5、calenvironment,preventingandcontrollingsoilpollution,safeguardingpublichealth,promotingpermanentuseofsoilresources,advancingthebuildingofecologicalcivilization,propellingsustainableandhigh-qualityeconomicandsocialdevelopment,andbuildingabeautifulShanghaiwherehumansandnaturecoexistinharmony,theseRegu

6、lationsareformulatedinaccordancewiththeSoilPollutionPreventionandControlLawofthePeoplesRepublicofChinaandotherrelevantlawsandadministrativerules,andinthelightoftheactualcircumstancesofthisMunicipality.Article2TheseRegulationsapplytothesoilpollutionpreventionandcontrolandrelevantactivitieswithinthead

7、ministrativeareaofthisMunicipality.上海市土壤污染防治条例(2023年7月25日上海市第十 六届人民代表大会常务委员会第 四次会议通过)第一章总则第一条为了保护和改善生 杰环境,防治土壤污染,保障公 众健康,推动土壤资源永续利 用,推进生态文明建设,促进经 济社会可持续、高质量发展,建 设人与自然和谐共生的美丽上 海,根据中华人民共和国土壤 污染防治法等有关法律、行政 法规,结合本市实际,制定本条 例。第二条本条例适用于本市 行政区域内的土壤污染防治及相 关活动。本条例所称土壤污染,是指因人 为因素导致某种物质进入陆地表 层土壤,引起土壤化学、物理、 生物等方

8、面特性的改变,影响土 壤功能和有效利用,危害公众健 康或者破坏生态环境的现象。ForthepurposesoftheseRegulations,usoilpollutionnmeansthephenomenonofasubstance,sentryintothesoilsurfaceoftheearthcausedbyahumanfactor,thuscausingchangesinthechemical,physical,biologicalandotherpropertiesofthesoil,affectingthefunctionsandeffectiveuseofthesoil,an

9、djeopardizingpublichealthordamagingtheecologicalenvironment.Article3Insoilpollutionpreventionandcontrol,theprinciplesoftheprimaryroleofprevention,priorityforprotection,categorizedadministration,riskmanagementandcontrol,liabilityforpollution,andpublicparticipationshallbeadheredto.ThisMunicipalityshal

10、lstrengthenoverallcoordinationbetweensoilpollutionpreventionandcontrolandatmospheric,water,solid-wastepollutionpreventionandcontrol,andachievepreventionatthesourcesofthepollutants.Inthelightoftheecologicalconditionsofthesoilandundergroundwater,thisMunicipalityshallimplementtheintegratedpreventionand

11、controlofsoilpollutionandundergroundwaterpollution,formulateaunifiedplanfortherelevantwork,andmakeholisticadvances.Article4Allorganizationsorindividualsareobligatedtoprotectsoilandpreventsoilpollution.1.and-userightsholdersengagedintheactivitiesoflanddevelopmentandutilization,andenterprises,publicin

12、stitutions,andotherproducersandoperatorsengagedinproductionandbusinessactivitiesshalltakeeffectivemeasurestopreventorreducesoilpollution,andassumeliabilityaccordingtolawforthesoilpollutiontheycause.第三条土壤污染防治应当 坚持预防为主、保护优先、分类 管理、风险管控、污染担责、公 众参与的原则。本市加强土壤污染防治与大气、 水、固体废物等污染防治的统筹 协同,实现源头预防。本市根据土壤和地下水生态环

13、境 状况,实行土壤污染与地下水污 染一体防治,对相关工作实施一 体部署、一体推进。第四条任何组织和个人都 有保护土壤、防止土壤污染的义 务。土地使用权人从事土地开发利用 活动,企业事业单位和其他生产 经营者从事生产经营活动,应当 采取有效措施,防止、减少土壤 污染,对所造成的土壤污染依法 承担责任。第五条本市各级人民政府 应当对本行政区域土壤污染防治 和安全利用负责。Article5Thepeople,sgovernmentsatalllevelsofthisMunicipalityshallberesponsibleforsoilpollutionpreventionandcontrolan

