5、accordancewiththeAtmosphericPollutionPreventionandControlLawofthePeoplesRepublicofChinaandotherlawsandadministrativeregulationsforpurposeofregulatingtheemissionsrecallsofmotorvehicles,protectingandimprovingtheenvironment,andsafeguardinghumanhealth.第一条为了规范机动车排放召回工作,保护和改善环境,保障人体健康,根据中华人民共和国大气污染防治法等法律、
6、行政法规,制定本规定。Article2TheseProvisionsshallapplytotheemissionsrecallsofmotorvehiclesandthesupervisionandadministrationthereofwithintheterritoryofthePeoplesRepublicofChina.第二条在中华人民共和国境内开展机动车排放召回及其监督管理,适用本规定。Article3ForthepurposeoftheseProvisions,emissionsrecallmeansthetakingofmeasuresbyamotorvehiclemanuf
7、acturertoeliminatemotorvehicleemissionshazards.第三条本规定所称排放召回,是指机动车生产者采取措施消除机动车排放危害的活动。ForthepurposeoftheseProvisions,“emissionshazardsmeansasituationthatdoesnotconformtothenationalstandardsforthedischargeofairpollutantscommonlyexistinginasamebatch,model,orcategoryofmotorvehiclesduetodesignorproductio
8、ndefectsornon-compliancewiththespecifiedenvironmentalprotectiondurabilityrequirements.本规定所称排放危害,是指因设计、生产缺陷或者不符合规定的环境保护耐久性要求,致使同一批次、型号或者类别的机动车中普遍存在的不符合大气污染物排放国家标准的情形。Article4Whereamotorvehiclehasemissionshazards,itsmanufacturershallmakearecall.第四条机动车存在排放危害的,其生产者应当实施召回。进口机动车的进口商,视为本 规定所称的机动车生产者。Theimp
9、orterofanimportedmotorvehicleshallbedeemedasthemanufacturerofthemotorvehicleasmentionedintheseProvisions.第五条国家市场监督管 理总局会同生态环境部负责机 动车排放召回监督管理工作。Article5TheStateAdministrationforMarketRegulation,togetherwiththeMinistryofEcologyandEnvironment,shallberesponsibleforthesupervisionandadministrationofmotorv
10、ehicleemissionsrecalls.国家市场监督管理总局和生态 环境部可以根据工作需要,委 托各自的下一级行政机关承担 本行政区域内机动车排放召回 监督管理有关工作。TheStateAdministrationforMarketRegulationandtheMinistryofEcologyandEnvironmentmay,asneededinwork,authorizetheirrespectiveadministrativeauthoritiesatthenextlowerleveltoundertakethesupervisionandadministrationofmot
11、orvehicleemissionsrecallswithintheirrespectiveadministrativeareas.国家市场监督管理总局和生态 环境部可以委托相关技术机构 承担排放召回的技术工作。TheStateAdministrationforMarketRegulationandtheMinistryofEcologyandEnvironmentmayauthorizerelevanttechnicalinstitutionstoundertakethetechnicalworkofemissionsrecalls.第六条国家市场监督管 理总局负责建立机动车排放召 回信息系
12、统和监督管理平台, 与生态环境部建立信息共享机 制,开展信息会商。Article6TheStateAdministrationforMarketRegulationshallberesponsibleforestablishinganinformationsystemandsupervisionandmanagementplatformformotorvehicleemissionsrecalls.Itshall,alongwiththeMinistryofEcologyandEnvironment,establishaninformation-sharingmechanismtocarryo
13、utinformationconsultation.第七条 生态环境部负责 收集和分析机动车排放检验检 测信息、污染控制技术信息和 排放投诉举报信息。Article7TheMinistryofEcologyandEnvironmentshallberesponsibleforthecollectionandanalysisofinformationonmotorvehicleemissionsinspectionandtesting,pollutioncontroltechnology,andemissionscomplaintsandtip-offs.设区的市级以上地方生态环境Theloca
14、lecologyandenvironmentauthorityatorabovethelevelofadistrictedcityshallcollectandanalyze information on motor vehicle emissions inspection and testing, pollution control technology and emissions complaints and tip-offs, and escalate the information that may relate to emissions hazards to the Ministry
15、 of Ecology and Environment.部门应当收集和分析机动车排 放检验检测信息、污染控制技 术信息和排放投诉举报信息, 并将可能与排放危害相关的信 息逐级上报至生态环境部。Article 8 The manufacturer of a motor vehicle shall record and keep information on the design, manufacture, emissions inspection and testing of the motor vehicle as well as information on the owner of the
