9、vativedevelopmentoftradeingoods2023年6月1日（此件有删减）关于在有条件的自由贸易试验区和自由贸易港试点对接国际高标准推进制度型开放的若干措施推进高水平对外开放，实施自由贸易试验区提升战略，加快建设海南自由贸易港，稳步扩大规则、规制、管理、标准等制度型开放，是贯彻落实习近平新时代中国特色社会主义思想的重大举措，是党的二十大部署的重要任务。为更好服务加快构建新发展格局，着力推动高质量发展，在有条件的自由贸易试验区和自由贸易港聚焦若干重点领域试点对接国际高标准经贸规则，统筹开放和安全，构建与高水平制度型开放相衔接的制度体系和监管模式，现提出如下措施。一、推动货物贸
10、易创新发展1. Pilotareasshallbesupportedinconductingthepilotprogramofimportsofre-remanufacturedgoodsinkeyindustries.RelevantimportedproductsnotsubjecttoChinasrelevantmeasuresforprohibitingorrestrictingimportsofusedproductsshallmeetallapplicabletechnicalrequirements(includingbutnotlimitedtoqualitycharacter
11、istics,safetyandenvironmentalprotectionperformance,andotheraspects)ofthestateforequivalentnewproductsandrelevantregulationsonremanufacturedproducts,andbemarkedwiththewords4rcmanufacturedproductsinconspicuouspositions.Pilotareasshallputforwardpilotplansinlightoftheirownactualcircumstances,andclarifyt
12、helistsofrelevantimportedproductsandapplicablespecificstandards,requirements,conformityassessmentproceduresandregulatorymeasures;andrelevantdepartmentsShalljointlystudyandmakedecisionswithinsixmonthsafterreceivingthepilotplans.Relevantdepartmentsandlocalitiesshallstrengthenthesupervision,managementa
13、ndinspectionofremanufacturedproducts,andstrictlypreventtheimportofforeigngarbageorusedproductsinthenameofremanufacturedproducts.(Scopeofapplication:Shanghai,Guangdong,Tianjin,Fujian,China(Beijing)PilotFreeTradeZone,andHainanFreeTradePort.ThescopeofapplicationofIhefollowingmeasures,excludingthosemark
14、edasapplicabletospecificpilotareas,isthesameasabove.)2. Aircraftandvessels(includingrelevantpartsandcomponents)re-transportedintopilotareasafterleavingChinatemporarilyforrepairshallbeexemptfromcustomsduties,nomatterwhethertheyarevalue-addedproductsornot.Theaforementionedaircraft”meanstheaircraftoper
15、atedby1. 支持试点地区开展重点行业再制造产品进口试点。相关进口产品不适用我国禁止或限制旧品进口的相关措施，但应符合国家对同等新品的全部适用技术要求（包括但不限于质量特性、安全环保性能等方面）和再制造产品有关规定，并在显著位置标注“再制造产品”字样。试点地区根据自身实际提出试点方案，明确相关进口产品清单及适用的具体标准、要求、合格评定程序和监管措施；有关部门应在收到试点方案后6个月内共同研究作出决定。有关部门和地方对再制造产品加强监督、管理和检验，严防以再制造产品的名义进口洋垃圾和旧品。（适用范围：上海、广东、天津、福建、北京自由贸易试验区和海南自由贸易港，以下除标注适用于特定试点地区的

Wheregoodsthataretemporarilyallowedtoenterpilotareasforrepairfromoverseasareasarere-transportedoutoftheterritory,theyshallbeexemptfromcustomsduties;andiftheyarenotre-transportedoutoftheterritoryandareinsteadsoldonthedomest
18、icmarket,customsdutiesshallbeleviedaccordingtotheregulations.(Scopeofapplication:areasunderspecialcustomssupervisionimplementingtheimportandexportmanagementsystemfeaturingfreeflowthroughthefirstlineandefficientcontrolatthesecondlineintheHainanFreeTradePort.)4. Afteranobligatorydutypayerprovidesguara
19、nteetotheCustomsforanyofthefollowinggoodsthattemporarilyenterapilotareafromanoverseasareaatthetimeoftheirentryintoChina,itisallowednottopaycustomsduties,importvalue-addedtaxandconsumptiontaxforthetimebeing:theprofessionalequipmentrequiredbythepersonnelenteringChinatemporarilyandcomplyingwithChinasla
20、wsforconductingbusiness,tradeorprofessionalactivities(includingsoftwareandtheinstruments,equipmentandarticlesusedinmakingnewsreportsorinproducingfilmsorTVprograms,amongothers);goodsusedforexhibitionsordemonstrations;commercialsamples,advertisingfilmsandaudiorecordings;andsportsproductsnecessaryforsp
21、ortscompetitions,运公司所运营的以试点地区内港口为船籍港的船舶。（适用范围：海南自由贸易港）3.对自境外暂时准许进入试点地区进行修理的货物，复运出境的，免征关税；不复运出境转为内销的，照章征收关税。（适用范围：海南自由贸易港实行“一线”放开、“二线”管住进出口管理制度的海关特殊监管区域）4.自境外暂时进入试点地区的下列货物，在进境时纳税义务人向海关提供担保后，可以暂不缴纳关税、进口环节增值税和消费税：符合我国法律规定的临时入境人员开展业务、贸易或专业活动所必需的专业设备（包括软件，进行新闻报道或者摄制电影、电视节目使用的仪器、设备及用品等）；用于展览或演示的货物；商业样品、广告
22、影片和录音；用于体育竞赛、表演或训练等所必需的体育用品。上述货物应当自进境之日起6个月内复运出境，暂时入境期间不得用于出售或租赁等商业目的。需要延长复运出境期限的，应按规定办理延期手续。performancesortrainings,amongothers.Theaforementionedgoodsshallbere-transportedoutoftheterritoryofChinawithinsixmonthsfromthedateofentry,andmaynotbesold,leasedorusedforcommercialpurposesduringtheperiodoftemp

24、ttogoodsjustbecauseofminorerrorssuchasmisprints,typos,oromissionsofnon-criticalinformationincertificatesoforiginorminordifferencesbetweendocuments.6.海关预裁定申请人在预裁定所依据的法律、事实和情况 未发生改变的情况下，可向试点地区海关提出预裁定展期 申请，试点地区海关应在裁定有效期届满前从速作出决 定。6. Ifthelaws,factsandcircumstancesonwhichanadvancerulingisbasedremainunch
25、anged,theapplicantforanadvancerulingatthecustommayapplytothecustomsofficeinthepilotareaforextendingtheperiodoftheadvanceruling,andthecustomsofficeinthepilotareashallmakeadecisionassoonaspossiblebeforethevalidityperiodoftherulingexpires.7.在符合我国海关监管要求且完成必要检疫程序的前提 下，试点地区海关对已提交必要海关单据的空运快运货 物，正常情况下在抵达后6小
26、时内放行。8.在符合我国相关法律法规和有关规定且完成必要检疫程序的前提下，试点地区海关对已抵达并提交通关所需全部7. 29、otherrespects,andguaranteeshavebeenprovidedtotheCustomsorthedispute-relatedpaymentprocedureshavebeenperformedasrequired,thecustomsofficesinpilotareasshallreleasethegoods.10.在试点地区，有关部门批准或以其他方式承认境外合格 评定机构资质，应适用对境内合格评定机构相同或等效的 程序、标准和其他条件；不得将境外合格评定机构在境内 取得法人资格或设立代表机构作为承认其出具的认证结果 或认证相关检查、检测结果的条件。10. 30、lotareas,theprocedures,standardsandotherconditionswhicharethesameasorequivalenttothosefordomesticconformityassessmentinstitutionsshallapplytotherelevantdepartmentsapprovalorrecognitionofqualificationsofoverseasconformityassessmentinstitutions;andoverseasconformityassessmentinstitutions,acquirementof
