6、mplementingtheLawofthePeoplesRepublicofChinaonthePreventionandControlofEnvironmentPollutionCausedbySolidWastesandotherlawsandregulations,improvingthecapacityforregulation,utilizationanddisposalofhazardouswastes,andeffectivelypreventingandcontrollingtheenvironmentalandsafetyriskspresentedbyhazardousw

7、astes.I.Generalrequirements1. Guidingideology.XiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewErashallbetheguidance,thespiritofthe19lhCPCNationalCongressand(heSecond,Third,FourthandFifthPlenarySessionsofthe19thCPCCentralCommitteeshallbefullyimplemented,XiJinpingThoughtonEcologicalCiviliz

8、ationshallbethoroughlyimplemented,thedecisionsandarrangementsoftheCPCCentralCommitteeandtheStaleCouncilandtherequirementsoftheNationalEcologicalandEnvironmentalProtectionConferenceshallbecompliedwith,precision,scientificandlawfulremediationofpollutionshallbeadheredto,withcontinuousimprovementofecolo

9、gicalandenvironmental强化危险废物监管和利用处置能力改革实施方案为深入贯彻党中央、国务院决策部署,落实中华人民共和国固体废物污染环境防治法等法律法规规定,提升危险废物监管和利用处置能力,有效防控危险废物环境与安全风险,制定本方案。一、总体要求(一)指导思想。以习近平新时代中国特色社会主义思想为指导,全面贯彻党的十九大和十九届二中、三中、四中、五中全会精神,深入落实习近平生态文明思想,按照党中央、国务院决策部署和全国生态环境保护大会要求,坚持精准治污、科学治污、依法治污,以持续改善生态环境质量为核心,以有效防控危险废物环境与安全风险为目标,深化体制机制改革,着力提升危险废物监

15、asonablelayout,andoptimizationof一坚持多元共治,着力防控风险。强化政府引导与支持, 压实企业主体责任,充分发挥社会组织和公众监督作用, 实行联防联控联治,严守危险废物环境与安全风险底线。()工作目标。到2022年底,危险废物监管体制 机制进一步完善,建立安全监管与环境监管联动机制;危 险废物非法转移倾倒案件高发态势得到有效遏制。基本补 齐医疗废物、危险废物收集处理设施方面短板,县级以上 城市建成区医疗废物无害化处置率达到99与以上,各省(自 治区、直辖市)危险废物处置能力基本满足本行政区域内 的处置需求。到2025年底,建立健全源头严防、过程严管、后果严惩的 危

Workgoals.Bytheendof2022,hazardouswasteregulatorysystemsandmechanismswillhavebeenfurtherimproved,andamechanismforinteractionbetweensafelyregulationandenvironmentalregu

18、lationwillhavebeenestablished;andthesituationoframpantcasesinvolvingillegalmovementanddumpingofhazardouswasteswillhavebeeneffectivelycurbed.Shortcomingsintheaspectsofmedicalwasteandhazardouswastecollectionandtreatmentfacilitieswillbebasicallyaddressed,theharmlessdisposalrateofmedicalwastesinthebuilt

19、-upareasofcitiesatorabovethecountylevelwillhavereachednotlessthan99%,andthecapacityfordisposalofhazardouswastesofallprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentwillhavebasicallymetthedemandfordisposalintheirrespectiveadministrativeareas.Bytheendof2025,ahazardouswaste

20、regulatorysystemfeaturingstrictpreventionatsource,strictmanagementthroughouttheprocess,andseverepunishmentforconsequenceswillhavebeenestablishedandimproved.Thecapacityforutilizationanddisposalofhazardouswasteswillhavebeenfullysafeguarded,andthetechnicalandoperationallevelwillhavebeenfurtherimproved.

