10、务院有关决策部署，现就知识产权领域中央与地方财政事权和支出责任划分改革制定如下方案。一、总体要求以习近平新时代中国特色社会主义思想为指导，深入贯彻 落实党的二十大精神，立足新发展阶段，完整、准确、全 面贯彻新发展理念，加快构建新发展格局，着力推动高质 量发展，坚定实施创新驱动发展战略，牢固树立保护知识 产权就是保护创新的理念，健全充分发挥中央和地方两个 积极性体制机制，厘清权责关系，适当加强中央在知识产 权保护方面财政事权，减少并规范中央和地方共同财政事 权，赋予地方更多自主权，优化政府间事权和财权划分， 建立权责清晰、财力协调、区域均衡的中央和地方财政关 系，形成稳定的各级政府事权、支出责任
11、和财力相适应的 制度，全面加强知识产权保护工作，健全新领域新业态知GeneralOfficeoftheStateCouncil识产权保护制度，维护知识产权领域国家安全，加强知识 产权法治保障，推动进一步提升知识产权创造、运用、保 护、管理和服务水平，为实施创新驱动发展战略和知识产 权强国战略、推动高质量发展提供有力支撑。二、主要内容（一）知识产权宏观管理将制定实施国家知识产权战略、规划、政策，制定知识产 权领域法律、行政法规、司法解释、部门规章等，构建数 据知识产权保护规则，推动建立数据知识产权保护行业规范，知识产权强国建设监测评估，全国性知识产权统计调relationshipbetweenp

13、shipbetweentheCentralGovernmentandlocalgovernmentsbuiltonclearlydefinedpowersandresponsibilities,appropriatefinancialresourceallocationandgreaterbalanceamongregions,formastablesysteminwhichtheadministrativepowersandexpenditureresponsibilitiesofgovernmentsatalllevelsarecommensuratewiththeirnancialres
14、ources,comprehensivelystrengthentheprotectionofIPRs,improvetheIPRprotectionsystemfornewfieldsandnewbusinessforms,safeguardnationalsecurityinthefieldofIPRs,strengthenthelegalprotectionofIPRs,promotethefurtherimprovementofthelevelsofIPRcreation,use,protection,managementandservices,andprovidestrongsupp
15、ortfortheimplementationoftheinnovation-drivendevelopmentstrategyandthestrategytomakeChinastrongonIPRsandthepromotionofhigh-qualitydevelopment.11.MainContent(1) Macro-managementofIPRsThedevelopmentandimplementationofnationalIPRstrategies,plans,andpolicies,thedevelopmentoflaws,administrativeregulation

18、Rstrategies,plans,andpolicies,thedevelopmentoflocalregulationsandlocalrulesinthefieldofIPRs,andtheIPRstatisticalsurvey,analysisandreleaseshallbeconfirmedasthefinancialpowersoflocalgovernments,andlocalgovernmentsshallassumeexpenditureresponsibilities.(2) GrantingandconfirmationofIPRs将专利、商标、地理标志、集成电路布
19、图设计、植物新品 种权等涉及的审查注册登记和复审无效，计算机软件著作 权、外国作者或其他著作权人作品、港澳台作者或其他著 作权人作品的登记，特殊标志、奥林匹克标志的登记备 案，专利、商标审查协作体系和审查能力建设，确认为中 央财政事权，由中央承担支出责任。Theexaminationandregistrationandthereexaminationandinvalidationrelatedtopatents,trademarks,geographicalindications,layoutdesignsofintegratedcircuits,andrightstonewvarieties

