4、fortheprojectchange.空调工程项目100%Airconditioningproject家具工程项目100%Furnitureengineering三、关于材料供应的约定AGREEMENTONTHESUPPLYOFMATERIALS1 .乙方提供的材料：乙方供应的材料、设备,如不符合设计、施工要求，应禁止使用。如已使用，对工程造成的损失由乙方负责。如甲方要另增加材料由甲方供应，并应符合下列规定：MaterialprovidedbyPartyB:AnymaterialsorequipmentsuppliedbyPartyBwhichdonotmeetthedesignandcon
5、structionrequirementsareprohibited.AnyextramaterialsrequestedbyPartyAwhichwerenotintheoriginaldesignmustbepaidforbyPartyA.2 .甲方提供的材料：另拟补充附件甲方提供材料、设备表甲方负责采购供应的材料、设备，应符合设计施工要求的合格产品，并应按时供应到现场。乙方发现甲方提供的材料、设备有质量问题或规格差异，应及时向甲方提出，甲方仍要求使用的，由此造成工程损失，责任由甲方承担。甲方供应的材料按时抵达现场后，由乙方负责保管MaterialprovidedbyPartyA:(see
6、theannex:TableofMaterialstobeprovidedbytheOwner).IfPartyAacquiresmaterialsfortheproject,itshouldfirstcheckwithPartyBthatthematerialsmatchtothedesignrequirements,andoncethematerialsareinthecareofPartyB,thenPartyBisresponsibleforthematerials.IfPartyArequiressomematerialswhichdonotfittothedesignthenits
7、hallbetheresponsibilityofPartyAtopayanyadditionalcostsincurredbyPartyB.四、关于工程质量及验收的约定FULFILMENTOFTHISAGREEMENT1 .本工程应符合建筑装饰工程技术规程和市建设行政主管部门制定的其它地方标准质量评定验收标准TheexecutionofthisprojectmustbeconsistentwiththeArchitecturalandEngineeringRulesofthecityadministrativedepartmentsresponsibleforthedevelopmentof
8、buildingsandlocalstandardsandqualityevaluationacceptancecriteria.2 .本工程由乙方进行设计，提供施工图纸一式两份，双方签字确认PartyBmustprovideaduplicatecopyoftheconstructiondesignsanddrawings,andbothcopiesshouldbesignedbybothparties.3 .甲方提供的材料、设备质量不合格而影响工程质量，其返工费用由甲方承担，工期相应顺延IfmaterialsprovidedbyPartyAfortheconstructiondonotmee
9、tthenecessaryrequirements,PartyAshallbearresponsibilityforanyresultingdelaysinthecompletionintheproject.4 .由于乙方原因造成质量事故，其返工费用由乙方承担IfthequalityofPartyB,sworkresultsinanyaccidents,theliabilityforsuchaccidentsshallbetheresponsibilityofPartyB.5 .在施工过程中，甲方提出设计修改意见及增减工程项目，须提前与乙方联系，在双方签订工程项目变更单后，方能进行该项目的施工
10、、因此影响工程竣工日期的，责任由甲方承担。凡甲方私自与施工人员商定更改施工内容、增加施工项目所引起的一切后果，甲方自负，给乙方造成损失的，甲方应予赔偿If,duringtheconstruction,PartyAwishestoproposeachangetothedesign,heshouldsignaChangeofProjectwithPartyBandmustassumeresponsibilityforresultingdelaysorincreaseincosts.IfPartyAsecretlyattemptstochangetodesigndirectlywiththecons
11、tructionpersonnelandthisactioncauseslosstoPartyB,thenPartyAmustcompensatePartyBforthisloss.6 .工程验收：乙方负责理隐蔽工程和中间工程的检查与验收手续。由乙方组织专门人员进行验收。一切理隐蔽工程和中间工程的质量由乙方负责Thestandardofwork.ItistheresponsibilityofPartyBtomakesurethatallconstructionworksarecarriedouttotherequirementsofthedesignandtomakesurethatallin
12、ternalwallsandhiddenconstructionpartsaretotherequiredstandard.7 .工程竣工：乙方完工后即应通知甲方验收，甲方应在竣工当日组织验收，并办理验收移交手续，双方签V工程质量验收单。如果甲方在规定时间内不能组织验收，须及时通知乙方，另定验收日期。如通过竣工验收，甲方应承认原竣工日期，并承担因此造成的乙方的看管费用和其他相关费用Projectcompletion.PartyBmustnotifyPartyAwhentheprojectiscompleteandreadyforinspectionbyPartyA.Afterinspectio
13、nbothpartiesmustsignanEngineeringQualityAcceptancedocument.IfPartyAisnotavailabletoinspecttheconstructionsiteonthecompletiondate,hemustnotifyPartyBofthesoonestavailabledate.WherePartyAisnotavailableonthecompletiondatetoretakecustodyofthelocation,hemustpayanyextracostsincurredbyPartyB.8 .工程保修期一年。工程竣工
14、验收后甲、乙双方签署工程保修单,凭保修单实行保修，保修期一年，从竣工验收签章之日起算Oneyearwarranty.AftercompletionoftheworkandsigningoftheSingleWarranty,thereshallbeaoneyearwarrantyontheconstruction.五、有关安全生产和防火的约定SAFEPRODUCTIONANDFIREREGULATIONS1 .施工图纸和施工说明应符合防火防事故的要求，主要包括电气线路等管道畅通、合格。乙方在施工中应采取必要的安全防护和消防措施，保障作业人员及相邻关系的安全,防止相邻单位的管道堵塞、渗漏水、停电
15、、物品毁坏等事故发生Constructiondrawingsandconstructionmustbeinlinewithfirepreventionregulations,andaccidentpreventionrequirements.Thisincludeselectricalcircuitsandpipelines.PartyBshalltakemeasurestoensurethesafetyofworkersandneighborsattheconstructionssiteandmustpreventleakageofwater,interruptionsofpowerandd
