5、ublicofChinaonMarch9,2023)ChapterIGeneralProvisionsArticle 1 TheseMeasuresareenactedaccordingtotheLawofthePeoplesRepublicofChinaonImportandExportCommodityInspectionandtheregulationontheimnlomontatinnthnrnnfcnllcnthnr定行为，维护社会公共利 益和进口贸易有关各方的 合法权益，促进对外贸易 的顺利发展，根据中华 人民共和国进出口商品检 验法及其实施条例，以 及其他相关法律、行政法 规的
6、规定，制订本办法。relevantlawsandadministrativeregulationsforthepurposeofstrengtheningtheinspectionandauthenticationofthedamagetoimportcommodities,regulatingtheinspectionandauthenticationofthedamagetoimportcommoditiesbytheCustomsandvarioussocialinspectioninstitutions,maintainingsocialpublicinterestsandtheleg
7、itimaterightsandinterestsofallthepartiesinvolvedinimporttrade,andpromotingthesmoothdevelopmentofforeigntrade.第二条本办法适用 于中华人民共和国境内的 进口商品残损检验鉴定活 动。第三条海关总署主 管全国进口商品残损检验 鉴定工作，主管海关负责 所辖地区的进口商品残损 检验鉴定及其监督管理工 作。Article 2 TheseMeasuresareapplicabletotheinspectionandauthenticationofthedamagetoimportcommoditie
8、swithintheterritoryofthePeople,sRepublicofChina.第四条主管海关负 责对法定检验进口商品的 残损检验鉴定工作。法检 商品以外的其他进口商品 发生残损需要进行残损检 验鉴定的，对外贸易关系 人可以向主管海关申请残 损检验鉴定，也可以向依 法设立的检验机构申请残 损检验鉴定。Article3TheGeneralAdministrationofCustomsshalltakechargeoftheinspectionandauthenticationofthedamagetoimportcommoditiesacrossthecountry,andthe
9、competentcustomsofficesshallberesponsiblefortheinspectionandauthenticationofthedamagetoimportcommoditieswithintheirrespectivejurisdictionsandtherelevantsupervisoryandadministrativework.Article4Thecompetentcustomsofficesshallberesponsiblefortheinspectionandauthenticationofthedamagetoimportcommodities
10、subjecttocompulsoryinspection.Incasetheimportcommoditiesotherthanthosesubjecttocompulsoryinspectionaredamagedandtheinspectionandauthenticationofthedamageisthusrequired,thepartyinvolvedinforeigntrademayfileanapplicationforinspectingandauthenticatingthedamagewiththecompetentcustomsofficesorwiththeinsp
11、ectioninstitutionlegallyformed.TheCustomsinvariousregionsshallsuperviseandadministratetheinspectionandauthenticationofthedamageascarriedoutbyinspectioninstitutions.Article5TheCustomsshallinspectandauthenticatethedamagetothefollowingdamagedimportcommoditieswhenneeded:(1) .Theimportcommoditiesthathave
12、beenincorporatedintothecatalogueofentry-exitcommoditiesforwhichtheCustomsshallcarryouttheinspectionandquarantine.(2) .Theconsigneeoranyotherpartyinvolvedintradeoftheimportcommoditiesotherthanthosesubjecttocompulsoryinspectionfindsthattheimportcommoditiesarenotuptostandards,aredamagedorrunshort,andth
13、usappliesfortheissuanceofacertificate.(3) .Thedangerousgoods,wasteandoldarticlesasimported.(4) .TheimportcommoditiesforwhichtheverificationmanagementorquotamanagementisimplementedandtheinspectionneedstobecarriedoutbytheCustoms.(5) .Theimportcommoditiessuspectedofbeinginvolvedinfraud.(6) .Theimportco
