13、mprehensivecalculationofworkinghour.ThepositionofPartyBpracticessystemofcomprehensivecalculationofworkinghouraftertheapprovalofthelaboradministrationauthority;calculationcircle;totalworkinghours.B. PartyAmayextendworkinghoursduetotherequirementofitsproductionorbusinessafterconsultationwiththeTradeUn
14、ionandthePartyB,but,withtheexceptionofthecircumstancesstipulatedinArticle42ofthePRCLaborLaw,theextendedhoursforadayshallgenerallynotexceedonehour;ifsuchextensioniscalledforduetospecialreasons,theextendedworkinghoursshallnotexceedthreehoursadayundertheconditionthatthehealthofthePartyBisguaranteed.How

PartyAshallprovidethePartyAwithlegalholidays,annualleave,marriageleave,funeralleave,homeleave,maternityleave,nursingleave,etc.inaccordancewithrelevantregulationsandpayvacationwagesaccordingtothewagestandardprovidedbythiscontractArticle 4 aborRem
16、unerationA.ThewageofPartyBfornormalworkinghoursshallbepaidpursuanttomodebelowandmaynotlessthantheminimumwagerateintheplacewherethePartyAislocated.1. Hourlywage:(1) ThewagesofthePartyBfornormalworkinghoursshallbepaidpursuantto;thebeginningwageamountisasRMB/monthorRMB/hour.(2) ThewagesofthePartyBisasR
17、MB/monthintheprobationaryperiod(theprobationalsalaryshallnotbelessthantheminimumwageofsamepostand80percentofappointedsalaryinthecontract,notlessthantheminimumwagestandardinwherePartyAislocated.);2. Duringthecontractperiod,PartyA,inaccordancewiththerelevantregulationsofnation,provinceanddistrict,shallpaythepension,medical,unemployment,workinjuryandmaternityinsuranceproceduresforPartyB,andshallpaysocialinsurancefundbasedonpaymentbaseandpaymentratiobyrule.PartyBshallundertakehisow
23、npartofsocialinsurancefund,thepayableamountshallbewithheldbyPartyAfromthePartyB,smonthlywages.PartyAshalltruthfullyinformthesituationofhandlingsocialinsuranceproceduresandwithholdingsocialinsurancepremiumstoPartyB.Article 6 IncasePartyBsufferssicknessornon-work-relatedinjury,PartyAshallofferPartyBap
24、eriodofmedicaltreatmentandsick-leavetreatmentstipulatedbynationalandlocalregulations,paymedicalinsuranceandothermedicalpaymentrelatingtorelevantregulations,andpaysicknesspayordiseasereliefduringspecifiedmedicalperiod,theamountmaybeRMBpermonth(nolessthan80%ofthelocalminimumwagestandard).Article 7 1.a
25、borProtection,WorkingConditionandProtectionAgainstOccupationalHazardsA. PartyAshallprovideworkingplaceconformedtothenationallaborhealthstandard,inaccordancewithlaborprotectionregulationsofthenationandprovince,andeffectivelyprotectthesafetyandhealthofPartyBduringworkingproduction.IfPartyBmaysufferocc
26、upationalhazardduringproductionprocedures,PartyAshalltruthfullyinformPartyB,andprotectthehealthandrelatedrightsofPartyBstipulatedby“LawofOccupationalDiseasePrevention.B. AccordingtothepositionofthePartyB,PartyAshallprovidePartyBwithlaborsafetyandhygieneconditionsinconformitywiththerelevantlawsandreg
27、ulations,andprovidefreephysicalexaminationforPartyBevery(year/season/month)inaccordancewithlaborprotectionprovisions.C. PartyAmustcarryoutrelevantprovisionsformulatedbythenationzprovinceanddiStrictforthelaborprotectionandhealth-careworkoffemaleworker.D. PartyBshallhavetherighttorefusetocarryoutanyda
