5、strationofthequalityandsafetyofaquaticproducts,ensuringthequalityandsafetyofaquaticproductsandmaintainingthehealthandlifesafetyofthepublic,theseProceduresareformulatedaccordingtotheLawofthePeoplesRepublicofChinaonFoodSafety,theLawofthePeoplesRepublicofChinaontheQualityandSafetyofAgriculturalProducts
6、,theRegulationsofShanghaiMunicipalityonFoodSafety,andotherrelevantlaws,rulesandregulations,andinthelightoftheactualcircumstancesofthisMunicipality.为了加强水产品质量安全监督管理，保障水产品质量安全，维护公众的身体健康和生命安全，根据中华人民共和国食品安全法中华人民共和国农产品质量安全法上海市食品安全条例等法律、法规，结合本市实际，制定本办法。Article2(ApplicationScopeandDefinition)第二条（适用范围和定义）本市行
7、政区域内水产品生产、经 营及其相关监督管理活动，适用 本办O本办法所称水产品，是指可供人TheseProceduresshallapplytotheproductionandbusinessoperationofaquaticproductsandtherelevantsupervisionandadministrationactivitieswithintheadministrativeareaofthisMunicipality.Theaquaticproductsmentionedinthese食用的水生动物、植物、微生物 及其初级产品。初级产品，是指 经过分拣、去皮、剥壳、干燥、 清洗
8、、切割、冷冻、分级、包装 等加工，但未改变其基本自然性 状和化学性质的产品。Proceduresrefertotheaquaticanimals,plants,microorganismsandtheirprimaryproductsedibletohumanbeings.Theprimaryproductsmeantheproductsthathavebeensorted,peeled,shelled,dried,cleaned,cut,frozen,graded,packed,orprocessedinotherways,butwithoutchangingtheirbasicnatura
9、ltraitsorchemicalproperties.第三条（生产经营者责 任）Article 3 (ResponsibilityofProducersandBusinessOperators)水产品生产经营者对其生产、经 营的水产品质量安全负责。水产 品生产经营者应当依法从事生 产、经营活动，执行水产品质量 安全相关标准，接受社会监督， 承担社会责任。Theproducersandbusinessoperatorsofaquaticproductsshallberesponsibleforthequalityandsafetyoftheaquaticproductsproducedorop
10、eratedthereby.Theproducersandbusinessoperatorsofaquaticproductsshallengageintheproductionandbusinessactivitiesaccordingtolaw,implementrelevantstandardsforqualityandsafetyofaquaticproducts,acceptthepublicsupervisionandbearthesocialresponsibilities.第四条（政府职责）Article 4 (GovernmentDuties)市、区人民政府对本行政区域内 水
11、产品质量安全监督管理工作负 责，统一领导、组织、协调水产 品质量安全监督管理工作以及水 产品质量安全突发事件应对工 作，建立健全水产品质量安全全 程监督管理工作机制和信息共享 机制。Themunicipalanddistrictpeoplesgovernmentsshallberesponsibleforthesupervisionandadministrationofaquaticproducts*qualityandsafetywithintheirownrespectiveadministrativeareas;lead,organizeandcoordinatethesupervisi
12、onandadministrationofaquaticproductsqualityandsafetyandtheresponsetotheemergenteventsofaquaticproducts*qualityandsafety;andestablishandperfectaworkingmechanismandaninformationsharingmechanismforthewhole-processsupervisionandadministrationofaquaticproductsqualityandsafety.区人民政府应当依照国家和本市 有关规定，明确乡、镇人民政
13、府 和街道办事处的水产品质量安全 管理职责，督促、指导乡、镇人 民政府和街道办事处做好水产品 质量安全日常工作，形成工作合 力。第五条（食品药品安全委 员会及其办公室职责）市、区人民政府设立的食品药品 安全委员会依法履行研究部署、 统筹指导水产品质量安全工作等 职责。市、区食品药品安全委员会下设 办公室，办公室设在同级市场监 管部门，负责辖区内水产品质量 安全综合协调、监督考评、应急 管理等工作，承担委员会在水产 品质量安全方面的日常工作。乡、镇人民政府和街道办事处建 立的食品安全综合协调机构，负 责做好辖区内水产品质量安全综 合协调、隐患排查、信息报告、Thedistrictpeoplesg
