6、rMarketRegu1.ationApri1.9,20242024年4月9日上海市食品经营许可和备案管理实施办法第一章总则第一条(制定依据)为规范食品经营许可和备案工作,加强食品经营安全监督管理,落实食品安全主体责任,保障食品安全,根据中华人民共和国行政许可法中华人民共和国食品安全法上海市食品安全条例食品经营许可和备案管理办法上海市酒类商品产销管理条例等规定,结合本市实际,制定本办法。笫二条(适用范围)本市食品经营许可的申请、受理、审查,决定,仅销售MeasuresofShanghaiMunicipa1.ityfortheImp1.ementationofAdministrationofFo

7、odBusiness1.icensingandRecordationChapterIGenera1.ProvisionsArtic1.e1(BasisforDeve1.opment)TheseMeasuresaredeve1.opedinaccordancewiththeAdministrative1.icensing1.awofthePeop1.esRepub1.icofChina,theFoodSafety1.awofthePeop1.esRepub1.icofChina,theRegu1.ationofShanghaiMunicipa1.ityonFoodSafety,theMeasur

8、esfortheAdministrationofFoodBusiness1.icensingandRecordation,theRegu1.ationofShanghaiMunicipa1.ityontheAdministrationofA1.coho1.icBeverageProductionandMarketing,andotherprovisions,in1.ightoftheconditionsofShanghai,forthepurposesofregu1.atingfoodbusiness1.icensingandrecordation,strengtheningthesuperv

9、isionandmanagementoffoodbusinesssafety,ensuringtheprimaryresponsibi1.ityforfoodsafety,andguaranteeingfoodsafety.Artic1.e2(App1.icabi1.ity)TheseMeasuresapp1.ytoapp1.ications,acceptance,examinations,anddecisionsre1.atedtofoodbusiness1.icensing,预包装食品(含保健食品、特殊医学用途配方食品、婴幼儿配方乳粉以及其他婴幼儿配方食品等特殊食品,下同)的备案,以及相关

11、rtic1.e3(WorkingPrincip1.es)Fp1.ywiththeprincip1.esof1.ega1.ity,openness,fairness,justice,convenience,andefficiency,andbeimp1.ementedbyc1.assificationbasedonthemainbusinessformsoffoodbusinessesandtherisk1.eve1.ofbusinessitems.笫四条(许可范围)在本市从事食品销售(含酒类商品,生猪产品、牛羊肉产品的批发和零售)和餐饮服务活动,应当依法取得食品经营许可。Artic1.e4(S

12、copeof1.icensing)Thesa1.eoffood(inc1.udingthewho1.esa1.eandretai1.sa1.eofa1.coho1.icbeverages,hogproducts,andbeefand1.ambmeatproducts)andcateringservicesinthiscityaresubjecttofoodbusiness1.icensinginaccordancewiththe1.aw.下列情形不需要取得食品经营许可:Thefo1.1.owingcircumstancesareexemptfromfoodbusiness1.icensing:

13、(一)销售食用农产品(不包含生猪产品、牛羊肉产品):(1) Thesa1.eofedib1.eagricu1.tura1.products(exc1.udinghog,beef,and1.ambmeatproducts).(二)仅销售预包装食品(不包含酒类商品):(2) Thesa1.eofon1.ypre-packagedfood(exc1.udinga1.coho1.icbeverages).(三)医疗机构、药品零售企业销售特殊医学用途配方食品中的特定全营养配方食品:(3) Amedica1.institutionormedicina1.productretai1.erse1.1.sanu

14、tritiona1.1.ycomp1.etefoodwithanutrient-adaptedformu1.ationthatfa1.1.sunderthecategoryoffoodforspecia1.medica1.purposes.(4) Afoodproducerthathasobtainedafoodproductionpermitse1.1.sthefooditproducesatitsproductionandprocessingsiteoron1.ine.(四)巳经取得食品生产许可的食品生产者,在其生产加工场所或者通过网络销售其生产的食品;(5) Exemptionfromf

15、oodbusiness1.icensingisotherwisegrantedby1.awsandregu1.ations.(五)法律、法规规定的其他不需要取得食品经营许可的情形。Artic1.e5(Princip1.esforRecordationofPrepackagedFood)Thesa1.eofon1.ypre-packagedfoodsha1.1.bereportedtothemarketregu1.atoryauthorityofthedistrictwherethesa1.eismade.笫五条(预包装备案的原则)仅销售预包装食品的,应当报所在地的区市场监管部门备案。Ifafo

16、odbusinessthaton1.yse1.1.spre-packagedfoodaddsafoodbusinessitemthatissubjecttofoodbusiness1.icensingaftercomp1.etingrecordation,itsha1.1.obtainafoodbusinesspermitinaccordancewiththe1.aw;therecordationautomatica1.1.ybecomesinva1.idonthedatewhenitobtainsafoodbusinesspermit.仅销售预包装食品的食品经营者在办理备案后,增加其他应当取