14、mmoditiesforwhichtheconsigneeoranyotherpartyinvolvedintraderequirestheCustomstoissueacertificateforcompensation.海关对检验机构的残损检 验鉴定行为进行监督管 理。第五条海关根据需 要对有残损的下列进口商 品实施残损检验鉴定：（一）列入海关必须实施 检验检疫的进出境商品目 录内的进口商品；（二）法定检验以外的进 口商品的收货人或者其他 贸易关系人，发现进口商 品质量不合格或者残损、 短缺，申请出证的；（三）进口的危险品、废 旧物品；（四）实行验证管理、配 额管理，并需由海关检验 的进口
15、商品；（五）涉嫌有欺诈行为的 进口商品；（六）收货人或者其他贸 易关系人需要海关出证索 赔的进口商品；（七）双边、多边协议协 定、国际条约规定，或国 际组织委托、指定的进口 商品；(7) .Theimportcommoditiesasprovidedbybilateralormultilateralagreementsorconventions,internationaltreaties,orasauthorizedordesignatedbyinternationalorganizations.(8) .Otherimportcommoditiessubjecttotheinspection
16、oftheCustomsaccordingtorelevantlawsoradministrativeregulations.ChapterIlDeclarationArticle6Incasetheimportcommoditiessubjecttocompulsoryinspectionaredamagedandtheinspectionandauthenticationofdamageisthusrequired,theconsigneeshallapplytothecompetentcustomsofficesfortheinspectionandauthenticationofdam
17、age.Incasetheimportcommoditiesotherthanthosesubjecttocompulsoryinspectionaredamagedandtheinspectionandauthenticationofdamageisthusrequired,theconsigneeoranyotherpartyinvolvedinthetrademayfileanapplicationfortheinspectionandauthenticationofthedamagewiththecompetentcustomsofficesoraninspectioninstitut
18、ionlegallyformed.Article7AconsigneeofimportcommoditiesoranyotherpartyinvolvedintrademayapplytotheCustomsfortheinspectionandauthenticationofdamagebyitself,ormayauthorizeforapplicationformality.Article8AsfortheimportcommoditiesrequestingtheinspectionandquarantineofdamagebytheCustoms,theapplicantshalla
19、pplyfortheinspectionandauthenticationofdamageattheplaceandwithinthetimelimitasprescribedbytheCustoms.()相关法律、行政法 规规定须经海关检验的其 他进口商品。第二章申报第六条法定检验进 口商品发生残损需要实施 残损检验鉴定的，收货人 应当向主管海关申请残损 检验鉴定；法定检验以外 的进口商品发生残损需要 实施残损检验鉴定的，收 货人或者其他贸易关系人 可以向主管海关或者依法 设立的检验机构申请残损 检验鉴定。第七条进口商品的 收货人或者其他贸易关系 人可以自行向海关申请残 损检验鉴定，也可以委
20、托 办理申请手续。第八条需由海关实 施残损检验鉴定的进口商 品，申请人应当在海关规 定的地点和期限内办理残 损检验申请手续。第九条进口商品发 生残损或者可能发生残损 需要进行残损检验鉴定 的，进口商品的收货人或 者其他贸易关系人应当向 进口商品卸货口岸所在地Article9Incasetheimportcommoditiesaredamagedorarelikelytobedamagedandtheinspectionandauthenticationofdamageisthusrequired,theconsigneeofimportcommoditiesoranyotherpartyinv
21、olvedintradeshallapplyfortheinspectionandQiIthantieotinnCfrlmctntho7ctnmcofIncasetheimportcommoditiesarefounddamagedbeforebeingtransportedtotheportfordischargingimportcommodities,orthetransportvehicleencounters,suffersorshowsanybadfactorduringthecourseofloadingandwhichmaycausethedamageorlosstocommod
22、ities,theconsigneeofimportcommoditiesoranyotherpartyinvolvedintradeshallfileanapplicationbeforetheimportcommoditiesarriveattheportfordischargingimportcommodities,orfileanapplicationnolaterthantheremovalofcontainers,openingofcabinorcontainers.Incaseanydamagetoimportcommoditiesisfoundorhappensduringth