21、II.Improvinghazardouswasteregulatorysystemsandmechanisms4. Allregionsandauthoritiesshallfulfilltheirdulyofregulationofhazardouswastesaccordingtothedivisionoflabor.Thestateshallcoordinatetheformulationofhazardouswastemanagementguidelinesandpolicies,andthelocalpeoplesgovernmentsatalllevelsshallbegener

22、allyresponsibleforthemanagementoflocalhazardouswastes.Developmentandreform,industryandinformationtechnology,ecologyandenvironment,emergencymanagement,publicsecurity,transport,health,housingandurban-ruraldevelopment,customsandotherrelevantauthoritiesshallfulfilltheirregulatorydutiesintheaspectsofutil

23、izationanddisposalofhazardouswastes,preventionandcontrolofenvironmentalpollution,worksafely,transportsafety,andhealthandepidemicprevention,amongothers.Coordinationandcommunicationamongauthoritiesshallbestrengthenedtojoinworkforces.(TheMinistryofEcologyandEnvironment,theNationalDevelopmentandReformCo

24、mmissiontheMinistryofIndustryandInformationTechnology,theMinistryofPublicSecurity,theMinistryofHousingandUrban-RuralDevelopment,theMinistryofTransport,theNationalHealthCommission,theMinistryofEmergencyManagement,theGeneralAdministrationofCustomsandotherauthoritiesandthelocalpeoplesgovernmentsatallle

25、velsshallberesponsiblefor二、完善危险废物监管体制机制(四)各地区各部门按分工落实危险废物监管职责。国家统筹制定危险废物治理方针政策,地方各级人民政府对本地区危险废物治理负总责。发展改革、工业和信息化、生态环境、应急管理、公安、交通运输、卫生健康、住房城乡建设、海关等有关部门要落实在危险废物利用处置、污染环境防治、安全生产、运输安全以及卫生防疫等方面的监管职责。强化部门间协调沟通,形成工作合力。(生态环境部、国家发展改革委、工业和信息化部、公安部、住房城乡建设部、交通运输部、国家卫生健康委、应急部、海关总署等部门及地方各级人民政府负责落实。以下均需地方各级人民政府负责落

27、rDelta,Chengdu-Chongqing,andotherregionswillhaveestablishedandimprovedacooperationmechanism,strengthenedthesharingofinformationonmanagementofhazardouswastesandjointlawenforcement,andachievedcomplementaryadvantagesintheconstruction,operationandmanagementofcentralizedhazardouswastedisposalfacilities.(

28、TheMinistryofEcologyandEnvironmentshalltakethelead,andtheMinistryofPublicSecurityandtheMiniSIryofTransport,amongothers,shallparticipate)6. Implementingthemainresponsibilityofenterprises.Themainresponsibleperson(legalrepresentativeandactualcontroller)ofahazardouswastegeneration,collection,storage,tra

29、nsport,utilizationordisposalenterprise(hereinaftercollectivelyreferredtoasthehazardouswaste-relatedenterprise)shallbetheprimarj,personresponsibleforpreventionandcontrolofenvironmentalpollutioncausedbyhazardouswastesandworksafetyandstrictlyimplementlaws,regulationsandsystemsinrelationtothepreventiona

30、ndcontrolofenvironmentalpollutioncausedbyhazardouswastesandworksafety.(TheMinistrj,ofEcologyandEnvironment,theMinistryofPublicSecurity,theMiniStryofTransport,andtheMinistryofEmergencyManagement,amongothers,shall(五)建立危险废物环境风险区域联防联控机制。2022年底前,京津冀、长三角、珠三角和成渝地区等区域建立完善合作机制,加强危险废物管理信息共享与联动执法,实现危险废物集中处置设施建

31、设和运营管理优势互补。(生态环境部牵头,公安部、交通运输部等参与)(六)落实企业主体责任。危险废物产生、收集、贮存、运输、利用、处置企业(以下统称危险废物相关企业)的主要负责人(法定代表人、实际控制人)是危险废物污染环境防治和安全生产第一责任人,严格落实危险废物污染环境防治和安全生产法律法规制度。(生态环境部、公安部、交通运输部、应急部等按职责分工负责)危险废物相关企业依法及时公开危险废物污染环境防治信息,依法依规投保环境污染责任保险。(生态环境部、银保监会等按职责分工负责)(七)完善危险废物环境管理信息化体系。依托生 态环境保护信息化工程,完善国家危险废物环境管理信息 系统,实现危险废物产生

