1、2019版工程预付款保函（中英文对照）中国对外承包工程商会制定FormulatedbytheChinaInternationalContractorsAssociation保函号：GuaranteeNo.:致：(甲方/受益人)To:(PartyA/beneficiary)本保函作为你方（受益人）与（申请人）于一年一月一日就项目（以下简称项目）提供（以下简称货物或服务）签订的合同（合同编号：_）（以下简称合同）的预付款保函。（开立本保函的银行，以下简称银行）承诺有资格开立本保函。ThisguaranteeservesasanadvancepaymentGuaranteeinrespectofth
2、econtract（ContractNo._）（hereinafterreferredtoastheContract)forthesupplyof(hereinafterreferredtoasthegoodsorservices)betweenyou(thebeneficiary)and(theapplicant)forthesupplyof(hereinafterreferredtoasthegoodsorservices)on(hereinafterreferredtoastheProject)onthedateofdaymonthyear.(thebankissuingthisGuar
3、antee,hereinafterreferredtoasthebank)undertakestobeeligibletoissuethisGuarantee.本银行已接受申请人的请求，愿就你方收回合同项下的预付款向你方提供无条件、不可撤销、见索即付、连带责任的保证。本银行、本银行的继承人和受让人将无追索地向你方以人民币(货币名称)支付总额不超过(金额)，相当于合同总价一%的金额，保证你方能根据合同约定全部收回支付给申请方的预付款。TheBankhasacceptedtheapplicantsrequesttoprovideyouwithanunconditional,irrevocable,
4、ondemandjointandseveralliabilityguaranteefortherecoveryoftheadvancepaymentunderthecontract.TheBank,itssuccessorsandassignswillpayyouzwithoutrecourse,atotalamountnotexceeding(amount)inRMB(currencyname),whichisequivalentto%ofthetotalcontractprice,toensureyoucanfullyrecovertheadvancepaymentpaidtotheapp
5、licantinaccordancewiththecontract.在本保函有效期内，只要本银行收到你方发出的未收回合同项下支付给申请人的全部或部分预付款的书面通知，无论申请人是否提出异议，本银行应立即按你方提出的要求在收到你方书面通知后5个工作日内将不超过上述金额的款项按你方通知约定的方式付给你方。本保函项下的任何支付应为免税和净值。对于现有或将来的税收、收费、费用扣减或预提税款，不论这些款项是何种性质和由谁征收，都不应从本保函项下的支付中扣除。DuringthetermofthisGuarantee,whenevertheBankreceiveswrittennoticefromyouth
6、atyouhavenotrecoveredallorpartoftheadvancepaymentmadetotheapplicantunderthecontractwhetherornottheApplicantobjects,theBankshallimmediatelypaytoyouzatyourrequest,withinfiveworkingdaysuponreceiptofyourwrittennotice,anamountnotexceedingthesaidamountinthemannerstipulatedinyournotice.Anypaymentsunderthis
7、GuaranteeshallbetaxfreeandnetNodeductionshallbemadefrompaymentsunderthisGuaranteeinrespectofexistingorfuturetaxes,charges,deductionsforexpensesorwithholdingtaxesofwhatevernatureandbywhomsoeverlevied.本保函独立于合同，本银行承诺任何对合同条款的修改、变更、补充以及你方采取的任何其他行为，均不能改变、减轻、解除或免除本银行在本保函项下的连带保证责任。有关上述变化、补充或修改也无须通知本银行。Thisg
8、uaranteeisindependentofthecontractandtheBankundertakesthatanymodification,alteration,additiontothetermsofthecontractandanyotheractiontakenbyyoushallnotalter,reduce,dischargeorexcludetheBanksjointandseveralliabilityunderthisguarantee.NorshalltheBankberequiredtobenotifiedofsuchchanges,additionsormodif
9、ications.本保函自签发之日起生效，至（日期）。如果在本保函到期日前的一个月时，申请人尚未履约完毕,那么申请人必须（按照你方的要求）立即申请对本保函进行与你方要求一致的延期，延长的期限必须使本保函在履约期间内保持有效。ThisGuaranteeshallbeeffectivefromthedateofissueuntil（date）.IfbyonemonthpriortotheexpirydateofthisGuaranteetheapplicanthasnotcompletedperformance,thentheapplicantshould(atyourrequest)immedi
10、atelyapplyforanextensionofthisGuaranteefortheperiodconsistentwithyourrequirements,whichshouldkeepthisGuaranteeinforceforthedurationoftheperformanceperiod.如果因申请人或者任何其他原因使得本保函在到期日前15天尚未能按照上述要求办理完延期，那么本银行在收到你方提交的书面通知后,应立即向你方支付本保函项下的担保金额。因本保函发生的任何纠纷应提交开具银行所在地有管辖权的人民法院裁决。Ifzduetotheapplicantorforanyother
11、reason,theextensionofthisguaranteeisnotcompleted15dayspriortotheexpirydateinaccordancewiththeaboverequirements,thentheBankshallpaytheamountguaranteedhereundertoyouimmediatelyuponreceiptofwrittennoticefromyou.AnydisputearisingoutofthisLetterofGuaranteeshallbereferredtothePeoplesCourtofCompetentjurisd
