1、全国人民代表大会常务委员会关于 完善和加强备案审查制度的决定（2023年12月29日第十四届全 国人民代表大会常务委员会第七次 会议通过）为了贯彻落实党中央关于健全保证 宪法全面实施的制度体系、完善和 加强备案审查制度的决策部署，更 好地行使宪法、法律赋予全国人民 代表大会常务委员会的监督职权， 充分发挥备案审查制度保障宪法和 法律实施、维护国家法制统一的重 要作用，提高备案审查能力和质 量，坚决纠正和撤销违反宪法、法 律的规范性文件，根据宪法和有关 法律，结合实践经验，作如下决 定：一、全国人民代表大会常务 委员会依法开展备案审查工作，坚 持以习近平新时代中国特色社会主 义思想为指导，贯彻习

4、nthNationalPeoplesCongressonDecember29,2023)ForthepurposesofimplementingthedecisionsandarrangementsmadebytheCPCCentralCommitteeonimprovingthesystemofrulesforensuringthefullimplementationoftheConstitution,improvingandstrengtheningthedecisionsandarrangementsontherecordationreviewsystem,betterexercisin
5、gthesupervisorypowersgrantedbytheConstitutionandlawstotheStandingCommitteeoftheNationalPeoplesCongress,maximizingtheimportantrolesoftherecordationreviewsysteminguaranteeingtheimplementationoftheConstitutionandlawsandsafeguardingtheunityofChinaslegalsystem,improvingthecapacityandqualityofrecordationr
6、eview,andresolutelycorrectingandrevokingtheregulatorydocumentsthatviolatetheConstitutionandlaws,thefollowingdecisionisherebymadeinaccordancewiththeConstitutionandrelevantlawsandinlightoftheactualcircumstances:I. TheStandingCommitteeoftheNationalPeoplesCongressshallconducttherecordationreviewworkinac
7、cordancewiththelaw,adheretobeingguidedbytheXiJinpingThoughtonSocialismwithChineseCharacteristicsinaNewEra,implementtheXiJinpingThoughtontheRuleofLaw,upholdtheeffectiveunityofPartysleadership,therunningofthecountrybythepeople,andlaw-basedgovernanceofChina,ensurethatallrelevantdocumentsundergorecordat
8、ionformalities,alldocumentssubmittedforrecordationarereviewed,andallerrorsfoundduringthereviewarecorrected,effectivelyensuretheimplementationofthedecisionsandarrangementsmadebytheCPCCentralCommittee,ensuretheimplementationoftheConstitutionandlaws,protectthelawfulrightsandinterestsofcitizens,legalper
9、sonsandotherorganizations,upholdtheunityoftheChinaslegalsystem,andpromotethelaw-basedgovernanceofChinaonallfronts.II. Ensuringthatallrelevantdocumentsundergorecordationformalities.Administrativeregulations,oversightregulations,localregulations,autonomousregulationsandseparateregulationsofautonomousp
10、refecturesandautonomouscounties,regulationsonspecialeconomiczones,regulationsonthePudongNewArea,regulationsontheHainanFreeTradePort(hereinaftercollectivelyreferredtoasregulations),andinterpretationsonspecificapplicationoflawintrialorprocuratorialworkasdevelopedbytheSupremePeoplesCourtortheSupremePeo
11、plesProcuratorate(hereinaftercollectivelyreferredtoasJudicialinterpretations*)shallbesubmittedtotheStandingCommitteeoftheNationalPeoplesCongressforrecordationinaccordancewiththelaw.III. Strengtheningtherecordationwork.AregulationorjudicialinterpretationshallbesubmittedtotheStandingCommitteeoftheNati