17、得食品经营许可的食品经营项目的,应当依法取得食品经营许可;取得食品经营许可之日起备案自行失效。Ifafoodbusinessthathasobtainedafoodbusinesspermitaddsthesa1.eofpre-packagedfood,itisexemptfromfurtherrecordation.食品经营者已经取得食品经营许可,增加预包装食品销售的,不需要另行备案。Ifafoodproducerthathasobtainedafoodproductionpermitse1.1.sthefooditproducesatitsproductionandprocessingsi

18、teoron1.ine,itisexemptfromfurtherrecordation.已经取得食品生产许可的食品生产者在其生产加工场所或者通过网络销售其生产的预包装食品的,不需要另行备案。医疗机构、药品零售企业销售特殊医学用途配方食品中Ifamedica1.institutionormedicina1.productretai1.erse1.1.sanutritiona1.1.ycomp1.etefoodwithanutrient-的特定全营养配方食品不需要备案,但是向医疗机构、药品零售企业销售特定全营养配方食品的经营企业,应当取得食品经营许可或者进行备案。adaptedformu1.at

20、(一地一证原则)食品经营者在不同经营场所从事食品经营活动的,应当依法分别取得食品经营许可或者进行备案。经营场所应当在食品经营者主体资格证明文件所载明的住所范围内。Artic1.e6(OneP1.ace,OnePermitPrincip1.e)Ifafoodbusinessengagesinfoodbusinessactivitiesatdifferentp1.acesofbusiness,itsha1.1.obtainafoodbusinesspermitorfi1.eforrecordationforeachp1.aceinaccordancewiththe1.aw.Ap1.aceofbus

21、inesssha1.1.bewithinthescopeofthedomici1.estatedinthefoodbusinesssdocumentofe1.igibi1.ity.机关、事业单位、社会团体、民办非企业单位、企业等申办集中用餐单位食堂的经营场所与主体资格证明文件载明的地址不一致,其上级主管部门、举办单位、前置审批部门或其他主管部门出具情况说明确认的地址可以作为经营场所。Ifthep1.aceofbusinessatwhichagovernmentagency,pub1.icinstitution,socia1.group,privatenon-enterpriseentity,o

24、nductbusinessactivitieswithinthescopeofthepermitorrecordationacrossthiscity.笫七条(职责分工)上海市市场监督管理局(以Article 7 (DivisionofResponsibi1.ities)TheShanghaiMunicipa1.AdministrationforMarketRegu1.ation(Municipa1.AdministrationforMarketRegu1.ation)isresponsib1.eforguidingtheadministrationofcitywidefoodbusiness

25、1.icensingandrecordation,aswe1.1.astheadministrationofreportingcross-provincia1.businessusingautomaticequipmentandfoodbusinessmanagement.下简称“市市场监管局”)负责指导全市食品经营许可和备案管理工作;负贲利用自动设备跨省经营、跨省从事食品经营管理的报告管理工作。Districtmarketregu1.atoryauthoritiesandthe1.in-gangSpecia1.AreaAdministrationforMarketRegu1.ation(co

26、1.1.ective1.y,districtmarketregu1.atoryauthority)areresponsib1.eforadministeringfoodbusiness1.icensingandrecordation,aswe1.1.asreportingmattersre1.atedtofoodbusinesseswithintheirjurisdictions.区市场监督管理部门、临港新片区市场监管局(以下简称“区市场监管部门“)负责辖区内食品经营许可和备案、食品经营相关报告事项的管理工作。第八条(其他情形职责分工)华舶食品经营的许可、备案及报告管理工作,由客运船舶经营期间

27、主要靠泊点所在地的区市场监管部门负贲。笫九条(展销会报Article 8 (DivisionofResponsibi1.itiesunderOtherCircumstances)Theadministrationof1.icensing,recordation,andreportingoffoodbusinessesonboardashipistheresponsibi1.ityofthedistrictmarketregu1.atoryauthorityinthemainberthoftheshipperformingpassengertransportationduringitsbusin

28、essactivities.告)食品展销会的举办者应当在展销会举办前十五个工作日内,向所在地的区市场监管部门报告。报告的内容包括展销会名称、地址、经营期限(起止日期)、食品安全管理制度、食品经营区域布局、经营项目、入场食品经营者主体信息核脸情况、食品安全应急处置预案、联系人、联系方式等信Article 9 (TradeFairReporting)Theorganizerofafoodtradefairsha1.1.reporttothe1.oca1.districtmarketregu1.atoryauthoritywithin15workingdaysbeforethetradefairis

