4、cavationinthecoursesoftheYangtzeRiver,maintainingthestabilityoftheYangtzeRiverandsafeguardingfloodprotectionandnavigation.Article2TheactivitiesofsandexcavationinthemainrivercoursesbelowYibinSectionoftheYangtzeRiver(hereafterreferredtoasthesandexcavationintheYangtzeRiver),andtheadministrativeactiviti
5、esthereofshallconformtotheseRegulations.Article3ThecompetentwateradministrativedepartmentandtheYangtzeRiverConservancyCommissionunderitshallenhanceunifiedadministrationandsupervisionofthesandexcavationintheYangtzeRiveranddowelltheworkofrelevantorganization,coordinationandguidance.Theresponsibilitysy
6、stembytheadministrativeheadsofthelocalpeoplesgovernmentsispracticedforadministrationofthesandexcavationintheYangtzeRiver.Thelocalpeople,sgovernmentsatoratorabovethecountylevelalongtheRivershallstrengthenadministrationofactivitiesofthesandexcavationintheYangtzeRiverwithintheirrespectiveadministrative
7、areas,anddowelltheworkoforganization,coordinationandsupervisionofthesandexcavationintheYangtzeRiver.ThecompetentwateradministrativedepartmentsofthelocalpeoplesgovernmentsatorabovethecountylevelalongtheRiverareinchargeofadministrationandsupervisionofthesandexcavationintheYangtzeRiverwithintheirrespec
8、tiveadministrativeareasinaccordancewiththeseRegulations.第二条在长江宜宾以 下干流河道内从事开采砂石 （以下简称长江采砂）及其 管理活动的，应当遵守本条 例。第三条国务院水行政 主管部门及其所属的长江水 利委员会应当加强对长江采 砂的统一管理和监督检查， 并做好有关组织、协调和指 导工作。长江采砂管理，实行地方人 民政府行政首长负责制。沿 江县级以上地方人民政府应 当加强对本行政区域内长江 采砂活动的管理，做好长江 采砂的组织、协调和监督检 查工作。沿江县级以上地方人民政府 水行政主管部门依照本条例 的规定，具体负责本行政区 域内长江采砂
9、的管理和监督 检查工作。国务院交通行政主管部门所 属的长江航务管理局负责长 江航道管理工作，长江海事 机构负责长江交通安全的监TheYangtzeRiverShippingAffairsAdministrationofthecompetentcommunicationsadministrativedepartmentoftheStateCouncilisresponsiblefornavigationadministrationoftheYangtzeRiver.TheYangtzeRiverMaritimeAffairsAdministrationisresponsibleforthesup
10、ervisionandadministrationofnavigationsafetyoftheYangtzeRiver.ThepublicsecuritydepartmentisresponsibleforthepublicsecurityoftheYangtzeRiver,andforcrackingdowncriminalactsinactivitiesofthesandexcavationintheYangtzeRiveraccordingtothelaw.Article 4 TheStateinstitutesaunifiedplanningsystemforthesandexcav
11、ationintheYangtzeRiver.TheplanforthesandexcavationintheYangtzeRivershallbecompiledbytheYangtzeRiverConservancyCommissionjointlywiththecompetentwateradministrativedepartmentsofthepeoplesgovernmentsofSichuanProvince,HubeiProvince,HunanProvince,JiangxiProvince,AnhuiProvinceandJiangsuProvince,ChongqingM
12、unicipalityandShanghaiMunicipalityandsubmittedforapprovaltothecompetentwateradministrativedepartmentoftheStateCouncil,afterseekingcommentsfromtheYangtzeRiverShippingAffairsAdministrationandtheYangtzeRiverAffairsMaritimeAdministration,andthecompetentwateradministrativedepartmentoftheStateCouncilshall