12、onalPeoplesCongressforrecordationwithin30daysfromthedateofissuance.Whenadocumentissubmittedforrecordation,bothpaperandelectronicversionsoftherecordationdocumentshallbesubmitted.TheGeneralOfficeoftheStandingCommitteeoftheNationalPeoplesCongressshallberesponsiblefortherecordationofregulationsandjudici
13、alinterpretationsandconductformalreviewofrecordationdocuments.ThedocumentsthatmeettherecordationrequirementsshallberegisteredandarchivedandbesenttorelevantspecializedcommitteesandtheworkingbodiesoftheStandingCommitteeoftheNationalPeoplesCongressforreviewaccordingtothedivisionoftheirrespectivefunctio
14、ns.Thedocumentsthatfailtomeettherecordationrequirementsshallbereturned,berequiredtoberesubmittedafterbeingsupplementedorcorrected,orbeotherwisedealtwith.TheGeneralOfficeoftheStandingCommitteeshallconductsupervisoryinspectionsonthesubmissionbytheauthoritiessubmittingthedocuments,andcirculateanoticeof
15、criticismofanyconcealment,delayoromissioninsubmissionandothercircumstances.IV. Ensuringthatalldocumentssubmittedforrecordationarereviewed.Theworkingmechanismforreviewshallbeimprovedaccordingtotherequirementthatalldocumentssubmittedforrecordationshallbereviewed,thecontentofreviewshallbespecified,revi
16、ewproceduresshallbestandardized,andthereviewshallbeconductedinaccordancewiththelawbycomprehensivelyusingmethodssuchasreviewuponrequest,proactivereview,specialreview,transferforreview,andjointreview.主、依法治国有机统一，实行有件 必备、有备必审、有错必纠，切实 保证党中央决策部署贯彻落实，保 障宪法和法律实施，保护公民、法 人和其他组织的合法权益，维护国 家法制统一，推进全面依法治国。二、坚持有件必
17、备。行政法 规、监察法规、地方性法规、自治 州和自治县的自治条例和单行条 例、经济特区法规、浦东新区法 规、海南自由贸易港法规（以下统 称法规）以及最高人民法院、最高 人民检察院作出的属于审判、检察 工作中具体应用法律的解释（以下 统称司法解释）依法报送全国人民 代表大会常务委员会备案。三、加强备案工作。法规、 司法解释应当自公布之日起三十日 内报送全国人民代表大会常务委员 会备案。报送备案时，应当一并报 送备案文件的纸质文本和电子文 本。全国人民代表大会常务委员会办公 厅负责法规、司法解释的备案工 作，对备案文件进行形式审查。对 符合备案要求的，予以登记、存 档，并根据职责分工分送全国人民
18、代表大会有关专门委员会和常务委 员会工作机构进行审查。对不符合 备案要求的，采取退回、要求补充 或者更正后重新报送等方式处理。 常务委员会办公厅对报送机关的报 送工作进行督促检查，并对瞒报、 迟报、漏报等情况予以通报。四、坚持有备必审。按照有 备必审的要求完善审查工作机制， 细化审查内容，规范审查程序，综 合运用依申请审查、主动审查、专 项审查、移送审查和联合审查等方 式，依法开展审查工作。全国人民代表大会专门委员会、常 务委员会工作机构负责审查工作。 专门委员会、常务委员会工作机构ThespecializedcommitteesandtheworkingbodiesoftheStanding
19、CommitteeoftheNationalPeoplesCongressshallberesponsibleforthereviewwork.ThespecializedcommitteesandtheworkingbodiesoftheStandingCommitteeoftheNationalPeoplesCongressshallstrengthencommunicationandcollaboration,andmayconductjointresearchandconsultationonimportantissuesandsituationsencountered;andmayc
20、onvenejointreviewmeetingswhentheyconsideritnecessarytoconductjointreview.V. Advancingtheconstitutionalityexamination.ThefocusofreviewshallbeputonwhetherthereisanycontentthatisinconsistentwiththeprovisionsoftheConstitution,theprinciplesoftheConstitutionorthespiritoftheConstitutioninaregulationorjudic
