3、dshallcomeintoforceonSeptember1,2019.Premier:LiKeqiangApril20,2019InterimRegulationonMajorAdministrativeDecision-MakingProcedures第一章总 则第一条为了健全科学、 民主、依法决策机制,规范重 大行政决策程序,提高决策质 量和效率,明确决策责任,根ChapterIGeneralProvisionsArticle1Forthepurposesofimprovingthescientific,democraticandlegaldecision-makingmechanis
4、ms,standardizingmajoradministrativedecision-makingprocedures,enhancingdecision-making据宪法、地方各级人民代表大 会和地方各级人民政府组织法 等规定,制定本条例。第二条县级以上地方人 民政府(以下称决策机关)重 大行政决策的作出和调整程 序,适用本条例。qualityandefficiency,andspecifyingdecision-makingresponsibilities,thisRegulationisdevelopedinaccordancewiththeConstitutionandorgani
5、zationlawsoflocalpeoplescongressesatalllevelsandlocalpeoplesgovernmentsatalllevelsandotherprovisions.第三条本条例所称重大 行政决策事项(以下简称决策 事项)包括:Article2ThisRegulationshallapplytotheproceduresformakingandadjustingmajoradministrativedecisionsoflocalpeople,sgovernmentsatorabovethecountylevel(hereinafterreferredtoa
6、s“decision-makingorgans).Article3ForthepurposesofthisRegulation,umajoradministrativedecision-makingmattersn(hereinafterreferredtoasudecision-makingmattersn)include:(一)制定有关公共服务、市 场监管、社会管理、环境保护 等方面的重大公共政策和措 施;(1) developingmajorpublicpoliciesandmeasuresrelatingtopublicservices,marketregulation,socialm
7、anagement,environmentalprotectionandotheraspects;(二)制定经济和社会发展等 方面的重要规划;(2) developingimportantplansforeconomicandsocialdevelopmentandotheraspects;(三)制定开发利用、保护重 要自然资源和文化资源的重大 公共政策和措施;(四)决定在本行政区域实施 的重大公共建设项目;(3) developingmajorpublicpoliciesandmeasurestodevelop,utilizeandprotectimportantnaturalandcult
8、uralresources;(4) decidingonmajorpublicconstructionprojectstobeimplementedintheadministrativeregion;and(五)决定对经济社会发展有 重大影响、涉及重大公共利益 或者社会公众切身利益的其他 重大事项。(5) decidingonothermajormattersthathaveasignificantimpactoneconomicandsocialdevelopment,involvematerialpublicinterest,orthevitalinterestsofthepublic.法
9、律、行政法规对本条第一款 规定事项的决策程序另有规定 的,依照其规定。财政政策、 货币政策等宏观调控决策,政 府立法决策以及突发事件应急 处置决策不适用本条例。决策机关可以根据本条第一款 的规定,结合职责权限和本地 实际,确定决策事项目录、标 准,经同级党委同意后向社会 公布,并根据实际情况调整。Wheredecision-makingproceduresforthemattersprescribedinparagraph1ofthisArticleareotherwiseprescribedinanylaworadministrativeregulation,suchlaworadminis
10、trativeregulationshallprevail.ThisRegulationshallnotapplytomacro-controldecisionssuchasfiscalpoliciesandmonetarypolicies,governmentlegislativedecisions,andemergencyresponsedecisions.第四条重大行政决策必 须坚持和加强党的全面领导, 全面贯彻党的路线方针政策和 决策部署,发挥党的领导核心 作用,把党的领导贯彻到重大 行政决策全过程。Thedecision-makingorganmay,inaccordancewith
11、theprovisionsofparagraph1ofthisArticle,andinlightoftheirfunctionsandpowersandlocalactualcircumstances,determinethecatalogueandstandardsofdecision-makingmatters,announcethemtothepublicwiththeconsentofthePartycommitteeatthesamelevel,andmakeadjustmentsaccordingtoactualcircumstances.第五条 作出重大行政决 策应当遵循科学决