13、solicitthecommentsofthecompetentcommunicationsadministrativedepartmentoftheStateCouncilpriortotheapproval.TheplanforthesandexcavationintheYangtzeRiveronceisapproved,itmustbestrictlyimplemented;ifanyamendmentisneeded,theapprovalshallbeobtainedinaccordancewiththeprovisionsoftheprecedingparagraph.督管理工作
14、。公安部门负责 长江水上治安管理工作，依 法打击长江采砂活动中的犯 罪行为。第四条国家对长江采 砂实行统一规划制度。长江采砂规划由长江水利委 员会会同四川省、湖北省、 湖南省、江西省、安徽省、 江苏省和重庆市、上海市人 民政府水行政主管部门编 制，经征求长江航务管理局 和长江海事机构意见后，报 国务院水行政主管部门批 准。国务院水行政主管部门 批准前，应当征求国务院交 通行政主管部门的意见。长江采砂规划一经批准，必 须严格执行；确需修改时， 应当依照前款规定批准。长江采砂规划批准实施前， 长江水利委员会可以会同沿 江省、直辖市人民政府水行 政主管部门、长江航务管理 局和长江海事机构确定禁采 区
15、和禁采期，报国务院水行PriortotheapprovalandimplementationoftheplanforthesandexcavationintheYangtzeRiver,theYangtzeRiverConservancyCommissionshalldefineexcavationforbiddenareasandexcavationforbiddenperiodsjointlywiththecompetentwateradministrationsofthepeoplesgovernmentsoftheprovincesormunicipalitiesdirectlyund
16、ertheCentralGovernmentalongtheRiver,theYangtzeRiver政主管部门批准。ShippingAffairsAdministrationandtheYangtzeRiverMaritimeAffairsAdministration,andsubmitthemtothecompetentwateradministrativedepartmentoftheStateCouncilforapproval.Article 5 TheplanforthesandexcavationintheYangtzeRivershalltakeintofullaccounto
17、ftherequirementsofsafetyoffloodprotectionandnavigationoftheYangtzeRiver,andcomplywiththecomprehensiveplanfortheYangtzeRiverBasinandtheprofessionalprogramssuchasfloodcontrol,harnessoftherivercoursesandharnessofthenavigationcoursesoftheYangtzeRiver.Article 6 TheplanforthesandexcavationintheYangtzeRive
18、rshallincludethefollowingcontents;(1) excavationforbiddenandpermittedareas;(2) excavationforbiddenandpermittedperiods;(3) annualcontrolledtotalquantityforsandexcavation;and(4) controllednumberofexcavationvesselsinthepermittedareas.第五条长江采砂规划 应当充分考虑长江防洪安全 和通航安全的要求，符合长 江流域综合规划和长江防 洪、河道整治以及航道整治 等专业规划。第六
19、条长江采砂规划 应当包括下列内容：（一）禁采区和可采区;（二）禁采期和可采期;（三）年度采砂控制总量;（四）可采区内采砂船只的 控制数量Q第七条沿江省、直辖 市人民政府水行政主管部门 根据长江采砂规划，可以拟 订本行政区域内长江采砂规 划实施方案，报本级人民政 府批准后实施，并报长江水 利委员会、长江航务管理局 备案。Article7ThecompetentwateradministrativedepartmentsofthepeoplesgovernmentsoftheprovincesandmunicipalitiesdirectlyundertheCentralGovernmentalo
20、ngtheRiver,accordingtotheplanforthesandexcavationintheYangtzeRiver,mayworkoutimplementationplansforthesandexcavationintheYangtzeRiverwithintheirrespectiveadministrativeareasandputthemintoeffectaftertheapprovaloftheirpeoplegovernments,andreportthemfortherecordtotheYangtzeRiverConservancyCommissionand
21、theYangtzeRiverShippingAffairsAdministration.ThepeoplesgovernmentsoftheprovincesormunicipalitiesdirectlyundertheCentralGovernmentalongtheRivershallissueannouncementsfortheexcavationforbiddenandpermittedareasdefinedintheplanforthesandexcavationintheYangtzeRiver.Thecompetentwateradministrativedepartme