21、ialinterpretationoranyotherregulatorydocumentduringtherecordationreview;Constitution-relatedissuesshallbeconscientiouslystudied;andthecorrectionofregulatorydocumentsthatcontravenetheConstitutionorinvolveconstitutionalityissuesshallbeoverseeninatimelymanner.Therequirementsforimprovingtheproceduresfor
22、theinterpretationoftheConstitutionshallbeimplementedduringtherecordationwork,therelevantprovisionsandspiritoftheConstitutionshallbeaccuratelymasteredandclarified,andtheconcernsofpartiesconcernedinthesocietyonConstitution-relatedissuesshallberespondedto.VI. Strengtheningreviewuponrequest.Whereareleva
23、ntstateorganfilesawrittenrequestforreviewwiththeStandingCommitteeoftheNationalPeoplesCongressinaccordancewiththelaw,therelevantspecializedcommitteeandtheworkingbodyoftheStandingCommitteeoftheNationalPeoplesCongressshallconductthereviewandofferopinions.Whereastateorgan,socialorganization,enterprise,p
24、ublicinstitution,orcitizensubmitsawrittenrecommendationonreviewtotheStandingCommitteeoftheNationalPeoplesCongress,theworkingbodyoftheStandingCommitteeshallconductthereview;andwhennecessary,refersuchrecommendationtotherelevantspecializedcommitteeforreviewandopinions.TheworkingbodyoftheStandingCommitt
25、eeshallconductapreliminaryexaminationoftherecommendationonreview,andinitiatethereviewproceduresifitconsidersthattheregulationorjudicialinterpretationunderrecommendationforreviewmaycontravenetheConstitutionoranylaworinvolveanyconstitutionalityorlegalityissue.Wherealocaloversightcommission,peoplescour
26、torpeoplesprocuratorateatanylevelfindsanyregulationorjudicialinterpretationcontravenestheConstitutionoranylaworinvolvesanyconstitutionalityorlegalityissueduringtheoversight,trialorprocuratorialwork,itmayescalateittotheNationalSupervisoryCommission,theSupremePeoplesCourtandtheSupremePeoplesProcurator
27、ate,andtheNationalSupervisoryCommission,theSupremePeoplesCourtandtheSupremePeoplesProcuratorateshallsubmitawrittenrequestforreviewtotheStandingCommitteeoftheNationalPeoplesCongress.应当加强沟通协作，遇有重要问题 和重要情况的，可以共同研究和协 商；认为有必要进行共同审查的， 可以召开联合审查会议。五、推进合宪性审查。在备 案审查工作中注重审查法规、司法 解释等规范性文件是否存在不符合 宪法规定、宪法原则、宪法精神的
28、 内容，认真研究涉宪性问题，及时 督促纠正与宪法相抵触或者存在合 宪性问题的规范性文件。在备案审 查工作中落实健全宪法解释工作程 序的要求，准确把握和阐明宪法有 关规定和精神，回应社会有关方面 对涉宪问题的关切。六、加强依申请审查。有关 国家机关依法向全国人民代表大会 常务委员会书面提出审查要求的， 由全国人民代表大会有关的专门委 员会和常务委员会工作机构进行审 查、提出意见。其他国家机关和社会组织、企业事 业单位以及公民依法向全国人民代 表大会常务委员会书面提出审查建 议的，由常务委员会工作机构进行 审查；必要时，送有关的专门委员 会进行审查、提出意见。常务委员 会工作机构对审查建议进行初步
29、审 查，认为建议审查的法规、司法解 释可能与宪法或者法律相抵触，或 者存在合宪性、合法性问题的，应 当启动审查程序。地方各级监察委员会、人民法院、 人民检察院在监察、审判、检察工 作中发现法规、司法解释同宪法或 者法律相抵触，或者存在合宪性、 合法性问题的，可以逐级上报至国 家监察委员会、最高人民法院、最 高人民检察院，由国家监察委员 会、最高人民法院、最高人民检察 院向全国人民代表大会常务委员会 书面提出审查要求。七、加强主动审查。全国人VII. Strengtheningproactivereview.Thespecializedcommitteesandtheworkingbodieso
