinconfin
10、edspacesanddesignatefull-timeorpart-timesupervisorstotakechargeoftheimplementationofsafetymeasuresforoperationsinconfinedspaces.Supervisorsshallhavethesafetyknowledgeandemergencydisposalabilityappropriateforthesupervisionofoperationsinconfinedspacesandbeabletocorrectlyusesuppliesandequipmentforgasde
11、tection,mechanicalventilation,respiratoryprotection,andemergencyrescue,amongothers.Article6Anindustryandtradeenterpriseshallidentifyconfinedspaces,establishaconfinedspacemanagementledgertospecifythequantityandlocationofconfinedspaces,hazardousfactors,andotherinformation,andupdatesuchinformationinati
12、melymanner.Anindustryandtradeenterpriseshallbeencouragedtoadoptinformation,digital,andintelligenttechnologiestoenhancethelevelofsafetyriskmanagementandcontrolinoperationsinconfinedspaces.理制度，明确有限空间作业审批 人、监护人员、作业人员的职责， 以及安全培训I、作业审批、防护用 品、应急救援装备、操作规程和应 急处置等方面的要求。第五条工贸企业应当实行有 限空间作业监护制，明确专职或者 兼职的监护人员，负责
13、监督有限空 间作业安全措施的落实。监护人员应当具备与监督有限空间 作业相适应的安全知识和应急处置 能力，能够正确使用气体检测、机 械通风、呼吸防护、应急救援等用 品、装备。第六条 工贸企业应当对有限 空间进行辨识，建立有限空间管理 台账，明确有限空间数量、位置以 及危险因素等信息，并及时更新。鼓励工贸企业采用信息化、数字化 和智能化技术，提升有限空间作业 安全风险管控水平。第七条工贸企业应当根据有Article7Anindustryandtradeenterpriseshallspecifyapprovalrequirementsaccordingtothedegreeofsafetyrisk
14、sassociatedwithoperationsinconfinedspaces.Anyoperationinaconfinedspacewiththeriskofpoisoningandasphyxiationbyhydrogensulfide,carbonmonoxide,orcarbondioxide,amongothers,shallbesubjecttoapprovalbytheprincipalpersoninchargeoftheindustryandtradeenterpriseorbyanotherpersonentrustedtherebyinwriting,andthe
15、relevantliabilityshallstillbebornebytheprincipalpersoninchargeoftheindustryandtradeenterpriseuponentrustment.Operationsinconfinedspacesshallnotbecarriedoutwithouttheapprovalofthepersoninchargeoftheapprovalofoperationsdesignatedbytheindustryandtradeenterprise.Article8Anindustryandtradeenterprisecontr
16、actingoutoperationsinconfinedspacestoanyotherentityinaccordancewiththelawshallagreeontheworksafetymanagementdutiesofeachpartywiththecontractorinthecontractoragreement.Theindustryandtradeenterpriseshalluniformlycoordinateandmanageoperationsinconfinedspaces,carryoutthesafetyinspectionsofon-siteoperati
17、ons,andurgethecontractortoeffectivelyimplementvarioussafetymeasures.限空间作业安全风险大小，明确审 批要求。对于存在硫化氢、一氧化碳、二氧 化碳等中毒和窒息等风险的有限空 间作业，应当由工贸企业主要负责 人或者其书面委托的人员进行审 批，委托进行审批的，相关责任仍 由工贸企业主要负责人承担。未经工贸企业确定的作业审批人批 准，不得实施有限空间作业。第八条工贸企业将有限空间 作业依法发包给其他单位实施的， 应当与承包单位在合同或者协议中 约定各自的安全生产管理职责。工 贸企业对其发包的有限空间作业统 一协调、管理，并对现场作业进
18、行 安全检查，督促承包单位有效落实 各项安全措施。第九条工贸企业应当每年至 少组织一次有限空间作业专题安全 培训，对作业审批人、监护人员、 作业人员和应急救援人员培训有限 空间作业安全知识和技能，并如实 记录。Article9Anindustryandtradeenterpriseshallorganizespecialsafetytrainingonoperationsinconfinedspacesatleastonceayeartoprovidetrainingonsafetyknowledgeandskillsrelatedtooperationsinconfinedspacestot
19、hepersoninchargeoftheapprovalofoperations,supervisors,workers,andemergencyrescuepersonnel,andkeeptruthfulrecords.Thosewhofailthetrainingshallnotparticipateinoperationsinconfinedspaces.Article 10 Anindustryandtradeenterpriseshallmakeon-sitedisposalplansforoperationsinconfinedspaces,organizedrillsinac