22、ntsofthepeoplesgovernmentsoftheprovincesandmunicipalitiesdirectlyundertheCentralGovernmentalongtheRiver,inlinewiththeconditionsoftheriver,engineeringworks,floods,changesofrivercoursesandmanagementneeds,mayaddtheexcavationforbiddenscopeandextendedforbiddenperiodsbeyondtheexcavationforbiddenareasandex
23、cavationforbiddenperioddefinedintheplanforthesandexcavationintheYangtzeRiver,andissueannouncementsafterthedecisionsaremadebytheirpeople,sgovernments.Article 8 TheYangtzeRiverConservancyCommissionandthecompetentwateradministrativedepartmentsofthepeoplesgovernmentsoftheprovincesandmunicipalitiesdirect
24、lyundertheCentralGovernmentalongtheRivershallstrengthenthesupervisionandinspectionoftheimplementationoftheplanforthesandexcavationintheYangtzeRiver.Article 9 TheStatecarriesoutalicensingsystemforthesandexcavationintheYangtzeRiver.沿江省、直辖市人民政府应 当将长江采砂规划确定的禁 采区和禁采期予以公告。沿江省、直辖市人民政府水 行政主管部门可以根据本行 政区域内长江的
25、水情、工 情、汛情、航道变迁和管理 等需要，在长江采砂规划确 定的禁采区、禁采期外增加 禁采范围、延长禁采期限， 报本级人民政府决定后公 告Q第八条长江水利委员 会和沿江省、直辖市人民政 府水行政主管部门应当加强 对长江采砂规划实施情况的 监督检查。第九条国家对长江采 砂实行采砂许可制度。河道采砂许可证由沿江省、 直辖市人民政府水行政主管 部门审批发放；属于省际边Thelicensesofthesandexcavationintherivercourseareapprovedandissuedbythecompetentwateradministrativedepartmentsofthepe
26、oplesgovernmentsoftheprovincesandmunicipalitiesdirectlyundertheCentralGovernmentalongtheRiver;thelicensesofsandexcavationinthemajorsectionswithintheboundariesofmorethantwoprovincesormunicipalitiesdirectlyundertheCentralGovernmentshallbeapprovedandissuedbytheYangtzeRiverConservancyCommission,alongthe
27、Riversigntheircomments;forthelicensesofsandexcavationinthenavigationcourses,beforetheyareapprovedandissued,commentsshallbesolicitedfromtheYangtzeRiverShippingAffairsAdministrationandtheYangtzeRiverMaritimeAffairsAdministration.Thescopeofthemajorriversectionswithintheboundariesofmorethantwoprovinceso
28、rmunicipalitiesdirectlyundertheCentralGovernmentshallbedeterminedbythecompetentadministrativewaterdepartmentoftheStateCouncil.TheformatforthelicenseofthesandexcavationintherivercourseshallbespecifiedbythecompetentwateradministrativedepartmentoftheStateCouncil,andprintedbythecompetentwateradministrat
29、ivedepartmentsofthepeoplesgovernmentsoftheprovincesandmunicipalitiesdirectlyundertheCentralGovernmentalongtheRiverandtheYangtzeRiverConservancyCommission.界重点河段的，经有关省、 直辖市人民政府水行政主管 部门签署意见后，由长江水 利委员会审批发放；涉及航 道的，审批发放前应当征求 长江航务管理局和长江海事 机构的意见。省际边界重点 河段的范围由国务院水行政 主管部门划定。河道采砂许可证式样由国务 院水行政主管部门规定，由 沿江省、直辖市人民
30、政府水 行政主管部门和长江水利委 员会印制O第十条从事长江采砂 活动的单位和个人应当向沿 江市、县人民政府水行政主 管部门提出申请；符合下列 条件的，由长江水利委员会 或者沿江省、直辖市人民政 府水行政主管部门依照本条 例第九条的规定，审批发放 河道采砂许可证：Article 10 Theentitiesandindividualsengagedinactivitiesofsandexcavationshallsubmitapplicationstothecompetentwateradministrativedepartmentsofthepeople,sgovernmentsoftheci
31、tiesorcountiesalongtheRiver;wherethefollowingconditionsaremet,thelicensesofthesandexcavationintherivercourseshallbeapprovedandissuedbytheYangtzeRiverConservancyCommissionorbythecompetentwateradministrativedepartmentsofthepeoplesgovernmentsoftheprovincesormunicipalitiesdirectlyundertheCentralGovernme