23、eprocessofdischarge,thedischargeofcommoditiesshallbestoppedandanapplicationshallbefiledimmediately.Article10Incasetheimportcommoditiesaredamagedandacertificateisneededforclaimingcompensationfromtheforeignparty,theconsigneeofimportcommoditiesoranyotherpartyinvolvedintradeshallfileanapplicationnolater
24、than20daysuponexpirationofthevaliditytermforcompensation.进口商品在运抵进口卸货 口岸前已发现残损或者其 运载工具在装运期间存 在、遭遇或者出现不良因 素而可能使商品残损、灭 失的，进口商品收货人或 者其他贸易关系人应当在 进口商品抵达进口卸货口 岸前申请，最迟应当于船 舱或者集装箱的拆封、开 舱、开箱前申请。进口商品在卸货中发现或 者发生残损的，应当停止 卸货并立即申请。第十条进口商品发 生残损需要对外索赔出证 的，进口商品的收货人或 者其他贸易关系人应当在 索赔有效期届满20日前 申请。第十一条需由海关 实施残损检验鉴定的进口 商品，
25、收货人或者其他贸 易关系人应当保护商品及 其包装物料的残损现场现 状，将残损商品合理分卸 分放、收集地脚，妥善保 管；对易扩大损失的残损 商品或者正在发生的残损 事故，应当及时采取有效Article11AsfortheimportcommoditiesrequestingtheinspectionandquarantineofdamagebytheCustoms,theconsigneeoranyotherpartyinvolvedintradeshallpreservethedamagestatusofcommoditiesandtheirpackingmaterials,unloadand
26、placethedamagedcommoditiesseparately,collecttailmarginsandproperlykeepthem.Asforthedamagedcommoditieseasytoexpandlossesoranyongoingdamageaccident,effectiverescuemeasuresshallbetimelyadoptedsoastn+rmintothoQnnirlontandnronntthoexpansionoflosses.Article12Whenaconsigneeoranyotherpartyinvolvedintradeapp
27、liesfortheinspectionandauthenticationofthedamagetoimportcommodities,itshallapplytotheCustomsforthefollowinginspectionitemsbyconsideringtheactualitiesandaccordingtointernationalpractice:(1) .themonitoringofloadingorunloading.(2) .theinspectionofcabinsorcontainers.(3) .theinspectionofcontainerdevannin
28、gprocess.(4) .otherrelevantinspectionitems.ChapterIIIInspectionandAuthenticationArticle13TheCustomsshallcarryouttheinspectionandauthenticationofdamageaccordingtothecompulsorytechnicalcriteriaofthestate.Wheretherelevantcriteriaorstandardshavenotbeenformulatedyet,therelevantforeigntechnicalcriteriaand
29、standardsforinspectionmaybeusedasreference.Article 14 Wheretheimportcommoditiesareunderanyofthefollowingcircumstances,theinspectionandauthenticationshallbecarriedoutattheportofdischarge:(1) .Thebulkimportcommoditiesaredefective.施救措施，中止事故和防 止残损扩大。第十二条收货人或 者其他贸易关系人在办理 进口商品残损检验鉴定申 请手续时，还应当根据实 际情况并结合国际通
30、行做 法向海关申请下列检验项 目：（一）监装监卸；（二）船舱或集装箱检验;（三）集装箱拆箱过程检 验；（四）其他相关的检验项 目。第三章检验鉴定第十三条海关按国 家技术规范的强制性要求 实施残损检验鉴定。尚未 制订规范、标准的可以参 照国外有关技术规范、标 准检验。第十四条进口商品 有下列情形的，应当在卸 货口岸实施检验鉴定：（一）散装进口的商品有 残损的；（二）商品包装或商品外 表有残损的；(2) .Thepackageorappearanceofcommoditiesisdefective.(3) .Thecontainersforcarryingimportcommoditiesareb
31、roken.Article 15 Wheretheimportcommoditiesareunderanyofthefollowingcircumstances,theyshallbetransferredtothedestinationofcommoditiesforinspectionandauthentication:(1) .Theyshallbeimmediatelyremovedfromtheportaccordingtotheprovisionsofthestate.(2) .Itisdifficulttorestitute,load,unloadortransporttheco