14、dsafesoilutilizationwithintheadministrativeareaofthisMunicipality.ThisMunicipalityshallimplementatarget-orientedresponsibilitysystemandaperformanceassessmentandevaluationsystemforsoilpollutionpreventionandcontrol,andusetheperformanceinachievingsoilpollutionprevention/controltargetsasacriterionforass

15、essingandevaluatingthepeoplesgovernmentsatalllevelsandtheleadersthereof,aswellasthedepartmentsresponsibleforthesupervisorymanagementofsoilpollutionpreventionandcontrolandtheleadersthereof.Article6Themunicipalanddistrictpeoplesgovernmentsshallstrengthentheirleadershipoversoilpollutionpreventionandcon

16、trol,establishandimprovetheworkingmechanismforcomprehensivesupervisionofsoilpollutionpreventionandcontrol,andorganize,coordinateandurgerelevantdepartmentstoperformtheirdutiesofsupervisorymanagementofsoilpollutionpreventionandcontrolaccordingtothelaw.Town/townshippeople,sgovernmentsandsub-districtoff

17、icesshall,accordingtotheirduties,dowelltheworkofsoilpollutionpreventionandcontrol.Article7ThedepartmentofecologyandenvironmentshallexerciseunifiedsupervisorymanagementofthesoilpollutionpreventionandcontrolworkintheadministrativeareaofthisMunicipality.本市实行土壤污染防治目标责任 制和考核评价制度,将土壤污染 防治目标完成情况作为考核评价 各级人民

18、政府及其负责人、负有 土壤污染防治监督管理职责的部 门及其负责人的内容。第六条市、区人民政府应 当加强对土壤污染防治工作的领 导,建立健全土壤污染防治综合 监管工作机制,组织、协调、督 促有关部门依法履行土壤污染防 治监督管理职责。乡镇人民政府、街道办事处按照 职责做好土壤污染防治相关工 作。第七条 生态环境部门对本 行政区域土壤污染防治工作实施 统一监督管理。农业农村、绿化市容部门按照各 自职责对农用地土壤污染防治实 施监督管理。Theagricultureandruralaffairsdepartmentandthelandscapingandcityappearancedepartmen

19、tshall,accordingtotheirduties,exercisesupervisorymanagementofthefarmlandsoilpollutionpreventionandcontrol.Theplanningandresourcesdepartmentshall,accordingtoitsduties,exercisesupervisorymanagementofthesoilpollutionpreventionandcontrolinthecourseoflanddevelopmentandutilization.Thedepartmentsofdevelopm

20、entandreform,housingandurban-ruraldevelopment,waterauthority,economyandinformationtechnology,transportation,finance,health,emergencymanagement,marketregulation,andscienceandtechnologyshall,accordingtotheirrespectiveduties,coordinatetodowellthesoilpollutionpreventionandcontrolwork.Anagencydispatchedb

21、ytheMunicipalPeople,sGovernmentshall,onthestrengthoftheauthorizationorentrustment,assumethedutiesofsupervisorymanagementofthesoilpollutionwithinitsadministrativearea.Article8ByrelyingontheGovernmentOnline-OfflineShanghaiPlatformforadministrativeservicesandtheIntegratedOnlineAdministrationPlatformfor

22、cityoperation,thisMunicipalityshallestablishaunifiedsoil-pollution-prevention/controlcomprehensivesupervisionplatform,andstrengthenthecollection,sharingandutilizationofthesoilenvironmentsupervisioninformation,soastoachievewhole-processandfull-coveragesupervisionofsoilpollutionpreventionandcontrol.规划

