5、ndamendedforthethirdtimeaccordingtotheDecisionoftheGeneralAdministrationofCustomstoAmendSomeRulesissuedbyOrderNo.262oftheGeneralAdministrationofCustomsonMarch9,2023)第一章总则ChapterIGeneralProvisions第一条为规范进境动物 遗传物质的检疫和监督管理， 保护我国畜牧业生产安全，根 据中华人民共和国进出境动 植物检疫法及其实施条例等 法律法规的规定，制定本办法。Article1ThepresentMeasures
6、areformulatedinaccordancewiththeLawofthePeoplesRepublicofChinaonQuarantineofInwardandOutwardAnimalsandPlantsandtheRegulationfortheImplementationthereofaswellasotherlawsandregulationswithaviewtoregulatingthequarantine,supervisionandadministrationofhereditarysubstanceofinwardanimals,andprotectingthepr
7、oductionsafetyoftheanimalhusbandryinChina.第二条本办法适用于进 境动物遗传物质的检疫和监督 管理。第三条本办法所称动物 遗传物质是指哺乳动物精液、 胚胎和卵细胞。第四条海关总署统一管 理全国进境动物遗传物质的检 疫和监督管理工作。Article2ThepresentMeasuresshallbeapplicabletothequarantine,supervisionandadministrationofhereditarysubstanceofinwardanimals.Article3Hereditarysubstanceofanimalsment
8、ionedinthepresentMeasuresmeansthesemen,embryosandeggcellsofmammals.主管海关负责辖区内的进境动 物遗传物质的检疫和监督管 理。Article4TheGeneralAdministrationofCustomsshallbeuniformlyresponsibleforthequarantine,supervisionandadministrationofhereditarysubstanceofinwardanimalsnationwide.Thecompetentcustomsofficesshallberesponsible
9、forthequarantine,supervisionandadministrationofhereditarysubstanceofinwardanimalswithintheirrespectivejurisdictions.第五条海关总署对进境 动物遗传物质实行风险分析管 理。根据风险分析结果，海关 总署与拟向中国输出动物遗传 物质的国家或地区政府有关主 管机构签订双边检疫协定（包 括协定、协议、议定书、备忘Article5TheGeneralAdministrationofCustomsshallapplyriskanalysisadministrationtotheheredita
10、rysubstanceofinwardanimals.Onthebasisoftheresultfromriskanalysis,theGeneralAdministrationofCustomsmayconcludeabilateralquarantineagreement(includinganroomontCrCteCClCrmomnrondimetc.)withtherelevantcompetentinstitutionofthegovernmentofthecountryorregionfromwhichthehereditarysubstanceofanimalsistobeex
11、portedtoChina.ChapterIlQuarantineExaminationandApprovalArticle6Whoeverintendstoimporthereditarysubstanceofanimalsmustgothroughtheformalitiesofquarantineapprovalinadvance,obtainthePermitofthePeoplesRepublicofChinaonQuarantineofInwardAnimalsandPlants,(hereinafterreferredtoastheQuarantinePermit*),andst
12、ipulateinthetradecontractortherelevantagreementthequarantinerequirementsofChina.Article7WhoeverintendstoapplyfortheexaminationandapprovalofquarantineofhereditarysubstanceofanimalsshallsubmitthefollowingmaterialstothelocalcustomsofficedirectlyundertheGeneralAdministrationofCustoms:(1) theApplicationF
13、ormforthePermitofthePeoplesRepublicofChinaonQuarantineofInwardAnimalsandPlants;(2) forhereditarysubstanceofanimalsimportedbyagency,aphotocopyofthecontractoragreementwiththeconsignorforimportbyagencyshallbeprovided.录等）。第二章检疫审批第六条输入动物遗传物 质的，必须事先办理检疫审批 手续，取得中华人民共和国 进境动植物检疫许可证（以 下简称检疫许可证），并 在贸易合同或者有关协议中