32、mmoditiesafteropeningthepackagesforinspection.(3) .Thereasons,extent,volumeandvalueofdamageneedtobedeterminedintheinstallation,debuggingoruse.（三）承载进口商品的集 装箱有破损的。第十五条进口商品 有下列情形的，应当转单 至商品到达地实施检验鉴 定：（一）国家规定必须迅速 运离口岸的；(4) .Thereisnocleardamagetothepackageorappearanceofcommodities,andfurtherinspectionnee
33、dstobeimplementedintheinstallation,debuggingoruse.Article 16 WhentheCustomsfindsthattheactualsituationoftheprojectunderapplicationdoesnotconformtothetechnicalcriteriaandstandardsforinspectionwhencarryingouttheinspectionandauthenticationofdamage,andwhichwillaffectthenormalinspectionortheaccuracyofins
34、pectionresults,itshalltimelynotifytheconsigneeoranyotherpartyinvolvedintrade;andtheconsigneeoranyotherpartyinvolvedintradeshallworkinconjunctionwiththeinspectionandquarantine.（二）打开包装检验后难 以恢复原状或难以装卸运 输的；（三）需在安装调试或使 用中确定其致损原因、损 失程度、损失数量和损失 价值的；（四）商品包装和商品外 表无明显残损，需在安装 调试或使用中进一步检验 的。第十六条海关在实 施残损检验鉴定时，发现
35、 申请项目的实际状况与检 验技术规范、标准的要求 不符，影响检验正常进行 或者检验结果的准确性， 应当及时通知收货人或者 其他贸易关系人；收货人 或者其他贸易关系人应当 配合检验检疫工作。第十七条海关在实 施残损检验鉴定过程中， 的华人或者苴仙帝易辛豕Article17WhiletheCustomsiscarryingouttheinspectionandauthenticationofdamage,theconsigneeoranyotherpartyinvolvedintradeshalltakeeffectivemeasurestoensurethattheconditionsandsi
36、tuationofthesceneconformtothetechnicalcriteriaandstandardsforinspection.BeforetheCustomsissuesitshandlingopinions,noentityorindividualmaymakehandlingatwill.IncasetheconditionsandsituationofthescenedonotconformtothetechnicalcriteriaandstandardsforinspectionassetdownintheseMeasures,theCustomsmaysuspen
37、dtheinspectionandquarantine,ordertheconsigneeoranyotherpartyinvolvedintradetotakeeffectivemeasuressoastoguaranteethesmoothoperationoftheinspection.Article18Afteranapplicationforinspectionandauthenticationofdamageisfiledforthedamagedimportcommoditiesinvolvingthepersonalorpropertysafety,hygiene,health
38、orenvironmentalprotection,theapplicantandtherelevantpartiesshallunloadandplacethemseparately,sealthemupforpreservation,andproperlyhandlethemasrequiredbytheCustoms.Article19Asfortheunqualifiedanddamagedimportcommoditiesinvolvingthepersonalorpropertysafety,hygiene,healthorenvironmentalprotection,etc.,
39、iftheCustomsordersthereturnordestructionofcommodities,theconsigneeoranyotherpartyinvolvedintradeshall,accordingtolegalprovisions,handletheformalitiesforreturnofcommoditiesatthecustoms,destroythecommodities,andreportthehandlingconditionstotheCustomsthathasmadethedecision.人应当采取有效措施保证 现场条件和状况，符合检 验技术规范
40、、标准的要求。海关未依法作出处理意见 之前，任何单位和个人不 得擅自处理。如果现场条件和状况不符 合本办法规定或检验技术 标准、规范要求，海关可 以暂停检验鉴定，责成收 货人或者其他贸易关系人 及时采取有效措施，确保 检验顺利进行。第十八条涉及人身 财产安全、卫生、健康、 环境保护的残损的进口商 品申请残损检验鉴定后， 申请人和有关各方应当按 海关的要求，分卸分放、 封存保管和妥善处置。第十九条对涉及人 身财产安全、卫生、健康、 环境保护等项目不合格的 发生残损的进口商品，海 关责令退货或者销毁的， 收货人或者其他贸易关系 人应当按照规定向海关办 理退运手续，或者实施销 毁，并将处理情况报作出