14、overnmentshall,accordingtotherelevantprovisionsoftheStateandthisMunicipality,definethefunctionsanddutiesofthetown/townshippeoplesgovernmentandthesub-districtofficefortheadministrationofaquaticproductsqualityandsafety,urgeandguidethetown/townshippeoplesgovernmentandthesub-districtofficetoensuretherou
15、tineworkofaquaticproducts,qualityandsafetyiswelldone,soastoformajointforceinthework.Article 5 (FunctionsandDutiesofFoodandDrugSafetyCommissionandItsSubordinateOffice)Thefoodanddrugsafetycommissionsestablishedbythemunicipalanddistrictpeoplesgovernmentsshall,inaccordancewithlaw,performthefunctionsandd
16、utiesofstudying,arranging,overallplanningandguidingtheworkofaquaticproductsqualityandsafety.Themunicipalanddistrictfoodanddrugsafetycommissionsshallhaveoffices,whichshallbefixedinthemarketregulationdepartmentatthesamelevel,andtheofficesshallberesponsibleforthecomprehensivecoordination,supervisionand
17、evaluation,emergencyresponseandotherrelevantworkofaquaticproductsqualityandsafetywithintheirjurisdiction,andcarryoutthecommissionsroutineworkinthefieldofaquaticproducts*qualityandsafety.Theagenciesestablishedbytown/townshippeoplesgovernmentsandsub-districtofficesforthecomprehensivecoordinationoffood
18、safetyshallberesponsibleforsuchworkonaquaticproductsqualityandsafetyasthecomprehensivecoordination,investigationof协助执法和宣传教育等工作。hiddendangers,informationreport,assistanceinlawenforcement,andpublicityandeducation.Article 6 (DepartmentalFunctionsandDuties)Themarketregulationdepartmentshallberesponsible
19、forthesupervisionandadministrationofthequalityandsafetyofaquaticproductsinthisMunicipalityswholesaleandretailmarkets.Theagricultureandruralaffairsdepartmentsshallberesponsibleforthesupervisionandadministrationoftheproductionofaquaticproductsandtheirqualityandsafetybeforeenteringthewholesaleandretail
20、marketsortheproductionandprocessingenterprisesinthisMunicipality;andcarryouttheinspectionofquarantinecertificatesforaquaticseedlingsatthecrossingsdesignatedbytheMunicipalPeoplesGovernment.TheCustomsshallcarryouttheinspection,quarantine,supervisionandadministrationofimportandexportaquaticproductsacco
21、rdingtolaw.Thedepartmentsofecologyandenvironment,health,commerce,publicsecurity,urbanmanagementandlawenforcement,andplanningandnaturalresourcesshall,accordingtotheirrespectivefunctionsandduties,doagoodjobinthesupervisionandadministrationofaquaticproductsqualityandsafety.第六条（部门职责）市场监管部门负责本市批发、零 售市场的水
22、产品质量安全监督管 理工作。农业农村部门负责本市水产品生 产以及进入批发、零售市场或者 生产加工企业前的质量安全监督 管理工作；在市人民政府指定的 道口，开展水产苗种检疫合格证 明检查工作。海关依法开展进出口水产品检验 检疫和监督管理工作。生态环境、卫生健康、商务、公 安、城管执法、规划资源等部门 按照各自职责，做好水产品质量 安全监督管理相关工作。第七条（信息追溯制度）Article 7 (InformationTraceabilitySystem)ThisMunicipalityshallestablishaninformationtraceabilitysystemforaquaticp
