4、ionPreventionandProtectioninIndustrialandTrade工贸企业粉尘防爆安全规定EnterprisesChapterIGeneralProvisionsArticle1TheseProvisionsaredevelopedinaccordancewiththeWorkSafetyLawofthePeoplesRepublicofChinaandotherapplicablelawsandregulationsforthepurposesofstrengtheningthesafetyofdustexplosionpreventionandprotection
5、inindustrialandtradeenterprises,preventingandreducingdustexplosionaccidents,andsafeguardingthelifesafetyofpractitioners.Article2TheseProvisionsshallapplytothesafetyworkofmetallurgy,non-ferrousmetal,buildingmaterials,machinery,lightindustry,textile,tobacco,commerceandtrade,andotherindustrialandtradee
6、nterpriseswiththehazardsofcombustibledustexplosion(hereinafterreferredtoasthe“enterprisesinvolvingdustexplosion)relatedtodustexplosionpreventionandprotectionandthesupervisionandadministrationthereof.Article3ForthepurposesoftheseProvisions,combustibledusf,meansanydust,fiberorflyingcatkinsthatreactvio
7、lentlywithgaseousoxidants(mainlyair)underatmosphericconditions.第一章总则第一条为了加强工贸企业 粉尘防爆安全工作，预防和减少 粉尘爆炸事故，保障从业人员生 命安全，根据中华人民共和国 安全生产法等法律法规，制定 本规定。第二条存在可燃性粉尘爆 炸危险的冶金、有色、建材、机 械、轻工、纺织、烟草、商贸等 工贸企业（以下简称粉尘涉爆企 业）的粉尘防爆安全工作及其监 督管理，适用本规定。第三条本规定所称可燃性 粉尘，是指在大气条件下，能与 气态氧化剂（主要是空气）发生 剧烈氧化反应的粉尘、纤维或者 飞絮。本规定所称粉尘爆炸危险场所， 是
8、指存在可燃性粉尘和气态氧化 剂（主要是空气）的场所，根据 爆炸性环境出现的频率或者持续 的时间，可划分为不同危险区ForthepurposesoftheseProvisions,anuareasubjecttodustexplosionhazardsmeansanyareawherecombustibledustandgaseousoxidizer(mainlyair)exist,andwhichmaybecategorizedintodifferenthazardousareasaccordingtothefrequencyordurationofthe域。explosiveenvironm
9、ent.Article4Anenterpriseinvolvingdustexplosionshallassumeprimaryresponsibilityforanysafetyworkrelatedtodustexplosionpreventionandprotection,andshallsatisfytheworksafetyconditionsfordustexplosionpreventionandprotectionasprovidedforinrelevantlawsandregulations,rules,nationalstandardsorindustrystandard
10、s,establishandimprovetheworksafetyresponsibilitysystemforallstaffandrelevantrulesandregulations,strengthenworksafetystandardizationandinformationtechnologydevelopment,establishadualpreventionmechanismconsistingofthegradedmanagementandcontrolofsafetyrisksandtheinvestigationandtreatmentofhiddendangers
11、,andimprovethemechanismforforestallinganddefusingrisks,soastoensureworksafety.Article5Suchdepartmentsofthelocalpeople,sgovernmentatorabovethecountylevelasareresponsibleforthesupervisionandadministrationofworksafetyofenterprisesinvolvingdustexplosion(hereinaftercollectivelyreferredtoasthe“departments
12、responsibleforthesafetyregulationofenterprisesinvolvingdustexplosion)shall,accordingtothedutiesprescribedbythepeoplesgovernmentatthesamelevelandundertheprincipleofterritorialjurisdictionatdifferentlevels,overseeandadministerthesafetyworkofdustexplosionpreventionandprotectionofenterprisesinvolvingdus