23、资源部门按照职责对土地开 发利用过程中的土壤污染防治实 施监督管理。发展改革、住房城乡建设管理、 水务、经济信息化、交通、财 政、卫生健康、应急管理、市场 监管、科技等部门按照各自职 责,协同做好土壤污染防治工 作。市人民政府派出机构根据授权或 者委托,承担管辖区域的土壤污 染防治监督管理职责。第八条本市依托政务服务 “一网通办”、城市运行“一网 统管”平台,建立全市统一的土 壤污染防治综合监管平台,加强 土壤环境监管信息的归集、共享 和利用,实现土壤污染防治全过 程、全覆盖监管。第九条本市建立健全与长 江三角洲区域相关省、市土壤污 染防治协作工作机制,开展土壤 污染预防、风险管控和修复、执A

24、rticle9ThisMunicipalityshall,incooperationwiththerelevantprovincesandcitesintheYangtzeRiverDelta,establishandimprovetheworkingmechanismforsoilpollutionpreventionandcontrol,toconductcooperationinsuchfieldsassoilpollutionprevention,riskmanagement/controlandremediation,lawenforcement,andemergencyhandli

25、ng.ThisMunicipalitysupportsinternationalexchangesandcooperationinsoilpollutionpreventionandcontrol.Article10ThisMunicipalitysupportsbasicresearchandresearchonkeygenerictechnologies,cutting-edgefrontiertechnologiesandmodernengineeringtechnologiesinthefieldofsoilpollutionpreventionandcontrol,promotegr

26、eatersynergybetweenindustry,academia,research,andapplication,enhancethecultivationofprofessionalandtechnicalpersonnel,andraisethecapabilitiesforscientificandtechnologicalinnovations,thusadvancingthesci-techprogressinsoilpollutionpreventionandcontrol.ThisMunicipalitysupportswiderapplicationofnewtechn

27、iques,technologies,equipmentandmaterialsinsoilpollutionpreventionandcontrol,andpromotethedevelopmentofgreenandlow-carbonindustriesforsoilpollutionpreventionandcontrol.法、应急处置等领域的合作。本市支持土壤污染防治国际交流 与合作。第十条本市支持土壤污染 防治方面的基础研究和共性关键 技术、前沿引领技术、现代工程 技术研究,推进产学研用深度融 合,加强专业技术人才培养,提 升科技创新能力,促进土壤污染 防治科学技术进步。本市支持土

28、壤污染防治新技术、 新工艺、新设备、新材料的推广 应用,推动土壤污染防治绿色低 碳产业发展。第十一条本市各级人民政 府及其有关部门、基层群众性自 治组织和新闻媒体应当加强土壤 污染防治宣传教育和科学普及, 增强公众土壤污染防治意识,拓 展公众参与途径,引导公众依法 参与土壤污染防治工作。Article11Thepeoplesgovernmentsatalllevelsandthedepartmentsthereof,grassrootsmassautonomousorganizations,andthepressshallstrengthensoil-pollution-prevention/

29、controlpublicity,educationandsciencepopularization,raisethepublicawarenessofsoilpollutionpreventionandcontrol,expandthechannelsforthepublicsparticipation,andguidethepublicinparticipatinginthesoilpollutionpreventionandcontrolworkaccordingtothelaw.Socialorganizationssuchasindustryassociationsandacadem

30、icsocietiesareencouragedtoparticipateinactivitiesofsoil-pollution-prevention/controlpublicity,educationandsciencepopularization.鼓励行业协会、学会等社会组织 参与土壤污染防治宣传教育和科 学普及活动。ChapterIlPlans,Standards,Surveysand第二章Monitoring测规划、标准、详查和监Article12Themunicipalanddistrictpeoplesgovernmentsshallincludethesoilpollutio

31、npreventionandcontrolworkinthenationaleconomicandsocialdevelopmentplanningandtheecologicalenvironmentprotectionplanning.Themunicipaldepartmentofecologyandenvironmentshall,jointlywiththedepartmentsofdevelopmentandreform,agricultureandruralaffairs,planningandresources,housingandurban-ruraldevelopment,