21、temandexaminationcapacityshallbeconfirmedasfinancialpowersoftheCentralGovernment,andtheCentralGovernmentshallassumeexpenditureresponsibilities.TheregistrationofworksofdomesticauthorsorothercopyrightholdersshallbeconfirmedasthefinancialpowerssharedbytheCentralandlocalgovernments,andtheCentralandlocal
22、governmentsshallrespectivelyassumeexpenditureresponsibilities.Asfortheregistrationhandledbythecopyrightadministrationdepartmentofthestate,theCentralgovernmentshallassumeexpenditureresponsibilities;andasfortheregistrationhandledbylocalcopyrightadministrationdepartments,localgovernmentsshallassumeexpe
23、nditureresponsibilities.(3) PromotionoftheuseofIPRsThebuildingofanationalIPRoperationservicesystemandtheguidanceonIPRtransactionnorms,thepledgeregistrationofpatents,trademarks,andcopyrights,theannouncementoftransferregistrationofrightstonewvarietiesofplants,patentlicensingrecordationandtransferregis
24、tration,trademarklicensingrecordationandtransferconfirmation,thecompulsorylicensingofpatentrightsandtherightstonewvarietiesofplants,openpatentlicensingstatementreviewanddisputeresolution,theregistrationofcontractsonthepublicationofoverseasaudio-visualrecordings,theenhancementofpatentnavigationaccord
25、ingtoindustryfields,theguidanceandregulationofthenationalassessmentofIPRintangibleassets,theregulationofthenationalIPRserviceindustry,thepracticinglicensingofpatentagenciesandtheapprovaloftheformationofresidentrepresentativeofficesinChinabyforeignpatentagencies,patentagentexaminationorganizationanda
26、ccreditation,therecordationoftrademarkagencies,theinvestigationandhandlingofmajorpatentand将国内作者或其他著作权人作品的登记，确认为中央与地方共同财政事权，由中央与地方分别承担支出责任.其中，国家著作权管理部门办理的登记，由中央承担支出责任：地方著作权管理部门办理的登记，由地方承担支出责任。(三)知识产权运用促进将全国性知识产权运营服务体系建设和知识产权交易规范指导，专利、商标、著作权质押登记，植物新品种权转让登记公告，专利许可备案和转让登记，商标许可备案和转让核准，专利、植物新品种权强制许可，专利开放许
27、可声明审查和纠纷调解，出版境外音像制品合同登记，按产业领域加强专利导航，指导和规范全国性知识产权无形资产评估，全国知识产权服务业监管，专利代理机构执业许可和外国专利代理机构在中国境内设立常驻代表机构审批，专利代理师考试组织和资格认定，商标代理机构备案，重大专利商标代理监管案件查办，著作权集体管理组织及其分支机构的设立审批，著作权涉外机构、国(境)外著作权认证机关、外国和国际著作权组织在华设立代表机构审批，确认为中央财政事权，由中央承担支出责任。trademarkagencyregulationcases,theapprovaloftheformationofcollectivemanageme

29、dtheCentralgovernmentshallassumeexpenditureresponsibilities.将地方性知识产权转移转化促进和知识产权交易运营监督 管理，地方性重大经济科技活动知识产权评议，出版外国 图书合同登记、出版和复制境外电子出版物和计算机软件 合同登记、复制境外音像制品委托合同登记，向国外申请 植物新品种权登记，结合本地区产业发展开展专利导航， 地方知识产权服务业监管，承办本行政区域内专利代理师 资格考试考务工作，确认为地方财政事权，由地方承担支 出责任。将著作权许可和转让备案，确认为中央与地方共同财政事 权，由中央与地方分别承担支出责任。其中，国家著作权 管理
30、部门办理的备案，由中央承担支出责任；地方著作权ThepromotionoflocalIPRtransferandtransformationandthesupervisionandmanagementofIPRtradingandoperation,thereviewofIPRsinlocalmajoreconomicandtechnologicalactivities,theregistrationofcontractsforpublishingforeignbooks,theregistrationofcontractsforthepublicationandreproductionofo
31、verseaselectronicpublicationsandcomputersoftware,andtheregistrationofcommissioncontractsforreproductionofoverseasaudio-visualrecordings,theregistrationofapplicationsforrightstonewvarietiesofplantsabroad,thepatentnavigationconductedbasedontheindustrialdevelopmentoflocalregions,theregulationofthelocal
32、IPRserviceindustry,andtheundertakingofpatentagentqualicationexaminationsandexaminationaffairswithintheirrespectiveadministrativeregionsshallbeconfirmedasthefinancialpowersoflocalgovernments,andlocalgovernmentsshallassumeexpenditureresponsibilities.Therecordationofcopyrightlicensingandtransfershallbe
33、confirmedasthejointfinancialpowersoftheCentralandlocalgovernments,andtheCentralandlocalgovernmentsshallassumeexpenditureresponsibilitiesrespectively.Asfortherecordationhandledbythecopyrightadministrationdepartmentofthestate,theCentralGovernmentshallassumeexpenditureresponsibilities;andasfortherecord
34、ationhandledbylocalcopyrightadministrationdepartments,localgovernmentsshallassumeexpenditureresponsibilities.(4) IPRprotectionThebuildingofanationalIPRprotectionsystem,thebuildingofanationalmechanismtorrespondingtoforeign-relatedIPRdisputes,nationalIPRprotectionstatusevaluationandperformancesupervis
35、ionandassessment,theorganizationofnationalspecialcampaignsforIPRprotection,theorganizationandsupervisionoftheinvestigationandhandlingofcasesonmajorviolationsofIPRlawswhichhaveamaterialimpactnationwideoracrossregions,theCustomsprotectionofIPRs,theadministrativeadjudicationandadministrativemediationof
36、patentinfringementdisputesthathaveamaterialimpactnationwide,theadministrativeadjudicationrelatedtothemechanismforearlyresolutionofmedicinalproductpatentdisputes,theadministrativeadjudicationofstandardsforcollectionofroyaltiesbycollectivemanagementorganizationofcopyrights,theadministrativemediationof
37、copyrightdisputesthathaveamaterialimpactnationwide,theadministrativeadjudicationandadministrativemediationofdisputesovertheexclusiverightstolayoutdesignsofintegratedcircuits,thereviewoftheoutboundtransferofIPRsinvolvedinsecurityreviewofmergersandacquisitionsofdomesticenterprisesbyforeigninvestors,th
38、eapprovalofrightstonewvarietiesofplantstransferredtoforeigncountries,theorganizationandadvancementofthenational管理部门办理的备案，由地方承担支出责任。（四）知识产权保护将全国性知识产权保护体系建设，全国性涉外知识产权纠纷应对机制建设，全国性知识产权保护状况评价和绩效监督考核，全国性知识产权保护专项行动组织，在全国有重大影响或跨区域的知识产权重大违法案件组织查办和督查督办，知识产权海关保护，在全国有重大影响的专利侵权纠纷的行政裁决和行政调解，药品专利纠纷早期解决机制相关行政裁决，著作权
39、集体管理组织收取使用费标准的行政裁决，在全国有重大影响的著作权纠纷的行政调解.，集成电路布图设计专有权侵权纠纷的行政裁决和行政调解，外国投资者并购境内企业安全审查中涉及的知识产权对外转让审查，向国外转让植物新品种权审批，全国软件正版化工作组织推进，植物品种保护名录征集和发布，确认为中央财政事权，由中央承担支出责任。softwarelegalizationwork,andthecollectionofthoseincludedinandthereleaseofplantvarietyprotectionlistsshallbeconfirmedasthefinancialpowersoftheC