12、策原则,贯 彻创新、协调、绿色、开放、 共享的发展理念,坚持从实际 出发,运用科学技术和方法, 尊重客观规律,适应经济社会 发展和全面深化改革要求。Article4ThePartysoverallleadershipmustbeadheredtoandstrengthenedinmajoradministrativedecision-making,theParty,slines,principles,policies,decisionsandarrangementsshallbecomprehensivelyimplemented,thecoreroleofthePartysleadershi
13、pshallbemaximized,andtheParty,sleadershipshallbeimplementedthroughouttheentiremajoradministrativedecision-makingprocess.Article5Majoradministrativedecisionsshallbemadeundertheprincipleofscientificdecision-making,thedevelopmentconceptsofinnovation,coordination,green,opennessandsharingshallbeimplement
14、ed,proceedingfromactualcircumstancesshallbeadheredto,scientifictechnologiesandmethodsshallbeapplied,andobjectivelawshallberespected,soastoadapttotherequirementsforeconomicandsocial第六条 作出重大行政决 策应当遵循民主决策原则,充 分听取各方面意见,保障人民 群众通过多种途径和形式参与 决策。developmentandcomprehensivelydeepeningthereform.第七条 作出重大行政决 策应当
15、遵循依法决策原则,严 格遵守法定权限,依法履行法 定程序,保证决策内容符合法 律、法规和规章等规定。Article6Majoradministrativedecisionsshallbemadeundertheprincipleofdemocraticdecision-making,opinionsshallbefullysolicitedfromallparties,anditshallbeguaranteedthatthepeopleparticipateindecision-makingthroughvariouschannelsandforms.第八条重大行政决策依 法接受本级人民代表
16、大会及其 常务委员会的监督,根据法律、 法规规定属于本级人民代表大 会及其常务委员会讨论决定的 重大事项范围或者应当在出台 前向本级人民代表大会常务委 员会报告的,按照有关规定办 理。Article7Majoradministrativedecisionsshallbemadeundertheprincipleofdecision-makinginaccordancewiththelaw,statutoryauthorityshallbestrictlyobserved,statutoryproceduresshallbeperformedinaccordancewiththelaw,andi
17、tshallbeensuredthatthecontentofthedecisioncomplieswithlaws,regulations,rulesandotherprovisions.上级行政机关应当加强对下级 行政机关重大行政决策的监 督。审计机关按照规定对重大 行政决策进行监督。Article8Majoradministrativedecisionsshallbesubjecttothesupervisionofthepeoplescongressatthesamelevelanditsstandingcommitteeinaccordancewiththelaw,andifthey
18、fallwithinthescopeofmajormattersthatshallbedeliberatedanddecidedbythepeople,scongressatthesamelevelanditsstandingcommitteeortheyshallbereportedtothestandingcommitteeofthepeoplescongressatthesamelevelbeforeissuanceinaccordancewithlawsandregulations,relevantprovisionsshallbefollowed.Theadministrativeo
19、rganatahigherlevelshallstrengthenthesupervisionofmajoradministrativedecisionsofadministrativeorgansatlowerlevels.Theauditorganshallsupervisemajoradministrativedecisionsasrequired.第九条重大行政决策情 况应当作为考核评价决策机关Article9Majoradministrativedecision-makingshallbeanimportantpartof及其领导人员的重要内容Qtheassessmentandeva
20、luationofdecision-makingorgansandtheirleaders.第二章决策草案的形成第一节决策启动第十条对各方面提出的 决策事项建议,按照下列规定 进行研究论证后,报请决策机 关决定是否启动决策程序:ChapterIlFormationoftheDraftDecisionSection1InitiationofDecision-Making(一)决策机关领导人员提出 决策事项建议的,交有关单位 研究论证;Article10Aftersuggestionsondecision-makingmattersofferedbyallpartiesaresubjecttore
21、searchanddemonstrationinaccordancewiththefollowingprovisions,areportshallbemadetothedecision-makingorgantodecidewhethertoinitiatethedecision-makingprocedures:(二)决策机关所属部门或者 下一级人民政府提出决策事项 建议的,应当论证拟解决的主 要问题、建议理由和依据、解 决问题的初步方案及其必要 性、可行性等;(1) Whereleadersofthedecision-makingorganoffersuggestionsondecisio
