6、定第四次修订根据2020年11月29日国务院关于修改和废止部分行政法规的决定第五次修订）第一章总则ChapterIGeneralProvisionsArticle1TheseRegulationsareenactedinaccordancewiththeConstitutionwithaviewtostrengtheningtheadministrationofpublishingactivities,developingandprosperingthesocialistpublishingindustryandpublishingcausewithChinesecharacteristics
7、,guaranteeingthecitizenstoexercisetherightoffreedomofpublicationinaccordancewiththelaw,andpromotingthesocialistspiritualcivilizationandmaterialcivilization.Article 2 TheseRegulationsshallapplytothepublishingactivitieswithintheterritoryofthePeopIe1SRepublicofChina.Publishingactivitiesmentionedinthese
8、Regulationsshallincludethepublication,pintreproduction,importanddistributionofpublications.PublicationsmentionedintheseRegulationsshallmeanthenewspapers,periodicals,books,audioandvideorecordingsandelectronicpublications,etc.Article 3 Publishingactivitiesmustadheretotheorientationofservingthepeoplean
9、dsocialism,followtheguidanceofMarxism-Leninism,MaoZedongThought,DengXiaopingTheoryandtheimportantthoughtof4ThreeRepresents,carryouttheScientificOutlookonDevelopment,disseminateandaccumulatethescientific,technologicalandculturalknowledgebenecialtotheimprovementofthequalityofthe第一条为了加强对出版活动的管理，发展和繁荣有中
10、国特色社会主义出版产业和出版事业，保障公民依法行使出版自由的权利，促进社会主义精神文明和物质文明建设，根据宪法，制定本条例。第二条在中华人民共和国境内从事出版活动，适用本条例本条例所称出版活动，包括出版物的出版、印刷或者复制、进口、发行。本条例所称出版物，是指报纸、期刊、图书、音像制品、电子出版物等。第三条出版活动必须坚持为人民服务、为社会主义服务的方向，坚持以马克思列宁主义、毛泽东思想、邓小平理论和“三个代表”重要思想为指导，贯彻落实科学发展观，传播和积累有益于提高民族素质、有益于经济发展和社会进步的科学技术和文化知识，弘扬民族优秀文化，促进国际文化交流，丰富和提高人民的精神生活。peopl
11、e,economicdevelopmentandsocialprogress,carryforwardtheexcellentnationalculture,promoteinternationalculturalexchange,andenrichandimprovethespirituallifeofthepeople.Article 4 Whoeverisengagedinpublishingactivitiesshallgiveprimacytothesocialbenefits,andcombinethesocialbenefitswiththeeconomicbenefits.Ar
12、ticle 5 Thepeoplesgovernmentateachlevelshallguaranteethecitizenstoexercisetherightoffreedomofpressinaccordancewiththelaw.Anycitizenmust,whenexercisingtherightoffreedomofpressofpress,abidebytheConstitutionandthelaw,andmustnotobjectthebasicprinciplesdeterminedintheConstitutionordamagetheinterestsofthe
13、State,thesocietyorthecollective,orthelawfulfreedomsandrightsofothercitizens.Article 6 ThecompetentpublicationdepartmentundertheStateCouncilshallberesponsibleforsupervisingandadministeringthepublishingactivitiesnation-wide.OtherrelevantdepartmentsundertheStaleCouncilshall,inaccordancewiththedivisiono
14、fdutiesprescribedbytheStateCouncil,beresponsibleforsupervisingandadministeringtherelevantpublishingactivities.Theadministrativedepartmentresponsiblefortheadministrationofpublication(hereinafterreferredtoas“thecompetentpublicationdcpartmenf,)underthelocaleole,s第四条从事出版活动，应当将社会效益放在首位，实现社会效益与经济效益相结合。第五条
15、公民依法行使出版自由的权利，各级人民政府应当予以保障。公民在行使出版自由的权利的时候，必须遵守宪法和法律，不得反对宪法确定的基本原则，不得损害国家的、社会的、集体的利益和其他公民的合法的自由和权利。第六条国务院出版行政主管部门负责全国的出版活动的监督管理工作。国务院其他有关部门按照国务院规定的职责分工，负责有关的出版活动的监督管理工作。县级以上地方各级人民政府负责出版管理的部门（以下简称出版行政主管部门）负责本行政区域内出版活动的监督管理工作。县级以上地方各级人民政府其他有关部门在各自的governmentatthecountyleveloraboveshallberesponsiblefor