16、 motor vehicle sold for the first time, and such information shall be kept for not less than ten years.Article 9 A motor vehicle manufacturer shall, in a timely manner, report the following information through the Information System for Motor Vehicle Emissions Recalls:第八条机动车生产者应 当记录并保存机动车设计、制 造、排放检验
17、检测等信息以及 机动车初次销售的机动车所有 人信息,保存期限不得少于 10年。第九条机动车生产者应 当及时通过机动车排放召回信 息系统报告下列信息:1. The name and warranty period of emission system parts and components;(一)排放零部件的名称和质 保期信息;2. Maintenance information and failure cause analysis report on the abnormal failure of emission system parts and components;(二)排放零部件的异
18、常故障 维修信息和故障原因分析报 告;3. Information on notifications and announcements relating to motor vehicle emissions-related maintenance, remote upgrading, and technical services;(三)与机动车排放有关的维 修与远程升级等技术服务通 报、公告等信息;4. Information( vehicles in use;on conformity inspections of motor(四)机动车在用符合性检验 信息;(五)与机动车排放有关的诉 讼
19、、仲裁等信息;5. Informationonlitigationsandarbitrationsrelatingtomotorvehicleemissions;(六)在中华人民共和国境外 实施的机动车排放召回信息;6. InformationonmotorvehicleemissionsrecallsconductedoutsidetheterritoryofthePeoplesRepublicofChina;and(七)需要报告的与机动车排 放有关的其他信息。7. Otherinformationrelatingtomotorvehicleemissionsthatisrequiredto
20、bereported.前款规定信息发生变化的,机 动车生产者应当自变化之日起 20个工作日内重新报告。Intheeventofanychangeintheinformationprescribedintheprecedingparagraph,themotorvehiclemanufacturershallmakeanewreportwithin20workingdaysfromthedateofchange.第十条 从事机动车销 售、租赁、维修活动的经营者 (以下统称机动车经营者)应 当记录并保存机动车型号、规 格、车辆识别代号、数量以及 具体的销售、租赁、维修等信 息,保存期限不得少于5年
21、。Article10Adealerengagedinthesales,lease,andmaintenanceactivitiesofmotorvehicles(hereinafterreferredtoasthel,motorvehicledealern)shallrecordandkeepthemodel,specification,vehicleidentificationcode,andquantityofmotorvehiclesaswellasthespecificinformationonthesales,lease,andmaintenanceofmotorvehicles,a
22、ndallinformationshallbekeptfornotbelessthanfiveyears.第十一条机动车经营 者、排放零部件生产者发现机 动车可能存在排放危害的,应 当向国家市场监督管理总局报 告,并通知机动车生产者。Article 11 Whereamotorvehicledealeroramanufacturerofemissionsystempartsandcomponentsfindsthatthemotorvehiclemayposeemissionshazards,itshallreporttotheStateAdministrationforMarketRegul
23、ationandnotifythemotorvehiclemanufacturer.第十二条机动车生产者 发现机动车可能存在排放危害 的,应当立即进行调查分析, 并向国家市场监督管理总局报 告调查分析结果。机动车生产 者认为机动车存在排放危害 的,应当立即实施召回。Article 12 Whereamotorvehiclemanufacturerdiscoversthemotorvehiclemayposeemissionshazards,itshallimmediatelycarryoutaninvestigationandanalysis,andreporttheinvestigation
24、andanalysisresultstotheStateAdministrationforMarketRegulation.Whereamotorvehiclemanufacturerconsidersthatthemotorvehicleisposingemissionshazards,itshallimmediatelyrecallthevehicle.第十三条国家市场监督 管理总局通过车辆测试等途径 发现机动车可能存在排放危害 的,应当立即书面通知机动车 生产者进行调查分析。Article 13 WheretheStateAdministrationforMarketRegulation
25、discovers,throughvehicletestingorotherchannels,thepossibleemissionshazardsofamotorvehicle,itshallimmediatelysendawrittennoticerequiringthemotorvehicletoconductaninvestigationandanalysis.机动车生产者收到调查分析通 知的,应当立即进行调查分 析,并向国家市场监督管理总 局报告调查分析结果。生产者 认为机动车存在排放危害的, 应当立即实施召回。Uponreceiptofthenotificationofinvest
26、igationandanalysis,themotorvehiclemanufacturershallimmediatelycarryoutaninvestigationandanalysis,andreporttheinvestigationandanalysisresultstotheStateAdministrationforMarketRegulation.Wherethemanufacturerconsidersthatthemotorvehicleisposingemissionshazards,itshallimmediatelyrecallthevehicle.第十四条有下列情