22、n-makingmatters,theyshallforwardthemtotherelevantentitiesforresearchanddemonstration.(三)人大代表、政协委员等 通过建议、提案等方式提出决 策事项建议,以及公民、法人 或者其他组织提出书面决策事 项建议的,交有关单位研究论 证。(2) Whereadepartmentsubordinatetothedecision-makingorganorthepeople,sgovernmentatthenextlowerlevelofferssuggestionsondecision-makingmatters,its
23、halldemonstratethemajorproblemstoberesolved,thereasonsandbasisforthesuggestions,thepreliminaryplanforresolvingproblems,andthenecessityandfeasibilitythereof,amongothers.(3) WhereNPCdeputiesandCPPCCmembers,amongothers,offersuggestionsondecision-makingmattersinsuchformsassuggestionsandproposals,andciti
24、zens,legalpersonsorotherorganizationsofferwrittensuggestionsondecision-makingmatters,theyshallsubmitthesuggestionstotherelevantentitiesforresearchanddemonstration.第十一条决策机关决定Article 11 Wherethedecision-makingorgandecidestoinitiatedecision-making启动决策程序的,应当明确决 策事项的承办单位(以下简称 决策承办单位),由决策承办 单位负责重大行政决策草案的
25、拟订等工作。决策事项需要两 个以上单位承办的,应当明确 牵头的决策承办单位。procedures,itshallspecifytheentityundertakingthedecision-makingmatters(hereinafterreferredtoastheudecision-makingentity1,),andthedecision-makingentityshallberesponsiblefordraftingmajoradministrativedecisionsandotherwork.Ifdecision-makingmattersneedtobeundertaken
26、bytwoormoreentities,theleadingdecision-makingentityshallbespecified.第十二条决策承办单位 应当在广泛深入开展调查研 究、全面准确掌握有关信息、 充分协商协调的基础上,拟订 决策草案。决策承办单位应当全面梳理与 决策事项有关的法律、法规、 规章和政策,使决策草案合法 合规、与有关政策相衔接。Article 12 Thedecision-makingentityshallpreparedraftdecisionsonthebasisofextensiveandin-depthinvestigationandresearch,obt
27、ainmentofrelevantinformationinacomprehensiveandaccuratemanner,andfullconsultationandcoordination.决策承办单位根据需要对决策 事项涉及的人财物投入、资源 消耗、环境影响等成本和经济、 社会、环境效益进行分析预测。Thedecision-makingentityshallcomprehensivelyreviewthelaws,regulations,rulesandpoliciesrelatingtothedecision-makingmatters,soastoensurethatthedraft
28、decisioncomplieswithlawsandregulations,andisconsistentwithrelevantpolicies.Thedecision-makingentityshallanalyzeandpredictcost,economicandsocialandenvironmentalbenefitssuchastheinputofhuman,propertyandmaterialresources,resourceconsumption,andenvironmentalimpactinvolvedindecision-makingmattersasrequir
29、ed.有关方面对决策事项存在较大 分歧的,决策承办单位可以提 出两个以上方案。第十三条决策事项涉及 决策机关所属部门、下一级人 民政府等单位的职责,或者与 其关系紧密的,决策承办单位Wheretherearemajordifferencesbetweentherelevantpartiesondecision-makingmatters,thedecision-makingentitymayoffertwoormoreplans.Article 13 Wherethedecision-makingmattersinvolvethedutiesofadepartmentsubordinateto
30、thedecision-makingorganorthepeople,sgovernmentatthenextlower应当与其充分协商;不能取得 一致意见的,应当向决策机关 说明争议的主要问题,有关单 位的意见,决策承办单位的意 见、理由和依据。leveloranyotherentity,orarecloselyrelatedtosuchentity,thedecision-makingentityshallfullyconsultwiththerelevantentity;inthecaseoffailuretoreachaconsensus,itshallexplainthemainis