23、roductsqualityandsafety,andimplementtheinformationsharinganddynamicsupervisionofaquaticproductsqualityandsafety.Theconsumers,producersandbusinessoperatorsofaquaticproductsmayinquiretheaquaticproducts,tracinginformationthroughShanghaiMunicipalFoodSafetyInformationTracingPlatform.Themunicipalmarketreg
24、ulationdepartmentshall,jointlywiththemunicipaldepartmentsofagricultureandruralaffairs,commerce,healthandcustoms,determinethecatalogueofaquaticproductstobeincludedinthetraceabilitymanagementofaquaticproducts,qualityandsafetyinformationaccordingtotheconsumptionsituation,risklevels,qualityandsafetystat
25、us,andresidentsconcern,andreportittotheMunicipalFoodandDrugSafetyCommissionforapprovalbeforeitispublishedtothepublic.Thecatalogueshallbesubjecttoadynamicmanagement.Theproducersandbusinessoperatorsofaquaticproductsshallpromptlyandtruthfullyuploadthetraceabilityinformationaccordingtothecatalogue.Andth
26、eyshallbeencouragedtouploadtherelevantinformationaboutthevarietiesthathavenotyetbeenincludedinthecatalogue.本市建立水产品质量安全信息追 溯制度，实施水产品质量安全信 息共享、动态监管。消费者、水 产品生产经营者等可以通过上海 市食品安全信息追溯平台查询水 产品追溯信息。市市场监管部门应当会同市农业 农村、商务、卫生健康和海关等 部门根据消费情况、风险程度、 质量安全状况以及市民关注度 等，确定纳入水产品质量安全信 息追溯管理的品种目录，报市食 品药品安全委员会批准后向社会 公布。品种目录
27、实行动态管理。水产品生产经营者应当根据品种 目录及时、如实上传追溯信息。 鼓励水产品生产经营者对于目录 以外的品种上传相关信息。Article 8 (RequirementsonEmergency第八条Response)求)（突发事件应对要水产品生产经营者应当依法落实 食品安全事故防范措施，防止食 品安全事故的发生。Theproducersandbusinessoperatorsofaquaticproductsshallconsolidatepreventivemeasuresagainstfoodsafetyaccidentsaccordingtolaw,andpreventtheoccu
28、rrenceoffoodsafetyaccidents.Incaseofpublichealthemergencies,theproducersandbusinessoperatorsofaquaticproductsshall,accordingtorelevantrequirements,ensuresuchworkastheroutineprotection,environmentaldisinfection,inspectionandquarantine,andemergencytreatmentiswelldone.Article 9 (EncouragingStandardized
29、ProductionandBusinessOperationandTechnologicalResearchandDevelopment)ThisMunicipalityshallencouragetheproducersandbusinessoperatorsofaquaticproductsandsocialorganizationstoformulatetheenterprisestandardsororganizationstandardsstricterthanthenationalorlocalstandardsforfoodsafety,andcarryoutthestandar
30、dizedproductionandbusinessoperationactivities.ThisMunicipalityshallencouragetheproducersandbusinessoperatorsofaquaticproductsandsocialorganizationstocarryoutscientificandtechnologicalresearchesonthequalityandsafetyofaquaticproducts,promotescientificmethodsofqualityandsafetymanagement,popularizeadvan