28、ngerousoperationforceduponhim/herbyPartyA.ForPartyAsoritsmanagersbehaviorwhichisindifferenttothesafetyandhealthofPartyB,PartyBmayhavetherighttoinformandreporttotherelevantgovernmentdepartments.E. IfPartyBsufferoccupationaldisease,work-relatedinjuryordeathduetowork,PartyAshallhandleitinaccordancewith
29、“workinjuryinsuranceregulations*.Article 8 ModificationoftheEmploymentContractA. EitherofthePartiesmaymodifyrelevanttermsoftheEmploymentContractwithwrittennoticetoothers.B. PartyAchangethename,legalrepresentative,principalresponsiblepersonorinvestor;dosenotaffecttheperformanceofthecontract.C. IfPart
30、yAoccurtheeventofmergerordivision,thecontractsremaininforce,andshallcontinuouslyperformbytheunitsucceededPartyAsrightsandobligations.D. Thetwopartiesmayalterthelaborcontractthroughmutualconsultationandagreement,andhandlechangeproceduresinwriting.Afterthechangeoflaborcontract,eachpartyholdsone.Articl
31、e 9 CancellationandTerminationoftheEmploymentContractA.Cancellation1. Thepartiesmayterminatethelaborcontractthroughmutualconsultationandagreement.IfPartyAproposestoterminatethiscontract,shallpaytheeconomiccompensationtoPartyBbyrule.2. PartyAmayterminatetheemploymentcontractunderanyofthefollowingcirc
32、umstancesinvolvingPartyB:(1) PartyBbeenproventobeincompetentfortheemployingrequirementduringprobationalperiod.(2) PartyBseriouslybreachlabordisciplinesorregulationsstipulatedbyPartyA.(3) PartyBneglectshisdutyandengagesinmalpracticesforselfishends,thuscausingsignificantharmtotheinterestsofthePartyA.(
33、4) PartyBbuildlaborrelationshipswithotherunits,tocauseaseriouslyimpactonthecompletionofthetaskofPartyA,orrefusetocorrecttherulesmadebyPartyA.(5) WherePartyBhasconcludedormodifiedthelaborcontractagainstthetrueintentionsofPartyAthroughtheuseoffraud,coercionorexploitationoftheunfavorablepositionofParty
34、A,asaresultofwhichthisagreementisdeemednullandvoid;(6) PartyBisfoundguiltyaccordingtothelawsofRR.C.(7) PartyBisillorinjuredduetonon-workrelation,afterthecompletionofmedical,stillisincompetentforhisoriginalwork,oralternativejobsarrangedbyPartyA.(8) PartyBisincompetentforworkaftertrainingoradjustmento
35、fjobs.(9) Iftheobjectivesituationchangessignificantlythiscontractbasedon,toresultthecontractunabletoperform,andmutualconsentcannotbereachedinchargeofthislaborcontracts.PartyAterminatethiscontractaccordingtoitem(7),(8)and(9),shouldnoticePartyBinwritingbefore30days(orextrapayamonthwagetoPartyB),andpay
36、economiccompensationtoPartyBsubjecttoregulations.IfPartyAterminatethiscontractaccordingtoitem(7),alsoshallpaymedicaltreatmentallowancestoPartyBconformingtorelevantregulations.3. Underanyofthefollowingcircumstances,PartyAcanmakeredundanciesstipulatedbyregulationsandprocedures,andpayeconomiccompensati
37、ontoPartyBbyrule:(1) PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw;(2) ProductionandbusinessoperationofPartyAmetseriousdifficulties;(3) Production,technologicalinnovationorbusinessmethodofPartyAadjusted;(4) Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontrac
38、tunabletoperform.4. PartyBmayterminatethelaborcontractwith30dayspriorwrittennoticetoPartyA;duringtheprobationaryperiodwith3dayspriorwrittennoticetoPartyA.PartyBmayterminatehisemploymentcontractunderanyofthefollowingcircumstancesinvolvingPartyA.PartyAshallpaytheeconomiccompensationtoPartyBbyrule:(1)