31、suesindisputetothedecision-makingorgan,theopinionsoftherelevantentity,andtheopinionsofthedecision-makingentityandrelevantreasonsandgrounds.第二节公众参与第十四条决策承办单位 应当采取便于社会公众参与的 方式充分听取意见,依法不予 公开的决策事项除外。Section2PublicParticipationArticle14Thedecision-makingentityshallfullysolicitopinionsintheformwidelyavail
32、ableforpublicparticipation,exceptdecision-makingmattersthatshallnotbedisclosedinaccordancewiththelaw.听取意见可以采取座谈会、听 证会、实地走访、书面征求意 见、向社会公开征求意见、问 卷调查、民意调查等多种方式。决策事项涉及特定群体利益 的,决策承办单位应当与相关 人民团体、社会组织以及群众 代表进行沟通协商,充分听取 相关群体的意见建议。Opinionsmaybesolicitedinsuchformsassymposiums,hearings,fieldvisits,writtensoli
33、citationofopinionsfromthepublic,questionnaires,andopinionpolls.第十五条决策事项向社 会公开征求意见的,决策承办 单位应当通过政府网站、政务 新媒体以及报刊、广播、电视 等便于社会公众知晓的途径, 公布决策草案及其说明等材 料,明确提出意见的方式和期 限。公开征求意见的期限一般 不少于30日;因情况紧急等原 因需要缩短期限的,公开征求Wherethedecision-makingmattersinvolvetheinterestsofaparticulargroup,thedecision-makingentityshallcomm
34、unicateandnegotiatewithrelevantpeoplesgroups,socialorganizations,andrepresentativesofthepeople,andfullysolicittheopinionsandsuggestionsofrelevantgroups.Article15Whereopinionsondecision-makingmattersaresolicitedfromthepublic,thedecision-makingentityshallpublishthedraftdecisionanditsexplanationandothe
35、rmaterialsthroughthegovernmentwebsite,newmediaofgovernmentaffairs,newspapersandperiodicals,radio,television,andothermeansaccessibletothepublic,andspecifythemethodsandperiodforofferingopinions.Theperiodforthepublicsolicitationofopinionsisgenerallynotlessthan30days;ifitisnecessaryto意见时应当予以说明。对社会公众普遍关心
36、或者专业 性、技术性较强的问题,决策 承办单位可以通过专家访谈等 方式进行解释说明。shortentheperiodduetourgentcircumstancesoranyotherreason,itshallbeexplainedwhenopinionsaresolicitedfromthepublic.第十六条决策事项直接 涉及公民、法人、其他组织切 身利益或者存在较大分歧的, 可以召开听证会。法律、法规、 规章对召开听证会另有规定 的,依照其规定。Fortheissuesofconcerntothepublicorissueswithahighdegreeofprofessionalo
37、rtechnicalrequirement,thedecision-makingentitymaymakeexplanationandinterpretationinsuchformsasexpertinterviews.决策承办单位或者组织听证会 的其他单位应当提前公布决策 草案及其说明等材料,明确听 证时间、地点等信息。Article16Wherethedecision-makingmattersdirectlyinvolvethevitalinterestsofcitizens,legalpersonsorotherorganizations,oriftherearemajordiffe
38、rences,ahearingmaybeconvened.Iftheconveningofahearingisotherwiseprovidedforbyanylaw,regulationorrule,suchlaw,regulationorruleshallprevail.需要遴选听证参加人的,决策 承办单位或者组织听证会的其 他单位应当提前公布听证参加 人遴选办法,公平公开组织遴 选,保证相关各方都有代表参 加听证会。听证参加人名单应 当提前向社会公布。听证会材 料应当于召开听证会7日前送 达听证参加人。Thedecision-makingentityoranyotherentitytha
39、torganizesthehearingshallpublishthedraftdecisionanditsexplanationandothermaterialsinadvance,andspecifythetimeandplaceofthehearingandotherinformation.Whereitisnecessarytoselecthearingparticipants,thedecision-makingentityoranyotherentitythatorganizesthehearingshallannouncethemethodsfortheselectionofhe
40、aringparticipantsinadvance,organizeselectioninafairandopenmanner,andensurethatallrelevantpartieshaverepresentativestoattendthehearing.Thelistofhearingparticipantsshallbeannouncedtothepublicinadvance.Hearingmaterialsshallbeserveduponhearingparticipantssevendaysbeforethehearingisconvened.第十七条听证会应当按Art