20、cordancewiththerelevantprovisions,andassesstheeffectivenessofdrills.Article 11 Anindustryandtradeenterpriseshallsetupconspicuoussafetywarningsignsatconspicuouspositionsatentrancesandexitsofconfinedspacesandsetupsafetyriskalertsatplaceswhereconditionsaremet.Article 12 Anindustryandtradeenterpriseshal
21、ltakelocking,separationfences,safetynets,orotherphysicalseparationmeasurestopreventunauthorizedaccesstoanyconfinedspacewheretoxicsubstancesmayexist.Supervisorsshallberesponsibleforremovingphysicalisolationmeasuresbeforetheoperation.Article 13 Anindustryandtradeenterpriseshall,accordingtothecharacter
22、isticsofriskfactorsinconfinedspaces,equipthemselveswithprotectivesuppliesandemergencyrescueequipmentsuchasgasdetectionandalarminstruments,mechanicalventilationequipment,respiratoryprotectiveequipment,andfull-bodysafetybeltsthatcomplywithnationalstandardsorindustrystandards.Theyshallalsoconductregula
23、rmaintenanceandserviceandperiodictestingofrelevantsuppliesandequipmenttoensuretheirnormal未经培训合格不得参与有限空间作业。第十条工贸企业应当制定有限空间作业现场处置方案，按规定组织演练，并进行演练效果评估。第H一条工贸企业应当在有限空间出入口等醒目位置设置明显的安全警示标志，并在具备条件的场所设置安全风险告知牌。第十二条工贸企业应当对可能产生有毒物质的有限空间采取上锁、隔离栏、防护网或者其他物理隔离措施，防止人员未经审批进入。监护人员负责在作业前解除物理隔离措施。第十三条工贸企业应当根据有限空间危险因素的
24、特点，配备符合国家标准或者行业标准的气体检测报警仪器、机械通风设备、呼吸防护用品、全身式安全带等防护用品和应急救援装备，并对相关用品、装备进行经常性维护、保养和定期检测，确保能够正常使用。use.第十四条有限空间作业应当 严格遵守“先通风、再检测、后作 业”要求。存在爆炸风险的，应当 采取消除或者控制措施，相关电气 设施设备、照明灯具、应急救援装 备等应当符合防爆安全要求。Article14Operationsinconfinedspacesshallstrictlyfollowtherequirementsofventilationbeforedetectionandoperationaft
25、erdetection.Incaseofanyriskofexplosion,measuresshallbetakentoeliminateorcontroltherisk,andrelevantelectricfacilitiesandequipment,lightingfixtures,andemergencyrescueequipmentshallsatisfyanti-explosionsafetyrequirements.作业前，应当组织对作业人员进行 安全交底，监护人员应当对通风、 检测和必要的隔断、清除、置换等 风险管控措施逐项进行检查，确认 防护用品能够正常使用且作业现场 配备
26、必要的应急救援装备，确保各 项作业条件符合安全要求。有专业 救援队伍的工贸企业，应急救援人 员应当做好应急救援准备，确保及 时有效处置突发情况。Beforetheoperation,thedisclosureofsafetyinformationtotheworkersshallbeorganized,andsupervisorsshallcheckventilation,detection,andnecessaryisolation,removal,replacement,andotherriskcontrolmeasuresonebyonetoconfirmthatprotectiveeq
27、uipmentcanbeusednormallyandnecessaryemergencyrescueequipmentisavailableattheoperationsite,soastoensurethatallworkingconditionssatisfysafetyrequirements.Theemergencyrescuepersonnelofanindustryandtradeenterprisewithaprofessionalrescueteamshallbewellpreparedforemergencyrescuetoensurethepromptandeffecti
28、vehandlingofemergencies.第十五条监护人员应当全程 进行监护，与作业人员保持实时联 络，不得离开作业现场或者进入有 限空间参与作业。Article15Supervisorsshallprovidefullprocesssupervision,maintainreal-timecontactwithworkers,andshallnotleavetheoperationsiteorentertheconfinedspacetoparticipateinoperations.发现异常情况时，监护人员应当立 即组织作业人员撤离现场。发生有 限空间作业事故后，应当立即按照 现场处
