3、备负责。Unlessotherwisestipulatedintheparticularconditionhereof,thecontractorshallberesponsibleforprocurement,transportationandstorageofthematerialsandengineeringequipmentprovidedbythecontractor.Thecontractorshallberesponsibleforthematerialsandengineeringequipmentitpurchases.5.1.2 承包人应按专用合同条款的约定，将各项材料和工
4、程设备的供货人及品种、规格、数量和供货时间等报送监理人审批。承包人应向监理人提交其负责提供的材料和工程设备的质量证明文件，并满足合同约定的质量标准。Thecontractorshall,subjecttothestipulationsintheparticularconditionhereof,submitthesupplier,thevariety,specifications,quantityanddeliverytimeofeachmaterialandengineeringequipmenttothesupervisorforapproval.Thecontractorshallsub
5、mittothesupervisorthequalitydocumentationofthematerialsandengineeringequipmentwhichareresponsibletobesuppliedtherebyandmeetthequalitystandardsagreedinthecontract.5.1.3 对承包人提供的材料和工程设备，承包人应会同监理人进行检验和交货验收，查验材料合格证明和产品合格证书，并按合同约定和监理人指示，进行材料的抽样检验和工程设备的检验测试，检验和测试结果应提交监理人，所需费用由承包人承担。Forthematerialsandengine

7、estandtestresultsofengineeringequipmentshallbesubmittedtothesupervisor,andtheexpensesthereofshallbebornebythecontractor.5.2 发包人提供的材料和工程设备Materialsandengineeringequipmentprovidedbytheemployer5.2.1 发包人提供的材料和工程设备，应在专用合同条款中写明材料和工程设备的名称、规格、数量、价格、交货方式、交货地点和计划交货日期等。Thematerialsandengineeringequipmentprovid
8、edbytheemployershall,intheparticularconditionhereof,includethenamezspecification,quantity,price,deliverymethod,deliverylocationandplanneddeliverydateofthematerialsandengineeringequipment.5.2.2 承包人应根据合同进度计划的安排，向监理人报送要求发包人交货的日期计划。发包人应按照监理人与合同双方当事人商定的交货日期，向承包人提交材料和工程设备。Thecontractorshall,pursuanttothes
9、cheduleofthecontractschedule,submittothesupervisorthedateplanforthedeliveryoftheemployer.Theemployershallsubmitthematerialsandengineeringequipmenttothecontractorinaccordancewiththedeliverydateagreedbetweenthesupervisorandthepartiestothecontract.5.2.3 发包人应在材料和工程设备到货7天前通知承包人，承包人应会同监理人在约定的时间内，赴交货地点共同进行
10、验收。除专用合同条款另有约定外,发包人提供的材料和工程设备验收后，由承包人负责接收、运输和保管。Theemployershallnotifythecontractor7daysbeforethearrivalofthematerialsandengineeringequipment,andthecontractorshallzwithintheagreedtime,gotothedeliveryplaceforacceptancetogetherwiththesupervisor.Unlessotherwisestipulatedintheparticularconditionhereof,t
11、hecontractorshallberesponsibleforreceiving,transportingandkeepingthematerialsandengineeringequipmentprovidedbytheemployerafteracceptance.8测量放线Measurementandpay-off8.1施工控制网Constructioncontrolnetwork8.1.1.1 发包人应在计划开工日期14天前，通过监理人向承包人提供符合国家有关规定的测量基准点、基准线和水准点。Theemployershall,14daysbeforetheplannedcommen
12、cementdatezprovidethecontractorwiththemeasurementreferencepoint,referencelineandlevelpointinaccordancewiththerelevantnationalregulations.8.1.1.2 承包人应在计划开工日期7天前,将施工控制网资料报送监理人。Thecontractorshallreporttheconstructioncontrolnetworkdatatothesupervisor7daysbeforetheplannedcommencementdate.9施工安全、治安保卫和环境保护C
13、onstructionsafety,publicsecurityandenvironmentalprotection1.1.1 承包人的施工安全责任ConstructionContractorsResponsibility9.2.8 承包人应对施工船舶、机械、设备、仪器等进行定期检查，消除隐患，并取得有关部门的检验许可证明。Thecontractorshallcarryoutregularinspectionsonconstructionvessels,machinery,equipment,instruments,etc.toeliminatehiddendangersandobtainin
14、spectionpermitcertificatesfromrelevantauthorities.9.2.9 承包人应按有关要求,设置施工水域的警示标志和施工船舶夜间警示标志。Thecontractorshallsetupwarningsignsforconstructionwatersandnightwarningsignsforconstructionvesselsinaccordancewithrelevantrequirements.9.2.10 承包人应对施工现场的供电、消防、基坑开挖、水下作业、爆破、不良工程地质以及施工通航等制定专项的措施及应急预案，并报监理人审查同意。发包人或