16、supen,isingandadministeringthepublishingactivitieswithinitsownjurisdiction.Otherrelevantdepartmentsunderthelocalpeople,sgovernmentatthecountyleveloraboveshall,withinthescopeoftheirrespectiveduties,beresponsibleforsupen,isingandadministeringtherelevantpublishingactivities.Article 7 Thecompetentpublic
17、ationdepartmentmay,wheninvestigatingtheactivitiessuchaspublication,PiintingZreproduction,importordistributionofpublications,whicharesuspectedtobeillegal,onthebasisoftheobtainedevidenceaboutthesuspectofillegalityorthereportofoffence,mayinspectthearticlesandbusinesspremisesrelatingtosuspectedillegalac
18、tivities;andmaysealupordistrainthearticleswhichcanbeprovedbytheexistingevidencetoberelatingtotheillegalactivities.Article 8 Asocialorganizationinthepublishingindustryshall,inaccordancewithitsarticlesofassociation,practiceself-disciplinedmanagementunderthedirectionofthecompetentpublicationdepartment.
19、Chapter11EstablishmentandAdministrationOfPublishingEntitiesArticle 9 Newspapers,periodicals,books,audioandvideorecordings,andelectronicpublications,etc.shallbepublishedbypublishingentities.职责范围内，负责有关的出版活动的监督管理工作。第七条出版行政主管部门根据已经取得的违法嫌疑证据或者举报，对涉嫌违法从事出版物出版、印刷或者复制、进口、发行等活动的行为进行查处时，可以检查与涉嫌违法活动有关的物品和经营场所；
20、对有证据证明是与违法活动有关的物品，可以查封或者扣押。第八条出版行业的社会团体按照其章程，在出版行政主管部门的指导下，实行自律管理。第二章出版单位的设立与管理第九条报纸、期刊、图书、音像制品和电子出版物等应当由出版单位出版。Thetermpublishingentity“asmentionedintheseRegulationsincludenewspaperoffices,periodicaloffices,bookpublishinghouses,audioandvideorecordingpublishinghousesandelectronicpublicationpublishing
21、houses,etc.Forlegalpersonpublishingnewspapersandperiodicalswithoutestablishingnewspaperofficesorperiodicaloffices,thenewspapereditorialdepartmentsorperiodicaleditorialdepartmentssetupbythemshallberegardedasthepublicationentities.Article 10 ThecompetentpublicationdepartmentundertheStaleCouncilshallfo
22、rmulatetheprogrammingonthetotalnumber,structureanddistributionofthenationalpublishingentities,directandcoordinatethedevelopmentofthepublishingindustryandpublishingcause.Article 11 Inordertoestablishapublishingentity,theapplicantshallmeetthefollowingconditions:1. Havingthenameandarticlesofassociation
23、ofthepublishingentity;2. HavingthesponsorandthecompetentauthoritywhicharecognizedbythecompetentpublicationdepartmentundertheStateCouncil;3. Havingawell-definedscopeofbusiness;本条例所称出版单位，包括报社、期刊社、图书出版社、音像出版社和电子出版物出版社等。法人出版报纸、期刊，不设立报社、期刊社的，其设立的报纸编辑部、期刊编辑部视为出版单位。第十条国务院出版行政主管部门制定全国出版单位总量、结构、布局的规划，指导、协调出版
24、产业和出版事业发展。第H条设立出版单位，应当具备下列条件：（一）有出版单位的名称、章程；（二）有符合国务院出版行政主管部门认定的主办单位及其主管机关；（三）有确定的业务范围：4. Havingaregisteredcapitalof300,000Yuanormoreandthe（四）有30万兀以上的注册资本和固定的工作场所;fixedworkpremises;5. HavinganorganizationalstructureadaptedtotheneedsofitsscopeOfbusinessandastaffofprofessionalsineditionandpublicationw
25、homeetthequalificationrequirementsprescribedbytheState;6. Otherconditionsprovidedforinlawsandadministrativeregulations.Theapprovalontheestablishmentofpublishingentityshallnotonlybeinaccordancewiththeconditionsenumeratedintheprecedingparagraph,butalsoconformtotheprogrammingoftheStateonthetotalnumber,