16、amagetoproperty.2 .施工中凡涉及改变房屋结构，拆、改承重墙，加大楼（地）面荷载，由甲方向物业管理部门提出申请，经所在地建设行政主管部门批准后方能施工Anychangestothehousingstructureordemolitionoralterationtoloadbearingwallsorincreaseinfloorloadmustfirstbeapprovedbythebuildingpropertymanagementbeforeconstructionbegins.3 .双方款项往来均应出具正规收据和发票，以备查验和结算Bothpartiesmustprovi
17、demoneyexchangereceiptsandinvoices.六、其它事项OTHERMATTERS1.甲方工作PartyA1 .甲方应在开工前确认施工图纸并腾出足够的施工空间，以清除影响施工的障碍物。甲方向乙方提供施工需用的水、电等必备条件，并说明使用注意事项WhenPartyAconfirmsthepre-constructionandconstructiondrawings,hemustalsomakesurethereissufficientspaceavailableattheconstructionsiteforconstructiontotakeplace.PartyAmu
18、stmakesurethatPartyBhaseverythingnecessaryonsiteforcompletionoftheconstruction,particularlyelectricityandwater.2 .做好施工中因临时使用公用部位操作影响邻里关系等的协调工作PartyAmusttakecareofthepublicrelationsintheconstructionsitearea-particularlywiththeneighbors.2.乙方工作PartyB1 .参加甲方召集的现场交底PartyBmustbeavailabletoattendmeetingsor
19、ganizedbyPartyA.2 .乙方按要求组织施工，保质、保量、按期完成施工任务PartyBmustfollowtheconstructionplans,andtheconstructionmustbedurable,andmustmeetthescheduledcompletiondate.七、违约责任LIABILITYFORBREACHOFCONTRACT1 .由于甲方原因导致延期开工或中途停工，工期顺延IfPartyAcausesanydelaystothecompletionofthisproject,thenthescheduledcompletiondateshouldbea
20、djustedaccordingly.2 .由于乙方原因逾期竣工的，每逾期一天，乙方向甲方支付工程造价S1（大写:千分之一）的违约金IfPartyBcausesanydelaytothecompletionofthisproject,thenPartyBmustpaytoPartyAafeeof0.1%o（inwords:11000）ofthetotaloverallprojectfeeforeachdaybeyondthescheduledcompletiondate.3 .甲方未办理有关手续，强行要求乙方拆改原有建筑承重结构及共用设备管线，由此发生的损失或事故（包括罚款）由甲方负责并承担责
21、任IfPartyAinstructsPartyBtomakeanyalterationstoaloadbearingwallandPartyAhasnotsoughtandreceivedpermissionfromthebuildingpropertymanagement,PartyAshallberesponsibleforanyresultingcostsandshallindemnifyPartyBforanyadditionalexpensesincurred.4 .乙方擅自拆改原有建筑承重结构或共用设备管线，由此发生的损失或事故（包括罚款），由乙方负责并承担责任IfPartyBma
22、kesanyunauthorizedchangestoloadbearingwallsorbuildingpipelinesandsuchchangesresultindamagesorloss,itshallbetheresponsibilityofPartyBtopayforsuchloss.5 .工程未办理验收、结算手续，甲方提前使用或擅自动用工程成品由此造成无法验收和损失的,由甲方负责并承担贡任PartyAshallberesponsibleforanyextracostsincurredduetohisuseofthepropertybeforethefinalcompletionm
23、eetingandsigningoftheEngineeringQualityAcceptancedocument.八、纠纷处理方式DISPUTES1 .因工程质量双方发生争议时，凭本合同文本向有关行业协会申请调解，也可向所在区、县建设行政主管部门或消费者协会投诉Ifthereisadisputebetweentheparties,thiscontractshouldbesubmittedtotherelevanttradeassociationformediationandalsotothehostdistrictandcountybuildingdepartmentsinchargeofa
24、dministrativecomplaints,ortoconsumerassociations.2 .当事人不愿通过协商、调解解决、或协商、调解不成时，可以按照本合同约定向-某某仲裁委员会申请仲裁-人民法院提起诉讼if,afternegotiation,mediationand/orconsultation,thepartieshavefailedtoreachanagreement,thenthedisputeshouldbesubmittedtothe-ShanghaiArbitrationCommission-filedasalawsuit.九、合同变更和解除Amendmentandt
25、ermination1 .合同经双方签字生效后，双方必须严格遵守。任何一方要求变更合同内容或解除合约，由双方协商解决，经双方签字确认后生效Afterthiscontractissigneditmustbestrictlyadheredto.Afterthecontractissigned,neitherpartycanleavethecontractwithoutagreementoftheotherparty.2 .本合同签订后，工程不得转包Afterthiscontractissigned,theprojectshallnotbesub-contracted.3 .本合同一式两份，甲、乙双
26、方各执份，合同附件为本合同的组成部分，具有同等的法律效力Thiscontractwillbeprintedandsignedinduplicateandeachpartyshallkeepacopy.十、其它约定FINALCLAUSES1如遇不可抗力因素，工期顺延Intheeventofforcemajeure,thiscontractwillbedelayedandresumeassoonaspracticablypossible.4 .其他未在本合同内规定的事项双方协商解决Ifanymattersarisewhicharenotcoveredwithinthiscontract,theys
