2、家的主 权、统一、领土完整和澳门的安 全，根据宪法和澳门特别行政区基 本法，制定本法。第二条 中央人民政府派驻澳 门特别行政区负责防务的军队，称 中国人民解放军驻澳门部队（以下1.awofthePeople,sRepublicofChinaonGarrisoningtheMacaoSpecialAdministrativeRegion(Adoptedatthe10thMeetingoftheStandingCommitteeoftheNinthNationalPeoplesCongressonJune28,1999andpromulgatedbyOrderNo.18ofthePresident
3、ofthePeoplesRepublicofChinaonJune28,1999)ContentsChapterIGeneralProvisionsArticle1ThisLawisenactedinaccordancewiththeConstitutionandtheBasicLawoftheMacaoSpecialAdministrativeRegiontoensurethelawfulperformanceoffunctionsandresponsibilitiesbythemilitaryforcesstationedbytheCentralPeoplesGovernmentinthe
4、MacaoSpecialAdministrativeRegionfordefence,andtomaintainthesovereignty,unityandterritorialintegrityoftheStateandthesecurityofMacao.Article2ThemilitaryforcesstationedbytheCentralPeoplesGovernmentintheMacaoSpecialAdministrativeRegionfordefenceshallbedesignatedastheMacaoGarrisonoftheChinesePeoplesLiber
5、ationArmy(hereinafterreferredtoastheMacaoGarrison).TheMacaoGarrisonshallbesubjecttothedirectionoftheCentralMilitaryCommissionofthePeoples和峋门q7)RepublicofChina.ItscompositionandnumberofmembersshallbedeterminedaccordingtotheneedforthedefenceoftheMacaoSpecialAdministrativeRegion.澳门驻军由中华人民共和国中Hk一工曰人行D，r

9、ties:(1)preparingagainst务职责：andresistingaggression,andsafeguardingthesecurityoftheMacaoSpecialAdministrativeRegion;(2) carrying out defence duties;()防备和抵抗侵略，保卫澳门特别行政区的安全;(3) administering military facilities; and(4) handling foreign-related military affairs.（二）担负防卫勤务;（三）管理军事设施;（四）承办有关的涉外军事事宜。第七条 在全国
10、人民代表大会 常务委员会决定宣布战争状态或者 因澳门特别行政区内发生澳门特别 行政区政府不能控制的危及国家统 一或者安全的动乱而决定澳门特别 行政区进入紧急状态时，澳门驻军Article 7 In the event that the Standing Committee of the National People,s Congress decides to declare a state of war or, by reason of turmoil within the Macao Special Administrative Region which endangers nationa
11、l unity or security and is beyond the control of the Government of the Region, decides that the Region is in a state of emergency, the Macao Garrison shall perform its duties in accordance with the provisions of the national laws that the Central People,s Government decides to apply in the Region.根据

15、fofficialduties.取措施予以制止。第三章澳门驻军与澳门特别ChapterIIIRelationshipBetweentheMacaoGarrisonandtheGovernmentoftheMacaoSpecialAdministrativeRegion行政区政府的关系第十条澳门特别行政区政府Article10TheGovernmentoftheMacaoSpecialAdministrativeRegionshallsupporttheMacaoGarrisoninits应当支持澳门驻军履行防务职责，performanceofdefencefunctionsandrespons
16、ibilitiesand保障澳门驻军和澳门驻军人员的合guaranteethelawfulrightsandinterestsoftheMacaoGarrisonanditsmembers.TheMacaoSpecialAdministrative法权益。RegionshallguaranteebylawtherightsandimmunitiestheMacaoGarrisonanditsmembersareentitledtoenjoywhen澳门特别行政区以法律保障澳performingtheirfunctionsandresponsibilities.门驻军和澳门驻军人员履行职责时Th