32、landscapingandcityappearance,waterauthority,economyandinformationtechnology,finance,etc.,formulatethemunicipalplanforsoilpollutionpreventionandcontrolaccordingtotherequirementsofecologicalandenvironmentalprotectionplanning,theuseoftheland,theresultsofthegeneralsurveyandmonitoringofthesoilpollutionst

33、atusbeforesubmittingtheplantotheMunicipalPeople,sGovernmentforapproval,publicationandimplementation.Whenthedepartmentsofagricultureandruralaffairs,landscapingandcityappearance,etc.drawupaplanforarelevantindustry,theplanshallincludethecontentofsoilpollutionpreventionandcontrol.第十二条市、区人民政府 应当将土壤污染防治工作

34、纳入国 民经济和社会发展规划、生态环 境保护规划。市生态环境部门应当会同发展改 革、农业农村、规划资源、住房 城乡建设管理、绿化市容、水 务、经济信息化、财政等部门, 根据生态环境保护规划要求、土 地用途、土壤污染状况普查和监 测结果等,编制本市土壤污染防 治规划,报市人民政府批准后公 布实施。农业农村、绿化市容等部门编制 的有关行业规划,应当包括土壤 污染防治内容。编制国土空间规划时,编制机关 应当充分考虑土壤环境质量因Whenformulatingaterritorialspaceplan,theformulatinginstitutionshalltakethesoilenvironme

36、anagementandcontrol,theMunicipalPeoplesGovernmentmayformulatelocalstandardsthatarestricterthanthestatestandards.ThelocalstandardsshallbefiledwiththeecologyandenvironmentdepartmentoftheStateCouncilandbemadepublicaccordingtolaw.Toformulatelocalstandardsforsoilpollutionriskmanagementandcontrol,itisnece

37、ssarytoorganizeexpertstoconductreviewanddiscussion,andsolicittheopinionsofrelevantdepartments,industryassociations,enterprises,publicinstitutions,thepublic,etc.Theimplementationofthestandardsforsoilpollutionriskmanagementandcontrolshallberegularlyassessed,andthestandardsW川berevisedinduecoursebasedon

38、theresultsoftheassessment.第十三条 市人民政府对国 家土壤污染风险管控标准中未作 规定的项目,可以制定地方土壤 污染风险管控标准;对国家土壤 污染风险管控标准中已作规定的 项目,可以制定严于国家土壤污 染风险管控标准的地方土壤污染 风险管控标准。地方土壤污染风 险管控标准应当依法报国务院生 态环境主管部门备案并予以公 布。制定地方土壤污染风险管控标 准,应当组织专家进行审查和论 证,并征求有关部门、行业协 会、企业事业单位和公众等方面 的意见。地方土壤污染风险管控标准的执 行情况应当定期评估,并根据评 估结果对标准适时修订。第十四条市、区人民政府 可以根据土壤污染状况

39、普查、土 壤环境监测情况以及耕地保护等 需要,组织生态环境、农业农 村、规划资源、绿化市容等部门 开展土壤污染状况详查。土壤污 染状况详查应当查明土壤污染区 域、地块分布、面积、主要污染 物和污染程度等。Article14Themunicipalanddistrictpeoplesgovernmentsmay,accordingtothesoilpollutionstatussurvey,soilenvironmentmonitoringresults,andtheneedforfarmlandprotection,organizethedepartmentsofecologyandenvir

40、onment,agricultureandruralaffairs,planningandresources,landscapingandcityappearance,etc.toconductdetailedsurveysofthesoilpollutionstatus.Thedetailedsurveysshallspecifythesoil-pollutionregions,distributionofthepollutedplotsandtheareasoftheplots,themainpollutants,andthedegreeofpollution,amongothers.Th