41、 决定的海关。第二十条海关实施 旄擢裕的鉴宗扃4文用翎Article20TheCustomsshall,whencarryingouttheinspectionandauthenticationofdamage,makeon-sitesurveys,records,takephotos,ormakeaudio-videomaterials.Therelevantentitiesandindividualsshalloffercooperation,andconfirmtherecordsbybearingsignaturesonthem;andanoteshallbemadeifanyofth
42、emhasanydifferentopinion.ChapterIVSupervisionandAdministrationArticle21TheCustomsinalltheregionsshallsuperviseandadministratevariousimportandexportcommodityinspectioninstitutionsestablishedwithintheterritory,domesticentitiesandpersonsengagingintheinspectionandauthenticationofthedamagetoimportcommodi
43、ties,aswellastheiractivities.Article22Variouslegallyformeddomesticandoverseasinspectioninstitutionsmayaccepttheauthorizationofthepartiesinvolvedinforeigneconomyandtradefortheinspectionandauthenticationofthedamagetoimportcommodities.Thesaidinspectioninstitutionsshallabidebylaws,administrativeregulati
44、ons,besubjecttothesupervisionandadministrationoftheCustoms,aswellasaccepttheinvestigationandpunishmentmadebyGeneralAdministrationofCustomsandthesaidtheCustomsfortheirillegalactionorwrongdoing.ChapterVSupplementaryProvisions场勘查，并进行记录、拍 照或录音、录像。有关单 位和个人应当予以配合， 并在记录上签字确认，如 有意见分歧，应当备注。第四章监督管理第二十一条海关依 法对
45、在境内设立的各类进 出口商品检验机构和在境 内从事涉及进口商品残损 检验鉴定的机构、人员及 活动实行监督管理。第二十二条依法设 立的境内外各类检验机构 可以接受对外经济贸易关 系人的委托办理进口商品 的残损检验鉴定。上述各检验机构应当遵守 法律、行政法规的规定， 接受海关的监督管理和对 其违法违规活动的查处。第五章附则第二十三条收货人 或者其他贸易关系人对主 管海关的残损检验鉴定结 果有异议的，可以在规定 的期限内向作出检验鉴定 结果的主管海关或者其上 一级海关以至海关总署申Article23Incaseaconsigneeoranyotherpartyinvolvedintradeholds
46、anobjectiontotheinspectionandauthenticationresultsaboutdamageasmadebythecompetentcustomsoffices,itmay,withintheprescribedtimelimit,applyforre-inspectiontothecompetentcustomsofficesthatmadetheinspectionandQiIthontieotinnrocltcnr+hoctnmc*+thonexthigherlevelevenuptoGeneralAdministrationofCustoms,andsim
47、ultaneouslypreservethesceneandthestatusofthecommodities.TheCustomsthathasacceptedthere-inspectionapplicationshalldrawthere-inspectionconclusionaccordingtotherelevantprovisionsonthere-inspection.Incaseanypartyinvolvedholdsanobjectiontothere-inspectionconclusionasdrawnbytheCustoms,itmayapplyforadminis
48、trativereconsideration,ormaylodgealawsuitwiththepeoplescourt.Article24Incaseanypartyinvolvedholdsanobjectiontotheinspectionandauthenticationresultsaboutdamageasmadebyanyotherinspectioninstitutionitauthorized,itmaylodgeacomplaintwiththelocalCustoms,andsimultaneouslypreservethesceneandthecargostatus.A
49、rticle25InthecaseofanyviolationoftheseMeasures,theCustomsshallpunishtherelevantpersonheldtoberesponsibleaccordingtotheLawofthePeople,sRepublicofChinaonImportandExportCommodityInspectionandtheregulationontheimplementationthereof.Article26TheCustomsshallcollectchargesaccordingtotherelevantprovisionsof