29、置方案进行应急处置，组织 科学施救。未做好安全措施盲目施Incaseofanyabnormalcircumstance,supervisorsshallimmediatelyorganizetheevacuationofworkers.Intheeventofanyaccidentinoperationsinaconfinedspace,emergencydisposalshallbeimmediatelyconductedaccordingtotheon-sitedisposalplan,andscientificrescueshallbeorganized.救的，监护人员应当予以制止。Su
30、pervisorsshallcurbblindrescuewithouttakingeffectivesafetymeasures.Duringtheoperation,theindustryandtradeenterpriseshallassignspecialpersonneltoconductcontinuousventilationandgasdensitydetectionintheoperationarea.Iftheoperationisinterrupted,workerscanre-entertheconfinedspaceforoperationonlyafterreven
31、tilationandtheareapassesthegasdetection.Article16Theconfinedspacethathastheriskofpoisoningandasphyxiationbyhydrogensulfide,carbonmonoxide,orcarbondioxide,amongothers,andrequireskeysupervisionandadministrationshallbeincludedinthecatalogformanagement.Thesupervisioncatalogshallbedetermined,adjusted,and
32、issuedbytheMinistryofEmergencyManagement.Article17Thedepartmentinchargeofthesupervisionandadministrationofworksafetyinanindustryandtradeenterpriseshallstrengthenthesupervisionandinspectionofoperationsinconfinedspacesoftheindustryandtradeenterprise,andincludeinspectionintheannualsupervisionandinspect
33、ionplan.Discoveredhiddenrisksofaccidentsandillegalactsshallbedealtwithinaccordancewiththelaw.作业过程中，工贸企业应当安排专 人对作业区域持续进行通风和气体 浓度检测。作业中断的，作业人员 再次进入有限空间作业前，应当重 新通风、气体检测合格后方可进 入。第十六条存在硫化氢、一氧 化碳、二氧化碳等中毒和窒息风 险、需要重点监督管理的有限空 间，实行目录管理。监管目录由应急管理部确定、调整 并公布。第十七条负责工贸企业安全 生产监督管理的部门应当加强对工 贸企业有限空间作业的监督检查， 将检查纳入年度监督
34、检查计划。对 发现的事故隐患和违法行为，依法 作出处理。负责工贸企业安全生产监督管理的 部门应当将存在硫化氢、一氧化 碳、二氧化碳等中毒和窒息风险的 有限空间作业工贸企业纳入重点检Thedepartmentinchargeofthesupervisionandadministrationofworksafetyinanindustryandtradeenterpriseshallincludetheindustryandtradeenterpriseoperatingin查范围，突出对监护人员配备和履 职情况、作业审批、防护用品和应 急救援装备配备等事项的检查。confinedspaceswi
35、ththeriskofpoisoningandasphyxiationbyhydrogensulfide,carbonmonoxide,orcarbondioxide,amongothers,inthescopeofthekeyinspection,withafocusontheinspectionofmatterssuchasthestaffingandperformanceofsupervisors,approvalofoperations,andtheprovisionofprotectivesuppliesandemergencyrescueequipment.第十八条负责工贸企业安全
36、 生产监督管理的部门及其行政执法 人员发现有限空间作业存在重大事 故隐患的，应当责令立即或者限期 整改；重大事故隐患排除前或者排 除过程中无法保证安全的，应当责 令暂时停止作业，撤出作业人员； 重大事故隐患排除后，经审查同 意，方可恢复作业。Article18Wherethedepartmentinchargeofthesupervisionandadministrationofworksafetyofanindustryandtradeenterpriseoranyofitsadministrativelawenforcementofficersdiscoversmajorhiddenris
37、ksofaccidentsinoperationsinconfinedspaces,itorheshallorderimmediaterectificationorrectificationwithinaprescribedtimelimit;andifsafetycannotbeguaranteedbeforeorduringtheeliminationofmajorhiddenrisksofaccidents,itorheshallorderthesuspensionofoperationsandevacuationofworkers.Theoperationmaynotberesumed
38、untilmajorhiddenrisksofaccidentshavebeeneliminatedandapprovalhasbeenobtaineduponexamination.第十九条工贸企业有下列行 为之一的，责令限期改正，处5万 元以下的罚款；逾期未改正的，处 5万元以上20万元以下的罚款， 对其直接负责的主管人员和其他直 接责任人员处1万元以上2万元以 下的罚款；情节严重的，责令停产 停业整顿；构成犯罪的，依照刑法 有关规定追究刑事责任：Article19Anindustryandtradeenterprisethatcommitsanyofthefollowingactssha