41、eresultsofthedetailedsoilpollutionstatussurveyshallconstituteanimportantbasisforcategorizedmanagementandriskmanagementinsoilpollutionpreventionandcontrol.Article15Themunicipaldepartmentofecologyandenvironmentshall,jointlywiththedepartmentsofagricultureandruralaffairs,planningandresources,landscaping

42、andcityappearance,waterauthority,etc.setupsoilenvironmentmonitoringstations(sites)andimprovethesoil-environmentmonitoringnetworkinaccordancewiththerelevantstateandmunicipalprovisions.Thedepartmentsofecologyandenvironment,agricultureandruralaffairs,planningandresources,landscapingandcityappearance,wa

43、terauthority,etc.shallconductmonitoringaccordingtothenormsforsoilenvironmentmonitoring,andstrengthencontrolofthemonitoringquality.Thelandownersanduserightholdersshallrendertheircooperationinthesettingupofsoilenvironmentmonitoringstations(sites)andinthemonitoringactivities.土壤污染状况详查结果应当作为 实施土壤污染防治分类管理

44、、风 险管控等的重要依据。第十五条市生态环境部门 应当会同农业农村、规划资源、 绿化市容、水务等部门按照国家 和本市有关规定,设置土壤环境 监测站(点),健全土壤环境监 测网络。生态环境、农业农村、规划资 源、绿化市容、水务等部门应当 按照土壤环境监测规范开展监 测,并加强监测质量控制。对土壤环境监测站(点)的设置 以及监测活动,土地所有权人、 使用权人应当予以配合。第十六条区农业农村、绿 化市容部门应当会同生态环境、 规划资源部门根据国家规定的情 形,制定农用地重点监测地块清 单,并进行重点监测。Article16Thedistrictdepartmentsofagricultureandr

45、uralaffairsandlandscapingandcityappearanceshall,jointlywiththedepartmentsofecologyandenvironmentandplanningandresources,drawupalistoffarmlandplotsunderprioritymonitoringinaccordancewiththestateprovisions,andputthemunderprioritymonitoring.Thedistrictecologyandenvironmentdepartmentshall,jointlywiththe

46、planningandresourcesdepartment,drawupalistofconstructionlandplotsunderprioritymonitoringinaccordancewiththestateprovisions,andputthemunderprioritymonitoring.ChapterIIIPreventionandProtectionArticle17Variouslandutilizationplansandconstructionprojectsthatmaypollutethesoilshallbesubjecttoenvironmentali

47、mpactassessmentaccordingtolaw.Theenvironmentalimpactassessmentdocumentshallincludepossibleadverseimpactsonsoil,thecorrespondingpreventivemeasurestotake,etc.Intheabsenceofanenvironmentalimpactassessmentaccordingtolaw,therelevantplanshallnotbecarriedout,andtherelevantconstructionprojectshallnotstart.区

48、生态环境部门应当会同规划资 源部门根据国家规定的情形,制 定建设用地重点监测地块清单, 并进行重点监测。第三章预防和保护第十七条各类涉及土地利 用的规划和可能造成土壤污染的 建设项目,应当依法进行环境影 响评价。环境影响评价文件应当 包括对土壤可能造成的不良影 响、应当采取的相应预防措施等 内容。未依法进行环境影响评价的,相 关规划不得组织实施,相关建设 项目不得开工建设。第十八条市、区人民政府 和发展改革、经济信息化、规划 资源、生态环境等部门应当按照 国土空间规划,严格执行相关行 业企业布局选址要求,禁止在居 民区和学校、医院、疗养院、养 老院等单位周边新建、改建、扩 建可能造成土壤污染的

49、建设项 目。Article18Themunicipalanddistrictpeoplesgovernmentsandthedepartmentsofdevelopmentandreform,economyandinformationtechnology,planningandresources,ecologyandenvironment,etc.shall,inaccordancewiththeterritorialspaceplans,strictlyfollowtherequirementsforthelayoutandsite-selectionoftherelevantindustriesandenterprises,anditisprohibitedtola