31、cedandsafeproductiontechnologies,andpropelthedevelopmentandestablishmentofaquaticproductbrands.Article 10 (TradeOrganization)发生公共卫生等突发事件时，水 产品生产经营者应当按照有关要 求，做好日常防护、环境消杀、 检验检疫、紧急处置等工作。第九条（鼓励标准化生产 经营和技术研发）本市鼓励水产品生产经营者及社 会团体制定严于食品安全国家标 准或者地方标准的企业标准或者 团体标准，开展标准化生产经营 活动。本市鼓励水产品生产经营者及社 会团体开展水产品质量安全科学 技术研究
32、，推行科学的质量安全 管理方法，推广先进安全的生产 技术，推进水产品品牌发展建 设。第十条（行业组织）本市鼓励水产品生产经营者依法 成立或者自主加入相应的水产品 行业组织。ThisMunicipalityshallencouragetheproducersandbusinessoperatorsofaquaticproductstoestablishaccordingtolaw,ortojoinontheirownwill,thetradeorganizationsforcorrespondingaquaticproducts.Theaquaticproducttradeorganizatio
33、nshallstrengthentheself-disciplinaryeducationandtradeadministration,guideitsmemberstoestablishtheconceptofgreenandhigh-qualitydevelopment,buildasystemforaquaticproductsqualityandsafetymanagement,promotetheecologicalandhealthyaquaculture,andpopularizethestandardizationandbrandingoftheproductionandbus
34、inessoperation.Article 11 (PublicityandEducation)Thedepartmentsofmarketregulation,agricultureandruralaffairs,andcommerceshallstrengthenthepublicityandeducationofaquaticproductsqualityandsafety,disseminatetheknowledgeofaquaticproducts,qualityandsafety,guidetheproducersandbusinessoperatorsofaquaticpro
35、ductstoimplementthetechnicalstandardsonqualityandsafetyandtosafelyuseaquaticauxiliarymaterials.Thenewsmediashallpublicizethelaws,rulesandregulationsonaquaticproductsqualityandsafetyandtherelevantstandardsandknowledge,andsupervisethepublicopiniononillegalactsinrespectofaquaticproductsqualityandsafety
36、.水产品行业组织应当加强自律教 育和行业管理，指导其成员树立 绿色高质量发展理念，建立水产 品质量安全管理制度，推进生态 健康养殖，推广生产经营标准 化、品牌化。第十一条（宣传教育）市场监管、农业农村、商务等部 门应当加强水产品质量安全宣传 教育，普及水产品质量安全知 识，引导水产品生产经营者落实 质量安全技术规范，安全使用水 产投入品。新闻媒体应当开展水产品质量安 全法律、法规、规章以及相关标 准和知识的宣传，并对水产品质 量安全违法行为进行舆论监督。Article 12 (RegionalCooperationinthe第十二条YangtzeRiverDelta)作)（长三角区域协农业农村
37、、市场监管、商务等部Thedepartmentsofagricultureandruralaffairs,marketregulation,andcommerceshallestablishacollaborationmechanismofaquaticproducts*qualityandsafetywiththerelevantdepartmentsoftheYangtzeRiverDeltaregion,collaborateinthefieldsofthedirectconnectionofproductionandmarketing,supervisionandsamplingins
38、pection,producttraceability,recallofsubstandardaquaticproducts,handlingofemergentevents,etc.,andraisethecapabilityforensuringthequalityandsafetyofaquaticproducts.门应当与长江三角洲区域的相关部门建立水产品质量安全工作协作机制，在产销对接、监督抽检、产品追溯、不合格水产品召回、突发事件应急处置等方面开展协作，提高水产品质量安全保障能力。ChapterIlProductionofAquaticProducts第二章水产品生产Article
39、13(WaterQualityMonitoringFacilityImprovementforAquaculture)and第十三条（养殖水质监测与设施完善）Theproducersofaquaticproductsshallmonitorthequalityofthewaterusedforaquacultureregularly,andshallimmediatelystopusingitwhendiscoveringthatthewatersourceispolluted.Ifitisreallynecessarytouseit,itshallbepurifiedandtreatedto