27、形之 一的,国家市场监督管理总局 会同生态环境部可以对机动车 生产者进行调查,必要时还可 以对排放零部件生产者进行调 查:Article 14 Underanyofthefollowingcircumstances,theStateAdministrationforMarketRegulation,inconjunctionwiththeMinistryofEcologyandEnvironment,mayinvestigatethemotorvehiclemanufacturer,andifnecessary,themanufacturerofemissionsystempartsandco
28、mponents:(一)机动车生产者未按照通 知要求进行调查分析,或者调 查分析结果不足以证明机动车 不存在排放危害的;1. Themotorvehiclemanufacturerfailstocarryoutaninvestigationandanalysisasrequiredbythenotification,ortheinvestigationandanalysisresultsarenotenoughtoprovethatthemotorvehicledoesnotposeemissionshazards;(二)机动车造成严重大气污 染的;2. Themotorvehiclecaus
29、esseriousatmosphericpollution;or(三)生态环境部在大气污染 防治监督检查中发现机动车可 能存在排放危害的。3. TheMinistryofEcologyandEnvironmentdiscovers,inthecourseofsupervisionandinspectionofthepreventionandcontrolofairpollution,thatthemotorvehiclemaycauseemissionshazards.第十五条国家市场监督 管理总局会同生态环境部进行 调查,可以采取下列措施:Article15TheStateAdministr
30、ationforMarketRegulationmay,inconjunctionwiththeMinistryofEcologyandEnvironment,takethefollowingmeasuresforpurposesofinvestigation:(一)进入机动车生产者、经 营者以及排放零部件生产者的 生产经营场所和机动车集中停 放地进行现场调查;(二)查阅、复制相关资料和1. Conductingon-siteinvestigationintheproductionandbusinesssitesofmotorvehiclemanufacturers,dealers,andma
31、nufacturersofemissionsystempartsandcomponentsandcentralizedparkingplacesformotorvehicles;2. Consultingandcopyingrelevantmaterialsand记录;records;(三)向有关单位和个人询问 机动车可能存在排放危害的情 况;3. Makinganinquiryofrelevantentitiesandindividualsaboutthepossibleemissionshazardsfrommotorvehicles;(四)委托技术机构开展机动 车排放检验检测;4. Au
32、thorizingtechnicalinstitutionstocarryoutmotorvehicleemissionsinspectionsandtests;and(五)法律、行政法规规定的 可以采取的其他措施。5. Othermeasuresthatmaybetakenasprescribedbylawsandadministrativelawsandregulations.机动车生产者、经营者以及排 放零部件生产者应当配合调 查。Themotorvehiclemanufactureranddealerandthemanufacturerofemissionsystempartsandc
33、omponentsshallbecooperativeintheinvestigation.第十六条经调查认为机 动车存在排放危害的,国家市 场监督管理总局应当书面通知 机动车生产者实施召回。机动 车生产者认为机动车存在排放Article 16 Whereamotorvehicleisconsideredtobeposingemissionshazardsafterinvestigation,theStateAdministrationforMarketRegulationshallprovideawrittennotificationthatthemotorvehiclemanufactur
34、ershouldrecallthevehicle.Whereamotorvehiclemanufacturerconsidersthatthemotorvehicleisposingemissionshazards,it危害的,应当立即实施召回。shallimmediatelyrecallthevehicle.第十七条机动车生产者 认为机动车不存在排放危害 的,可以自收到通知之日起 15个工作日内向国家市场监 督管理总局提出书面异议,并 提交证明材料。国家市场监督管理总局应当会 同生杰环境部对机动车生产者 提交的材料进行审查,必要时 可以组织与机动车生产者无利 害关系的专家采用论证、检验 检测
35、或者鉴定等方式进行认 定。Article 17 Wherethemotorvehiclemanufacturerconsidersthatthemotorvehicleposesnoemissionhazard,itmay,within15workingdaysfromthedateofreceiptofthenotification,raiseawrittenobjectiontotheStateAdministrationforMarketRegulationandsubmitsupportingmaterials.TheStateAdministrationforMarketRegula
36、tionshall,togetherwiththeMinistryofEcologyandEnvironment,examinethematerialssubmittedbythemotorvehiclemanufacturer,andwhennecessary,maymakearrangementsforexpertswhohavenointerestwiththemotorvehiclemanufacturertodeterminebymeansofdemonstration,inspectionandtestingorappraisal.第十八条机动车生产者 既不按照国家市场监督管理总
37、局通知要求实施召回又未在规 定期限内提出异议,或者经认 定确认机动车存在排放危害 的,国家市场监督管理总局应 当会同生态环境部书面责令机 动车生产者实施召回。Article 18 WherethemotorvehiclemanufacturerneitherrecallsthemotorvehicleasrequiredbythenotificationoftheStateAdministrationforMarketRegulationnorraisesobjectionswithintheprescribedtimelimit,orwherethemotorvehicleisdetermi