41、ollaborativeprotectionofIPRsandIPRprotectionassistance,theadministrativeadjudicationandadministrativemediationofIPRinfringementdisputesnotlistedasthefinancialpowersoftheCentralGovernment,thereviewoftheoutboundtransferofpatents,exclusiverightstolayoutdesignsofintegratedcircuits,andcopyrightsincompute
42、rsoftwareinvolvedintechnologyexport,andtheorganizationandadvancementofsoftwarelegalizationworkinlocalregionsshallbeconfirmedasthefinancialpowersoflocalgovernments,andlocalgovernmentsshallassumeexpenditureresponsibilities.(5) PublicservicesforIPRsTheconstructionofanationalpublicservicesystemforIPRs,t
43、heprocessingandanalysis,overallmanagement,sharingandopeningofnationalIPRdataresources,theresearch,analysis,disseminationandutilizationofnationalIPRinformation,andtheconstructionandcybersecurityprotectionofnationalinformationtechnology-enabledandintelligentIPRinfrastructure,andnationalIPRriskpredicti
44、onandearly将地方性知识产权保护体系建设，地方性涉外知识产权纠纷应对机制建设，地方知识产权保护状况评价和绩效监督考核，地方知识产权执法、快速协同保护、维权援助，未列入中央财政事权的知识产权侵权纠纷的行政裁决和行政调解，技术出口中涉及专利权、集成电路布图设计专有权、计算机软件著作权的对外转让审查，本地区软件正版化工作组织推进，确认为地方财政事权，由地方承担支出责任。（五）知识产权公共服务将全国性知识产权公共服务体系建设，全国性知识产权数据资源加工分析、统筹管理、共享开放，全国性知识产权信息的研究分析和传播利用，全国性知识产权信息化、智能化基础设施建设和网络安全防护，全国性知识产权风险预测

47、ningforandcoordinationofforeign-relatedIPRmatters,IPRcooperationandexchangesatthenationallevel,thedeepeningofIPRcooperationwithcountriesandregionsalongthe44BeltandRoad,“foreign-relatedIPRnegotiations,negotiationsonandsigning,performanceandimplementationofIPR-relatedinternationaltreaties,thecooperati
48、onandexchangeswiththeWorldIntellectualPropertyOrganizationandotherrelevantinternationalorganizations,andtheresearchonthepromotionofthedevelopmentofinternationalrulesontheprotectionofIPRsindatashallbeconfirmedasthefinancialpowersoftheCentralGovernment,andtheCentralGovernmentshallassumeexpenditureresp
49、onsibilities.IPRcooperationandexchangesbetweenIoCaliIieSandforeignlocalgovernmentsandlocalorganizationsshallbeconfirmed将地方性知识产权公共服务体系建设，推动知识产权信息在地方的传播利用和融合应用，地方性知识产权信息化、智能化基础设施建设和网络安全防护，地方性知识产权风险预测预警，确认为地方财政事权，由地方承担支出责任。（六）知识产权涉外工作将知识产权涉外事宜统筹协调，国家层面知识产权合作交流，深化同共建“一带一路”国家和地区知识产权合作，涉外知识产权谈判，知识产权相关国际条约磋商、签署、履约及落实，与世界知识产权组织和其他相关国际组织的合作交流，研究推动数据知识产权保护国际规则制定，确认为中央财政事权，由中央承担支出责任。将地方与外国地方政府和地方组织开展知识产权合作交asthefinancialpowers