30、ftheStandingCommitteeoftheNationalPeoplesCongressshallstrengthentheproactivereviewofregulationsandjudicialinterpretations.Theworkingmechanismsandmethodsforproactivereviewshallbeimproved,andtheprioritiesofreviewshallbehighlightedbycenteringontheprioritiesofworkoftheStandingCommittee,inconsiderationof
31、thephasedcharacteristicsofreformanddevelopment,andwithrespecttoexistingtendentiousandtypicalproblemssoastoimprovetheefficiencyandqualityofproactivereview.VIII. Conductingspecialreviewinapertinentmanner.ThespecializedcommitteesandtheworkingbodiesoftheStandingCommitteeoftheNationalPeoplesCongressshall
32、,asneeded,conductspecialreviewoftheregulationsandjudicialinterpretationsinvolvingthedecisionsandarrangementsmadebytheCPCCentralCommittee,majornationalreform,implementationofimportantlaws,andthevitalinterestsofthepeople,amongothers,andsolveinacentralizedmannercommonproblemsinregulations,judicialinter
33、pretationsandotherregulatorydocumentsincertainfieldsorcategories.Whereitisfoundduringthereviewuponrequest,proactivereviewortransferforreviewthatotherlaws,judicialinterpretationsorotherregulatorydocumentsalsohavecommonproblems,suchregulatorydocumentsmayalsobesubjecttospecialreviewalongwithalltheother

Improvingthemechanismfortransferforreview.WheretheworkingbodiesoftheStandingCommitteeoftheNationalPeoplesCongressreceivetherecommendationsonreviewthatshallbehandledbyotherorgansordiscovertheissuesthatshallbereviewedandhandledbyotherorgans,theyshalltransfersuchrecommendationsonrevieworissuestor
35、elevantorgansinatimelymanner.Opinionsandproposalsonresearchandhandlingmaybeputforwardatthetimeoftransfer.WhereanyotherorganthatfindsduringtherecordationreviewanyconstitutionalityorlegalityissueinvolvedinanylaworjudicialinterpretationtransfersittotheworkingbodyoftheStandingCommitteeoftheNationalPeopl
36、esCongressforreviewandhandlingorrelevantworkrecommendations,theworkingbodyoftheStandingCommitteeoftheNationalPeoplesCongressshallconductthereview.X. Exploringthejointreviewmechanism.WhereaworkingbodyoftheStandingCommitteeoftheNationalPeoplesCongressfindsthatanyregulation,ruleorjudicialinterpretation
37、oranyotherregulatorydocumenthasanycommonprobleminvolvingthescopeofrecordationreviewdutiesofanyotherorgan,itmayconductinvestigationorreviewjointlywiththeworkingbodyinchargeofrecordationreviewofsuchotherorgantoconductjointresearchandofferreviewopinionsandrecommendations.民代表大会专门委员会、常务委员 会工作机构应当加强法规、司法解
38、 释主动审查工作。健全主动审查的 工作机制和方式，围绕常务委员会 工作重点，结合改革发展阶段性特 征，针对存在的倾向性、典型性问 题，突出审查重点，提高主动审查 效率和质量。八、有针对性开展专项审 查。全国人民代表大会专门委员 会、常务委员会工作机构根据需要 对涉及党中央决策部署、国家重大 改革、重要法律实施、人民群众切 身利益等方面的法规、司法解释进 行专项审查，集中解决某一领域或 者某一类别法规、司法解释等规范 性文件中普遍存在的问题。在开展 依申请审查、主动审查、移送审查 过程中，发现其他法规、司法解释 等规范性文件存在共性问题的，可 以一并进行专项审查。九、完善移送审查机制。全 国人民