39、PartyAhasfailedtoprovidelaborprotectionorworkingconditionsasstipulatedinthelaborcontract;(2) PartAhasfailedtopayremunerationontimeorinfull;(3) PartyAhasfailedtocontributesocialinsurancefundonbehalfofPartyBinaccordancewiththelaw;(4) PartyAspoliciesviolatelawsorregulations,therebyinfringinguponPartyBs
40、rightsandinterests;(5) PartyAhasconcludedormodifiedthelaborcontractagainstthetrueintentionsofPartyBthroughtheuseoffraud,coercionortakingadvantageofPartyB,sunfavorableposition,asaresultofwhichthiscontractorthechangingagreementisdeemednullandvoid;(6) PartyAisexemptedfromitslegalliabilityandPartyBsrigh
41、ts,asaresultofwhichthiscontractisdeemednullandvoid;(7) PartyAviolatesobligatoryprovisioninlawsandregulations,asaresultofwhichthiscontractisdeemednullandvoid;(8) IfPartyAusesviolence,intimidation,oranunlawfulrestraintofindividualfreedomtocompelPartyBtowork,orifPartyAinstructsPartyBtoviolatethelaworen
42、gageinhazardousworkthatendangershispersonalsafety.(9) OthercircumstancesforterminationbyPartyBasspecifiedunderlawsandregulations.Ifthesituationofitem(8)occurs,PartyBhastherighttoterminatethecontractimmediatelywithoutnoticePartyAinadvance.5. Oftheanyofthefollowingcircumstances,PartyAcannotterminateth
43、elaborcontractonthebasisofarticle40and41ofthe,/LaborContractLaws*;(1) PartyBthatconductsoperationsexposinghim/hertooccupationaldiseasehazardshasnotgonethroughanoccupationalhealthexaminationbeforeleavinghispost,orissuspectedofhavinganoccupationaldiseaseandisunderdiagnosisormedicalobservation.(2) Inju
44、redduetotheoccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.(3) Illnessornonwork-relatedinjurywithintheprescribedperiodofmedicaltreatment.(4) Womenworkersinpregnancy,childbirth,breastfeeding.(5) Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfr
45、omhislegalretirementageinthisunit.(6) Othercircumstancesstipulatedbylawsadministrativeregulations.BJermination1. Oncethecontractexpiredorstatutoryterminationconditionoccurs,thecontractshallbeterminated.2. Thecontractterminateduetooneofthefollowingcircumstance,PartyAshouldpayeconomiccompensationtoPar
46、tyBstipulatedbyregulations.(1) InadditiontothePartyAmaintainorimprovetheconditionofthelaborcontracttorenewthelaborcontract,PartyBdisagreetonewalease,thelaborcontractexpires;(2) PartyAwasdeclaredbankruptbycourt.(3) BusinesslicenseofPartyAwasrevoked,ordertoclose,cancellationorearlydissolutionof.(4) Ot
47、hercircumstancesstipulatedbylawsadministrativeregulations.3. WhenPartyBhasthecircumstancesofthefirstparagraph(5)ofarticle8,thecontactexpired,PartyAshallrenewthecontractuntilthecorrespondingcircumstancedisappeared.ButifPartyBsuffersfromoccupationaldiseaseorwork-relatedinjuryandisconfirmedtohavetotall
48、yorpartiallylosttheabilityofwork,PartyAshallexecuteaccordingtoworkinjuryinsuranceregulationsformulatedbynationandprovince.C. IfPartyAillegallydissolvesorterminatesthecontract,PartyBrequeststocarryonthiscontract,PartyAshallcontinuetoperform;PartyBdoesnotrequiretocarryonthecontractorthecontractcannotc
49、ontinuetobeperformed,PartyAshallpaydoublecompensationforPartyBaccordingtoeconomiccompensationstandard.D. ProceduresofthedissolutionorterminationofthecontractWhenrelievingorterminatingthiscontract,PartyAshallshowthecertificateofrelievingorterminatinglaborcontact,andhandletransferformalitiesoffilesandsocialinsurancef