15、监理人的认可不能免除承包人所应承担的责任。Thecontractorshallformulatespecialmeasuresandemergencyplansforpowersupply,fireprotection,foundationpitexcavation,underwateroperations,blasting,unfavorableengineeringgeology,andconstructionnavigationattheconstructionsitezandreporttothesupervisorforapproval.Theapprovaloftheemploye
16、rorthesupervisorcannotrelievethecontractoroftheresponsibility.9.2.11 护Environmentalprotection9.4.7承包人应严格执行国家有关水域环境生态保护的规定,合理选择施工船机施工工艺，采取有效措施，减少施工对周边水域的影响。Thecontractorshallstrictlyimplementthestatesregulationsonenvironmentalandecologicalprotectionofwaterareas,reasonablyselectconstructionmachineryan
17、dconstructiontechnology,andtakeeffectivemeasurestoreducetheimpactofconstructiononsurroundingwaters.10进度计划Progressschedule10.1 合同进度计划Contractprogressschedule10.1.1 承包人应在计划开工日期7天前，向发包人和监理人报送施工组织设计；监理人应在7天内批复或提出修改意见，否则视为已得到批准。Thecontractorshall,7daysbeforetheplannedcommencementdatezsubmittheconstructio
18、norganizationdesigntotheemployerandthesupervisor,forwhichthesupervisorshallapproveorproposeamendmentswithin7dayszotherwiseitshallbedeemedashavebeenapproved.11开工和竣工Commencementandcompletion11.1开工Commencementofconstruction11.13分项工程的开工应事先得到监理人的书面同意，承包人应提前48小时将申请开工的书面通知报送监理人，监理人应在收到通知48小时内予以书面答复否则视为同意。T
19、hecommencementofasub-projectshallbeapprovedinadvancebythesupervisor.Thecontractorshallsubmitwrittennoticeoftheapplicationforcommencementtothesupervisor48hoursinadvance,forwhichthesupervisorshallgivewrittenreplywithin48hoursofreceivingthenotice,otherwisedeemedconsent.11.1.4承包人不能按期开工时，应在接到开工令24小时内向监理人
20、提出延期开工申请报告，监理人应在接到报告24小时内作出答复。若监理人在24小时内同意或未予答复，工期相应顺延；若监理人不同意延期要求，则工期不予顺延。Wherethecontractorfailstocommencementworkonschedule,heshallsubmitanapplicationreportforthepostponementtothesupervisorwithin24hoursofreceivingthecommencementorder,andthesupervisorshallreplywithin24hoursofreceivingthereport.Ift
21、hesupervisoragreesordoesnotreplywithin24hours,theconstructionperiodwillbepostponedaccordingly;ifthesupervisorfailstoagreetotheextensionrequest,theconstructionperiodwillnotbepostponed.11.2竣工Completion11.2.1重要节点工期：Importantnodeconstructionperiod:11.4 异常恶劣的气候条件AbnormalweatherconditionsHAl异常恶劣的气候条件是指水运工
22、程水域施工作业难以正常进行或须采取其他补救措施才能进行的气候条件。一般是指：Abnormalweatherconditionsrefertotheclimaticconditionsinwhichtheconstructionworkinthewaterareaofawatertransportationprojectisdifficulttonormallyproceedorotherremedialmeasuresshouldbetaken.Generallyrefersto:11.5 承包人的工期延误Contractorsconstructiondelay11.5.1 由于承包人原因造成
23、工期延误，承包人应向发包人支付逾期竣工违约金。Ifdelayofworksperiodduetothecontractorsreason,thecontractorshallpaytheemployertheoverduecompletionpenalty.逾期竣工违约金的计算方法为：Thecalculationmethodofliquidateddamagesforoverduecompletionis:工期延误天数XPl,其中Pl：NumberofdaysdelayedinconstructionPlzinwhichPl:逾期竣工违约金累计最高不得超过总合同价款的5%oThecumulat
24、ivemaximumpenaltyforlatecompletionshallnotexceed5%ofthetotalcontractprice.11.6 工期提前Advanceschedule11.6.1 发包人(同意或不同意)向承包人支付提前工期奖。Employer(agreeordisagree)paythecontractoranadvancedeadlineaward.提前工期奖金的计算方法为：Thecalculationmethodoftheadvanceschedulebonusis:工期提前天数xP2,其中P2:DaysaheadofscheduleXP2,inwhichP2:提前工期奖金累计最高不得超过总合同价款的5%oTheaccumulatedbonusfortheadvancescheduleshallnotexceed5%ofthetotalcontractprice.12暂停施工Suspendedconstruction12.1 承包人暂停施工的责任Responsibilityofthecontractorssuspensionofconstruction12.1.1 承包人承担的其他暂停施工：Othersuspensionsofconstructionundertakenbythecontractor:
