1、工程合同关于雇主人员的条款（中英文对照）工程合同关于雇主人员的条款（中英文对照）C1.AUSESOFEMP1.0YER,SPERSONNE1.发包人应要求在施工现场的发包人人员遵守法律及有关安全、质量、环境保护、文明施工等规定，并保障承包人免于承受因发包人人员未遵守上述要求给承包人造成的损失和责任。发包人人员包括发包人代表及其他由发包人派驻施工现场的人员。Theemployershouldrequireitspersonnelonsitetoabidebythelawsandregulationsofsafety,quality,environmentalprotection,orderedc
2、onstructionandsoonzandindemnifythecontractoragainstthelossandliabilityduetotheemployerpersonneltoobserveaboverequirements.Theemployer,spersonnelincludeitsrepresentativeandotherpersonneldispatchedbytheemployertothesite.“EmployersPersonnezmeanstheEmployer*sRepresentative,theassistantsreferredtoinSub-C
3、lause3.2OtherEmployer7sPersonnelandallotherstaff,labourandotheremployeesoftheEmployerandoftheEmployer*sRepresentative;andanyotherpersonnelnotifiedtotheContractor,bytheEmployerortheEmployersRepresentative,asEmployer,sPersonnel.雇主人员系指雇主代表、第3.2款其他雇主人员中提到的助手、以及雇主和雇主代表的所有其他职员、工人和其他雇员，以及雇主或雇主代表通知承包商作为雇主人员
4、的任何其他人员.“EmployersPersonelmeanstheEngineer,theEngineersRepresentative(ifappointed),theassistantsdescribedinSub-Clause3.4DelegationbytheEngineerandallotherstaff,labourandotheremployeesoftheEngineerandoftheEmployerengagedinfulfillingtheEmployersobligationsundertheContract;andanyotherpersonnelidentifie

6、tractors(ifany)whoisfound,basedonreasonableevidence,tohaveengagedincorruptfraudulent,collusiveorcoercivepractice.承包商可要求雇主将根据合理证据发现从事腐败、欺诈、串通或胁迫行为的雇主人员或雇主的其他承包商(如有)的任何人撤离(或安排撤离)。ifSub-Clause4.5Trainingapplies,theContractorshallcarryouttrainingoftheEmployersPersonnelintheoperationandmaintenanceofthisp
7、art.如果第4.5条培训适用，承包商应对雇主人员进行该部分的操作和维护方面的培训。TheEmployershallberesponsibleforensuringthattheEmployersPersonnelandtheEmployersothercontractorsontheSite:雇主应负责保证在现场的雇主人员和其他承包商做到：IfunderClause66theEmployershallcarryoutworkontheSitewithhisownworkmenheshall,inrespectofsuchworks:根据第66条的规定，如果雇主用自己的工作人员在现场工作，在这
8、方面他应当：havefullregardtothesafetyofallpersonsentitledtotheupontheSitezand对所有授权在现场的人员的安全负全面责任；以及keeptheSiteinanorderlystateappropriatetotheavoidanceofdangertosuchpersons.保持现场的井然有序，以防对这些人员造成危险。TheEmployerandtheEngineershallalsobeindemnifiedunderthepolicyofinsurance,exceptthatthisinsurancemayexcludelossesandclaimstotheextentthattheyarisefromanyactorneglectoftheEmployeroroftheEmployersPersonnel.雇主和工程师也应依据保险单得到赔偿，但该保险不包括雇主或雇主人员的任何行为或疏忽引起的雇主和工程师也应在保险政策下得到赔偿,但该保险可将损失和索赔排除在雇主或雇主人员的任何行为或疏忽引起的损失和索赔。