13、texplosionwithinitsadministrativeregion.第四条粉尘涉爆企业对粉 尘防爆安全工作负主体责任，应 当具备有关法律法规、规章、国 家标准或者行业标准规定的粉尘 防爆安全生产条件，建立健全全 员安全生产责任制和相关规章制 度，加强安全生产标准化、信息 化建设，构建安全风险分级管控 和隐患排查治理双重预防机制， 健全风险防范化解机制，确保安 全生产。第五条 县级以上地方人民 政府负责粉尘涉爆企业安全生产 监督管理的部门（以下统称负责 粉尘涉爆企业安全监管的部 11）,根据本级人民政府规定的 职责，按照分级属地的原则，对 本行政区域内粉尘涉爆企业的粉 尘防爆安全工作
14、实施监督管理。国务院应急管理部门应当加强指 导监督。TheemergencymanagementdepartmentoftheStateCouncilshallstrengthenitsguidanceforandsupervisionoverthedepartmentsabovementioned.ChapterIlWorkSafetyGuarantee第二章安全生产保障Article6Theprimarypersoninchargeofanenterpriseinvolvingdustexplosionshallbethefirstresponsiblepersonforthesafety
15、workrelatedtodustexplosionpreventionandprotection,andotherresponsiblepersonsshallberesponsibleforthesafetyworkrelatedtodustexplosionpreventionandprotectionwithinthescopeoftheirrespectiveresponsibilities.第六条粉尘涉爆企业主要负责人是粉尘防爆安全工作的第一责任人，其他负责人在各自职责范围内对粉尘防爆安全工作负责。Anenterpriseinvolvingdustexplosionshallspe
16、cify,initsworksafetyresponsibilitysystem,thesafetyresponsibilitiesfordustexplosionpreventionandprotectionoftheprincipalpersonincharge,thepersonsinchargeofrelevantdepartments,thepersonsinchargeofproductionworkshopsandthepersonnelondustoperationposts.粉尘涉爆企业应当在本单位安全生产责任制中明确主要负责人、相关部门负责人、生产车间负责人及粉尘作业岗位人
17、员粉尘防爆安全职责。Article7Anenterpriseinvolvingdustexplosionshall,inlightofitsactualcircumstances,establishandimplementthesafetymanagementrulesfordustexplosionpreventionandprotection.Thesafetymanagementrulesfordustexplosionpreventionandprotectionshallcoverthefollowingcontents:第七条粉尘涉爆企业应当结合企业实际情况建立和落实粉尘防爆安全管
18、理制度。粉尘防爆安全管理制度应当包括下列内容：(1)Identification,assessment,andmanagementandcontrolofdustexplosionrisks.（一）粉尘爆炸风险辨识评估和管控；(2) Investigationandtreatmentofdangersofdustexplosionaccidents.hidden（二）粉尘爆炸事故隐患排查治理；（三）粉尘作业岗位安全操作规(3) Proceduresforsafeoperationsondust程;（四）粉尘防爆专项安全生产教 育和培训；（五）粉尘清理和处置;（六）除尘系统和相关安全设施 设备运
19、行、维护及检修、维修管 理；（七）粉尘爆炸事故应急处置和 救援。第八条粉尘涉爆企业应当 组织对涉及粉尘防爆的生产、设 备、安全管理等有关负责人和粉 尘作业岗位等相关从业人员进行 粉尘防爆专项安全生产教育和培 训，使其了解作业场所和工作岗 位存在的爆炸风险，掌握粉尘爆 炸事故防范和应急措施；未经教 育培训合格的，不得上岗作业。粉尘涉爆企业应当如实记录粉尘 防爆专项安全生产教育和培训的 时间、内容及考核等情况，纳入 员工教育和培训档案Q第九条粉尘涉爆企业应当operationposts.(4) Specialworksafetyeducationandtrainingondustexplosion
20、preventionandprotection.(5) Dustcleaninganddisposal.(6) Theoperation,maintenance,overhaul,andrepairmanagementofthedustcollectionsystemandrelevantsafetyfacilitiesandequipment.(7) Emergencydisposalandrescueindustexplosionaccidents.Article8Anenterpriseinvolvingdustexplosionshallorganizetherelevantperso
21、nsinchargeof,amongothers,production,equipment,andsafetymanagement,andrelevantpractitionerson,amongothers,dustoperationpostsinvolvingdustexplosionpreventionandprotectiontoreceivespecialworksafetyeducationandtrainingondustexplosionpreventionandprotection,soastomakethemunderstandtheexplosionrisksassoci