39、llbeorderedtotakecorrectiveactionwithinaprescribedtimelimitandbefinednotmorethan50,000yuan;ifitfailstotakecorrectiveactionwithintheprescribedtimelimit,itshallbefinednotlessthan50,000yuannormorethan200,000yuan,anditsdirectlyresponsiblepersoninchargeandotherdirectlyliablepersonsshalleachbefinednotless
40、than10,000yuannormorethan20,000yuan;ifthecircumstancesareserious,itshallbeorderedtosuspendproductionorbusinessoperationforanoverhaul;andifitiscriminallypunishable,theoffendershallbeheldcriminallyliableinaccordancewiththerelevantprovisionsoftheCriminalLaw:（一）未按照规定设置明显的有限 空间安全警示标志的；(1) Failingtosetupc
41、onspicuoussafetywarningsignsforconfinedspacesinaccordancewiththeapplicableprovisions.（二）未按照规定配备、使用符合 国家标准或者行业标准的有限空间 作业安全仪器、设备、装备和器材 的，或者未对其进行经常性维护、 保养和定期检测的。(2) Failingtobeequippedwithorusesafetyinstruments,equipment,fittings,andinstrumentsforoperationsinconfinedspacesthatmeetnationalstandardsorind
42、ustrystandards,orfailingtoconductregularmaintenanceandserviceandperiodictesting.第二十条工贸企业有下列行 为之一的，责令限期改正，处10 万元以下的罚款；逾期未改正的， 责令停产停业整顿，并处10万元 以上20万元以下的罚款，对其直 接负责的主管人员和其他直接责任 人员处2万元以上5万元以下的罚 款：Article20Anindustryandtradeenterprisethatcommitsanyofthefollowingactsshallbeorderedtotakecorrectiveactionwith

44、ersonsshalleachbefinednotlessthan20,000yuannormorethan50,000yuan:（一）未按照规定开展有限空间作 业专题安全培训或者未如实记录安 全培训情况的；(1) Failingtocarryoutspecialsafetytrainingforoperationsinconfinedspacesorfailingtotruthfullyrecordtheinformationonsafetytraining.（二）未按照规定制定有限空间作 业现场处置方案或者未按照规定组 织演练的。(2) Failingtomakeon-sitedispos
45、alplansforoperationsinconfinedspacesinaccordancewiththeapplicableprovisionsorfailingtoorganizedrillsinaccordancewiththeapplicableprovisions.第二H一条违反本规定，有 下列情形之一的，责令限期改正， 对工贸企业处5万元以下的罚款， 对其直接负责的主管人员和其他直 接责任人员处1万元以下的罚款：Article21Anindustryandtradeenterprisethatfallsunderanyofthefollowingcircumstancesinv
46、iolationofthisRegulationshallbeorderedtotakecorrectiveactionwithinaprescribedtimelimit,befinednotmorethan50,000yuan;anditsdirectlyresponsiblepersoninchargeandotherdirectlyliablepersonsshalleachbefinednotmorethan10,000yuan:（一）未配备监护人员，或者监护 人员未按规定履行岗位职责的；(1) Failingtodesignatesupervisorsorthesupervisor
47、sfailtoperformtheirpostdutiesinaccordancewiththeapplicableprovisions.（二）未对有限空间进行辨识，或 者未建立有限空间管理台账的；(2) Failingtoidentifytheconfinedspaceorfailingtoestablishtheconfinedspacemanagementledger.（三）未落实有限空间作业审批， 或者作业未执行“先通风、再检 测、后作业”要求的；(3) Failingtoimplementtheapprovalforoperationsinconfinedspaces,orcarry
48、ingoutoperationsinnon-compliancewiththerequirementsof“ventilationbeforedetectionandoperationafterdetection,（四）未按要求进行通风和气体检 测的。(4) Failingtoconductventilationandgasdetectionasrequired.第二十二条本规定自2024 年1月1日起施行。原国家安全生 产监督管理总局2013年5月20日 公布的工贸企业有限空间作业安 全管理与监督暂行规定（国家安 全生产监督管理总局令第59号） 同时废止。Article22TheseProvisionsshallcomeintoforceonJanuary1,2024,uponwhichtheInterimProvisionsontheAdministrationandSupervisionoftheSafetyofOperationsinConfinedSpacesofIndustryandTradeEnterprises(OrderNo.59,StateAdministrationofWorkSafety)issuedbytheformerStateAdministrationofWorkSafetyonMay20,2013sh