27、rticle 14 WheretheMacaoSpecialAdministrativeRegionaskstheCentralPeoplesGovernmentforassistancefromtheMacaoGarrisoninthemaintenanceofpublicorderorindisasterreliefandsuchrequestisapprovedbytheCentralPeople,sGovernment5theMacaoGarrisonshallcallouttroopsinaccordancewiththeorderoftheCentralMilitaryCommis
28、siontocarryouttasksofassistanceinthemaintenanceofpublicorderorindisasterrelief,anduponcompletionofthetasks,thetroopsshallreturntotheirbarracksimmediately.ThetroopsoftheMacaoGarrisonwhoarecalledouttoassistinthemaintenanceofpublicorderorindisasterreliefshall,underthearrangementoftheGovernmentoftheIeEj

31、力。Article 15 TheMacaoGarrisonandtheGovernmentoftheMacaoSpecialAdministrativeRegionshallestablishnecessaryliaisontodealwithmattersconcerningtheMacaoGarrisonthroughconsultation.第四章澳门驻军人员的义务ChaPterWObligationsofandDisciplineforMembersoftheMacaoGarrison与纪律第十六条澳门驻军人员应当履行下列义务：（一）忠于祖国，履行职责，Article 16 Membe
32、rsoftheMacaoGarrisonshallfulfillthefollowingobligations:(1)tobeloyaltotheirmotherland,performtheirfunctionsandresponsibilities,maintainthesecurity,honorandinterestsoftheirmotherland,andsafeguardthesecurityofMacao;维护祖国的安全、荣誉和利益，维(2)toabidebynationallawsandthelawsoftheMacaoSpecial护峋门的、：全Administrative
33、Region,andobservemilitarydiscipline;(3) torespecttheorgansofpoliticalpower,thesocialsystemand(二)遵守全国性的法律和澳thewaysoflifeoftheMacaoSpecialAdministrativeRegion;门特别行政区的法律，遵守军队的小SCharieh+hcehlicCrCea小,CfMacacCCACT(4) tocherishthepublicpropertyoftheMacaoSpecial纪律；AdministrativeRegionandtheprivatepropertyo