38、nedtobeposingemissionshazards,theStateAdministrationforMarketRegulationshall,jointlywiththeMinistryofEcologyandEnvironment,orderinwritingthemanufacturertorecallthevehicle.第十九条机动车生产者 认为机动车存在排放危害或者 收到责令召回通知书的,应当 立即停止生产、进口、销售存 在排放危害的机动车。Article 19 Wherethemotorvehiclemanufacturerconsidersthatthemotorve
39、hicleisposingemissionshazardsorreceivesanotificationofmandatoryrecall,itshallimmediatelysuspendtheproduction,import,orsaleofthemotorvehiclewithemissionshazards.第二十条机动车生产者Article 20 Themotorvehiclemanufacturershallworkoutarecallplan,andsubmittherecallplantotheStateAdministrationforMarketRegulationwit
40、hinfiveworkingdaysfromthedatewhenitconsidersthatthemotorvehicleisposingemissionshazardsorreceivesthenotificationofmandatoryrecall.应当制定召回计划,并自认为 机动车存在排放危害或者收到 责令召回通知书之日起5个工 作日内向国家市场监督管理总 局提交召回计划。机动车生产者应当按照召回计 划实施召回。确需修改召回计 划的,机动车生产者应当自修 改之日起5个工作日内重新提 交,并说明修改理由。Article 21 A recall plan shall include:第
41、二十一条召回计划应 当包括下列内容:1. the scope of motor vehicles to existing emissions hazards, and measures;be recalled, emergency(一)召回的机动车范围、存 在的排放危害以及应急措施;2. the specific recall measures;(二)具体的召回措施;3. the organization responsible for recall, its contact information, and the schedule of recall;(三)召回的负责机构、联系 方式、进度
42、安排等;4. other matters required to be reported.(四)需要报告的其他事项。The motor vehicle manufacturer shall be responsible for the authenticity and accuracy of the recall plan and the effectiveness of the recall measures.机动车生产者应当对召回计划 的真实性、准确性及召回措施 的有效性负责。Article 22 The motor vehicle manufacturer shall notify th
43、e motor vehicle dealer of the recall plan in a timely manner, and publish the recall information to the public within five working days of submission第二十二条机动车生产 者应当将召回计划及时通知机 动车经营者,并自提交召回计Themotorvehiclemanufacturershallrecallthemotorvehicleaccordingtotherecallplan.Whereitisreallynecessarytoamendther
44、ecallplan,themotorvehiclemanufacturershallre-submititwithinfiveworkingdaysfromthedateofamendment,andexplainthereasonstherefor.划之日起5个工作日内向社会 发布召回信息,自提交召回计 划之日起30个工作日内通知 机动车所有人,并提供咨询服 务。oftherecallplan;notifythemotorvehicleownerswithin30workingdaysofsubmissionoftherecallplan,andprovideconsultationserv
45、ices.国家市场监督管理总局应当向 社会公示机动车生产者的召回 计划。TheStateAdministrationforMarketRegulationshallpublicizetherecallplanofthemotorvehiclemanufacturer.第二十三条机动车经营 者收到召回计划的,应当立即 停止销售、租赁存在排放危害 的机动车,配合机动车生产者 实施召回。Article23Themotorvehicledealer,uponreceiptoftherecallplan,shallimmediatelystopsellingorleasingthemotorvehicl
46、eswithemissionshazardsandcooperatewiththemotorvehiclemanufacturerintherecall.机动车所有人应当配合生产者 实施召回。机动车未完成排放 召回的,机动车排放检验机构 应当在排放检验检测时提醒机 动车所有人。第二十四条机动车生产 者应当采取修正或者补充标 识、修理、更换、退货等措施 消除排放危害,并承担机动车 消除排放危害的费用。Themotorvehicleownersshallcooperatewiththeproducerontherecallefforts.Wheretheemissionsrecallofamoto
47、rvehiclehasnotbeencompleted,themotorvehicleemissionsinspectionagencyshallremindthemotorvehicleownerwhenconductingemissionsinspectionandtesting.Article24Themotorvehiclemanufacturershalltakesuchmeasuresasrevisingorsupplementinglabels,repairing,replacingandreturninggoodstoeliminatetheemissionshazards,a
48、ndbeartheexpensesincurredbythemotorvehicleforeliminatingtheemissionshazards.未消除排放危害的机动车,不 得再次销售或者交付使用。Amotorvehiclethathasnotclearedofftheemissionshazardsmaynotbere-soldordeliveredforuse.第二十五条机动车生产 者应当自召回实施之日起每3 个月通过机动车排放召回信息Article 25 Themotorvehiclemanufacturershall,everythreemonthsfromthedateofrecall,submitarecallreportforthecurrentstagethroughthe系统提交召回阶段性报告。国 家市场监督管理总局、生态环 境部另有要求的,依照其要 求。InformationSystemforMotorVehicleEmissionsRecalls,exceptasotherwiseprescribedbytheStateAdministr