32、情况在线申报、管理计划在线备 案、转移联单在线运行、利用处置情况在线报告和全过程 在线监控。开展危险废物收集、运输、利用、处置网上交 易平台建设和第三方支付试点。鼓励有条件的地区推行视 频监控、电子标签等集成智能监控手段,实现对危险废物 全过程跟踪管理,并与相关行政机关、司法机关实现互通 共享。(生态环境部牵头,国家发展改革委、财政部等参 与)beresponsibleaccordingtothedivisionofduties)Hazardouswaste-relatedenterprisesshalltimelyandpubliclydiscloseinformationontheprev

Improvingtheframeworkofinformatizationofenvironmentalmanagementofhazardouswastes.Inrelianceontheecologicalandenvironmentalprotectioninformatizationproject,theNationalHazardousWasteEnvironmentalManagementInformationSystemshallbeimprovedtoachieveonlinereportingofhazardouswastegen

35、eration,onlinefilingofmanagementplans,onlineprocessingofmovementmanifests,onlinereportingofutilizationanddisposal,andonlinemonitoringthroughouttheprocess.Theconstructionofonlinetradingplatformsforthecollection,transport,utilizationanddisposalofhazardouswastesandapilotprogramofthird-partypaymentshall

36、belaunched.Regionswithgoodconditionsshallbeencouragedtopromoteintegratedintelligentmonitoringmeanssuchasvideosurveillanceandelectronictagstoachievethetrackingandmanagementofhazardouswastesthroughouttheprocessandintercommunicationandsharingwithrelevantadministrativeorgansandjudicialorgans.(TheMinistr

37、yofEcologyandEnvironmentshalltakethelead,andtheNationalDevelopmentandReformCommissionandtheMinistryofFinance,amongothers,shallparticipate)三、强化危险废物源头管控(八)完善危险废物鉴别制度。动态修订国家危 险废物名录,对环境风险小的危险废物类别实行特定环 节豁免管理,建立危险废物排除管理清单。2021年底前制 定出台危险废物鉴别管理办法,规范危险废物鉴别程序和 鉴别单位管理要求。(生态环境部牵头,国家发展改革 委、公安部、交通运输部等参与)(九)严格环境准入

41、tassessmentsshallbeconductedforconstruction,reconstructionandexpansionprojectsinaccordancewiththelaw,andtheconcurrentdesign,constructionanduseoffacilitiesforpreventionandcontrolofenvironmentalpollutioncausedbyhazardouswastesshallbestrictlymanaged.Theapprovedenvironmentalimpactassessmentdocumentsforh

42、azardouswaste-relatedconstructionprojectsinkeyindustriesshallbereviewedinaccordancewithlawsandregulations.Thesystemforlicensingdischargeofindustrialhazardouswastesshallbeimplementedinaccordancewiththelaw.Thewell-regulatedenvironmentalmanagementofhazardouswastesshallbeadvanced.(TheMinistryofEcologyan

Promotingreductionatsource.Theresearchonanddevelopmentandpromotionofproductionprocessesandequipmentthatreducethegenerationofindustrialhazardouswastesanddiminishtheharmfulnessofindustrialhazardouswastesshallbesupportedsoastopromotethereductioningenerationofhazardous

47、hazardouswastesgeneratedbymicroandsmall-sizedenterprises,scientificresearchinstitutions,andschools,amongothers.Apilotprogramofthecentralizedcollectionandstorageofhazardouswastesinindustrialparksshallbelaunched.Theconstructionofmodelprojectsfortheclassifiedcollectionandpretreatmentoflaboratoryhazardo