22、atedwithworkplacesandposts,andmasterpreventionandemergencyresponsemeasuresfordustexplosionaccidents;andthosewhofailtopasssucheducationandtrainingshallnottaketheirposts.Anenterpriseinvolvingdustexplosionshalltruthfullymakearecordofthetime,contentandassessmentofthespecialworksafetyeducationandtraining
23、ondustexplosionpreventionandprotection,andincludesuchinformationinstaffeducationandtrainingarchives.Article9Anenterpriseinvolvingdustexplosionshallprovidepractitionersondustpostswithlaborprotectionarticlesinlinewithnationalorindustrystandards,andsuperviseandeducatepractitionersonwearingorusingthemac
24、cordingtotheuserules.Article10Anenterpriseinvolvingdustexplosionshalldevelopemergencyrescueplansfordustexplosionaccidentsandorganizedrillsonaperiodicalbasisinaccordancewiththelaw.Afterafireordustexplosionaccidentoccurs,theenterpriseinvolvingdustexplosionshallimmediatelyinitiateemergencyresponseandev
25、acuatealloperatorstosafeplaces,andshallnottakeanyemergencydisposalmeasuresthatmaycausedust.Article11Anenterpriseinvolvingdustexplosionshallidentifytheriskfactorsofdustexplosion,suchasdustcloudsandignitionsourcesonaperiodicalbasis,anddeterminethelocationandscopeofanareasubjecttodustexplosionhazards.I
26、naddition,theenterpriseshall,accordingtothefeaturesofdustexplosion,thenumberofoperatorsfordustoperations,andotherkeyelements,assessanddeterminethesafetyriskleveloftherelevantareasubjecttohazards,formulateandimplementmanagementandcontrolmeasures,specifytheresponsibledepartmentandresponsiblepersonnel,
27、establishasafetyrisklist,andmaintaintheinformationarchivesonidentification,assessment,andmanagementandcontrolprocessofsafetyrisksinatimelymanner.为粉尘作业岗位从业人员提供符 合国家标准或者行业标准的劳动 防护用品，并监督、教育从业人 员按照使用规则佩戴、使用。第十条粉尘涉爆企业应当 制定有关粉尘爆炸事故应急救援 预案，并依法定期组织演练。发 生火灾或者粉尘爆炸事故后，粉 尘涉爆企业应当立即启动应急响 应并撤离疏散全部作业人员至安 全场所，不得采用可能
28、引起扬尘 的应急处置措施。第H一条粉尘涉爆企业应 当定期辨识粉尘云、点燃源等粉 尘爆炸危险因素，确定粉尘爆炸 危险场所的位置、范围，并根据 粉尘爆炸特性和涉粉作业人数等 关键要素，评估确定有关危险场 所安全风险等级，制定并落实管 控措施，明确责任部门和责任人 员，建立安全风险清单，及时维 护安全风险辨识、评估、管控过 程的信息档案。粉尘涉爆企业应当在粉尘爆炸较 大危险因素的工艺、场所、设施 设备和岗位，设置安全警示标 志OAnenterpriseinvolvingdustexplosionshallsetupsafetywarningsignsfortheprocesses,places,fa
29、cilities,equipmentandpostswithgreaterriskfactorsofdustexplosion.Wherethereisanychangein,amongothers,processes,places,facilities,andequipmentwithdustexplosionhazards,theenterpriseinvolvingdustexplosionshallconductsafetyriskidentificationandassessmentonceagain.Article12Anenterpriseinvolvingdustexplosi
30、onshall,inaccordancewiththerelevantnationalorindustrystandardssuchastheSafetyRegulationsforDustExplosionPreventionandProtection,andinlightofthemanagementandcontrolmeasuresfordustexplosionrisks,establishalistofhiddendangersofaccidents,specifytheitems,details,frequency,andresponsiblepersonnelfortheinv
31、estigation,organizeandcarryouttheinvestigationandtreatmentofhiddendangersofaccidentsinatimelymanner,truthfullymakearecordoftheinvestigationandtreatmentofhiddendangers,andcirculatethesameamongthepractitionersconcerned.Incaseofanyhiddendangerofamajoraccidentassetforthinthestandardsfordeterminingthehid