26、structureanddistributionofthepublishingentities.Article12Toestablishapublishingentity,itssponsorshallapplytothelocalcompetentpublicationdepartmentofthepeoplesgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment;anduponitsexaminationandconsent,reporttothecompetentpu
27、blicationdepartmentoftheStateCouncilforexaminationandapproval.Iftheto-be-eslablishedpublishingentityisapublicinstitution,itshallalsogothroughtheinstitutionalstaffingexaminationandapprovalfbmalities.Article13Theapplicationfortheestablishmentofapublishingentityshallexplicitlystatethefollowing:（五）有适应业务
28、范围需要的组织机构和符合国家规定的资格条件的编辑出版专业人员；（六）法律、行政法规规定的其他条件。审批设立出版单位，除依照前款所列条件外，还应当符合国家关于出版单位总量、结构、布局的规划。第十二条设立出版单位，由其主办单位向所在地省、自治区、直辖市人民政府出版行政主管部门提出申请：省、自治区、直辖市人民政府出版行政主管部门审核同意后，报国务院出版行政主管部门审批。设立的出版单位为事业单位的，还应当办理机构编制审批手续。第十三条设立出版单位的申请书应当载明下列事项：1.Thenameandaddressofthepublishingentity;（）出版单位的名称、地址;2. Thenamean
29、daddressofthesponsorandthecompetentauthorityofthepublishingentity;3. Thename,addressandqualificationcertifyingdocumentsofthelegalrepresentativeandmajorperson-in-chargeofthepublishingentity;4. Thesourcesandamountoffundsofthepublishingentity.Fortheestablishmentofanewspaperoffice,periodicaloffice,newsp
30、apereditorialdepartmentorperiodicaleditorialdepartment,theapplicationshallexplicitlystatethename,publishingfrequency.IayoutZformat,andprintingsiteofthenewspaperorperiodicalinaddition.Theapplicationshallbeattachedwiththearticleofassociationofthepublishingentityandtherelevantattestationdocumentsofthes
31、ponsorandthecompetentauthorityofthepublishingentity.Article14ThecompetentpublicationdepartmentundertheStateCouncilshall,within60daysafteracceptingtheapplicationforestablishingapublishingentity,makeadecisiononwhetherornottograntapproval,andthecompetentpublicationdepartmentunderthepeoplesgovernmentoft
32、heprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentshallinformthesponsorinwriting;iftheapplicationisnotapproved,itshallbejustified.（二）出版单位的主办单位及其主管机关的名称、地址；（三）出版单位的法定代表人或者主要负责人的姓名、住址、资格证明文件；（四）出版单位的资金来源及数额。设立报社、期刊社或者报纸编辑部、期刊编辑部的，申请书还应当载明报纸或者期刊的名称、刊期、开版或者开本、印刷场所。申请书应当附具出版单位的章程和
33、设立出版单位的主办单位及其主管机关的有关证明材料。第十四条国务院出版行政主管部门应当自受理设立出版单位的申请之日起60日内，作出批准或者不批准的决定，并由省、自治区、直辖市人民政府出版行政主管部门书面通知主办单位；不批准的，应当说明理由。第十五条 设立出版单位的主办单位应当自收到批准决定之日起60日内，向所在地省、自治区、直辖市人民 政府出版行政主管部门登记，领取出版许可证。登记事项 由国务院出版行政主管部门规定。Article15Asponsorwhichintendstoestablishapublishingentityshall,within60daysafteracceptingth
34、edecisiononapproval,gothroughtheregistrationproceduresinthecompetentpublicationdepartmentunderthepeoplesgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentatitslocality,andobtainthepublishinglicense.Thedetailofregistrationshallbeprescribedbythecompetentpublication
35、departmentundertheStateCouncil.出版单位领取出版许可证后，属于事业单位法人的，持出 版许可证向事业单位登记管理机关登记，依法领取事业单 位法人证书；属于企业法人的，持出版许可证向工商行政 管理部门登记，依法领取营业执照。Apublishingentityshall,afterobtainingthepublicationlicense,gothroughtheregistrationformalitiesattheorganinchargeofregistrationofpublicinstitutionswiththepublicationlicenseando