31、thelegalpersonstatusorestablishmentofrepresentativeinstitutionsdomesticallyshallnotbetakenastheconditionsforrecognizingthecertificationresultsorthecertification-relatedinspectionandtestingresultsissuedbythem.11 .对于在试点地区进口信息技术设备产品的，有关部门应 允许将供应商符合性声明作为产品符合电磁兼容性标准或 技术法规的明确保证。12 .在试点地区，允许进口标签中包括ChateaU
32、（酒庄）、11. Exceptforspecificnewfinancialservices
34、,ifChinese-fundedfinancialinstitutionsareallowedtoprovidecertainnewfinancialservices,foreign-fundedfinancialinstitutionsinpilotareasareallowedtoprovidesimilarservices.Financialmanagementdepartmentsmaydeterminethetypesandnatureofinstitutionsthatprovidesuchnewfinancialservicesaccordingtotheirfunctions
35、andpowers,andrequirethatpermitsbeobtainedforprovidingsuchservices.Financialmanagementdepartmentsshallmakedecisionswithinreasonabletimelimits,andareallowedtonotgrantpermissiononlyforprudentialreasons.14. Financialmanagementdepartmentsinpilotareasshall,undertheprincipleofplacingdomesticandforeignentit
36、iesonanequalfooting,makedecisionswithin120daysafterreceivingapplicationsrelatedtotheprovisionoffinancialservicesthatarecompleteandinstatutoryformssubmittedbyoverseasfinancialinstitutions,overseasfinancialinstitutioninvestors,andcross-bordernancialserviceproviders,andclassic（经典的）、clos（葡萄园）、cream（柔滑的）
37、、crusted/crusting（有酒渣的）、fine（精美的）、Iatebottledvintage（迟装型年份酒）、noble（高贵的）、reserve（珍藏）、ruby（宝石红）、specialreserve（特藏）、solera（索莱拉）、superior（级别较高的）、surlie（酒泥陈酿）、tawny（陈年黄色波特酒）、vintage（年份）或Vintagecharacter（年份特征）描述词或形容词的葡萄酒。二、推进服务贸易自由便利13.除特定新金融服务外，如允许中资金融机构开展某项新金融服务，则应允许试点地区内的外资金融机构开展同类服务。金融管理部门可依职权确定开展此项新金
38、融服务的机构类型和机构性质，并要求开展此项服务需获得许可。金融管理部门应在合理期限内作出决定，仅可因审慎理由不予许可。14.试点地区金融管理部门应按照内外致原则，在收到境外金融机构、境外金融机构的投资者、跨境金融服务提供者提交的与开展金融服务相关的完整且符合法定形式的申请后，于120天内作出决定，并及时通知申请人。如不能在上述期限内作出决定，金融管理部门应立即通知申请人并争取在合理期限内作出决定。15 .允许在试点地区注册的企业、在试点地区工作或生活的 个人依法跨境购买境外金融服务。境外金融服务的具体种 类由金融管理部门另行规定。16 .鼓励境外专业人员依法为试点地区内的企业和居民提供 专业服
39、务，支持试点地区建立健全境外专业人员能力评价 评估工作程序。三、便利商务人员临时入境17 .允许试点地区内的外商投资企业内部调动专家的随行配 偶和家属享有与该专家相同的入境和临时停留期限。18 .对拟在试点地区筹建分公司或子公司的外国企业相关高 级管理人员，其临时入境停留有效期放宽至2年，且允许 随行配偶和家属享有与其相同的入境和临时停留期限。notifyapplicantsinatimelymanner.Whereadecisioncannotbemadeduringtheaforementionedperiod,anancialmanagementdepartmentshallnotify

Enterprisesregisteredinpilotareasandindividualsworkingorlivinginpilotareasareallowedtopurchaseoverseasfinancialservicesacrossbordersinaccordancewiththelaw.Thespecifictypesofoverseasfinancialservicesshallbeprescribedseparat