32、dendangersofmajoraccidentsinvolvingtheindustrialandtradeindustry,theenterpriseinvolvingdustexplosionshallmakeatreatmentplaninaccordancewithapplicableprovisions,whichshallexplicitlyprovideformeasures,responsibilities,funds,timelimitandemergencyresponseplans,soastoeliminateanyhiddendangeroftheaccident
33、inatimelymanner.涉及粉尘爆炸危险的工艺、场 所、设施设备等发生变更的，粉 尘涉爆企业应当重新进行安全风 险辨识评估。第十二条粉尘涉爆企业应 当根据粉尘防爆安全规程等 有关国家标准或者行业标准，结 合粉尘爆炸风险管控措施，建立 事故隐患排查清单，明确和细化 排查事项、具体内容、排查周期 及责任人员，及时组织开展事故 隐患排查治理，如实记录隐患排 查治理情况，并向从业人员通 报。构成工贸行业重大事故隐患判定 标准规定的重大事故隐患的，应 当按照有关规定制定治理方案， 落实措施、责任、资金、时限和 应急预案，及时消除事故隐患。第十三条粉尘涉爆企业新 建、改建、扩建涉及粉尘爆炸危 险的
34、工程项目安全设施的设计、 施工应当按照粉尘防爆安全规 程等有关国家标准或者行业标Article13Thesafetyfacilitiesofanenterpriseinvolvingdustexplosionforitsnewlyconstructed,reconstructedorexpandedengineeringprojectwithdustexplosionhazardsshallbedesignedandconstructedinaccordancewithapplicablenationalorindustrystandardssuchastheSafetyRegulations
35、forDustExplosionPreventionandProtection,andtheirdesigndocumentsandconstructionplansshallincludeexplicitcontentsondustexplosionpreventionandprotection.Thedesignentityshallberesponsibleforthedesignrelatedtothedustexplosionpreventionandprotectionofsafetyfacilities,andthecontractorshallconstructaccordin
36、gtothedesignandberesponsiblefortheconstructionquality.Article14Theframeworkandlayoutofthebuildings(structures)ofanenterpriseinvolvingdustexplosionwherethereisanyareasubjecttodustexplosionhazardsshall,incompliancewiththerequirementsofapplicablenationalorindustrystandardssuchastheSafetyRegulationsforD
37、ustExplosionPreventionandProtection,beaccompaniedbymeasuressuchasfire,explosionandlightningprotection.Theroofofasingle-storyfactorybuildingshallgenerallybealightstructure,andinthecaseofamulti-storyfactorybuilding,theframestructureshallbeadopted,withapressurereliefareaincompliancewithapplicablestanda
38、rdsandrequirements.准，在安全设施设计文件、施工 方案中明确粉尘防爆的相关内 容。设计单位应当对安全设施粉尘防 爆相关的设计负责，施工单位应 当按照设计进行施工，并对施工 质量负责。第十四条粉尘涉爆企业存 在粉尘爆炸危险场所的建（构） 筑物的结构和布局应当符合粉 尘防爆安全规程等有关国家标 准或者行业标准要求，采取防火 防爆、防雷等措施，单层厂房屋 顶一般应当采用轻型结构，多层 厂房应当为框架结构，并设置符 合有关标准要求的泄压面积0粉尘涉爆企业应当严格控制粉尘 爆炸危险场所内作业人员数量， 在粉尘爆炸危险场所内不得设置 员工宿舍、休息室、办公室、会 议室等，粉尘爆炸危险场所
39、与其 他厂房、仓库、民用建筑的防火 间距应当符合建筑设计防火规 范的规定。Anenterpriseinvolvingdustexplosionshallstrictlycontrolthenumberofworkersoperatingattheareasubjecttodustexplosionhazards,andshallnotsetup,amongothers,staffdormitories,lounges,offices,conferenceroomsattheareasubjecttodustexplosionhazards.Thefirepreventiondistancebe
40、tweentheareasubjecttodustexplosionhazardsandotherfactorypremises,warehousesandcivilbuildingsshallcomplywiththeprovisionsoftheCodeforFireProtectionDesignofBuildings.Article15Anenterpriseinvolvingdustexplosionshall,inaccordancewithapplicablenationalorindustrystandardssuchastheSafetyRegulationsforDustE