14、订 明我国的检疫要求。第七条申请办理动物遗 传物质检疫审批的，应当向所 在地直属海关提交下列资料：（一）中华人民共和国进境 动植物检疫许可证申请表；（二）代理进口的，提供与货 主签订的代理进口合同或者协 议复印件。第八条直属海关应当在 海关总署规定的时间内完成初 审。初审合格的，报海关总署 审核，海关总署应当在规定的 时间内完成审核。审核合格的, 签发检疫许可证；审核不 合格的.塔后中华人民共和Article8ThecustomsofficedirectlyundertheGeneralAdministrationofCustomsshallfinishthepreliminaryexamin
15、ationwithinthetimeprescribedbytheGeneralAdministrationofCustoms.Ifthehereditarysubstanceofanimalsispreliminarilyexaminedasqualified,itshallhcihmittodtnthGanaralArlminictrotinn国进境动植物检疫许可证申请 未获批准通知单。ofCustomsforverification,andtheGeneralAdministrationofCustomsshallfinishtheverificationwithintheprescri
16、bedtime.Ifitisverifiedasqualified,theQuarantinePermitshallbeissued;ifitisverifiedasunqualified,thenNoticeonFailureoftheApplicationtobeapprovedforthePermitofthePeoplesRepublicofChinaonQuarantineofInwardAnimalsandPlants*shallbeissued.第三章进境检疫第九条输入动物遗传物 质前，海关总署根据检疫工作 的需要，可以派检疫人员赴输 出国家或者地区进行动物遗传 物质产地预检。C
17、hapterIIIInwardQuarantine第十条海关总署对输出 动物遗传物质的国外生产单位 实行检疫注册登记，并对注册 的国外生产单位定期或者不定 期派出检疫人员进行考核。Article9Beforethehereditarysubstanceofanimalsisimported,theGeneralAdministrationofCustomsmay,onthebasisoftheneedsinquarantine,sendquarantineofficerstogototheexportingcountryorregiontocarryoutpre-inspectionofthe
18、placeoforiginofthehereditarysubstanceofanimals.Article10TheGeneralAdministrationofCustomsshallapplyquarantineregistrationtotheforeignproducerswhichexporthereditarysubstanceofanimalstoChina,andshallsendquarantineofficerseitherregularlyorirregularlytoappraisetheregisteredforeignproducers.第十一条输入的动物遗 传物
19、质，应当按照检疫许可 证指定的口岸进境。第十二条输入动物遗传 物质的货主或者其代理人，应 当在动物遗传物质进境前，凭 贸易合同或者协议、发票等有 效单证向进境口岸海关报检。 动物遗传物质进境时，应当向 进境口岸海关提交输出国家或Article11ImportedhereditarysubstanceofanimalsshallentertheterritoryviatheportdesignatedbytheQuarantinePermit.Article12Theconsignorofhereditarysubstanceofanimalsorhisagentshall,beforetheh
20、ereditarysubstanceofanimalsentersChina,declaretothecustomsofficeattheportofentryforinspectionuponthestrengthofthetradecontractoragreement,thecontract,invoicesandCTharalirldnmmntcandchallu/hantha者地区官方检疫机构出具的检 疫证书正本。第十三条进境动物遗传 物质无输出国家或者地区官方 检疫机构出具的有效检疫证 书，或者未办理检疫审批手续 的，进境口岸海关可以根据具 体情况，作退回或者销毁处理。heredi
21、tarysubstanceofanimalsenterstheterritory,submittotheCustomsattheportofentrytheoriginalofthequarantinecertificateissuedbythegovernmentalquarantineinstitutionoftheexportingcountryorregion.Article13If,withrespecttosomecertainhereditarysubstanceofinwardanimals,thereisnoeffectivequarantinecertificateissu
22、edbythegovernmentalquarantineinstitutionoftheexportingcountryorregion,ortheformalitiesforquarantineapprovalhavenotbeengonethrough,theCustomsattheportofentrymay,inlightofthespecificsituation,returnordestroythesaidsubstance.第十四条输入的动物遗 传物质运抵口岸时，检疫人员 实施现场检疫：（一）查验检疫证书是否符合 检疫许可证以及我国与输 出国家或者地区签订的双边检 疫协定的要求
23、；（二）核对货、证是否相符；Article 14 Whentheimportedhereditarysubstanceofanimalsiscarriedtotheport,thequarantineofficersshallcarryouttheon-the-spotquarantine:(1) inspectingwhetherthequarantinecertificateconformstotheQuarantinePermit1andtherequirementsinthebilateralquarantineagreementbetweenChinaandtheexportingc