39、代表大会常务委员会工作机 构收到应当由其他机关处理的审查 建议，或者发现应当由其他机关审 查处理的问题，及时移送有关机关 处理。移送时，可以提出研究处理 的意见和建议。其他机关在备案审查工作中发现法 规、司法解释存在合宪性、合法性 问题，移送全国人民代表大会常务 委员会工作机构审查处理或者提出 有关工作建议的，常务委员会工作 机构应当进行审查。十、探索联合审查机制。全 国人民代表大会常务委员会工作机 构发现法规、规章、司法解释等规 范性文件存在涉及其他机关备案审 查工作职责范围的共性问题的，可 以与其他机关备案审查工作机构开 展联合调研或者联合审查，共同研 究提出审查意见和建议。H一、明确审查
40、重点内容。XI. Clarifyingthecontentmainlyreviewed.Thefollowingcontentshallbemainly reviewed during the review:在审查工作中，应当重点审查以下内容：(1)WhethertheprovisionsoftheConstitution,theprinciplesoftheConstitutionandthespiritoftheConstitutionarecompliedwith.（一）是否符合宪法规定、宪法原则和宪法精神；(2)Whetherthemajordecisionsandarrangemen
41、tsoftheCPCCentralCommitteeandthedirectionsofmajornationalreformarecompliedwith.（二）是否符合党中央的重大决策部署和国家重大改革方向；(3)Whetherthepowersareoverstepped,ortherightsofcitizens,legalpersons,orotherorganizationsareimpairedortheirobligationsareincreased.（三）是否超越权限，减损公民、法人和其他组织权利或者增加其义务；(4)Whethertheprovisionsofsupero
42、rdinatelawsareviolated.（四）是否违反上位法规定;(5)Whetherlegalproceduresareviolated.（五）是否违反法定程序;(6)Whetherthemeasurestakenandtheirpurposesareconsistentwiththeprincipleofproportionality.（六）采取的措施与其目的是否符合比例原则。XII.Promotingcentralizedreview.TheStandingCommitteeoftheNationalPeoplesCongressanditsworkingbodiesmay,asn
43、eeded,organizethecentralizedreviewoftheregulations,rules,judicialinterpretations,andotherregulatorydocumentsinvolvingthedevelopmentoramendmentofimportantlaws,socialandpublicinterests,andotheraspects,overseerelevantpartiestimelyamendmentorrepealoftheprovisionsthatfailtoconformto,toconnectwithandtoada
44、pttolegalprovisions,thespiritoftheCPCCentralCommittee,ortherequirementsofthetimes,anddevelopsupportingprovisionsinatimelymanner.Whenacentralizedreviewisorganized,thescope,maincontent,timelimitrequirements,amongothers,ofthereviewshallbeclarified.十二、推进集中清理工作。全国人民代表大会常务委员会及其工作机构根据需要，可以对涉及重要法律制定或者修改、社会公
45、共利益等方面的法规、规章、司法解释和其他规范性文件组织开展集中清理，督促有关方面及时修改或者废止不符合、不衔接、不适应法律规定、中央精神、时代要求的规定，并及时制定配套规定。组织开展集中清理，应当明确清理的范围、主要内容、时限要求等。XIII.Ensuringthatallerrorsfoundduringthereviewarecorrected.WhereaspecializedcommitteeoraworkingbodyoftheStandingCommitteeoftheNationalPeoplesCongressconsidersuponreviewthatanylaworjud
46、icialinterpretationshallbecorrected,itmaycommunicatewiththeenactingauthoritytoboosttheamendmentorrepealofthelaworjudicialinterpretationbytheenactingauthority.WheretheenactingauthorityagreestoamendorrepealtheregulationOrjudicialinterpretation,andproposesaspecifichandlingplanortimelimitinwriting,itisa
47、llowednottoofferawrittenreviewopiniontotheenactingauthorityanymore,andthereviewshallbesuspended.十三、坚持有错必纠。全国人民代表大会专门委员会、常务委员会工作机构经审查认为法规、司法解释应当予以纠正的，可以与制定机关沟通，推动制定机关修改或者废止。制定机关同意对法规、司法解释予以修改或者废止，并书面提出明确处理计划和时限的，可以不再向其提出书面审查意见，审查中止。Wheretheenactingauthoritydisagreestoamendorrepealtheregulationorjudic