32、ntalongtheRiveraccordingtotheprovisionsoftheArticle9oftheseRegulations:(1) conformingtotherequirementsofexcavationpermittedareasandexcavationpermittedperiodasdefinedintheplanforthesandexcavationintheYangtzeRiver;(2) conformingtotherequirementsoftheannualcontrolledtotalquantityforsandexcavation;(3) c
33、onformingtothespecifiedoperationmode;(4) conformingtothecontrolrequirementsofnumberofvesselsforsandexcavation;（一）符合长江采砂规划确 定的可采区和可采期的要 求；（二）符合年度采砂控制总 量的要求；（三）符合规定的作业方 式；（四）符合采砂船只数量的 控制要求；(5) havingacompletesetofcertificatesofvessels(五)采砂船舶、船员证书andcrewsforsandexcavation;齐全；(6) havingequipmentandtechn
34、icalpersonneluptothestandardforsandexcavation;(7) otherconditionsspecifiedbytheYangtzeRiverConservancyCommissionorbythecompetentwateradministrativedepartmentsofthepeoplesgovernmentsoftheprovincesandmunicipalitiesdirectlyundertheCentralGovernmentalongtheRiver.（六）有符合要求的采砂设 备和采砂技术人员；（七）长江水利委员会或者 沿江省、直辖
35、市人民政府水 行政主管部门规定的其他条 件。市、县人民政府水行政主管 部门应当自收到申请之日起 10日内签署意见后，报送沿 江省、直辖市人民政府水行 政主管部门审批；属于省际 边界重点河段的，经有关 省、直辖市人民政府水行政 主管部门签署意见后，报送ThecompetentwateradministrativedepartmentsofthepeoplesgovernmentsofthecitiesorcountiesalongtheRivershallsigntheircommentswithintendaysfromthedateofreceivingapplicationsandsubm
36、itthemforapprovaltothecompetentwateradministrativedepartmentsofpeoplesgovernmentsoftheprovincesormunicipalitiesdirectlyundertheCentralGovernmentalongtheRiver.TheapplicationsforsandexcavationinthemajorriversectionswithintheboundariesofmorethantwoprovincesormunicipalitiesdirectlyundertheCentralGovernm
37、entshallbesubmittedtotheYangtzeRiverConservancyCommissionafterthecommentsaresignedbythecompetentwaterdepartmentsofthepeople,sgovernmentsoftheprovincesormunicipalitiesdirectlyundertheCentralGovernmentalongtheRiver.TheYangtzeRiverConservancyCommissionorthecompetentwaterdepartmentsofthepeoplesgovernmen
38、tsoftheprovincesofmunicipalitiesdirectlyundertheCentralGovernmentalongtheRivershallapprovetheapplicationswithin30daysfromthedateofreceivingtheapplications;iftheapplicationsarenotapproved,theapplicantsshallbenotifiedwithinsevendaysfromthedateofmakingthedecisionsnottoapproveandbegivenreasonsthereof.Ar
39、ticle11Thelicenseofthesandexcavationintherivercourseshallstatetheitemsandcontentssuchasthenameofthevesselowner,thenameofthevessel,thenumberofthevessel,character,type,site,andthetimelimitandthemodeofexcavationoperation,wastedisposaltreatmentmethod,andvalidityperiodofthelicense.Article12Entitiesandind
40、ividualsengagedinactivitiesofsandexcavationintheYangtzeRiver,shalloperateinaccordancewiththestipulationsofthelicensesofthesandexcavationintherivercourse.ThecompetentwateradministrativedepartmentsofthelocalpeoplesgovernmentatorabovethecountrylevelandtheYangtzeRiverConservancyCommissionshallstrengthen