24、ountryorregion;(2) checkingwhetherthegoodsandthecertificateareinconformitywitheachother;（三）检查货物的包装、保存 状况。第十五条经进境口岸海 关现场检疫合格的，调往检 疫许可证指定的地点实施检 疫。笛+去冬动物孺传物后(3) inspectingthepackingandpreservationofthegoods.Article 15 Thehereditarysubstancethatpasseson-sitequarantinebythecustomsofficeattheportofentrysh

26、fficeatthedestination.Article17TheCustomsshallmakequarantineasrequiredbytheQuarantinePermi.ThehereditarysubstanceofanimalsquarantinedasqualifiedshallbeunderthelawfulquarantinesupervisionandadministrationoftheCustoms;whiletheonequarantinedasunqualifiedshallbereturnedordestroyedunderthesupervisionofth
27、eCustoms.第四章检疫监督第十八条海关对进境动 物遗传物质的加工、存放、使 用（以下统称使用）实施检疫 监督管理；对动物遗传物质的 第一代后裔实施备案。ChapterIVSupervisionofQuarantine第十九条进境动物遗传 物质的使用单位应当到所在地 直属海关备案。Article18TheCustomsshallconductquarantinesupervisionandadministrationontheprocessing,depositionanduseofthehereditarysubstanceofinwardanimals(hereinafterunifo
28、rmlyreferredtoasuse);andshallrecordthefirstgenerationofdescendentsofthehereditarysubstanceofanimals.Article19TheentityusingthehereditarysubstanceofinwardanimalsshallgotothecustomsofficedirectlyundertheGeneralAdministrationofCustomsatitslocalitytomaketherecord.第二十条使用单位应当 填写进境动物遗传物质使用 单位备案表，并提供以下说 明材料
29、：（一）具有熟悉动物遗传物质 保存、运输、使用技术的专业 人员；Article20TheusingentityshallfillouttheFormonRecordoftheEntityUsingHereditarySubstanceofInwardAnimals,andprovidethefollowingstatementdocuments:(1) documentstatingthatithasprofessionalsfamiliarwiththepreservation,transportanduseofthehereditarysubstanceofanimals;（二）具备进境动
30、物遗传物质 的专用存放场所及其他必要的 设施。第二十一条 直属海关将 已备案的使用单位，报告海关 总署。第二十二条使用单位应 当建立进境动物遗传物质使用 的管理制度，填写进境动物 遗传物质检疫监管档案，接 受海关监管；每批进境动物遗 传物质使用结束，应当将进 境动物遗传物质检疫监管档 案报海关备案。第二十三条海关根据需 要，对进境动物遗传物质后裔 的健康状况进行监测，有关单 位应当予以配合。第五章附则第二十四条对违反本办 法规定的，海关依照有关法律 法规的规定予以处罚。第二十五条 本办法所规 定的文书由海关总署另行制定 并且发布。第二十六条本办法由海(2) documentstatingtha

32、temfortheuseofhereditarysubstanceofentryanimals,fillouttheArchivesontheQuarantineandSupervisionofHereditarySubstanceofEntryAnimals,andacceptthesupervisionoftheCustoms;andshall,aftertheendofuseofeachbatchofhereditarysubstanceofinwardanimals,submittheTileonQuarantineandSupervisionofHereditarySubstance
33、ofInwardAnimals*totheCustomsforrecord.Article23TheCustomsmay,whennecessary,monitorthehealthofthedescendentsofthehereditarysubstanceofinwardanimals,andtherelevantentitiesshallcooperatewiththeCustoms.ChapterVSupplementaryProvisionsArticle 24 WhoeverviolatesthepresentMeasuresshallbepunishedbytheCustoms
34、inaccordancewiththerelevantlawsandregulations.Article 25 ThedocumentsasprescribedintheseMeasuresshallbedevelopedandissuedbytheGeneralAdministrationofCustomsseparately.Article 26 TheresponsibilitytointerpretthnrncontK力crcchallromaini+htheGeneralAdministrationofCustoms.关总署负责解释。Article27ThepresentMeasuresshallcomeintoforceonJuly1,2003.第二十七条本办法自二OO三年七月一日起施行。