37、sciplinarysanction.澳门驻军人员违反军队纪律的，给予纪律处分。j-F.D乩一jChapterVJudicialJurisdictionoverMembersoftheMacao第五章澳门驻军人员的司法h管辖第二十条 澳门驻军人员犯罪 的案件由军事司法机关管辖；但 是，澳门驻军人员非执行职务的行 为，侵犯澳门居民、澳门驻军以外 的其他人的人身权、财产权以及其 他违反澳门特别行政区法律构成犯 罪的案件，由澳门特别行政区司法 机关管辖。军事司法机关和澳门特别行政 区司法机关对各自管辖的澳门驻军 人员犯罪的案件，如果认为由对方 管辖更为适宜，经双方协商一致 后，可以移交对方管辖。军事
38、司法机关管辖的澳门驻军 人员犯罪的案件中，涉及的被告人 中的澳门居民、澳门驻军以外的其 他人，由澳门特别行政区法院审 判。第二十一条 澳门特别行政区 执法人员依法拘捕的涉嫌犯罪的人 员，查明是澳门驻军人员的，应当 移交澳门驻军羁押。被羁押的人员GarrisonArticle20CriminaloffencescommittedbymembersoftheMacaoGarrisonshallbeunderthejurisdictionofthemilitaryjudicialorgans;butoffenceswhicharecommittedbymembersoftheMacaoGarriso
39、nwhennotperformingtheirofficialdutiesandinsuchviolationofthepersonalrightorpropertyrightofMacaoresidentsorotherpersonswhoarenotoftheMacaoGarrisonorotherwiseinsuchcontraventionofthelawsoftheMacaoSpecialAdministrativeRegionastoconstitutecrimes,shallbesubjecttothejurisdictionofthejudicialorgansoftheMac
40、aoSpecialAdministrativeRegion.ThemilitaryjudicialorgansandthejudicialorgansoftheMacaoSpecialAdministrativeRegionmaytransfertotheotherpartythecriminalcasesofmembersoftheMacaoGarrisonundertheirrespectivejurisdictioniftheyconsiderittobemoreappropriatefortheotherpartytoexercisejurisdiction,providedthatc
41、onsensusisreachedthroughmutualconsultation.MacaoresidentsorotherpersonsnotoftheMacaoGarrisoninvolvedasdefendantsinthecriminalcasesofmembersoftheMacaoGarrisonunderthejurisdictionofthemilitaryjudicialorgansshallbetriedbythecourtsoftheMacaoSpecialAdministrativeRegion.Article21Anypersonwhoislawfullyarre
42、stedasasuspectedoffenderbylaw-enforcingofficersoftheMacaoSpecialAdministrativeRegion,onceconfirmeduponinvestigationtobeamemberoftheMacaoGarrison,shallbehandedovertotheMacaoGarrisonforcustody.Jurisdictionoverthecaseinvolvingthepersonincustodyshallbedeterminedin所涉及的案件，依照本法笫二十条accordancewiththeprovisio
43、nsinArticle20ofthisLaw.的规定确定管辖。第二十二条澳门驻军人员被澳门特别行政区法院判处剥夺或者限制人身自由的刑罚或者保安处分的，依照澳门特别行政区的法律规定送交执行；但是，澳门特别行政区有关执法机关与军事司法机关对执行的地点另行协商确定的除外。Article22AnymemberoftheMacaoGarrisonsentencedbyacourtoftheMacaoSpecialAdministrativeRegiontocriminalpunishmentorsecuritymeasurewhichdepriveshimoforrestrictshispersonal
44、freedomshallbedeliveredforsentenceenforcementaccordingtotheprovisionsofthelawsoftheMacaoSpecialAdministrativeRegion,exceptforthecaseinwhichtheplaceofsentenceenforcementisotherwisedeterminedbyarelevantlaw-enforcingorganoftheMacaoSpecialAdministrativeRegionandthemilitaryjudicialorganoftheMacaoGarrison
45、throughconsultation.第二十三条澳门驻军人员违反澳门特别行政区的法律，侵害澳Article23WhereanymemberoftheMacaoGarrison,incontraventionofthelawsoftheMacaoSpecialAdministrativeRegion,infringesthecivilrightsofanyMacaoresidentsor门居民、澳门驻军以外的其他人的民事权利的，当事人可以通过协otherpersonsnotoftheMacaoGarrison,thepartiesconcernedmayseeksettlementthroug
46、hconsultationormediation;iftheyareunwillingorfailtoreachsettlement商、调解解决；不愿通过协商、调解解决或者协商、调解不成的，被侵权人可以向法院提起诉讼。澳门驻军人员非执行职务的行为引起的民事侵权案件，由澳门特别行政区法院管辖；执行职务的行为引起的民事侵权案件，由中华人民共和国最高人民法院管辖，侵权行为的损throughconsultationormediation,theinfringedpartymaybringanactioninthecourt.Casesoftortarisingfromactscommittedbyme
47、mbersoftheMacaoGarrisonwhennotperformingtheirofficialdutiesshallbesubjecttothejurisdictionofthecourtsoftheMacaoSpecialAdministrativeRegion;casesoftortarisingfromactscommittedbymembersoftheMacaoGarrisonwhenperformingtheirofficialdutiesshallbesubjecttothejurisdictionoftheSupremePeoplesCourtofthePeoplesRepublicofChina,andcompensationforanylossorinjuryincurredbyactsoftortshallbegovernedbythelawsoftheMacaoSpecialAdministrativeRegion.害赔偿适用澳门特别行政区法律。第二十四条澳门驻军的机关或者单位在澳门特别行政区与澳门Article 24 WhereanycontractualdisputeariseswithintheMacaoSpec