41、icle 17 Ahearingshallbeconvenedinpublicunderthefollowingprocedures:照下列程序公开举行:(1) Thedecision-makingentityintroducesthedraftdecision,thebasisandrelevantinformation.(一)决策承办单位介绍决策 草案、依据和有关情况;(2) Hearingparticipantsshallstatetheiropinions,conductinquiries,cross-examinationanddebates,andthedecision-makin
42、gentityorrelevantexpertsshallmakeinterpretationandexplanationwhennecessary.(二)听证参加人陈述意见, 进行询问、质证和辩论,必要 时可以由决策承办单位或者有 关专家进行解释说明;(3) Hearingparticipantsshallconfirmhearingrecordsandsigntheirnames.(三)听证参加人确认听证会 记录并签字。Article 18 Thedecision-makingentityshallsummarize,conductresearchanddemonstratetheopin
43、ionsofferedbyallpartiesofthesociety,fullyadoptreasonableopinions,andimprovedraftdecisions.Section 3 ExpertDemonstrationArticle19Fordecision-makingmatterswithahighdegreeofprofessionalortechnicalrequirement,thedecision-makingentityshallorganizeexpertsandprofessionalinstitutionstodemonstratethenecessit
44、y,feasibilityandScientificitythereof,amongothers,andprovidenecessaryguarantee.第十八条决策承办单位 应当对社会各方面提出的意见 进行归纳整理、研究论证,充 分采纳合理意见,完善决策草 案。第三节专家论证第十九条对专业性、技 术性较强的决策事项,决策承 办单位应当组织专家、专业机 构论证其必要性、可行性、科 学性等,并提供必要保障。专家、专业机构应当独立开展 论证工作,客观、公正、科学 地提出论证意见,并对所知悉 的国家秘密、商业秘密、个人 隐私依法履行保密义务;提供 书面论证意见的,应当署名、 盖章。Expertsa
45、ndprofessionalinstitutionsshallindependentlycarryoutthedemonstrationwork,offerdemonstrationopinionsinanobjective,impartialandscientificmanner,andperformtheobligationtokeepconfidentialstatesecrets,tradesecretsandpersonalprivacytowhichtheyhaveaccess;iftheyprovidewrittendemonstrationopinions,signatures
46、andsealsshallbeaffixedtosuchopinions.第二十条决策承办单位 组织专家论证,可以采取论证 会、书面咨询、委托咨询论证 等方式。选择专家、专业机构 参与论证,应当坚持专业性、 代表性和中立性,注重选择持 不同意见的专家、专业机构, 不得选择与决策事项有直接利 害关系的专家、专业机构。Article20Thedecision-makingentitymayorganizeexpertdemonstrationinsuchformsasdemonstrationmeetings,writtenconsultation,andentrustedconsultation
47、anddemonstration.Whenselectingexpertsandprofessionalinstitutionstoparticipateindemonstration,professionalism,第二十一条省、自治区、 直辖市人民政府应当建立决策 咨询论证专家库,规范专家库 运行管理制度,健全专家诚信 考核和退出机制。representativenessandneutralityshallbeadheredto,attentionshallbepaidtoselectingexpertsandprofessionalinstitutionswithdifferentopi
48、nions,andexpertsandprofessionalinstitutionsthathavedirectinterestrelationswithdecision-makingmattersshallnotbeselected.市、县级人民政府可以根据需 要建立决策咨询论证专家库。Article21People,sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentshallestablishanexpertdatabasefordecision-maki
49、ngconsultationanddemonstration,standardizemanagementrulesfortheoperationoftheexpertdatabase,andimprovethemechanismfortheassessmentofexpertsintegrityandexit.决策机关没有建立决策咨询论 证专家库的,可以使用上级行 政机关的专家库。Municipalandcountypeoplesgovernmentsmayestablishanexpertdatabasefordecision-makingconsultationanddemonstrationasre