40、meetthequalitystandardsforaquaculturewater.水产品生产者应当定期监测养殖用水水质，发现养殖用水水源受到污染时，应当立即停止使用；确需使用的，应当经过净化处理达到养殖用水水质标准。Theproducersofaquaticproductsshallimprovetheiraquaculturefacilities,optimizetheaquaculturedensity,raisethecapacityofwaterqualityrestoration,andensurethedischargeofaquaculturewateruptothestan
41、dard.水产品生产者应当完善养殖设施，优化养殖密度，提升水质修复能力，确保养殖用水达标排放。Article14(ProductionofAquaticSeedlings)第十四条（水产苗种生产）除自育、自用水产苗种外，从事 水产苗种生产的，应当依法取得 水产苗种生产许可。Exceptfortheself-breedingorself-useofaquaticseedlings,theproducerswhoengageintheproductionofaquaticseedlingsshallobtainthelicenseforaquaticseedlingproductionaccord
42、ingtolaw.水产苗种生产者应当在符合规定 的生产场地，使用符合种质标准 的亲本，按照水产苗种生产技术 操作规程的要求从事生产活动。Theproducersofaquaticseedlingsshallconducttheirproductionactivitiesattheproductionsitesthatconformtotheprovisions,usingtheseedlingparentsthatconformtothegermplasmstandards,andaccordingtotherequirementsofthetechnicaloperationnormsfor
43、theproductionofaquaticseedlings.水产苗种生产者应当建立技术资 料档案，详细记录亲本的引进时 间、来源、使用年限、繁殖、更 新、销售等情况。档案保存期限 不得少于2年。Theproducersofaquaticseedlingsshallestablishtechnicaldatafiles,recordindetailtheintroductiontime,source,servicelifetime,reproduction,renewalandsalesoftheseedlingparents.Thefilesshallbekeptfornolessthan
44、twoyears.Article 15 (Quarantine of Aquatic Seedlings)第十五条（水产苗种检 疫）水产苗种生产者出售水产苗种 的，应当依法取得检疫合格证 明。采购水产苗种的，采购者应 当要求出售者提供检疫合格证 明。Incaseofsellingaquaticseedlings,theproducersofaquaticseedlingsshallobtainaquarantinecertificateaccordingtolaw.Incaseofpurchasingaquaticseedlings,thepurchasershallrequirethesel
45、lertoprovidethequarantinecertificate.捕获野生水产苗种的，应当经检 疫合格，取得检疫合格证明后， 方可投放养殖场所、出售或者运 输。Anycapturedwildaquaticseedlingsshallpassaquarantineinspectionandbeissuedaquarantinecertificatebeforebeingputintoanaquaculturefarm,soldortransported.经航空、铁路、道路、水路等运 输水产苗种的，托运人托运时应 当提供检疫合格证明；没有检疫 合格证明的，承运人不得承运。Incaseoft
46、ransportingaquaticseedlingsbyair,railway,roadorwaterway,theconsignorshallprovideaquarantinecertificatewhenconsigningtheshipment.Withoutaquarantinecertificate,thecarriermaynotaccepttheconsignment.Article 16 (Use of Aquatic Auxiliary Materials)第十六条（水产投入品使 用）Whenpurchasingaquaticauxiliarymaterialssucha
47、saquaticseedlings,feed,feedadditives,andveterinarydrugs,theproducersofaquaticproductsshallexaminetherelevantlicensingdocuments,truthfullyrecordthename,specification,quantityandpurchasedateoftheauxiliarymaterialspurchased,andkeeptherelevantcertificates.水产品生产者采购水产苗种、饲 料、饲料添加剂、兽药等水产投 入品，应当查验相关许可证明文 件，如
48、实记录所购买投入品的名 称、规格、数量和购买日期等内 容，并保存相关凭证。Whentheproducersofaquaticproductsuseaquaticauxiliarymaterials,thedosage,frequency,methodandsafetyintervaloftheusageshallconformtotherelevantprovisionsandberecorded.水产品生产者使用水产投入品 的，其用量、次数、方法和安全 间隔期等应当符合相关规定，并 予以记录。水产投入品购买和使用记录，保 存期限不得少于2年。Article 17 (Testing of Aquatic Product Quality)第十七条（水产品质量检 测）Therecor