41、xplosionPreventionandProtection,setuprelativelyindependentdustcollectionsystemsatthedifferentplacesoftheareasubjecttodustexplosionhazardsaccordingtodifferentprocesses.Combustibledustandcombustiblegasandothermediathatareeasytoaggravateexplosionhazardsshallnotsharethesamesetofdustcollectionsystem,andd
42、ustcollectionsystemsindifferentfirepreventionareasshallnotbeinterconnected.Incaseoftheprocessequipmentwithdustexplosionhazards,oneormoreexplosioncontrolmeasuressuchasventingofdustexplosion,explosionisolation,inerting,explosionsuppressionandexplosionresistanceshallbeadopted,exceptanyexplosionisolatio
43、nmeasuresadoptedseparately.Dustsettlingchambershallnotbeusedfordustcollectionorroadwaystructureshallnotbeusedasdustremovalducts.Aluminum,magnesiumandothermetaldustshouldberemovedbynegativepressure.Ifotherdustisblownbypositivepressureduetotherestrictionofprocessconditions,reliablemeasuresshallbetaken
44、toguardagainstignitionsources.第十五条粉尘涉爆企业应 当按照粉尘防爆安全规程等 有关国家标准或者行业标准规 定，将粉尘爆炸危险场所除尘系 统按照不同工艺分区域相对独立 设置，可燃性粉尘不得与可燃气 体等易加剧爆炸危险的介质共用 一套除尘系统，不同防火分区的 除尘系统禁止互联互通。存在粉 尘爆炸危险的工艺设备应当采用 泄爆、隔爆、惰化、抑爆、抗爆 等一种或者多种控爆措施，但不 得单独采取隔爆措施。禁止采用 粉尘沉降室除尘或者采用巷道式 构筑物作为除尘风道。铝镁等金 属粉尘应当采用负压方式除尘， 其他粉尘受工艺条件限制，采用 正压方式吹送时，应当采取可靠 的防范点燃源
45、的措施。采用干式除尘系统的粉尘涉爆企 业应当按照粉尘防爆安全规 程等有关国家标准或者行业标 准规定，结合工艺实际情况，安 装使用锁气卸灰、火花探测熄 灭、风压差监测等装置，以及相 关安全设备的监测预警信息系 统，加强对可能存在点燃源和粉Anenterpriseinvolvingdustexplosionthatadoptsthedrydedustingsystemshall,inaccordancewithapplicablenationalorindustrystandardssuchastheSafetyRegulationsforDustExplosionPreventionandPro
46、tection,andinlightoftheactualcircumstancesoftheprocess,installandusedevicessuchasgaslockingandairdischarge,sparkdetectionandextinguishment,andairpressuredifferencemonitoring,aswellasthemonitoringandearlywarninginformationsystemofrelevantsafetyequipment,andstrengthenthereal-timemonitoringoftheareasub
47、jecttodustexplosionhazardswhereignitionsourcesanddustcloudsmayexist.Thewetdedustingsystemforaluminum,magnesiumandothermetaldustshallbeequippedwithaliquidlevelandflowratemonitoringandalarmdeviceinterlockedwiththepolishingequipmentTheworkplaceandthedustcollectorshallbekeptwellventilated,soastopreventt
48、heaccumulationofhydrogen.Theprecipitateddustmudshallbecleanedupinatimelyandstandardizedmanner.Article16Withrespecttotheprocessesthatareeasytoproducemechanicalignitionsources,suchascrushing,grinding,granulation,andsanding,anenterpriseinvolvingdustexplosionshall,inastandardizedmanner,takemeasurestopreventignitionsources,suchassundriesremovalorsparkdetectionandelimination,cleanupandmaintainthemonaperiodicalbasis,andmakeanappropriaterecordthereof.尘云的粉尘爆炸危险场所的实时 监控。铝镁等金属粉尘湿式除尘 系统应当安装与打磨抛光设备联 锁的液位、流速监测报警装置， 并保持作业场所和除尘器本体良 好通风，防止氢气积聚，及时规 范清理沉淀的粉尘泥浆。第十六条针对粉碎、研 磨、造粒、砂光等易产生机械点 燃源的工艺，粉尘涉爆企业应当 规范采取