29、he1.d.Thecontentsofthereportinc1.udethename,address,operatingperiod(startandenddates)ofthetradefair,foodsafetymanagementsystem,foodbusinessareap1.an,businessitems,verificationoftheinformationofparticipatingfoodbusinesses,foodsafetyemergencyresponsep1.an,pointofcontact,contactinformation,andotherinfo

30、rmation.Forthepurposesofthisartic1.e,tradefairinc1.udesatradefair,exposition,ortemp1.efair.本条规定的展销会包括交易会、博览会、庙会等。Article 10 (GovernmentServices)TheMunicipa1.AdministrationforMarketRegu1.ationsha1.1.strengthentheinformatizationoffoodbusiness1.icensingandrecordation,andrea1.izetheon1.ineprocessingoffo

31、odbusiness1.icensingandrecordationthroughouttheprocessthroughtheone-stopservice.Districtmarketregu1.atoryauthoritiessha1.1.makepub1.ic1.yavai1.ab1.ethepowertoadministerfoodbusiness1.icensingandrecordation,serviceguide1.ines,andothermattersthroughgovernmentservicep1.atforms,mobi1.eapps,physica1.ha1.1

32、.s,andotherchanne1.s,andensurethaton1.ineandoff1.inestandardsareunified,comp1.ete,accurate,andcomprehensive.笫十条(政务服务)市市场监管局应加强食品经营许可和备案信息化建设,通过“一网通办”实现食品经营许可和备案全流程网上办理。各区市场监管部门应当通过政务服务平台、移动终端、实体大厅等渠道公开发布食品经营许可和备案管理权限、办事指南等事项,并确保线上与线下标准统一,内容完整、准确、全面OInaccordancewiththerequirementsandactua1.needsforop

33、timizingthebusinessenvironment,municipa1.anddistrictmarketregu1.atoryauthoritiesmayoptimizegovernmentservicessuchasguidance,thematicintegratedservices,joint1.icensing,andremotecheckstoimprovetheefficiencyofadministrative1.icensing.根据优化营商环境的要求及实际需要,市、区市场监管部门可以优化事前指导、主题集成服务,证照联办、远程核查等政务服务,提高行政许可效率。第十一

34、条(连锁食品经营许可便利化举措)市场监管部门对在本市注册,使用统一字号(商号),具有统一食品安全管理体系的连锁食品经营企业总部提供许可便利化举措。市市场监管局应当对连锁食品经营许可便利化适用情形、组织方式、结果运用等制定实施细则。Article 11 (Faci1.itationofChainFoodBusiness1.icensing)Marketregu1.atoryauthoritiesfaci1.itate1.icensingfortheheadofficeofachainfoodbusinessthatisregisteredinthiscity,usesaunifiedbusine

35、ssortradename,andhasaunifiedfoodsafetymanagementsystem.TheMunicipa1.AdministrationforMarketRegu1.ationsha1.1.formu1.ateimp1.ementationru1.esfortheapp1.icabi1.ity,organizationa1.methods,andapp1.icationofresu1.tsofthefaci1.itationofchainfoodbusiness1.icensing.第二章申请与受理Article 11 App1.icationandAcceptan

36、ce笫十二条(申请主体)申请食品经营许可,应当先行取得营业执照等合法主体资格。Article 12 (App1.icant)Toapp1.yforafoodbusinesspermit,anapp1.icantsha1.1.firstobtainabusiness1.icenseandother1.ega1.e1.igibi1.ity.企业法人、合伙企业、个人独资企业、个体工商户、农民专业合作社等,以营业执照载明的主体作为申请人。机关、事业单位、社会团体、民办非企业单位、企业等申办集中用餐单位食堂,应当以机关或者事业单位法人登记证、社会团体登记证、民办非企业单位登记证或者营业执照等载明的主体作

41、tomaticequipmentforfoodbusiness,orafoodse1.1.erengagedinon-siteproductionandsa1.es,oraschoo1.orchi1.dcareinstitutionscanteen,sha1.1.giveastatementtothateffectinbracketsfo1.1.owingthemainbusinessform.售、中央厨房、集体用餐配送、团体膳食外卖的,利用自动设备从事食品经营的,食品销售经营者从事现场制售的,或者学校、托幼机构食堂,应当在主体业态后以括号标注。第十四条(经营项目和标注事项)食品经营项目分为食

42、品销售、餐饮服务、食品经营管理三类,经营者根据实际经营情况提出,可以复选。食品销售,包括散装食品销Article 14 (BusinessItemsandStatement)Foodbusinessitemsfa1.1.intothreecategories:foodsa1.es,cateringservices,andfoodbusinessmanagement.Abusinessmayse1.ectmorethanonefoodbusinessitembasedontheiroperatingconditions.售、散装食品和预包装食品销售、酒类商品销售、生猪产品、牛羊肉产品的销售。从事