36、btainthelegalpersoncertificateforapublicinstitutionaccordingtolawifitisapublicinstitutionwiththelegalpersonstatus;andifitisacorporateenterprise,gothroughtheregistrationformalitiesattheindustrialandcommercialadministrationwiththepublicationlicense,andobtainthebusinesslicenseaccordingtolaw.第十六条报社、期刊社、
37、图书出版社、音像出版 社和电子出版物出版社等应当具备法人条件，经核准登记 后，取得法人资格，以其全部法人财产独立承担民事责 任。Article16Thenewspaperoffice,periodicaloffice,bookpublishinghouse,audioandvideorecordingpublishinghouseorelectronicpublicationpublishinghouse,etc.shallmeettheconditionstobealegalperson.Itshallbequalifiedasalegalpersonafterbeingapprovedan
38、dregistered,andshallindependentlybearthecivilliabilitywiththetotalpropertyitowns.依照本条例第九条第.三款的规定，视为出版单位的报纸编辑部、期刊编辑部不具有法人资格，其民事责任由其主办AnewspapereditorialdepartmentorperiodicaleditorialdepartmentwhichisregardedasapublishingentityinaccordancewithParagraph3ofArticle9oftheseRegulationsshallnotbequalifieda
39、salegalperson,anditscivilliabilityshallbebornebyitshostingentity.Article17Whereapublishingentityintendstochangeitsname,sponsororitscompetentauthority,businessscopeorcapitalstructure,tomergeorsplit,toestablishabranch,publishanewnewspaperorperiodical,ortochangethenameofitsnewspaperorperiodical,itshall
40、gothroughtheexaminationandapprovalformalitiesaccordingtoArticles12and13ofthisRegulation.Ifthepublishingentityisapublicinstitutionwiththelegalpersonstatus,itshallalsogothroughthecorrespondingregistrationformalitiesattheorganinchargeofregistrationofpublicinstitutionswiththeapprovaldocuments;andifitisa
41、corporateenterprise,itshallalsogothroughthecorrespondingregistrationformalitiesattheindustrialandcommercialadministrationwiththeapprovaldocuments.Whereapublishingentityintendstochangeanyitemother(hanthoselistedintheprecedingparagraph,itshall,upontheexaminationandconsentofitssponsoranditscompetentaut
42、hority,fileanapplicationformodificationregistrationwiththelocalcompetentpublicationdepartmentofthepeoplesgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment,andreporttothecompetentpublicationdepartmentoftheStateCouncilforarchivalpurposes.Ifthepublishingentityisapu
43、blicinstitutionwiththelegalpersonstatus,itshallalsogothroughthemodificationregistrationformalitiesattheorganinchargeofregistrationofpublicinstitutionswiththeapprovaldocuments;andifitisacorporateenterprise,itshallalsogo单位承担。第十七条出版单位变更名称、主办单位或者其主管机关、业务范围、资本结构，合并或者分立，设立分支机构，出版新的报纸、期刊，或者报纸、期刊变更名称的，应当依照本
44、条例第十二条、第十三条的规定办理审批手续。出版单位属于事业单位法人的，还应当持批准文件到事业单位登记管理机关办理相应的登记手续；属于企业法人的，还应当持批准文件到工商行政管理部门办理相应的登记手续。出版单位除前款所列变更事项外的其他事项的变更，应当经主办单位及其主管机关审查同意，向所在地省、自治区、直辖市人民政府出版行政主管部门申请变更登记，并报国务院出版行政主管部门备案。出版单位属于事业单位法人的，还应当持批准文件到事业单位登记管理机关办理变更登记；属于企业法人的，还应当持批准文件到工商行政管理部门办理变更登记。throughthemodificationregistrationformal

46、hepeoplesgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment,andgivethereasonsandtimelimitforsuspension.Thepublishingactivitiesofthepublishingentityshallnotbesuspendedformorethan18()days.出版单位终止出版活动的，由主办单位提出申请并经主管 机关同意后，由主办单位向所在地省、自治区、直辖市人 民政府出版行政主管部门办理注销登记，并报国务院出版