41、supervisionandexaminationaccordingtotheirdivisionofduties.长江水利委员会审批。长江 水利委员会或者沿江省、直 辖市人民政府水行政主管部 门应当自收到申请之日起30 日内予以审批；不予批准 的，应当在作出不予批准决 定之日起7日内通知申请 人，并说明理由。第H条河道采砂许 可证应当载明船主姓名（名 称）、船名、船号和开采的 性质、种类、地点、时限以 及作业方式、弃料处理方 式、许可证的有效期限等有 关事项和内容。第十二条从事长江采 砂活动的单位和个人应当按 照河道采砂许可证的规定进 行开采。有关县级以上地方 人民政府水行政主管部门和 长江
42、水利委员会应当按照职 责划分对其加强监督检查。从事长江采砂活动的单位和个人需要改变河道采砂许可WhereentitiesandindividualsengagedinactivitiesofthesandexcavationintheYangtzeRiverneedtochangetheitemsandcontentsinthelicensesofthesandexcavationintherivercourseshallreapplyforthelicensesofthesandexcavationintherivercourse.Itisprohibitedtoforge,alter,bu
43、yorsell,hireoutortransferinotherwayslicensesofthesandexcavationintherivercourse.Article13Inordertoensuresmoothandsafenavigation,theoperationofsandexcavationshallbesubjecttonavigationrequirementsandclearsignsbesetup.Article14ThetotalamountofannualsandexcavationapprovedbytheYangtzeRiverConservancyComm
44、issionandthecompetentwateradministrativedepartmentsofthepeoplesgovernmentsoftheprovincesandmunicipalitiesdirectlyundertheCentralGovernmentalongtheRivershallnotexceedtheannualtotalcontrolamountofsandexcavationasfixedintheplan.Thecompetentwateradministrativedepartmentsofthepeople,sgovernmentsoftheprov
45、incesandmunicipalitiesdirectlyundertheCentralGovernmentshall,beforeJanuary31eachyear,submitfortherecordtotheYangtzeRiverConservancyCommissiontheapprovalandissuanceofthelicensesfortheexcavationintheYangtzeRiverandtheimplementationsituationinthepreviousyear.证规定的事项和内容的，应 当重新办理河道采砂许可 证O禁止伪造、涂改或者买卖、 出租、出
46、借或者以其他方式 转让河道采砂许可证。第十三条为保障航道 畅通和航行安全，采砂作业 应当服从通航要求，并设立 明显标志Q第十四条长江水利委 员会和沿江省、直辖市人民 政府水行政主管部门年审批 采砂总量不得超过规划确定 的年度采砂控制总量。沿江省、直辖市人民政府水 行政主管部门应当在每年1 月31日前将上一年度的长 江采砂审批发证情况和实施 情况，报长江水利委员会备 案。第十五条沿江县级以 上地方人民政府水行政主管 部门因整修长江堤防进行吹 填固基或者整治长江河道采 砂的，应当经本省、直辖市 人民政府水行政主管部门审Article15Theactivitiesofsandexcavationfo
47、rthepurposeofreinforcingtheembankmentorharnessingtherivercoursescarriedoutbythecompetentwateradministrativedepartmentsofthelocalpeoplesgovernmentsatorabovethecountylevelalongtheRivershallbereportedforexaminationtothecompetentwateradministrativedepartmentsofthepeoplesgovernmentsoftheprovincesormunici
48、palitiesdirectlyundertheCentralGovernmentandsubmittedforapprovaltotheYangtzeRiverConservancyCommission;wheretheYangtzeRiverShippingAffairsAdministrationneedstoexcavatesandfordredgingwaterways,itshallsolicitcommentsinadvancefromtheYangtzeRiverConservancyCommission.Entitiesandindividualsengagedinactiv
49、itiesofsandexcavationforlandreclamationshallapplyforlicensesofthesandexcavationintherivercourseaccordingtolaw.Article16Exceptforoperationsinthemineableareasduringtheperiodprescribedintherivercoursesandandgravelminingpermit,sandandgravelminingvesselsshallbeberthedinacentralizedmanneratthelocationsdesignatedbythepeoplesgovernmentsatthecountylevelalongtheriver,a