41、elybyfinancialmanagementdepartments.16. Overseasprofessionalsshallbeencouragedtoprovideprofessionalservicestoenterprisesandresidentsinpilotareasinaccordancewiththelaw,andpilotareasshallbesupportedinestablishingandimprovingtheirworkingproceduresfortheevaluationandassessmentoftheabilitiesofforeignprof
42、essionals.III.FacilitatingthetemporaryentryOfbusinesspersonnel17. Accompanyingspousesandfamilymembersofexpertstransferredinsideforeign-fundedenterpriseswithinpilotareasareallowedtoenjoythesameentryandtemporarystayperiodsastheexperts.18. Thevalidityperiodofeachtemporaryentryorstayofarelevantseniorexe
43、cutiveofaforeignenterprisewhichistoestablishanybranchorsubsidiaryinapilotareashallbeextendedtotwoyears,andhisorheraccompanyingspouseandfamilymembersareallowedtoenjoythesameperiodofentryorIemPorarystay.IV.Promotingthehealthydevelopmentofdigitaltrade19. Inthecaseoftheimport,distribution,saleoruseofmas
44、smarketsoftware(excludingsoftwareusedforcriticalinformationinfrastructure)orproductscontainingsuchsoftware,relevantdepartmentsandtheirstaffmembersshallnotusethetransferoracquirementoftherelevantsoftwaresourcecodesownedbyenterprisesorindividualsasaconditionorrequirement.20. Pilotareasshallbesupported
45、inimprovingtherulesfortheprotectionofconsumersrightsandinterests,andthefraudsandcommercialfraudsthatcausedamagesorpotentialdamagestoconsumersinonlinecommercialactivitiesshallbeprohibited.V.Increasingeffortstooptimizethebusinessenvironment21. Pilotareasshallallowfreeremittanceinandoutwithoutdelayinal
46、lrealandregulation-complianttransfersrelatedtoinvestmentsbyforeigninvestors.Suchtransfersinclude:capitalcontributions;profits,dividends,interest,capitalgains,royalties,managementfees,technicalguidancefees,andotherexpenses;PrOCeedSfromthesaleofinvestmentsinwholeorinpartandproceedsfromtheliquidationof
47、investmentsinwholeorinpart;paymentsmadeundercontractsincludingloanagreements;compensationsorindemnitiesobtainedinaccordancewiththelaw;andpaymentsarisingfromdispute四、促进数字贸易健康发展19.对于进口、分销、销售或使用大众市场软件（不包括用于关键信息基础设施的软件）及含有该软件产品的，有关部门及其工作人员不得将转让或获取企业、个人所拥有的相关软件源代码作为条件要求。20. 支持试点地区完善消费者权益保护制度，禁止对线上商业活动消费者
48、造成损害或潜在损需的诈骗和商业欺诈行为。五、加大优化营商环境力度21. 试点地区应允许真实合规的、与外国投资者投资相关的所有转移可自由汇入、汇出且无迟延。此类转移包括：资本出资：利润、股息、利息、资本收益、特许权使用费、管理费、技术指导费和其他费用；全部或部分出售投资所得、全部或部分清算投资所得：根据包括贷款协议在内的合同所支付的款项：依法获得的补偿或赔偿；因争议解决产生的款项。resolution.22 .试点地区的采购人如采用单一来源方式进行政府采购, 在公告成交结果时应说明采用该方式的理由。23 .对于涉及试点地区内经营主体的已公布专利申请和已授 予专利，主管部门应按照相关规定公开下列信
49、息：检索和 审查结果（包括与相关现有技术的检索有关的细节或信息 等）；专利申请人的非保密答复意见；专利申请人和相关 第三方提交的专利和非专利文献引文。24 .试点地区人民法院对经营主体提出的知识产权相关救济 请求，在申请人提供了可合理获得的证据并初步证明其权 利正在受到侵害或即将受到侵害后，应不预先听取对方当 事人的陈述即依照有关司法规则快速采取相关措施。25 .试点地区有关部门调查涉嫌不正当竞争行为时，应对被 调查的经营者给予指导，经营者作出相关承诺并按承诺及 时纠正、主动消除或减轻危害后果的，依法从轻、减轻或 不予行政处罚。22.
